More and more scholars of social justice have been calling for a closer collaboration between empirical and normative disciplines. Psychological and sociological research, as well as philosophical theories can, so they claim, learn from one another and work should be based on results obtained in the other fields of research. Some political philosophers do not share this view. They argue that, since most empirical research does not capture people's moral views on justice, its results cannot be of any value to their theories. Based on this critique I suggest in the first part of this paper that empirical research should distinguish between two classes of justice judgments: First, justice judgments in a narrow sense, which are made under conditions of impartiality and grounded in moral principles, and second, justice attitudes, which differ from other types of social attitudes only in their attitude objects. In the second part I present a quasi-experimental study that aimed at testing the two different classes of justice judgments empirically. The results show that justice judgments in the narrow sense can be obtained even under conditions in which complex experimental manipulations cannot be employed. In the third part of this paper I hypothesize that justice judgments which are based on the two formal criteria provided by political philosophy (impartiality and reference to moral principles) may serve as important intervening variables when trying to explain the impact of justice beliefs on different patterns of human behavior.  相似文献

Under conditions of polycentric globalisation, a positive concept of justice is definitively impossible. Justice is aimed at removing unjust situations, not creating just ones. The justice of fundamental rights coerces expansive social systems into self-restriction. Human rights in particular take the role of counter-principles to communicative violations of body and soul, a protest against inhumanities of communication, without it ever being possible to say positively what the conditions of humanly just communication might be. The article analyses some consequences of this view for social counter-movements and counter-institutions.

Justice issues have been prominent in the environmental debate since its beginning in the second half of the twentieth century. This is not surprising, because environmental crises highlight our conceptions of justice, challenging us to consider their adequacy as well as their implications. Does current justice theory accurately describe the issues raised by environmental threats, especially about the justice for future generations? What are the implications of perceptions of justice or injustice for responses to environmental problems, up to and including social protest? For the most part, environmental social sciences have not been at the forefront of these debates, despite some very important contributions. The goal of the present issue is, therefore, to bring together researchers in the field of environmental psychology and justice research and to provide a forum for current research in the field of environmental justice. Sociolegal research indicates that when citizens perceive that legal processes and procedures are fair, both positive and negative legal outcomes will be viewed as acceptable. However, little is known about perceptions of fairness in informal contexts such as in restorative justice (RJ) practices and with victims (and offenders) who participate in these programs. Drawing on interviews with key actors engaged in post-conviction RJ programs for serious crimes in Australia and the USA, this paper asks, do post-conviction therapeutic RJ programs for violent crimes enhance procedural justice for victims and offenders? The data reveal that RJ is compatible with procedural justice for both victims and offenders. Specifically, RJ aids in correcting the harms created by the formal criminal justice system and, thus, satisfies and even greatly enhances procedural justice goals for both victims and offenders.  相似文献

Although much is known about humans?? responses to inequity, little is known about similar responses in other species. The goal of these issues is to bring together researchers focusing on both humans and non-humans to provide a synthesis of our knowledge of non-human responses to inequity to date, and what these data tell us about the evolution of humans?? responses. In this Introduction, I provide a brief background, highlighting both areas in which differences among the related literatures emerge and the ways in which the comparative approach can provide insight in to this question. As becomes clear in these issues, we have reached the point where we can move beyond documenting these responses in other species and develop research programs combining both human and non-human perspectives to better understand the evolution of fairness and justice.  相似文献

In his rich and stimulating book, Blake argues (among other things) that comprehensive coercion triggers egalitarian obligations of distributive justice. I argue that (1) coercion is not a necessary condition for egalitarian justice to apply; (2) Blake’s use of a moralised conception of coercion is a mistake; (3) coercion is a redundant member of any set of sufficient conditions that might explain why distributive justice applies; (4) Blake’s emphasis on providing conditions for the exercise of autonomy might support a much more cosmopolitan theory of distributive justice.  相似文献

With the abundance of prime-time crime dramas on television, it is imperative that researchers examine how female criminal justice professionals are depicted in the world of fiction versus in reality. In this study, a content analysis of 10 prime-time television crime dramas was conducted. Of the 69 characters observed, female criminal justice professionals were portrayed as young, White, and single. Female characters were more provocatively dressed, and they also were more likely to be victims of crime. Unlike previous studies that showed that female characters were underrepresented on prime-time television, here women were overrepresented as crime scene investigators, detectives, and special agents. Stereotypical images of women as subordinate, nurturing, affectionate, and sexually attractive still prevail. However, compared to their male counterparts, female characters were equally assertive, self-confident, and competitive.  相似文献

At its very core, the phrase “criminal justice sciences” points to the interdisciplinary nature of our field. However, efforts to promote and support interdisciplinary teaching and research face significant barriers. In this paper, I address how interdisciplinarity is conceptualized, the history of criminal justice as an interdisciplinary field, why we should promote interdisicplinarity, barriers we confront in interdisciplinary efforts, the degree to which ACJS members engage in interdisciplinary practices, factors related to interdisciplinarity, and opportunities for increased interdisciplinary research in criminal justice. To grow as an academic field, I conclude that we must look to other disciplines such as biology, computer science, policy, and women’s studies as we expand our disciplinary boundaries.  相似文献

This paper offers a close reading of Derridas essay Force of Law that emphasises the twin strengths of a deconstructive approach to questions of law and justice -- textual analysis and political context. Derridas interest is in limit or test cases, and so he engages with the fraying edges of the law, its borders, the frontiers that are most heavily policed because they are most fragile, for example capital punishment, genocide, general strikes and terrorism. Derrida undertakes an exploration of violence through a reinterpretation of Walter Benjamins Critique of Violence. At the heart of Derridas difficult argument is a demand for justice that goes beyond the cataloguing of specific injustices, and beyond the terms of Benjamins critique. The utopian impulse that underpins Force of Law is carried over into Specters of Marx, Derridas recent explicit grappling with the legacy of Marxism. The links between these two texts by Derrida implies a sustained politics of radical commitment on the part of deconstruction, a commitment to future forms of legality and egalitarianism, a theory of justice posited upon prescience rather than precedent.  相似文献

This article discusses key issues that affect the efficiency and credibility of criminal justice systems. It discusses the consequences of an ineffective criminal justice system, which include unnecessary delays within the court process, ‘cracked’ or ‘collapsed’ trials, and lack of public confidence. It notes that a successful system must contain strategic, integrated, and sustainable mechanisms that enhance the entire criminal justice process. The article examines a number of initiatives taken by various countries, noting the measurable and sustainable results, while also suggesting ways that these programs could be improved. Finally, the author notes the importance of measuring the outcomes and impact of the suggested initiatives in an effort to promote transparency and accountability, as well as effectively record successful strategies.  相似文献

A well-known maxim instructs that justice should be seen to be done. When “seen” is understood in the sense of “observed”, the maxim is easily defended: open court proceedings protect against arbitrary and partial decisions. However, when “seen” is understood in the sense of “seem,” the maxim is more puzzling, since it is not obvious why courts should concern themselves with people's perceptions that justice has been done. This article addresses this issue, with a particular focus on the social and other benefits that result when judges observe procedures that are widely regarded as fair, especially in criminal trials. The article draws on empirical studies in social psychology that show that when legal authorities treat people in ways that accord with “lay” procedural expectations, they are more likely to view the authorities as legitimate, to cooperate with them, and to obey the law out of an internalized sense of obligation. The article explores the moral significance of these empirical findings, arguing that it would be superficial to see them as a recipe for social stability. The deeper truth conveyed by the empirical research is that relating to people in ways that are widely perceived to be fair is a way for authorities to engage people's moral sentiments and to enliven their virtuous capacity to put aside considerations of self-interest so as to do what is right. This dynamic provides a sound moral foundation for courts to concern themselves with perceptions of justice.  相似文献

This review essay analyses two significant recent contributions to the debate over the reasoning of the Court of Justice (CJ). These contributions highlight the impossibility of a wholly scientific and deductive approach to attributing ‘correct’ outcomes to the Court's case‐law. At the same time, their analysis adds significant findings for the debate over the Court's possible ‘activist’ or political role. Following from these contributions, this essay makes two arguments: firstly, that the inability of the Court to anchor its reasoning solely in a deductive form of legal reasoning should encourage the CJ to engage in a more advanced ‘constitutional dialogue’ with the EU's political institutions; and secondly, that truly understanding the Court's reasoning involves a closer analysis of the institutional and personal dynamics influencing Court decisions. Understanding European judicial reasoning may require a closer look at the social and political—as well as doctrinal—context within which European judges act.  相似文献

Objectives

This study tests the generality of Tyler’s process-based model of policing by examining whether the effect of procedural justice and competing variables (i.e., distributive justice and police effectiveness) on police legitimacy evaluations operate in the same manner across individual and situational differences.

Methods

Data from a random sample of mail survey respondents are used to test the “invariance thesis” (N = 1681). Multiplicative interaction effects between the key antecedents of legitimacy (measured separately for obligation to obey and trust in the police) and various demographic categories, prior experiences, and perceived neighborhood conditions are estimated in a series of multivariate regression equations.

Results

The effect of procedural justice on police legitimacy is largely invariant. However, regression and marginal results show that procedural justice has a larger effect on trust in law enforcement among people with prior victimization experience compared to their counterparts. Additionally, the distributive justice effect on trust in the police is more pronounced for people who have greater fear of crime and perceive higher levels of disorder in their neighborhood.

Conclusion

The results suggest that Tyler’s process-based model is a “general” theory of individual police legitimacy evaluations. The police can enhance their legitimacy by ensuring procedural fairness during citizen interactions. The role of procedural justice also appears to be particularly important when the police interact with crime victims.

The American criminal justice system fails to achieve justice, reduce crime, and provide equal protection to Americans regardless of their social class, race, and gender. But, criminal justice as an academic area of study has become a popular and fast growing liberal arts major in the United States, churning out tens of thousands to work in the criminal justice system. Given the demonstrable harms caused by criminal justice, which are suffered disproportionately by the least powerful people, academic criminologists and criminal justicians have the obligation to promote a reformed discipline. This article briefly summarizes the evidence of bias in the criminal justice system and then turns to how these biases relate to criminal justice as an academic discipline. Using the war on drugs as an example, I argue that the practice of criminal justice as an academic endeavor runs counter to the goal of promoting social justice in America. One of the ironic conclusions of this article is that criminal justice as an academic discipline must get smaller if we are to achieve larger goals of social justice outlined here.
