A solicitor, when drafting a will, can owe a duty of care in tort to the intended beneficiary of a bequest under that will. The Court of Appeal has recently confirmed that where a solicitor has misdrafted the will, the intended beneficiary can sometimes rectify it, and recover the intended gift. The pattern of this rectification is restitutionary, raising the question analysed in this article of whether an intended beneficiary can have a direct personal action in restitution to reverse the unjust enrichment of an unintended recipient. It seems that, though fraught, such an action may indeed in principle lie.  相似文献

This article examines how institutional design leads state governments to win their cases before the U.S. Supreme Court. We analyze whether states are more likely to prevail on the merits when they create a formal solicitor general office and have an attorney from that office argue their cases before the Court. We employ an analytical matching approach and find that attorneys from state solicitor general offices are significantly more likely to win their cases compared to other kinds of state attorneys. Accordingly, if states prioritize victory before the Court, they should consider creating state solicitor general offices and granting those solicitors general the authority to control their appellate litigation.  相似文献

Differences in the working lives of solicitors have become increasingly marked in recent years. Growing numbers of lawyers are employed in the public and corporate sectors and, with the increasing size and wealth of City of London commercial firms, there are significant differences between these firms and those 'high-street' firms that serve local communities. These differences impact on lawyers throughout training and beyond, both in terms of rites of passage into the profession and in conditions of employment. This research, the final stage in a longitudinal survey spanning the 1990s, combines quantitative and qualitative methods to explore the reactions of newly qualified solicitors to their work. Building on the project's previous surveys, which charted the nature of disadvantage suffered by many prospective entrants to the legal profession, the research finds a large measure of satisfaction regarding careers. It also identifies causes for concern, including increasing specialisation in legal education and the potential separation of the intrinsic and extrinsic rewards of professional practice.  相似文献

Two major regulatory changes are affecting the provision of undergraduate legal education in England and Wales. On the one hand, the Qualifying Law Degree is being deregulated, meaning law schools are free to make significant changes to how and what they teach. On the other hand, higher education in England has seen a significant overhaul through the creation of the Office for Students, which treats students as consumers. Now more than ever, law schools need to ask themselves existential questions which will not only test their continued relevance or indeed viability within the ‘market’ for higher education, but also the status of the discipline of law as a whole. The regulatory landscape may indeed present a significant threat, but it is also an opportunity to reflect on what law schools are for, and consequently what changes could result from the academic freedom that comes with deregulation. Whilst different law schools will interpret their mission differently, they should caution against either generalised inertia or succumbing to an outcomes-oriented provision that simply prepares students for the new Solicitors Qualifying Examination. Instead, law schools will find their proper purpose in critical reflection and academic self-grounding, providing undergraduate students with a ‘question everything’ mentality, and showing them that law is something to be experienced and not merely learnt.

This article will consider the theoretical explanations for why women are not remaining within and progressing through the ranks of the solicitors' profession in England and Wales. It sets out the findings from a Law Society commissioned project to examine the reasons why women have had a break from practice or chosen to leave the profession. Finally, it considers whether one of the purported strategies used to empower women solicitors – the business case for equality of opportunity in the solicitors' profession – is actively working against women and the profession (more broadly), and that only a return to a wider values-based approach to professional identity will meet the criticisms raised by many of the women who participated in this research.  相似文献
