Mortuuspolitics: politicization of the dead,capitalism, and inequality

Capitalism has led to the appropriation of oppressed groups, their experiences and narratives. We believe this includes narratives and given value of the dead where there remains a continuation of inequalities of life unto death and being dead. Specifically, we suggest that the discrepancy of the value of the dead is the result of the links between power, politics, and hegemonic discourse embedded in neoliberalism that propagate and reify unequal power edifices that value some groups over others, in life and death, what we refer to as mortuuspolitics. The State, entrenched within the capitalistic neoliberal definition of value, also decides on the value or non-value of the dead.     

信用社会的软法治理——以赔礼道歉的法制化为视角

赔礼道歉的法制化是以法律机制特有的严格、公平与程序正义的他律特征,结合道德机制深入作用于人类心理,唤起良知的自律性机制,催化与加速理性人重识信用评价中道德观的进程。这种以正式法律制度嵌入非正式社会规范体系,以筛选、改良与优化其社会治理功能的法律方法就是"软法"。作为一种结合确定的法律规范与不确定的道德机制两者优势,弥补两者传统劣势的社会综合治理策略,软法尤其适合承担重树社会普遍信用与道德信仰的治理任务,在我国构建信用社会的系统工程中发挥越来越重要的作用。     

Structuring of Identities in Relation to Material Possessions in Poland of the 1990s: Issues of Policy, Culture, and Individual Life-Worlds

This paper explores the re-defining and re-creating of individual, group and social identities in relation to material possessions in the context of private property becoming one of the fundamental principles of organization of the socio-cultural reality of Poland in the 1990s. These processes can be seen as a crucial part of the cultural and civilizational transformation of Polish society towards a more individualistic and materially oriented one. Part of this development is the mostly uncritical adoption of the materialistic paradigm 'to have is to be', which threatens to destroy the capital of humanist values traditionally existing in Polish society, and which renders problematic the facilitation of socio-cultural conditions of a 'secure moral order' or a 'moral economy'.     

论迁徙自由立法的例外规定

迁徙自由原则一直以来都是国际移民法的重点原则，也是世界公认的一项基本人权，对迁徙自由权可以从一般性规定。限制性规定和保护性规定三个方面来阐述，其中后两者即例外性规定是政策制定与司法实践过程中的焦点，其目的是为了更有效地保障公民的迁徙自由权。本文通过对《公民权利和政治权利国际公约》，各国特别是美德两国关于迁徙自由权限制性，以及限制之限制规定的立法模式和立法内容的分析，给例外规定的中国化提供了借鉴，以更全面地保障中国公民的迁徙自由权。
