Domestic violence (DV) is a pervasive and serious threat to women's lives and well-being. Medical social workers, family practitioners, and obstetrician–gynecologists are in key positions to screen and offer help. Florida NASW members and board certified family practitioners and obstetrician–gynecologists were mailed a psychometrically tested scale. A total of 388 surveys were analyzed. Education (especially the number of in-service hours) and the presence of institutional supports, decreased barriers to screening, increased screening behaviors, and lead to increased victim identification. Only 20.8% of participants always or nearly always routinely screened for DV; 24.0% reported that routine screening did not apply to their role. Self-Efficacy was the strongest predictor of screening behavior with Fear of Offending, Safety Concerns, CEUs/CMEs, and in-service hours contributing approximately equally to the prediction of screening behavior.  相似文献

In the 50 years since the U.S. President's Commission on Law Enforcement and Administration of Justice under President Johnson issued its report, feminist activism and both feminist and mainstream research have resulted in defining domestic violence (DV) as a social problem. This awareness of the seriousness and expansiveness of DV has spurred the development of unprecedented programs and policies. Although DV policing changes have been significant, so too have been the development of and changes in safehouses, no‐drop court policies, domestic violence courts, community‐coordinated responses, and batterer intervention programs. In this article, we review the nonpolice responses to DV cases and outcomes and provide recommendations. First, research and policies need to more regularly be aimed at addressing victims’ safety and their diverse needs and experiences. Second, assessments should include addressing the processing of these cases through the impact of responses by individual community and criminal legal system actors (e.g., victim advocates, police, prosecutors, and judges) to victims and offenders.  相似文献

Survivors of intimate partner violence have myriad reasons why they turn to domestic violence shelter programs. While all are seeking immediate safety and feel a pressing need to leave their homes to obtain it, safety is rarely the only issue survivors are grappling with upon shelter entry. Other concerns are particular to each person’s history and circumstances, and include but are not limited to employment, counseling, social support, health care, addiction recovery services, immigration help, housing, and services for their children. The current study involved secondary analysis of survey data completed at two points in time by 565 shelter residents. The original research involved 215 domestic violence programs across eight states in the U.S., and surveys were completed by shelter residents shortly after they arrived in shelter and again as they were close to exiting. Results confirmed that survivors had numerous needs in addition to safety when entering shelter. Residents’ overall rating of how helpful their stay at shelter had been for them was predicted by how much help they had received across their presenting needs, as well as how they were treated by staff. The amount of help received, as well as treatment by staff, also related to survivors’ hopefulness at shelter exit, as well as the extent to which they felt better able to do things on their own. The study findings provide further evidence that domestic violence shelter staff assist residents with a variety of complex needs in addition to safety, and that this assistance is related to positive outcomes for survivors.  相似文献

Restorative justice is coming out of the shadows and in Europe this interest grows alongside a stronger victims’ movement with a domino effect on EU member states’ laws. In the UK, legislation now allows restorative justice at all stages of the criminal justice system, and as part of these developments, new restorative justice services that will be ‘victim-led’ are being funded. This paper questions this ‘kind’ of restorative justice, using unpublished findings from a research project that was conducted in 2017 in London. The project involved a survey with 66 victims and 44 offenders, followed by 11 in-depth victim interviews and a focus groups with 7 victims and practitioners. The data point out a number of assumptions and caveats, which must be addressed in order to ensure that further investment in restorative justice will yield benefits to all those whose lives are blighted by crime. The conclusions are relevant to anyone practising restorative justice internationally including policy makers and funders.  相似文献

ABSTRACT

Due to new legislation passed in 2011, Finnish police have been legally obligated to record and investigate all assaults, including petty assaults, occurring in close relationships. Referred to as domestic violence (DV), these assaults can be prosecuted even without victim consent. Much like pro- and mandatory arrest policies, this reform was aimed at decreasing victim and police discretion, based on the assumption that recording and preliminary investigation of every DV incident would help prevent further violence. Comparison between police call outs and the number of offences indicate that in reality not every DV incident is recorded. Using Police and Emergency Call Database data merged with 410 police officer survey responses, the current study presents the first empirical results on legal and extra-legal factors associated with recording DV as an offence in Finland. Factors explaining non-recording are discussed based on police officers’ free-text comments, and implications for policy and practice are presented.  相似文献

The main reasons abused men do not seek social services include their strong endorsement of social/cultural values and avoidance of gender role conflict. Through internet-based service connections, we did not find sources in Asia, Australia, or New Zealand that advertised programs exclusively for male victims of domestic violence (DV). Nine social services in Hong Kong and Singapore describe their work with men in DV situations, but the main focus is “men as perpetrators.” Targeting men as victims, 32 sources in Canada, the United States, and the United Kingdom describe services designed especially for male DV victims. Findings demonstrate that services for male victims must address such factors as secretiveness, cultural values, masculine identity, tolerance, shame, and loss of face.  相似文献

The perinatal period may include domestic violence (DV). In this study, the perinatal period extends from the start of pregnancy to the end of the child’s second year of life. DV places the safety of both mother and child at risk and undermines the mother–child attachment bond. In this article, we look at the challenges for motherhood in a context of domestic violence during the perinatal period (DVPP). In semi-directed interviews, 17 mothers shared their stories of DVPP. Interview questions focused on the trajectory of DVPP, perceptions and occupation of motherhood within two years of childbirth and the associated challenges. Data were analyzed using thematic analysis and discussed in a feminist conceptual framework and a parental theoretical model. DVPP negatively influences the experience and practice of motherhood, in addition to increasing parental responsibility to protect the child. Three main themes were noted: 1) A parental experience impoverished by the context of DVPP, caused by an increase in tasks, a weakened bond with the child and a loss of self-confidence; 2) Parenting responsibility in a context of DVPP is expressed as greater vigilance and the need to protect the child from violence; and 3) Parenting practices: the children as targets and victims of violence, resulting in additional child needs that mothers must meet. The results underscore the need for early detection of DVPP and a trauma-informed approach in health services. Specialized support services should be provided to help mothers cope with violence.

Even if there has been some theoretical debate on the role of what has been called the ‘community of care’ in restorative justice (RJ) there has not been much research on, or analysis of, the implications of the role of significant others in its practice. This lack of reflection is especially evident in the case of the victims’ community of care, despite findings that would indicate a systematic lack of participation of victim’s supporters in restorative practices. Through the qualitative analysis of 35 interviews with victims of crime who consented to attend mediation (direct and indirect), an attempt to describe and discuss the characteristics of victim’s communities of care that may become relevant for the practice of RJ is made. Results indicate that, despite a victims’ need for company or support, victims tend to disclose few details about the offense, its consequences and the mediation offered as a way to protect their loved ones or to avoid possible negative reactions from their communities. Theoretical and practical implications of these findings are offered.  相似文献

The article addresses the argument, put forward by Lernestedt, that the proprietor of the ‘criminal-law conflict’ is the community (or the community and the offender) and discusses his proposed theoretical model of criminal law trial. I raise questions regarding the legitimacy of such a model, focusing on four counts. Firstly, I assert that his assumptions about the state the individual and the old/new versions of criminal law theory are society-dependent. Secondly, I address some problems with the concept of community and particularly with the proposed conception of community, which seems to mostly exclude the offender. Thirdly, I question the need for (or added value of) such a proposed conceptual involvement of the community as an actor in the criminal law process and theory. Lastly, some potential problems with the idea of the victim as a mere “representative of us” are mentioned, including the possibly undesirable demands and limitations on the victim’s agency and issues of respect for the victim’s individuality.  相似文献

Each year, thousands of victims of violence enter the Canadian criminal justice system and, by extension, justice buildings, such as police stations and courthouses. The architecture and design of these buildings communicate symbolic messages about justice and may influence the emotions, behaviors, and well-being of survivors. This qualitative study explored survivors’ emotional experiences with justice architecture. Findings reveal that survivors experience justice architecture as cold and hard; a facilitator of feelings of insignificance; lacking in privacy and; representative of their raw emotional state. The author discusses implications of these findings for victim engagement in the context of justice spaces.  相似文献

Dating violence (DV) among young people is increasingly recognized as a significant problem and preventive efforts targeting adolescents and young adults are being mobilized to tackle it. However, an accumulating body of evidence shows that these efforts fail to adequately capture young people’s needs, particularly those from diverse cultures and contexts, and to incorporate their perspectives into practice. The present study aimed to address this gap by exploring young people’s views on how DV can be prevented and what they expect from prevention programs in an urban Turkish context, where DV remains an under-studied issue and preventive efforts are only slowly progressing. Toward this goal, a qualitative research design was employed. Thirty-nine college students, aged 18–25, were recruited through convenience sampling and individually interviewed in a semi-structured manner. The interviews were transcribed and thematically analyzed from a social constructionist perspective. The analysis revealed five main themes that indicated young people’s suggestions for and expectations from DV prevention: 1) setting new dating norms, 2) targeting socialization processes, 3) improving relational competence, 4) improving oneself, and 5) managing obstacles. The findings and practice implications are discussed within a contextual-ecological framework in the changing socio-cultural terrain of Turkey. The study highlights the fact that young people’s views can guide the development of effective, contextually relevant, empowering, and collaborative practices, and indicates the value of listening to young people’s voices in the field of DV prevention.

Home care services funded by Medicare and Medicaid grew rapidly throughout most of the 1990s. During this period some state Medicaid programs transferred costs for home care claims to the Medicare program to reduce their liability and increase beneficiary access to Medicare coverage. This article reports the findings of the first national study of these Medicare maximization billing practices for home care services. Primary data were collected to determine which states conduct retrospective Medicare billing practices and the amounts recovered from Medicare. Our analysis indicates that seven states recovered as much as dollar 265 million from Medicare in state and federal dollars during the 1990s. Ratios of recovered expenditures-to-costs incurred for retrospective billing practices conducted in Connecticut, New York, and Massachusetts are between 5:1 and 7:1. While retrospective billing practices may aid states in reducing Medicaid outlays and potentially help dual Medicare beneficiaries gain coverage for their home care claims, they increase Medicare expenditures for home care at a time of concern for the long-term financial viability of Medicare and illustrate the need for reforming our national long-term care financing policy.  相似文献

Abstract

Florida's community control program (CC) developed as a punitive alternative to prison. Characterized by intensive supervision and home confinement, the language and the guidelines assume gender equality, however, the model ignores the family responsibilities of controllees. Because women are more likely than men to be primary caregivers for their families, the issue has gender implications at the policy level. This study examines the background of CC legislation in relation to gender, and presents a case example of how the language of community control is applied at the local level. From interviews and observations, the authors show how officers and female controllees in a county program describe the tensions between caregiving and policy restrictions in their daily lives. They argue that caregiver status should be addressed at the policy level, and advocate the formation of “social families” as a way to help controllees meet CC requirements while caring for families.  相似文献

It provides an overview of the roles a prosecutor is expected to play, e.g. whether a contribution to national or local crime prevention policy or to act in victim’s interest is expected. This study applied Andersen’s model of health service use to help-seeking among collegiate dating violence (DV) victims, and examined factors for help-seeking. A total of 338 students from a Midwest public university were included in the sample. The study results showed many college students experience psychological, physical, sexual and technological violence; substance use is associated with DV; the type of violence experienced is associated with the type of help sources that victims will use; and victims seek help from informal sources more than formal sources. Implications for social work research, practice and policy are discussed.  相似文献

This article addresses practical implications for preventing lethal and nonlethal domestic violence (DV) that stem from recent research on male domestic homicide perpetrators. The role of risk assessment and batterer intervention programs is emphasized, including specific programming for treatment-resistant perpetrators. Adjunct interventions for related problems (e.g., anger, suicidal behaviour, substance abuse) are offered, and risk management tactics are summarized. The article highlights the significance of safety planning for victims and teaching youth skills for forming and maintaining healthy relationships. Possible solutions to the problem of DV perpetrators who avoid arrest also are highlighted (e.g., public awareness campaigns). Additionally, this article discusses approaches for dealing with psychopathic DV perpetrators, including the possible benefits of community education on psychopathy and early intervention for youth at risk for developing these traits. Some policy implications concerning DV and psychopathy also are covered. The article underscores the importance of coordinated community responses to DV.  相似文献

In Romania, the quantification of traumatic injuries is achieved in medical- legal services; therefore, each domestic violence (DV) victim needs a medical-legal certificate to prove in a court of law the presence of traumatic injuries. In this study, we aimed to determine the pattern of traumatic injuries in DV. A total of 219 consecutive DV cases were included. For each victim, a detailed medical-legal examination was performed, including specialized consults, if needed. Results were analyzed statistically using the SPSS software. Traumatic injuries in DV cases were usually located in the head, face, and neck areas and had a low severity index. Severe lesions were found in less than 10% and no sexual aggression was found. The severity increases with age and is higher for males than females. The pattern of DV-associated injuries we have encountered is similar to the one found in other similar studies. Knowing this pattern may be useful in clinical practice to detect cases of DV.  相似文献

The historic use of offense reports by police agencies for decision making is examined in the light of another data source — victim surveys. Survey information data can be used to: (1) more reliably estimate the extent and distribution of crime in a community; (2) evaluate the effectiveness of innovative programs; (3) develop police-sponsored public education programs; (4) describe the characteristics of victims and high crime areas; (5) sensitize police to the needs of the victim; and (6) develop police training programs that include dealing with the victim.  相似文献

This paper addresses an important conceptual question surrounding the categorisation of honour-based violence (hereafter ‘HBV’) – Is HBV a subspecies of domestic violence (hereafter ‘DV’)? According to academic commentators such as Reddy, Aujla and Gill, HBV falls within the broad spectrum of DV. Utilising data extracted from interviews conducted with 30 key agents, this paper will seek to provide incontrovertible evidence that HBV is different to DV because the characteristics it presents offer some differences. Furthermore, the overall strategies used to investigate HBV by UK law enforcement agencies differ to that of DV. Being this specific about HBV does not necessarily mean that one succumbs to cultural-essentialist assumptions about the prevalence of such violence in particular communities either. Rather, an understanding that HBV can be different will help identify the serious dangers it presents and the strategies needed to support victims.  相似文献

Of all the advocacy services provided to partner violence and sexual assault victims, safety planning may be most central. However, unlike many community behavioral health or case management services, there is virtually no literature on standards of care in safety planning, ways to measure its effectiveness, or discussion of the challenges advocates face in their day-to-day practice of planning for victim safety. The purpose of this paper is to describe advocate perceptions of training and supervision, how they obtain feedback about their work with victims, and their personal challenges in safety planning with victims. Study results highlight the need for more guidance, training, and support as well as more coping strategies for the numerous personal challenges advocates face in their day-to-day safety planning work.
