This article examines Quentin Skinner's revisionist project of reconciling republican liberty and negative freedom. His conceptualisation is analysed in the contexts of both contemporary political theory as well as a historiographical interpretation of Machiavelli. Skinner advances two claims: first, that Machiavelli's idea of liberty is negative freedom, and second, that republicanism shows that liberty is best maintained by the coercive use of the law. I argue that there are two conflicting concepts of the law underlying Skinner's theory. One regards the law as an invisible hand, while the other takes the law to be a liberating agency. Skinner's influence on the emerging juristic paradigm in republicanism is also considered.  相似文献

This article explores the possibilities for a normative understanding of the politics of EU development from a republican perspective. It draws on current debates on republicanism, which combine republican, liberal and multicultural themes, and defends an approach to European citizenship and the design of European institutions in which the contemporary republican emphasis on freedom as non-domination is complemented with the multiculturalist concern with group rights that cut across national boundaries. It is argued that the combination of republican institutions and multicultural citizenship can provide a model for European construction.  相似文献

Alexander Hamilton's conception of human nature grounds his political thought. His predominately and radically liberal conception of human nature is based on Locke's concept of liberty, Hobbes's concept of power, and Machiavelli's concept of the "effectual truth." It thus stresses the necessary relation between self-interest and republican government and entails the repudiation of classical republican and Christian political ideals. But Hamilton's love of liberty is nonetheless rooted in a sense of classical nobility and Christian philanthropy that elevates even while contradicting his liberalism. The complex relation between liberty, nobility, philanthropy, and power in Hamilton's conception of human nature, in effect, defines his thought, reveals its assumptions, constitutes its strengths, and poses urgent problems. That complexity forms the spirit of his liberal republicanism.  相似文献

The Federalist claims to present a republican response to thetypical political problems faced by republics. That solutionrequired a departure from all models of republics known at thattime, and in particular a break with Anti-Federalist modelsthat posited heavy reliance on responsibility, understood aseither political accountability or as moral and political virtue.The Federalist challenges the Anti-Federalist notion that a"no-gap polity" is the means to safe and effective republicanism.It also challenges those who believe that virtue of people orrulers is the precondition of a republican polity. In this article I defend a broadly Rawlsian interpretation of citizenship which combines both liberal and republican themes to provide an account of citizenship which is more appropriate for modern democracies than alternative interpretations, such as that offered by communitarian critics of political liberalism. Liberal republicanism, I argue, gives a convincing interpretation of the nature and value of citizenship and provides the basis for a radical political agenda.  相似文献

What normative principles should multicultural states be guided by in responding to minority claims for the accommodation of cultural and religious social practices? This article explores how theories of non-domination can contribute to debates on this question in the multiculturalism literature. It examines Philip Pettit’s, Cecile Laborde’s and Frank Lovett’s republican theories and argues that non-domination-based approaches to multicultural accommodation are more suitable to assess the dynamic of intra- and inter-group relations than the prominent liberal–multiculturalist alternative. However, their advantages are not contingent on the wider theories from which they emerge, but rather related to generalizable features of the non-domination ideal. This suggests that non-domination should also be appealing to non-republicans, who can adopt it minimally as a critical principle to determine illegitimate policies.  相似文献

This article examines the relationship between liberty and itscommunal basis in Switzerland. The author identifies the basiccultural values shared by the Swiss that have served to guaranteea republican form of government. These values are an expectationof "nonpersonalized" government and a preference for small-scaleorganization. These, together with the multilingual compositionof the country, have combined to produce Swiss republicanismfrom which liberty is a byproduct. This article discusses recent developments in dissident Irish republicanism and some of the arguments advanced to explain its emergence as a factor in Northern Irish politics. In particular it considers those explanations which define these new armed groups as either the latest manifestation of a historically determined Irish republican tradition or simply as ‘residual terrorist groups’ left behind by Provisional republicanism's movement into the constitutional mainstream in the 1990s. It rejects these arguments as ahistorical and schematic, and instead suggests that the dynamics and trajectory of dissident republicanism are shaped instead by the inherent tensions and structures of ‘the new Northern Ireland’. It goes on to compare the contemporary political, social and economic forces that produce the dissidents with the conditions that created the Provisionals as in the early 1970s and concludes that whilst these new groups will continue to pose a threat to the ‘normalization’ of the new dispensation they will not be successful as their republican forebears in mobilizing a significant and sustained challenge to the Northern Irish state.  相似文献

The Northwest Ordinance, enacted by the Congress of the Confederationon 13 July 1787, addressed in its own way the two crises facingthe Framers in Philadelphia: the crisis of the Union and thecrisis of republican government. It gave government to the NorthwestTerritory, which had been created for the sake of the Unionand with an eye to the security of republicanism. That territorywas destined to be a matrix of new states, equal members ofthe Union and republican in form. The working out of those principles,commanded by the Declaration and foreshadowing the Constitution,is traced from Jefferson's plan of 1784 to the Ordinance of1787. The uncultivated and intractable character of the frontiersman,making his attachment to the Union and his capacity for self-governmentdubious, presented a special problem. It is seen how the NorthwestOrdinance, establishing government, procuring certain socialand economic conditions, and inducing proper habits and opinions,sought to make the expansion of the Union an extension of republicanism.  相似文献

Michael Sandel's Democracy's Discontent strives to contribute to the project of "democratic theory," which aims to bring people together across ideological differences. Sandel wants to revitalize citizenship by uniting religious conservatives and those committed to a more just political economy through an appeal to the American tradition of civic republicanism. However, his project is fundamentally incoherent. First, Sandel's narrative conflates the republican and religious aspects of the American founding, ignoring the fact that civic republican political theory actually developed in direct opposition to the ideal of a Christian polity. Second, his version of civic republicanism deviates from the historic tradition in a way that renders it much more conservative than it actually was and might still be. Third, his reading of American history consistently highlights conservative themes. Consequently, Sandel ultimately undercuts the progressive aspects of his own vision, detracting from rather than contributing to the transideological aspirations of "democratic theory."  相似文献

In this article, I show that the assumptions underpinning John Rawls's so-called "duty of civility" ought to lead one not to affirm the duty but to reject it. I will begin by setting out in its essentials the content and rationale of the "duty of civility," which lies at the heart of Rawls's ideal of public reason. Secondly, I will argue that the very premises allegedly underpinning the duty of civility—namely, the values of reciprocity and political autonomy, and the burdens of judgment—in fact rule it out. Thirdly, I will suggest that if my argument against the duty of civility is correct, then one recent attempt to salvage political liberalism and reasonableness from the charge of incoherence fails. Finally, I draw some challenging lessons from our discussion for political liberalism and the liberal tradition as a whole.  相似文献

The episodic dissident republican activity evident in Northern Ireland since the Good Friday Agreement has been accompanied by regular assertions from the police, politicians and commentators that dissidents have no backing. This article examines the historic importance of mandates and support for previous and contemporary republican armed campaigns. It explores whether violent republicans have ever enjoyed widespread support in Ireland and assesses the extent to which a lack of backing has precluded violent campaigns. The piece analyses the evidence regarding the lack of sympathy for current dissident violence, assessing the degree to which armed republicanism has reached a new level of isolation.  相似文献

This article examines the ideological roots and historical development of an early radical economic egalitarian tradition in American political thought. It concentrates on a group of thinkers and social critics that were active from the 1820s through the beginning of the Civil War. Inspired by republican themes, they forged a radical critique of the emerging capitalist order and a skepticism of economic modernity. By reworking the republican political notion of an equality of social relations as an essential context for individual liberty, these radical critics posed a challenge to the emerging capitalist order. They would also be unique in the way that they analyzed the workings of this new economic system arguing that it was a mechanism that would systematically reproduce economic inequality eroding republican forms of government and society making them a distinct voice in America's egalitarian tradition.  相似文献

This article will examine the development of John Milton's arguments for democracy as against monarchy and other sorts of autocratic rule. These arguments are interesting both in their own right and insofar as they shed light on historiographical debates concerning the classical republican tradition. Milton is shown to hold a negative conception of liberty, as opposed to a positive or participatory conception, which lends support to the neo-roman interpretation of that tradition, associated with Quentin Skinner and Philip Pettit. However, it is further shown that Sinner and Pettit misunderstand the classical republicans' case for democracy, attributing to them a conceptual argument in place of an empirical one. A better understanding of Milton's political theory contributes to a better understanding of this dilemma, and perhaps suggests a solution.  相似文献

Proponents of justice for animals often argue that non-human animals have an interest in liberty. Furthermore, they usually claim that this animal interest in liberty is intrinsic rather than instrumental; that is to say, liberty is regarded to be good for animals in itself, irrespective of its contribution to the achievement of other goods, such as pleasure. For this reason they argue that legislating to improve welfare standards in zoos, circuses, laboratories and agriculture is inadequate. Instead, they claim that such practices are analogous to human slavery, necessarily harmful and must be abolished. In this article I refute this assertion and claim that for most animals, their interest in liberty can only ever be instrumental. In doing so I outline and reject two different arguments in favour of an intrinsic animal interest in liberty: first, that liberty is an intrinsic interest of animals because they possess preference autonomy; and second, that it is good for animals to be free, where freedom is defined as the ability to exercise one's natural functionings. I conclude that most animals do not possess an intrinsic interest in liberty because they are not autonomous in the relevant sense; that is, they cannot frame, revise and pursue their own conception of the good. If my conclusion is correct, this would have important effects on our obligations to non-human animals. I end the article by introducing some of these possible implications. Specifically, I propose that for most animals, our obligations do not consist of liberating them, and that it might be permissible to use and interfere with animals more often than other proponents of justice for animals have suggested. If this is the case, not all of the ways we keep and use animals need to be abolished. Nevertheless, many need to be reformed to improve welfare standards.  相似文献

This article reassesses Thomas Jefferson's political economy in light of debates about the influence of liberal and republican ideas on his thought. I argue that Jefferson embraced liberal premises, but used them to reach anticapitalist conclusions. He opposed neither commerce nor the prosperity it promised; he opposed working for a wage, and he did so on liberal grounds. The first section of this article shows that John Locke's theory of property turns on the justification of capitalist labor relations. The second section establishes, first, that Locke's argument played a decisive role in the development of Jefferson's own and, second, that Jefferson redefined its terms to fashion a forceful critique of wage labor. An examination of Jefferson's writings elucidates a neglected variant of the liberal tradition, prevalent in the United States until the Populist agitation. Its core is the stigma attached to working for hire as a diminished form of liberty, tantamount to wage slavery.  相似文献

Liberal and republican political theorists have not paid much attention to a theory of public administration or policy implementation. To the extent that they have, they have tended to endorse an ideal-typical Weberian model of bureaucracy and impersonal ethics of rules to limit street-level discretion. This article argues that the Weberian bureaucratic ethics is inconsistent with core liberal and republican values and, in fact, dominating at the street level. In order for laws and policies to be implemented in a manner consistent with liberal and republican principles, an alternative public ethics is proposed—a public ethics of care. Building on earlier research, this article argues that a public ethics of care represents an important supplement to liberal and republican ideals, as well as a better alternative to Weberian bureaucratic ethics, for implementing laws and policies at the street level in limited and responsive, nondominating ways.  相似文献

I raise three objections to Philip Pettit's republican account of justice: (a) that it fails to account adequately for the role of certain values such as substantive fairness; (b) that it represents an uncomfortable hybrid of egalitarianism and sufficientarianism; and (c) that it fails Pettit’s own ‘eyeball test’. I then conclude in a more constructive vein, speculating about the kind of account of justice it is supposed to be and suggesting that, construed a certain way, it may have resources for answering the three objections.  相似文献
