从重婚无效是否可以阻却看人治与法治思维——《<婚姻法>解释一》第8条的价值判断与选择

从《<婚姻法>解释一》第8条的文意上理解,重婚属于阻却范围。但最高人民法院法官在解读该条文时认为,重婚不属于阻却范围。应当按解释条文理解,还是按法官的解读理解,关键在于厘清第8条到底是司法解释存在错误或疏漏,还是立法者作出的价值选择。重婚无效是否可以阻却,在立法和法理上存在肯定与否定两种选择。在域外法律上,重婚无效可以阻却有立法规定;在法理上,重婚无效阻却也可以得到合理解释;在司法解释的制定和征求意见的过程中,也有人主张重婚无效可以阻却。因此,重婚无效可以阻却不论是在立法上还是在理论上均是选项之一。如果最高人民法院认为重婚无效不属于阻却范围,则应在解释中作出例外或排斥性规定,而第8条并没有作出排斥性规定。在这种情况下,只能理解第8条是立法者作出的价值选择,而没有理由认为是司法解释存在错误或疏漏,更没有理由作出与第8条意思相反的解读。只有这样才符合法治思维,否则就是"法外释法",是以人治思维代替法治思维,这将使法律缺乏安定性,影响法律的权威。

重婚罪的价值取向

据报道,原国家统计局局长邱晓华因犯重婚罪,可能被提起公诉。这是我国部级领导干部中,因婚姻问题而被追究刑事责任的第一案。根据我国刑法规定,有配偶而重婚的,或者明知他人有配偶而与之结婚的,处两年以下有期徒刑或者拘役。重婚罪破坏我国一夫一妻制婚姻制度,是一种侵犯公民人身权利的犯罪。现实生活中,由于重婚犯罪侵犯夫妻一方的民事权利,所以,一般由受害人提起刑事诉讼。但邱晓华是否由检察机关提起公诉,我们还不得而知。     

事实婚姻与重婚罪的重合适用问题辨析

文章从正义和秩序两个角度分析了事实婚姻制度与重婚罪制度的基本价值取向。事实婚姻制度的秩序诉求是要建立一种否认事实婚姻行为效力的婚姻登记制度,通过这一秩序诉求的达到,进而实现意思自由原则、公序良俗原则与诚实信用原则的正义诉求;重婚罪制度的秩序诉求是建立刑法保护的一夫一妻秩序,通过这一秩序诉求的达到,实现一夫一妻的伦理正义。从对两者的比较分析中推论出对事实重婚行为应当同时适用两种制度的结论。     

浅论故意侵害配偶权之第三者民事责任

根据我国新《婚姻法》第46条和《最高人民法院关于适用（婚姻法）若干问题的解释（一）》第29条的规定，重婚或者有配偶者与他人同居导致离婚的，无过错方有权向其配偶请求损害赔偿。从以上规定可以看出，新《婚姻法》及司法解释就故意侵害配偶权的法律责任问题作了如下限制。     

仅有一纸婚书是不够的

现实生活中,由于当事人弄虚作假、欺骗婚姻登记机关等原因或者婚姻登记机关不依法履行职责等原因,使某些欠缺结婚实质要件的男女当事人也经婚姻登记机关办理了结婚登记手续成为夫妻。若从法律的严格界定来说,这些婚姻应属于无效婚姻。据有关部门的反映,目前在婚姻登记中或登记结婚后发现的无效婚姻的情形主要有：1.婚姻当事人不到法定结婚年龄;2.有禁止结婚的亲属关系;3.患有禁止结婚的疾病;4.重婚;5.使用他人身份证件登记结婚;（例如,某省有一对姐妹,妹妹结婚时,因未到晚婚年龄,用姐姐的身份证结婚登记,结婚证上写的是姐姐的…
