What can Southern Criminology Contribute to a Post-Race Agenda?

Drawing on Raewyn Connell’s Southern Theory (2007), Carrington et al. (British Journal of Criminology, 56(1), 1–20, 2015) have called for a de-colonization and democratization of criminological knowledge, which, they argue, has privileged the epistemologies of the global North. Taking up the challenge of “southern criminology,” in this paper we examine the concept of race as a political artifact of northern thinking. The idea of race is durable in criminology. To illustrate this, we examine the racialization of Aboriginal Australians. Given the relationship between processes of racialization and criminalization, criminology should avoid engaging in practices which produce or reinforce racial schema. Further, with reference to southern epistemologies, we offer an alternative construct of human difference and diversity grounded in discourses of belonging specific to Australasian cultures.     

What does it mean to suffer loss? Haxton v Philips Electronics

In Haxton v Philips Electronics the Court of Appeal considered whether a widow could recover the diminution in value of her dependency claim following the defendant's tortious reduction of her life expectancy. The note outlines the development of the common law, demonstrating that Haxton is novel but not unorthodox, and tests whether Haxton's principles can provide a sound foundation for future cases. Positing three hypothetical scenarios, it argues that the disparity in outcome, rather than indicating a lack of unifying principle, as was suggested in Jobling v Associated Dairies, may be explained by combining Austin's division between primary and secondary rights with Gardner and Stevens' contributions as to how they are protected. Restitutio in integrum requires consideration of the reasons and values underlying the right in question and these are discernible in the jurisprudence. The note also considers whether Haxton could have been decided on the basis that a defendant should not profit from its own wrongdoing.     

How to deal with resale price maintenance: What can we learn from empirical results?

The US Supreme Court’s overruling of the pre-existing per se illegality of resale price maintenance and the recommendation of a rule of reason approach in the Leegin decision (Leegin Creative Leather Products, Inc. vs. PSKS, Inc., 2007), raise the question whether other jurisdictions should follow this approach and what future assessments of resale price maintenance cases should look like. Policy decisions have to rely on the importance of various theories concerning welfare effects of resale price maintenance practices, which must be supported by empirical studies. The paper focuses on empirically confirmed theoretical arguments for the analysis and discussion of existing assessment proposals. Furthermore, the paper derives a new recommended assessment procedure for resale price maintenance from a special point of view by combining empirical results with the decision-theoretic approach of optimal sequential investigation rules.

A National Survey of Mental Health Services Available to Offenders with Mental Illness: Who Is Doing What?

The purpose of this study was to examine the national practices of psychotherapy services for male offenders with mental illness (OMI) in state correctional facilities. Participants consisted of 230 correctional mental health service providers from 165 state correctional facilities. Results indicated that mental health professionals provided a variety of services to OMI that can be conceptualized by six goals considered important in their work: mental illness recovery, emotions management, institutional functioning, re-entry, risk-need, and personal growth. Mental health professionals in this study generally viewed mental illness recovery, institutional functioning, and personal growth as significantly more important and spent more time focused on these goals than emotions management, re-entry, and risk-need. Mental health professionals tended to believe the services they provided were effective across four key treatment foci including mental illness, skill development, behavioral functioning, and criminogenic needs with more progress perceived in areas related to mental illness and skill development than their ability to effectively change behavioral functioning. Implications of these findings and directions for future research are discussed.     

‘What to do with the cutters?’ – Best practices for offender self-injurious behaviors

This paper addresses focal concerns regarding self-injurious behavior (SIB) in offenders, provides guidance on current best practices, and explains and challenges myths often held by correctional staff and administration regarding SIB. It is organized along the following thematic areas: (1) Behavior: SIBs within corrections are complex, challenging, and often misunderstood; (2) People: reducing rates of SIB in a correctional facility is a difficult challenge that requires collaboration; and (3) Place: the challenge of providing therapeutic and medical care within a correctional setting. Subsequently, policy implications and best practices recommendations are provided in order to better address this problematic behavior.     

What is the goal of access to health care?

This article first examines the justifications for the goal of access to health care and the variations between health systems in their endorsement of individuals' rights to health care irrespective of income, ethnicity, age and other characteristics. It then examines the meanings of the goal of "access" to health care and considers four key dimensions--service availability ("having" access), service utilisation ("gaining" access), the relevance and effectiveness of services and equity of access. These dimensions provide a common framework that can be applied across countries and health systems and employed to assess the extent to which access to health care is actually achieved.
