The first phase of this study focused on the development of comprehensive, conceptually integrated measures of procedural and distributive justice in the context of family decision making. In the second phase, these measures were used to examine older adolescents' justice appraisals of specific family disputes and the relation of these justice appraisals to family systems functioning along dimensions of conflict and cohesion. A Family Justice Inventory was constructed, which included two global indices (one for procedural justice and one for outcome fairness) and 13 subscales: 9 measuring specific facets of the procedural justice construct and 4 measuring specific dimensions of the distributive justice construct. Factor analysis revealed that the 13 Family Justice Inventory subscales could be reduced to 5 interpretable procedural justice factors (personal respect, status recognition, process control, correction, and trust) and 4 interpretable distributive justice factors (decision control, need, equality, and equity). Using procedural justice factor scores in regression analyses, personal respect, status recognition, correction, and trust each accounted for unique variance in family conflict and family cohesion. The heavy concentration of crime on a few areas, and the concentration on the chronically victimised within those areas, together illustrate the gross inequality of the risk of crime victimisation. This inequality also characterises other hazards of life. Criminology has too often reduced the problem of crime to the problem of the offender. Recognising crime hazard as an issue of distributive justice requires a different mind set. The Crime and Disorder Act 1998 recognises the drivers of crime as lying outside criminal justice, but does not put in place a panhazard analysis of the kind required, community safety being presented as a type of crime prevention. Movement towards panhazard thinking may well be somewhat facilitated by the workingthrough of the incorporation of the European Convention on Human Rights, actions flowing from section 17 of the Crime and Disorder Act, and a reconsideration of how emergency services might work.  相似文献

In an experimental study, participants read a scenario about five business partners who sold plants at a flea market. Each partner obtained a different outcome and still had to pay the costs of the partnership. Participants either had to indicate what they considered to be a fair distribution of the costs (given each individual partner's earnings) or what they considered to be a fair distribution of the net results (the total outcome minus the costs). The total outcome was either higher or lower than the costs (i.e., the enterprise resulted in a net profit or a net loss). The results indicate that fairness judgments are affected by the target of distribution. Negative outcomes are distributed differently than positive outcomes, and within the domain of negative outcomes, marked differences are observed between costs and net losses. The results are explained in terms of the differential salience of the distribution of the net result.  相似文献

Theoretical progress is essential to the viability of any scientific subdiscipline. Ever since a growth spurt in the 1980s, however, and despite a very active research enterprise, distributive justice theory has developed very little. Our approach is first to discuss the role that theory plays in disciplinary growth. After noting the indicators of stagnation in distributive justice areas, we identify key problems with the way distributive justice theories are constructed and evaluated. Specifically, little attention is paid to the clear definition and consistent use of theoretical terms, or to the construction of explicit logical arguments from which empirical hypotheses may be derived. Weaknesses in these areas all but prohibit the evolution of improved theories over time. We conclude with a set of evaluative criteria that, if applied collectively by members of the field, would optimize the chances for theoretical progress. Ultimately this also would lead to more efficient empirical tests and better-informed practical applications of distributive justice theories.  相似文献

This article reports judgments on the rights and obligations of the unemployed in The Netherlands. A large majority of the Dutch population is shown to support (i) the unemployed’s right to social security as well as their obligation to work, (ii) the principle that declining a job offering should be punished, and (iii) harsh sanctions in some specific cases of job refusal. An emphasis on the obligation to work results from conservative attitudes regarding both distributive justice (economic conservatism) and retributive justice (cultural conservatism). Furthermore, conservative attitudes regarding distributive justice derive from a privileged economic position (especially high income and infrequent experience of unemployment), whereas conservative attitudes regarding retributive justice result from a restricted cultural position (low level of education, technical rather than cultural type of education, and limited involvement in arts and culture).  相似文献

Miller's volume is a useful, thorough, and innovating overview of the subject of social justice. It inspires three lines of critical response. The first involves the symbiotic role of philosophy and empirical inquiry in the analysis of justice. The second involves the qualities of opportunity that ought to underlie justice. Finally, there are a few lessons regarding the status of justice in the overall evaluation of society that can be learned from the case of the United States, which has an anomalously bad record with respect to distributive justice. The study proposes a taxonomy that maps and organizes various normative (ought) and empirically oriented (is) theories of distributive justice, with the aim of examining possible relations between these two research traditions. The taxonomy distinguishes between theories according to two shared dimensions of content: (a) microjustice versus macrojustice principles and (b) the unidimensional versus multidimensional character of these principles. The combination of these dimensions yields four groups of theories of distributive justice: unidimensional macro (the utilitarian approach); multidimensional macro (Rawls' theory of justice); unidimensional micro (desert and equity theories); and multidimensional micro (Miller's theory and the multiprinciple approach). A fifth group of hybrid theories is identified (including Walzer's and Jasso's theory of justice), which is built upon the layers of the other taxonomy cells, combining elements of macro- and microjustice and emphasizing the multidimensional character of distributive justice. The analysis revealed that the empirical and normative traditions have much in common. In certain cases, as with the utilitarian approach and Rawls' theory, empirical research has sought correspondence between the ought and the is. In other cases, such as with equity theory and the multiprinciple approach, it has used some basic normative ideas and assumptions as its starting point. Nevertheless, these research traditions often develop in parallel ways without sufficient mutual recognition or interaction. The study concludes by considering possible exchanges that may develop between these two traditions, examining to what extent and how philosophical–normative and empirically oriented research can contribute to one another.  相似文献

The concepts of fairness and justice are embodied within the organizing principle of social justice. Although social justice is a primary focus of social work, social service workers are not always treated with fairness by their own employers. The results from a survey of 255 social service employees from a variety of agencies in Northwest Ohio indicate that distributive justice and procedural justice, two dimensions of organizational justice, are both significant predictors of job satisfaction and organizational commitment, with procedural justice having two to three times the impact of distributive justice.  相似文献

This paper presents a theoretical framework for the integration of distributive and procedural justice in positive and negative outcome allocations. The framework consists of seven basic assumptions, seven propositions, and seven groups of interrelated hypotheses. The expected outcome offers a coherent program for future justice research based on the realization that distributive and procedural aspects of fairness cannot be meaningfully treated (1) in isolation from one another, and (2) without taking into account the valence of the allocated outcome. The framework should also reveal the need to reassess existing distributive and procedural justice study conclusions that neglected to examine the interactive effects of the allocation outcome (distribution) and the procedure and the outcome valence.  相似文献

The present paper describes the development and validation of the Preference for the Merit Principle (PMP) Scale, a measure to assess people's preference for allocating outcomes on the basis of the distributive justice principle of merit. On the basis of data from a large sample of undergraduate students, we tested the construct and predictive validity of the scale and compared the results with the performance of two existing justice scales (Rasinski's, 1987, Proportionality Scale, and Rubin and Peplau's, 1975, Belief in a Just World Scale). Overall, we found that the PMP Scale had superior construct validity as compared with the Proportionality Scale. In brief, the PMP Scale was more independent of conceptually distinct constructs, such as prejudice and right-wing authoritarianism. Distributive, procedural, and interactional justice have taken on various interpretations. Even when the meaning assigned to each term has been specified and clarified, however, no single set of unique interpretations for each term allows for an unambiguous set of interrelations among the terms. That is, definitional clarity alone cannot resolve all of the questions that can be raised about how one construct is related to another. My discussion raises some of those questions to illustrate that point. A related point is that although an agreed upon set of conceptual defintions might allow for independence of the constructs and thus their independent manipulation, in practice—and as measured (rather than manipulated) variables—these constructs inevitably reveal considerable overlap. Several different reasons for this overlap are explored and the implications discussed.  相似文献

The concept of distributive justice and the theoretical and empirical work conducted on it during the past two decades are examined. Three questions provide the structure for this examination: (i) What are fundamental conceptual dimensions of distributive justice and the specific substantive issues to which they are related? (ii) What central questions has recent work on distributive justice addressed? and (iii) What are the most important emerging issues on which work in the near-term future should focus? Much of the theory and research examined in the paper is social psychological in nature, but reference is made to related work in related disciplines, particularly sociology and philosophy.  相似文献

Public-goods dilemmas are characterized by conflicts between self-interest and the welfare of a group or society at large. Research has identified several factors that enhance cooperation in such dilemmas. However, less is known about how concern for distributive justice affects willingness to contribute in asymmetric public-goods dilemmas. To test the hypothesis that contributions to a common resource is related to perceived fairness, experiments were performed to investigate willingness to pay to the social service of child care in hypothetical societies. Experiment 1 aimed at replicating a previous survey study (Biel et al., 1997). Experiments 2 and 3 were extensions. In all three experiments subjects were asked to indicate how fair they considered different distributions of the quality of child care provided by their municipality. These distributions corresponded to the principles of equality, equity, and need. University students (32, 48, and 32 in the three experiments, respectively) served as subjects. Ratings of perceived fairness were positively related to willingness to pay. Other factors also positively related to willingness to pay included ability to pay, personal need, expected payment from others, and the number of households who had to contribute in order to maintain the quality. Furthermore, decreasing municipality size increased willingness to pay.  相似文献

欧洲各国致力于福利国家的建设已逾百年,经历了两次世界大战.各国在社会投入水平和福利机构方面的巨大差异至今仍在,但是各国对于福利社会的可持续性的认可和公众对福利社会的高度承诺则是基本一致的.各福利社会有来自各方面的维系:中央政府或地方政府、公司企业、家庭和自发组织的机构.不同的福利社会体系与它们之间的关系长期以来对欧洲各福利国家有着不同的意义,形成了具有不同特点的福利制度.在20世纪最后十年里重建福利国家的痛苦过程中,经济增长和社会发展之间的关系一直是整个斯堪的纳维亚地区社会问题的争论热点.然而到目前为止,效率与平等之间的冲突大多得到了解决,在北欧五国都保持了福利政策的稳定.该地区独特的历史经验并不排斥发展中国家的政府和机构为了发展福利事业而积极推行普及政策所做出的努力.  相似文献

西方福利法治国尽管在一定程度上促进了经济增长、社会和谐和政治稳定,但同时也带来了一系列的“福利病”,如不经济性、庞大的政府机构和如牛负重的财政压力等等,并最终导致了福利国危机甚或宪政危机的全面爆发。在“福利国”的反思浪潮中,诺齐克的“最弱意义国家”对抗着罗尔斯的“差别原则”,布坎南的“公共选择理论”回应着马斯格雷夫的“公共财政”学说,但问题的真正破解似乎必须回归自由主义传统,实现税权的有效规范与控制。  相似文献

收益公正分配是转型时期社会公正的重要维度,维系人权保护、经济发展、社会稳定与国家治理,蕴涵着分配正义理论。多种因素决定经济法分配正义是复合正义,强化在市场分配机制基础上的国家再分配职能,以促进社会基本结构的公正。经济法分配正义理论通过奠定收益分配之理论基础,提供收益分配之制度属性的路径促进收益公正分配,进而实现以社会公正为中心的可持续经济发展,推动中国社会顺利转型。而以分配正义为衡量尺度,我国收益分配制度需要进一步完善。  相似文献
