口岸限定区域,是指根据出入境边防检查、监护、管理等工作的需要,依据国家法律、法规在出入境口岸划定的一定区域,是边检机关实施出入境管理的主要场所。近年来我国与各国经济、文化交流逐渐增多,人员往来日益密切,在当前反恐、维稳的严峻形势下,对陆路口岸限定区域管理问题的研究显得尤为重要。

北美自由贸易区整合式边境管理法律的中国启示

整合式边境管理具有跨国边境管理的深度合作和国内边境管理部门的整合两大特点。北美自由贸易协定是依托于经济条约的整合式边境管理国际条约,其整合式边境管理法律制度推动了国家边界的转型,实现了边境管理部门的整合、国际法与国内法的协调、区域边境管理的风险共担。借鉴该制度,我国应以自由贸易协定为依托,建设整合式边境管理国际法律框架;以"软边界"为核心,推动整合式边境管理理念创新;以经济发展带动安全发展,推动经济框架下的安全合作;以"大通关"为背景,推动我国口岸出入境部门的整合;以出入境新政为起点,建设国内移民管理"新常态"。     

我国地方行政区公安出入境管理制度比较研究

尽管我国公安出入境管理具有明显的国家事权的特征,但其实质上具有更多的行政权力内容。由于地理位置、经济发展不平衡和政策倾斜等原因,我国各行政区的出入境口岸数量和出入境业务量差异极大,在依照本地区特点和需要的基础上设计和安排的公安出入境管理制度大相径庭。目前,我国地方行政区存在着六种不同类型的公安出入境管理模式,具体差异主要表现在管理体制、中国公民出入境管制、外国人及港澳台居民入出境管制及居留管理等四个方面。不同类型的公安出入境管理模式有利于当地出入境管理效率的提高和行政效益的增长,并促进各地区经济的发展;同时,也造成了出入境管理制度的区域冲突,导致一定程度上的管理失衡,因此有必要进行协调机制的建立和完善。
