Seit kurzem kennen das europäische und das deutsche Recht den Handel mit Emissionszertifikaten. Der Beitrag stellt vor dem Hintergrund der Einführung des Emissionshandels die wirtschaftstheoretischen Leitlinien der Umweltökonomie sowie ihre Verwirklichung in Zertifikathandel und anderen umweltpolitischen Steuerungsmitteln vor. Herausgestellt wird, dass das Zertifikatmodell ökonomische und ökologische Vorzüge vorweisen kann. Grenzen werden dem Emissionshandel jedoch insbesondere bei der „hot spot“- Problematik durch den Schutz- und Vorsorgegrundsatz gesetzt. Die Erstreckung des Emissionshandels auf andere Bereiche der Umweltregulierung ist daher nicht für alle Gebiete möglich und bedarf weiterhin der Flankierung durch das Ordnungsrecht.* Der Verfasser ist Rechtsanwalt der Sozietät Baumeister Rechtsanwälte, Münster.  相似文献

F.W. Maitland claimed that Sir Martin Wright propagated among English lawyers the view that English law had a feudal origin and was part of a European family of law and that Wright's opinions were popularized by Blackstone. This article demonstrates that Wright's opinions on feudal law, its history, and its impact on English law owed a considerable amount to the Scottish author Thomas Craig, who, through Wright, Blackstone, and others, as well as independently, had a significant impact on English lawyers’ understanding of their legal history and in overturning theories of the ‘immemorial’ nature of the common law. The infusion of Craig's European learning on feudalism into discussion of English law helped English legal history to develop.  相似文献

In a 2019 article in this journal, which drew on previous work, we argued by examination of a number of extremely important cases that the senior judiciary is in the process of attempting to create judicial supremacy in the UK. It is doing so, not by democratic debate, but by legal procedural innovation incomprehensible to the electorate. Invited by the journal to reply to a criticism of our argument by Dr Stephanie Palmer and Dr Stevie Martin, we have sought to defend our account of the undemocratic procedural novelty of those cases.  相似文献

This article considers the life and work of Stephen Martin Leake and seeks to locate his work within the wider context of the procedural and substantive transformation of the mid-to-late Victorian legal world. In particular, the article attempts to rescue Leake from obscurity and emphasise his importance in this process. It is argued that Leake's work began the process whereby common lawyers conceived of their law as organised in a principled rather than procedural manner. Later common law jurists built upon this work. Consideration is also given to the philosophical and jurisprudential sources upon which Leake drew in constructing his treatises.  相似文献
