Animals In Law: Introduction

This essay opens the Special Issue of the International Journal for the Semiotics of Law dedicated to Animality, entitled “Animals in Law”. It focuses on revealing the principal issues faced in the volume, by positioning the contributors’ works into the general theoretical perspectives which shape the social discourse over animals.     

Introduction: Yugoslavia Dismantled and International Law

Yugoslavia existed as a country for several decades. Competing explanatory narratives as to why and how this state ceased to exist—labeled “the self-destruction of Yugoslavia” and “the Hegemon did it”—are contrasted, and connected to two related viewpoints on the question “What role did international law play in the process of dismantling Yugoslavia?”: “reformist optimism” and “traditionalist realism”. It is argued that the former position leads not only to the marginalization of state sovereignty, but also impunitism, genocidalism, humanrightism, and most alarmingly to the decriminalization of aggression. A brief review of essay contributions to this special issue on “Yugoslavia Dismantled and International Law” offers a further argument in favor of traditionalist realism as the preferred postion to take regarding the current state of international relations and international law. In this regard, the case of Yugoslavia is extremely instructive.

Introduction: Procedural Justice, Law and Policy

Over the last few years, procedural justice has become one of the most debated fields in social science and law. Modern thinking about law, democracy and public policy inevitably leads to a consideration of appropriate procedures. Images of such procedures are culturally bound and also formed by individual cognition. The word "fair" seems to encompass the most desired features of procedures.     

激烈竞争下的变革:公司法判例法方法的引入

我国《公司法》2005年的修改拉开了公司法现代化的序幕。在大量借鉴和引入西方先进公司法制度的同时,我们应审视我国公司法发展和变革轨迹。目前,西方国家公司法发展和竞争的良好态势使学习和借鉴一些判例法国家的先进公司法律制度成为首选,但是,一味将这些属于舶来品的制度进行盲目借鉴,必将导致产生一些不可预知的后果,我国的公司法改革也将可能因此而误入歧途。这就有必要在我国现有公司成文法体系的基础上,适时引入产生先进公司法律制度的方法和途径即判例法方法,以有效推进有中国特色公司法的改革,使我国公司法既能满足自身制度发展的内在需求,也能够沉着应对潜在的区域公司法的制度性竞争,为今后我国公司法的不断改进和迅速发展奠定良好的体系性基础。

Psychological Injury and Law: Introduction to the First Issue

In this introductory article to the special series of articles written to initiate the new journal, Psychological Injury and Law, I provide the background and impetus for this fast-growing area as a distinct field of scientific study. Professionals working in the area need to be aware of its diverse components, from evidence law and forensic psychology to disability and assessment, to its three core areas of Posttraumatic Stress Disorder and other distress, chronic pain, and traumatic brain injury, as well as issues such as malingering. I provide summaries of the articles in this special series that appear in this inaugural issue. The remaining articles of the special series of articles to introduce the journal are presented in the next two issues.
