Care and Justice in the Global Context

Abstract. Morality is often dismissed as irrelevant in what is seen as the global anarchy of rival states each pursuing its national interest. When morality is invoked, it is usually the morality of justice with its associated moral conceptions of individual rights, equality, and universal law. In the area of moral theory, an alternative moral approach, the ethics of care, has been developed in recent years. It is beginning to influence how some see their global responsibilities.     

Surrogate Motherhood and the Morality of Care

The celebrated case of Baby M focused public attention on the practice of surrogate motherhood. This paper examines the judicial and legislative responses and the public policy implications of surrogate parenting contracts from the perspective of a morality of care. This perspective, which owes much to the pioneering work of Carol Gilligan, elevates the bond between mother and child over the rights conferred by contract. Working with this perspective, several arguments are advanced against the granting of specific performance of surrogate parenting contracts.     

论公安民警的身体健康及自我保健

一个时期以来,公安民警积劳成疾、英年早逝的事例时有发生,令人痛心。各地调查发现,公安民警身体健康状况不容乐观,已给我们敲响警钟。造成公安民警身体健康出现问题特别是出现积劳成疾的原因很复杂,其中不健康的生活方式和观念是“头号杀手”。健康是生命的基础,健康水平决定生命的质量。作为公安民警自身来说,要改善健康状况,提高生命质量,提升战斗力,必须构建健康的生活方式。     

Recidivism and the Availability of Health Care Organizations

Incarceration has been identified as a cause of poor health in current and formerly incarcerated individuals. Given the high likelihood of being in poor health when exiting prison, it is plausible that health impacts recidivism. Furthermore, ex-prisoners cluster in disadvantaged neighborhoods that are unlikely to have decent health services. Currently, there is insufficient research to examine this relationship at an ecological level. In this study, we investigate the relationship between the availability of health care organizations (HCOs) and their changes over time with neighborhood level recidivism, and how these relationships may be moderated by neighborhood disadvantage. We determine that the effect of HCOs on recidivism is indeed moderated through disadvantage: as disadvantage increases, the negative effect of losing significant amounts of HCOs on recidivism accelerates. Our results suggest that while increasing HCOs in disadvantaged neighborhoods is important, keeping HCOs in place is equally important for moderating negative neighborhood level outcomes.     

过失犯的标尺:注意能力和注意义务

如何认定过失将直接影响到对行为人的定罪量刑。注意能力和注意义务是过失犯构成要件的核心,但在《刑法》分则具体罪状中少有明确规定,仅从《刑法》条文我们还无法认定行为人的过失。在法律规范缺失的情况下,如何正确理解注意能力和注意义务就显得尤为必要。从构成要件角度判断行为人是否是在具备注意能力的前提下违反所负的注意义务,并造成了一定的危害结果来认定过失犯,可以为正确适用法律提供依据。     

医疗权的伦理辩护

为国家设定建立医疗保障体系和高效优质的医疗服务体系以保障和促进人民健康义务的基本人权是医疗权,而不是健康权.合作抵御包括疾病在内的自然的侵害,是人际社会形成的重要根据.现代医疗服务已经成为一种基本的善,一种人之生命的必需.病人的医疗权是病人对分享社会合作成果的一种期待,这种期待具有伦理的正当性,能够得到伦理的辩护.这种作为正当性期待的医疗权本身又要受限于权利秩序中当时的条件和资源.     

亲切的关怀 生动的实践——周永康书记视察山西律师工作一周年之际工作报告

2009年4月3日,中共中央政治局常委、中央政法委书记周永康同志视察山西期间,深入到临汾劳教所、晋中监狱、山西佳镜律师事务所调研视察工作,对山西省司法行政工作和佳镜律师事务所的工作给予充分肯定,并对进一步做好律师工作提出明确要求。今年4月,山西省司法厅厅长王水成同志撰写了《周永康书记视察山西律师工作一周年之际工作报告》,对山西司法行政机关和广大律师认真贯彻落实周永康书记重要指示、努力践行＂五者＂要求的做法进行了认真总结和汇报。4月19日,周永康书记在报告上作了重要批示,对山西及佳镜律师事务所工作给予充分肯定。山西省委书记袁纯清同志批示：律师工作非常重要。要以学习和贯彻周永康同志批示为契机,在总结好佳镜律师事务所先进经验的同时,推广和宣传好这一先进典型,进而促进我省的律师工作以至推进我省的司法行政工作更进一步。省长王君同志批示：要认真贯彻落实永康书记重要指示精神,进一步开创工作新局面。司法部吴爱英部长批示：要认真学习贯彻周永康书记的重要批示,进一步加强对律师的教育工作,认真总结山西及佳镜律师事务所的经验。本刊全文刊登,旨在对如何践行＂五者＂要求、加强对律师的管理和教育起到积极的启示作用。
