This article reports on the first extensive survey of Approved Social Worker (ASW) activity in Northern Ireland. It begins with a review of literature that identifies the complexity of legal and professional functions expected of ASWs, in the context of mental health legislation in the UK. Findings include high levels of perceived competence reported by practitioners, but diversity in the management of the service, and some problems in multi-disciplinary working. The emergency, out-of-hours duty teams in which many ASWs were employed appeared to vary in organization and operation. Service users and carers were generally dissatisfied with the responses to crisis services and appealed for adequately funded community supports. At a time when the review of the Mental Health (England and Wales) Act, 1983, is taking place, the authors suggest that ASWs can still perform an important statutory role, on condition that there is a more consistent approach to training, re-approval and funding of community-based services.  相似文献

The relationship between the legal and medical professions is improving, but many problems remain. There has been been and continues to be substantial growth in medicolegal organizations of various kinds. Better medicolegal investigative methods are being developed, and medicolegal teaching programs are on the increase. The two professions have worked together successfully on such problems as human heart transplantation and drug abuse. On the other hand, several problem areas continue to cause difficulty and friction, including medical experimentation on humans, the legal definition of death, abortion, euthanasia, and medical malpractice. The author calls on the existing medicolegal organizations to apply their expertise and influence to define and resolve these problems.  相似文献

一个政府要在全社会建立起良好的信用氛围,它首先必须自己是一个信用的政府。而要使政府诚信于民,重要的是将政府的权力运行纳入法制轨道。政府诚信也因此不仅仅是一种抽象的道义要求,更是一种具体的法律义务。《行政许可法》第八条规定标志着信赖利益保护原则在我国法律中得到了确认,对建设诚信政府和法治政府具有深远意义。但我国对信赖利益保护制度尚缺乏足够法律构建,诚信政府的法制建设也有待于进一步完善。  相似文献

在宪政建设及价值目标实现的诸因素中 ,协商机制的建立与完善 ,无疑是其中十分重要的一个方面。立宪的过程本质上就是一个协商的过程。在现代社会中 ,各种政治利益的协调应当是通过协商来实现的。建立协商机制的宪政意义在于 ,通过协商 ,达成宪法共识 ;而协商精神的贯彻和实现 ,则应有一个保障协商进行的完备的程序性制度设计和一个稳定、健康的市民社会 ,以及相应的宪政制度安排等。协商精神与协商机制的建立 ,不仅是现代民主政治的精髓 ,而且是宪法与宪政制度适应社会变化、不断发展完善的前提条件。  相似文献

世纪之交,我国的法制建设正在走向新的发展时期。尽管社会对司法赋予了极高的期待,民众对于司法的利用也在不断增加,但是司法的实际运行却并不尽如人意,司法腐败和判决的执行成为公众共同关注、批评最多的问题,司法的公正与权威正在受到严峻的挑战。面对这些问题,社会对于通过各种监督机制、特别是外部监督对司法机关、司法人员和司法活动进行严格的监督制约显示出高度的认同和积极性。然而,究竟应该设计建构何种监督制约机制,已有的监督机制是否能够达到预期目标,怎样更合理地解决司法独立与监督之间的关系,则是并没有真正达成共识的问题。本文的目的就是通过对检察院民事行政案件抗诉与人大个案监督的制度进行比较研究,对司法监督的功能与制度设计提出几点意见。  相似文献

An analysis of the legislative activity of the House of Lords during the period of Labour government between 1974 and 1979. At the time much of their activity was depicted as a clash between Lords and Commons, between the two chambers of the British legislature – one a ‘one‐sided, hereditary, unprized, unrepresentative, irresponsible absentee’ and other made up of the directly elected representatives of the people.

The author shows that the events during the period were in fact rather more complex than this, being more accurately portrayed as a clash between Government and Parliament facilitated by the House of Lords. In addition, the author points not only to the importance of the peers perceptions of the parliamentary situation at the time, what it was generally as well as at specific times and with regard to specific issues, and to the impact that this had, but also highlights the fact that the political complexion of the House of Lords is far more complex than a simple Conservative‐Labour dichotomy.

By way of conclusion it is argued not only that the activity of the House of Lords during this period provides ample evidence of the extent and nature of the work of the House, but also that the members were doing no more than their constitutional position provides for, namely to scrutinise and revise legislation – it was, as Bagehot observed, a Chamber of ‘temporary rejectors and palpable alterers’.  相似文献

This article tracks the genesis of one of the EU's most established meta-narratives, that of Europeanisation-through-case-law. Instead of studying this theory of European integration as an explanatory frame, I consider what is at stake in its genesis as a dominant frame of understanding of Europeanisation. I trace its emergence in the conflicting theorisations of the relationship between law and the European Communities that come along with the ECJ's 'landmark' decisions (Van Gend en Loos and Costa v ENEL). This approach helps seize the genesis of a specific and—at the time—rather unlikely political model for Europe in which a Court (the ECJ) is regarded as the very locus of European integration's dynamics as well as the best mediator and moderator of both Member States' 'conservatism' and individuals' 'potential excesses'.  相似文献
