亲子话语冲突结束方式研究——以美剧《摩登家庭》为例

冲突话语有起始、激化、结束三个阶段。本文以美国电视剧《摩登家庭》作为语料来源,收集了38个亲子冲突话语为语料,详细研究了亲子冲突话语的结束方式,并总结了六种结束方式:一方获胜、妥协让步、转换话题、三方介入、退出和客观环境中止。在六种模式中,妥协让步、第三者介入式和退出式是亲子冲突的最主要结束模式。     

我国环境冲突研究回顾及未来展望——基于CSSCI文献(1998-2020)的可视化分析

环境冲突是社会冲突的主要类型之一,环境冲突的有效治理是防范化解由环境问题引致的社会冲突的关键。本文借助Citespace软件,以1998-2020年间中文社会科学索引(CSSCI)数据库收录的135篇环境冲突相关文献为研究样本,综合采用文献计量和知识图谱分析两种方法对样本进行分析。研究发现,我国环境冲突文献发表数量各年份起伏较大,产生了高产学者和发文量较多的科研机构,关键词聚类分析确定了环境冲突的4个主题,邻避冲突是环境冲突领域研究的重点。未来应加强环境冲突研究领域研究者共同体、研究机构共同体建设以及多学科的融合,加强对大数据、区块链技术融入环境冲突治理等前沿问题的研究。     

我国商标权与商号权冲突的类型化分析与解决对策

针对我国知识产权学界对有关商标权与商号权冲突的研究大多停留于理论层面的现状，从解决现实冲突的指引角度出发，通过对我国商标权与商号权冲突进行类型化归纳，并结合不同类型冲突的具体法律适用，尝试提出了更为具体有针对性的冲突解决对策。     

商业秘密保护中的价值冲突与权利冲突研究

在商业秘密法律保护中存在着一系列的价值冲突与权利冲突。法律对任何权利的保护都应是有限度的,否则将容易造成权利人对权利的滥用。因此,法律对商业秘密的保护应有一定的限制。在对商业秘密保护中的价值冲突、权利冲突进行分析的基础上,借助法经济学和法理学的分析方法探讨冲突的解决问题。在坚持追求价值最大化的前提下,尊重社会主导价值观和社会总体利益,贯彻共同抑制标准和效率优先、兼顾公平原则来寻找权利保护的临界点和平衡点,从而解决冲突。     

论海峡两岸民商事法律冲突的特殊性

海峡两岸的民商事法律冲突既具有中国区际法律冲突的共性特点,又具有区别于大陆与香港、澳门地区法律冲突的个性特征。研究海峡两岸民商事法律冲突的特殊性,对于正确认识、合理解决两岸的法律冲突具有重要的理论意义和现实意义。     

从冲突理论视角看和谐社会之构建

分析和研究西方的社会冲突理论,认为一定程度的社会冲突有利于社会稳定,有利于推动社会发展,对我国构建和谐社会具有重要的启示。直面我国当前社会冲突的现状,认为只有正确面对社会冲突,理智地谋求冲突问题的解决方法,才能将冲突的正功能发挥出来,将冲突变为合作、和谐的动力。

知识产权权利冲突研究近年来不断升温,实务界和学术界都很关注。知识产权权利冲突作为一个法学概念,系对特定法律现象从法学角度做出的归纳总结,其本身具有一定的模糊性,需要在学术讨论中达成共识。知识产权权利冲突与法律冲突、知识产权侵权是相区别的概念,不应一概而论地否定对权利冲突的研究价值。知识产权权利冲突有积极的意义,但也有消极的影响,研究权利冲突最终的价值在于减少消极影响,促进权利体系完善和发展。

权利冲突现象是近几年颇受关注的法学问题。对其进行深刻的理论研究,对于如何正确配置权利有着重大的理论和现实意义。本文从权利冲突的概念和特征入手,分析权利冲突的原因,最后提出权利冲突的解决途径。

条约冲突对国际法的体系化、一致性及其权威造成了不利的影响，并且为条约当事国善意履行条约义务带来了困难。解决条约冲突是一个复杂的系统工程，它要区分“真实冲突”与“虚假冲突”两种具体情况，设计出适合各自不同特点的解决路径。     

Exploring the association between organizational structure variables and work on family strain among Indian police officers

Work-family conflict occurs when the domains of work and home spill over into one another leading to conflict, which is a real possibility for the unique occupation of policing. Work on family conflict, a subdomain of work-family conflict, occurs when issues at work spill over impacting home life. One form of work on family conflict is strain-based conflict, which is when work problems results in conflict at home, such being irritable at home or arguments with family members and friends. This study examined the relationship between organizational structure variables and work on family conflict strain among Indian police officers. India is the most populous democracy in the world, but little has been published in Western journals of how workplace variables maybe related to work on family strain among Indian officers. Among the organizational structure variables, instrumental communication, organizational support, formalization, distributive justice, and procedural justice each had negative relationships with work on family strain. Input into decision-making had a nonsignificant association.     

行政审判依据间的冲突及选择的操作分析

行政诉讼中的法律冲突有合法与非法之分.合法冲突是法律允许存在的冲突,只需按照冲突的一般解决规则选择适用法律即可.非法冲突即法律不允许并存的冲突,只能是承认一方有效,另一方无效.非法冲突表现多样,危害法律权威和行政、司法公正,其产生有立法观念、立法体制、立法技术等法律方面原因,为提高诉讼效率,尽量减少法律冲突带来的危害,我国需要确立一些可操作的选择适用规则.     

通过司法解决法律权利之间的冲突———卡尔.威尔曼等美国学者及美国最高法院对典型案例的司法推理简

权利冲突是法治领域中的一个世界性问题，如何解决权利冲突也就成为世界各国所要竭力面对的问题。一般来讲，通过立法和司法是解决权利冲突问题的有效手段。本文以美国学者卡尔·威尔曼的《真正的权利》一书中所列举的典型案例为据，系统地介绍威尔曼和其他美国学者以及美国最高法院“通过司法解决法律权利冲突问题”时，对这些典型案例的推理过程及其所阐发的精彩论证。这些推理过程及其论证和论点是笔者最感兴趣的部分，也是中国学术界和司法界在研究和解决权利冲突问题时较为缺乏的。通过这些推理，我们来看看他们是如何通过司法来解决有关权利冲突问题的。     

PARENT PSYCHOEDUCATIONAL PROGRAMS AND REDUCING THE NEGATIVE EFFECTS OF INTERPARENTAL CONFLICT FOLLOWING DIVORCE

This article reviews psychoeducational programs to reduce interparental conflict in divorcing families and the negative impact of conflict on children. The authors initially identify factors shown in the basic psychosocial research literature to be related to the effects of interparental conflict on children. They then review the content of programs currently being delivered and evaluate the evidence from well-controlled studies concerning their effectiveness. Finally, the article considers directions for future program development and evaluation.     

TOWARD THE DIFFERENTIATION OF HIGH‐CONFLICT FAMILIES: AN ANALYSIS OF SOCIAL SCIENCE RESEARCH AND CANADIAN CASE LAW

Social science research and the courts have begun to recognize the special challenges posed by “high‐conflict” separations for children and the justice system. The use of “high conflict” terminology by social science researchers and the courts has increased dramatically over the past decade. This is an important development, but the term is often used vaguely and to characterize very different types of cases. An analysis of Canadian case law reveals that some judges are starting to differentiate between various degrees and types of high conflict. Often this judicial differentiation is implicit and occurs without full articulation of the factors that are taken into account in applying different remedies. There is a need for the development of more refined, explicit analytical concepts for the identification and differentiation of various types of high conflict cases. Empirically driven social science research can assist mental health professionals, lawyers and the courts in better understanding these cases and providing the most appropriate interventions. As a tentative scheme for differentiating cases, we propose distinguishing between high conflict cases where there is: (1) poor communication; (2) domestic violence; and (3) alienation. Further, there must be a differentiation between cases where one parent is a primary instigator for the conflict or abuse, and those where both parents bear significant responsibility.     

文化视野下的中国犯罪论体系争鸣

近年来中国刑法理论界围绕传统四要件理论和德日三阶层体系孰优孰劣的争论,其实质是不同法文化的冲突,是文化冲突在刑法学领域的具体体现。这种文化冲突,既是我国刑法学理论自我反思的结果,也是自清末以来不同理论之间进行选择和论争过程的延续。围绕中国犯罪论体系的理论争鸣具有重要的文化现实意义,它有助于促进刑法学理论知识的发展,促成刑法学派在中国的早日形成,同时也有利于营造良好的学术生态环境。     

INTERPARENTAL CONFLICT AS A RISK FACTOR FOR CHILD MALADJUSTMENT: Implications for the Development of Prevention Programs

This article reviews research on the effects of interparental conflict on children and examines its implications for divorce education programs designed to reduce conflict after divorce. Basic research indicates that prevention programs for parents will be most effective in fostering children's adaptation to divorce if they can reduce the level of destructive conflict that children are exposed to, foster good parent–child relationships, and keep children from being caught in the middle of parental tensions and disagreements. Programs for children are likely to be most helpful if they help children learn ways to cope with situations in which they feel pressured to side with one parent against the other and avoid feeling responsible for parental problems. Although psycho-educational programs are widely available and often court-mandated, evaluation studies are rare and support for their efficacy is mixed.     

论社会转型时期的价值冲突

价值冲突是社会转型过程中的必然现象.社会转型过程中社会存在的变化、利益格局的调整、多元价值的存在、人的存在方式的改变等是引起价值冲突的主要原因.转型时期价值冲突的表现形式主要有价值主体之间的矛盾冲突,功利性价值和非功利性价值的矛盾冲突,目的性价值与手段性价值的矛盾冲突,社会主导价值和基础性价值的矛盾冲突以及解释性价值和操作性价值的矛盾冲突等.深刻地认识并合理地处理价值冲突对于社会转型和社会主义市场经济体制建立具有重要意义.     

法律义务冲突初论

法律义务冲突概括的是这种情况:同一法律义务人同时承担两种或两种以上不相容(具体表现为两种或者两种以上的义务不能得到同时履行)的法律义务,履行其中一个法律义务,就必然要违反其他的法律义务进而可能承担责任的义务抵触状态。法律义务冲突具有法律性、客观性、冲突性和身分性等特征。同时,法律规则之间、法律规则与法律原则之间以及法律原则之间冲突的解决方法为解决法律义务冲突提供了可参考的途径。     

The red herring of adolescent mental health

An increase in adolescent distress and mental health symptoms has been clearly documented since the COVID-19 pandemic, as has increased exposure to adverse childhood experiences. Layer on top of these stressors being a youth of divorcing or separating high conflict families, and adolescent symptomatology can suddenly become a flashpoint for parental attention, division and conflict. Approaching cases using an ecological and family systems framework is necessary for accurate conceptualization and assessment of best interests in the context of child custody evaluations. Doing so ensures that adolescent mental health does not become a red herring in high conflict cases, leading to undue focus on the adolescent's mental health without considering other salient factors in the case, such as the broader parent conflict. Programs offered at the Center of Excellence for Children, Families & the Law at William James College designed to improve the lives of youth by addressing parental conflict are described.
