Sprachliche Aspekte der Auslegung von internationalen Rechtstexten

Bereits bei der Ausarbeitung internationaler Rechtstexte ist bei der sprachlichen Ausgestaltung auf das Ziel einer einheitlichen Auslegung Bedacht zu nehmen. Dadurch kann vermieden werden, dass Rechtsanwender bei der Auslegung in ihren nationalen Rechtsstrukturen verhaftet bleiben. Verschiedene M?glichkeiten der sprachlichen Gestaltung internationaler Rechtstexte werden anhand des UN-Kaufrechts, der Principles of European Contract Law und insb der Principles of European Tort Law erl?utert.     

论医疗损害技术鉴定危机与改革

法律规定的不完善以及法官对鉴定结论的依赖性造成了目前医疗鉴定中,医疗事故技术鉴定与法医学医疗鉴定共存的二元化局面。侵权责任法在民事赔偿上否定了医疗事故的概念,提出以医疗损害责任为核心的民事责任制度,使医疗鉴定面临了新的问题。医疗事故技术鉴定机制和法医学医疗鉴定机制都存在种种缺陷,不能完全满足侵权责任法对医疗鉴定的新的需求。无论是鉴定结论的固有属性还是侵权责任法的新的技术内容都要求对现有的医疗事故技术鉴定模式进行改革,建立起符合《侵权责任法》要求的医疗损害技术鉴定制度。     

论高楼抛物致人损害责任的完善

高楼抛物行为不但会造成受害人人身及财产的严重损害,而且危害公共安全。《侵权责任法》第87条虽然对该行为的侵权责任作出了规定,但仍不完善。我国民法典侵权责任编应当针对高楼抛物致人损害的行为,强化有关机关在查找行为人方面的职责;在确定高楼抛物责任时,需要区分高楼抛物和高楼坠物的责任;由于高楼抛物致人损害的发生有可能是物业服务企业违反安全保障义务造成的,应当在民法典中规定此种违反安全保障义务的责任。鉴于《侵权责任法》第87条有关可能加害的建筑物使用人的责任承担的规定并不清晰,有必要在民法典侵权责任编中作出完善。     

安全保障义务:属性识别与责任分配——兼评《民法典侵权责任编(草案第三次审议稿)》第973条

《侵权责任法》第37条第1款是违反安全保障义务的过错责任之规范基础,其设置于该法第6条第1款过错责任一般条款之后是过错责任从一般到具体的规范逻辑范式。侵权法的功能主要为救济与预防,故宜将第37条"造成他人损害"修改为"侵害他人民事权益",从而为停止侵害、排除妨碍、消除危险等责任方式的司法适用提供通道。为充分救济损害,宜认可安全保障义务具有法定义务与合同义务的双重属性。根据补充责任制度的内在逻辑,第37条第2款的适用范围应限缩为"第三人的主观故意+安全保障义务人的主观过失",进而在立法上明确补充责任人承担责任后可向第三人追偿的法权结构。对《侵权责任法》第37条的检讨,可以作为完善《民法典侵权责任编(草案第三次审议稿)》第973条的基础。

医疗管理损害责任与法律适用

医疗管理损害责任是《侵权责任法》规定的医疗损害责任中的一种具体类型,与医疗伦理损害责任、医疗技术损害责任和医疗产品损害责任一道,构成医疗损害责任的类型体系。医疗管理损害责任应当适用《侵权责任法》第54条的规定确定赔偿责任,但与该法第34条第1款规定的用人单位责任构成竞合关系,受害患者可以根据自己的利益选择法律。
