Online dispute resolution (ODR), the practice of resolving disputes via the Internet or digital applications, has been developing since the mid‐1990s. As the field has grown and gained traction, it has increasingly received attention from professional associations and industry leaders in the world of alternative dispute resolution (ADR). More recently, it has begun to receive recognition from sources outside of this field — in both the public and private sectors. As the field develops and individual initiatives become widely adopted, the attention it receives from external sources will undoubtedly focus on questions of quality, ethics, practitioner training, service provider qualifications, and monitoring. These questions — already beginning to be heard from within the field — derive, in essence, from one shared overall question, that of appropriate governance for the ODR field. In this article, we will explain what we mean when we discuss a field's governance and suggest that the field itself should investigate issues of its own governance. We explore and explain the current “low‐to‐no” state of governance in ODR — and the developments that are likely, should the field fail to actively address this issue. We discuss the costs of no governance, and the potential costs and disadvantages of employing a higher‐governance model. We ask whether ODR can, indeed, be governed at all, and illustrate why addressing ODR governance is a very complex venture, in terms of the web of factors to be addressed, no matter how beneficial internal governance may be. We do not, in this article, intend to decide any of these questions — but, rather, to pose them to the ODR field and to the wider fields of ADR and conflict management. We point out why the ODR field is at a developmental point that is highly suitable for discussing and deciding these questions — and why these decisions might have far‐reaching implications for a wide range of conflict‐related fields.  相似文献

The notion that the terrorism subject‐area has failed to become a specialty because of too few researchers and trainees in the field arose first in 1983, and most recently in 1997 (by Reid), thus indicating an ongoing, unsolved obstacle in the developmental life of this sub‐field. This issue is discussed in the present study.

Authors of M.A. and Ph.D. theses were considered here as the future researchers in this field and as fulfilling the role of apprenticeship. The literature has pointed to this function as one of several conditions enabling a sub‐field to become a specialty, since it fulfills the function of self‐reproduction by providing a discipline with new and young researchers, new views and ideas and more accumulated and organized knowledge.

The abstract and bibliographical details of theses and dissertations were retrieved and analyzed from Dissertation Abstract International, which is a UMI database on OCLC's FirstSearch. This analysis of meta‐information should provide some indication of the status of the subject of terrorism today as a subfield and its chances of becoming an institutionalized specialty in the future.  相似文献

Conflict resolution as an academic field was built by pioneers like John Burton on the idea that conflict resolution academics must accomplish three basic interlocking tasks: conduct cutting‐edge research, educate students, and make a positive contribution to the real‐world work of practitioners engaged in resolving actual conflicts. Over time and as the field has grown, so have the demands to produce research deemed rigorous enough according to increasingly competitive and rigid traditional standards and so too have the demands of teaching growing numbers of students. Research and teaching commitments thus diminish the time and support available to engage in practice. In this article, I consider those pressures within universities and also consider the options available to conflict resolution scholar–practitioners outside the traditional university  相似文献

The Common European Security and Defence Policy (CESDP) of the European Union (EU) was launched in 1999 and has been perceived as a landmark step toward European security cooperation, particularly in the field of crisis management. Still in its early stages, some difficult issues have become apparent. Of these, the so‐called ‘third‐country’ issue may prove to be among the most significant. This problem refers to the necessity of associating states outside the EU with CESDP. In this regard, three states stand out — the United States, Turkey and Russia — and this article considers their concerns and the European response in detail. This is prefaced by a general overview of how the third‐country problem emerged and what the EU has done to address it. It concludes by suggesting that third‐country considerations could well determine where and how EU‐led missions operating under the auspices of CESDP are deployed.  相似文献

The discipline of project management (PM), a well‐recognized management approach to large‐scale, high‐cost projects, has much to offer the field of dispute systems design (DSD). This article explores the core concepts of each discipline, noting similarities and differences, with a particular focus on stakeholder management, scope management, risk management, and quality management. Two case studies, General Electric's early dispute resolution program and Chevron's corporate social responsibility initiative in the Niger Delta, demonstrate the application of project management priciples in two DSD scenarios: one with internal corporate stakeholders and one with external community stakeholders. The authors identify five key lessons that dispute systems design can draw from project management and identify areas for further study.  相似文献

The emerging field of risk communication has yet to thoroughly grapple with how the mass media report risk. Through a content analysis of five newspapers noted for their science reporting, newspaper coverage of four environmental hazards is compared to media coverage of more traditional risky events. In general, these slow‐to‐develop stories are reported in much the same way as more traditional disaster stories. News accounts emphasized an event orientation, framed risks in terms of human activity rather than social and political contexts, described risk in terms of harms and benefits, and relied on traditional sources. The authors then explore how this version of mass‐mediated risk might change current definitions of risk communication and how a mediated construction of risk may influence public perception of the political choices these issues raise.  相似文献

The International Commercial Mediation Competition is organized by the International Chamber of Commerce (ICC) in Paris, which held the event for the eighth time in February 2013. As the competition has grown, participation has become more and more diverse and thus mediation and negotiation have become more and more cross‐cultural. This led the ICC to invite external research on culture at the competition in February 2011. In this article, I discuss this student competition, the external research project question, and the culture of the competition. I also identify some of the further cultural issues raised by referring to relevant research on conflict and mediation across cultures, and conclude with some thoughts on how better to conceptualize the field of cross‐cultural mediation in terms of a systems approach.  相似文献

Abstract

This is a study of various aspects of Marxist‐Leninist propaganda, in terms of the problems encountered in this field by any extremist ideology and movement.

The nature of ideology is briefly analyzed in order to outline the basic problem faced by an ideology that claims to have the “only solution” to all of the world's problems: a built‐in gap between the ideology and reality that, with the passage of time, becomes more obvious and more embarrassing. Some techniques used by Marxist‐Leninist propaganda in order to solve this problem are then discussed, in particular the building of an imaginary mental environment for believers in the ideology that is in large measure based on a redefinition of part of the vocabulary. The use of redefined words as a cryptic, internal language by the initiated is also briefly discussed.

The parallel use of seemingly sophisticated arguments and of disinformation techniques, the peculiar, but frequently used, extremist debating style, the claims of a “scientifically derived” ideology, and the acceptance of apparent absurdities by those who have a psychological need to believe in them are, likewise, briefly analyzed. The paper also notes the susceptibility of many persons, particularly of many intellectuals, to Marxist‐Leninist propaganda and the indirect influence that, through their assistance, Marxist‐Leninists have been able to exercise in the Western World.  相似文献

As the pandemic forces public and private institutions to move online, many court and business leaders are looking to the field of online dispute resolution (ODR) for best practices and lessons learned. Developed over the last twenty years, largely in response to the growth of e‐commerce, the ODR field has generated a deep well of theory and practice while also identifying potential ethical dilemmas and risks. The application of technology, the “fourth party,” plays an increasingly integral role in how we negotiate resolutions to our disputes, with or without a third party. A brief overview of the history of ODR’s development will set the context for the exploration of the range of tools and techniques encompassed by online dispute resolution. Consideration of the ethical challenges raised by ODR practice will illuminate key questions and choices that need to be made in designing ODR systems and in governing their use.  相似文献

This article is drawn from interviews with thirty‐one of mediation's “founders,” those pioneers who began mediating in the 1970s and 1980s, when the field was young. They describe what first attracted them to mediation and why they have remained active in the field. Some told us that they have found it to be both intellectually challenging and interpersonally satisfying to assist disputing parties in their search for a mutually acceptable resolution they could not find on their own. Others see mediation's collaborative approach to decision making as a means of bringing about social and political change that might be otherwise unattainable. The mediators also described the changes they have observed since they entered the field: mediation's dramatic growth, institutionalization in the judicial system, and market domination by lawyers and retired judges. Among the concerns they expressed were the prevalence of a mediation model that focuses primarily on the legal strengths and weaknesses of each party's position, and the dollar amount that should resolve the dispute, with little interest in creative outcomes. Other concerns are a lack of quality control of mediators and trainers, and unproductive debate about whether the “correct” approach to mediation is evaluative, facilitative, or transformative. The mediators who work on public policy matters, including environmental disputes, were the most positive about the opportunity for creativity in their work, considerably more so than those mediators whose practice is primarily business/commercial. The mediators' views of the future of mediation are remarkably similar — their general sense is that the type of mediation that takes place in the shadow of the courts is likely to increase and to become even more routinized than it is at present. Several respondents told us that they also expect to see substantial growth in the use of mediation to resolve public policy issues. Many of these mediators predicted that this type of mediation is likely to be carried out by organizational insiders, rather than outside interveners. As one mediator said, “Maybe there's a new set of mediation roles for people within traditional institutions, not just for free‐standing neutrals.”  相似文献

This article reviews over sixty years of research on psychological barriers to intergroup conflict resolution and finds that scholars have identified eighty nominally different barriers that create or exacerbate intergroup conflict. In order to create a tractable list that would be more helpful to future scholars and practitioners, we consolidate this vast literature (e.g., by eliminating substantive and conceptual redundancies) to produce a list of twenty‐six “unique” psychological barriers. We further organize this inventory of barriers with a framework that distinguishes between “cognitive,” “affective,” and “motivated” psychological barriers. To better understand the literature ecosystem of research on psychological barriers, we employ a data visualization tool to illustrate the extent to which each of the twenty‐six unique barriers has been studied conjointly with every other barrier in the articles we reviewed. We then shift our attention to the work of scholars who have attempted, experimentally, to attenuate psychological barriers in negotiation and conflict settings, and identify five primary methods for doing so. Finally, we discuss the implications of our review for future work in this field.  相似文献

Informal institutions have grown in relevance for the analysis of new ‘third wave’ democracies. The research strategy receives its impetus from the debate on neo‐institutionalism theory, which offers a productive perspective for structuring the field of analysis. This article explains the distinguishing factors between formal and informal institutions. It addresses five basic types of informal institutions, examines the ways in which they function and discusses their relevance in terms of democracy theory. Each type is characterized by the way in which it enacts its respective means of political influence. The study distinguishes between forms of specific relationship (clientelism), of material exchange (corruption), of violent exertion of influence (putsch threat), of civil resistance (civil disobedience) and of legal practice (custom law), and discusses their relevance to democracy. The central argument maintains that a differentiated study of informal institutions is crucial to addressing this question. The necessary typological differentiation allows us to make an appropriate assessment ‐one that does not manifest itself in a simple clear‐cut choice of affirmative or negative answers.  相似文献

It is remarkable that precedents and their use have not been well explored within the negotiation literature. In this article, I examine the sparse knowledge of precedents and offer a preliminary framework for understanding the role of precedents in negotiation, including how negotiators establish and apply them. Precedents can either evolve randomly or be created with strategic intent. Understanding precedents generally involves examining how negotiators build, adopt, avoid, and reject them. In this review of the existing literature, I identify twelve concepts and paradigms that are particularly relevant to our understanding of negotiation precedents. I also establish a research agenda and identify three methods for further developing our knowledge of precedents: applying path dependence theory from the field of international relations to a negotiation context; conducting experimental research in a laboratory setting involving subjects engaged in negotiation exercises that contain opportunities to apply precedents; and conducting field research with a focus on case methodology grounded in negotiation linkage theory and theories of negotiation dynamics. Finally, in this article, I formulate a two‐part framework on building and applying precedents, and offer managerial guidance for the negotiation practitioner. Precedents serve as a strategic technique and provide a source of power at that point in a negotiation when decisions are made.  相似文献

In addition to understanding conceptual frameworks and mastering fundamental skills of mediation, what role do the personal characteristics of the mediator play in the resolution of conflict? Bringing Peace Into the Room is a groundbreaking collection of essays addressing these questions. In a thoughtful and provocative way, the authors ask us to examine ourselves and our field. They invite us to consider the ways in which our own individual development as human beings impacts the parties and cases with whom we work. This article builds on the tendency in recent decades in the field of alternative dispute resolution (ADR) to analyze conflict and its transformation from a relational perspective. It surveys developments in twentieth‐century philosophy that support the ongoing quest to explore the self in ADR from a relational perspective. It then shows how the concept of dialogue provides a framework for understanding conflict transformation from a relational perspective, by exploring the relational foundations of dialogue. It also draws a connection between the growing use of mindfulness practices in conflict settings and the practice of dialogue, suggesting that Buddhist philosophy and practices can help cultivate relational awareness and dialogue. The article therefore suggests that incorporating dialogue and exploring its relational characteristics can assist ADR scholars and practitioners to develop further practices that can promote collaboration by shifting disputants from adversarial and fragmented orientations to more relational mindsets.  相似文献

The field of conflict resolution is fractured. Despite many decades of fine research, we still lack a basic unifying framework that integrates the many theories of conflict dynamics. Thus, the findings from research on conflict are often piecemeal, decontextualized, contradictory, or focused on negative outcomes, which contributes to a persistent research‐practice gap. In this article, we describe a situated model for the study of conflict that combines separate strands of scholarship into a coherent framework for conceptualizing conflict in dyadic social relations. The model considers conflict interactions in the context of social relations and employs prior research on the fundamental dimensions of social relations to create a basic framework for investigating conflict dynamics. The resulting model is heuristic and generative. We discuss the theoretical context and main propositions of this model as well as its implications for conflict resolution practitioners.  相似文献

International diplomacy, to the extent it is effective, should not only prevent escalation of low‐intensity conflict, but should also facilitate de‐escalation. This article focuses on the short‐term effects of managing low‐intensity civil wars through third‐party mediation. Specifically, we compare the efficacy of third party‐mediated direct (face‐to‐face) and indirect talks in low‐intensity civil wars from 1993 to 2004 using the Managing Intrastate Low‐Intensity Conflict data set. We argue that a focus on short‐term success is valid because of the relationship among mediation, short‐term success, humanitarian aid access, and peacebuilding. We also assess the roles of mediator identity, mediation strategy (behavior focus versus incompatibility focus), peace agreements, war type, per capita gross domestic product, level of democracy, and conflict duration. Our overarching finding is that direct forms of mediation in which all parties meet face to face were the most likely to yield short‐term success in the sample of civil wars that we analyzed.  相似文献

A variety of definitions of “crisis” plague the study of international crisis. The purpose of the paper is to demonstrate the reasons for the divergence and a possible solution to the problem.

Definitions of “crisis” tend to incorporate a variety of elements. Some focus on the micro‐level of decisionmakers in particular countries; others look at the macro‐level of international system change; still other definitions are multi‐level, incorporating both micro‐ and macro‐components. A second set of differences is rooted in metaphysical assumptions. Some definitions look at “crisis” as something recognized by the mind of the individual, a perceptual process that is basically mental; other definitions, which tend to equate “crisis” with “stress,” assume that “crisis” is a physical phenomenon that can be measured by information flows, physiological tensions, or other objective observable behavior. A dualist approach insists that “crisis” is simultaneously physical and nonphysical is also evident in the literature. A third aspect of “crisis” definitions is whether the researcher seeks to stipulate an arbitrary meaning for the term on the basis of supposed self‐evident logic or whether data are collected prior to an effort to define the term; this is the familiar distinction between rationalism and empiricism, with facet theory as an approach that combines elements of both approaches.

Various approaches attempt to test theories of “crisis” with definitions determined by their metaphysical foundations. The models identified are as follows: hostile interaction, individual stress, physiological overload, organizational response, and cost calculation. Findings based on various empirical tests of the theories show that there is very little agreement in the literature on variables associated with “crisis”; more often than not, if a variable is linked with “crisis” positively in one study, the same variable is either linked negatively or has no correlation with “crisis” in a second study. The source of the empirical divergence may be that the various studies sample different cases—or differing definitions may account for the lack of consensus in the field.

The paper concludes by urging that research on international crisis should be absorbed into larger theoretical concerns that focus on the objectives motivating the studies, as this appears to be one way to maintain definitional uniformity. Studies on crisis anticipation and crisis management should be viewed as efforts at war prevention. Studies on crisis management, which aim to reduce foreign policy fiascoes should be conceived in terms of foreign policy management. Findings of such studies can then be appraised in terms of the goals they seek.  相似文献

This article considers how a nationally homogeneous state in East‐Central Europe, Poland, which in this respect is comparable to Hungary and the Czech Republic, has responded to a major post‐1989 challenge – that of meeting European standards of national minority protection within a civic‐territorial model of democracy. The forced assimilation and repression of such minorities as the Ukrainians and the Belarusans in prewar and communist Poland is now being handled within a common pan‐European perspective; this offers a model for the resolution of ethnic‐communal conflicts in the remainder of the highly differentiated post‐communist space. Although Poland's national minorities are now very small, historical memories of bad integral nationalist practice has induced post‐1989 governments to allay external criticism of alleged ethno‐nationalism by meeting European standards in this area as a key step towards eventual EU membership. The dual identity, linguistic, cultural and autonomy‐seeking characteristics of its currently non‐state‐destroying (that is, non‐secessionist) minorities points to comparisons with such groups as the Welsh or the Bretons. It argues for the redefinition of ‘normal’ as against more publicized aggressive forms of East European nationalism.  相似文献

The paper examines the performance of tit‐for‐tat in iterated plays of prisoners’ dilemma and chicken. In particular, the paper examines, via computer simulations, a space of surrogate Axelrod‐type tournaments over these games. The surrogate tournaments are specified in terms of characteristics of strategies similar to those Axelrod identifies as fundamental.

The paper shows that the zones of optimality for tit‐for‐tat in tournament play of both prisoners’ dilemma and chicken remarkably constrained, but that tit‐for‐tat generally does well relative to other strategies. Furthermore, our results show that the success of tit‐for‐tat is sensitive to the number of players and the assignment of payoff values.  相似文献
