论社区农民集体的再组织化

《物权法》有关农民集体所有权主体的规定充满矛盾,反映出农民集体虚化的现实。社区农民集体再组织化具有必要性和可行性,未来的民法典编纂不能继续采取回避的态度。再组织化应满足底线要求,在充分尊重历史和现实、尊重农民意愿的基础上依法进行,允许探索多元模式,但再组织化要适度。再组织化之后形成的社区农民集体可成为民事法律关系主体,在民法典中有所体现,并以单行法的形式进行具体的、制度化的调整。
