Restorative justice is a form of informal justice growing rapidly among criminal justice practitioners. It decenters the focus of criminal justice from the offender breaking a law of the state to the harm caused the victim and community. Resolution is said to come from offenders taking responsibility and making amends for the harm done and from communities supporting the victim and providing offenders with opportunities and skills to reintegrate as contributing members.
Restorative justice theory largely ignores the role of professionals in the criminal justice process, and yet professionals have played a dominant part in initiating many restorative justice programs. Several theoretical traditions recognize professionals as being important intermediaries between citizens and the state. The theory of democratic professionalism argues that professionals can play crucial roles in increasing and improving democratic participation in public affairs. This article examines two functioning restorative justice programs to flesh out what democratic professionalism might look like in operation—what tasks professionals perform and what citizen involvement means to the professionals. We argue that restorative justice cannot get along without professionals and that democratic professionalism may help restorative justice to avoid some of the problems associated with other approaches to informal justice by increasing true community participation but balancing it with concern for individuals' rights.  相似文献

Restorative justice (RJ) has found significant utility outside the prison setting. For many reasons, it has not received the same level of consideration inside the institution. While not every case can, or perhaps should be considered for restorative justice processing inside the prison, some could easily fall into the broad purview range of restorative and transformative justice. We provide examples of RJ practices that exist in some prisons focusing on: offending behavior and victim awareness programs, community service work, and victim‐offender mediation, as well as prison systems that exhibit a RJ philosophy. Also considered are the effectiveness of prison RJ practices, and the limitations of such efforts. Although RJ has the potential to have a positive impact on the work of prisons and the experience of imprisonment, it has not found wide acceptance and is currently limited to a relatively small number of prisons and then often only delivered in partial form. We believe that RJ has a realistic future in prison settings and that the contradictions that may be identified are not debilitating.  相似文献

Criminal justice policy faces the twin challenges of improving our crime reduction efforts while increasing public confidence. These challenges are exacerbated by the fact that at least some measures popular with the public are counterproductive to greater crime reduction. How to achieve greater crime reduction without sacrificing public confidence? While restorative justice approaches offer a promising alternative to traditional sentencing with the potential to achieve these goals, they suffer from several serious obstacles, not least their relatively limited applicability, flexibility, and public support. Punitive restoration is a new and distinctive idea about restorative justice modeled on an important principle of stakeholding, which states that those who have a stake in penal outcomes should have a say about them. Punitive restoration is restorative insofar as it aims to achieve the restoration of rights infringed or threatened by criminal offences. Punitive restoration is punitive insofar as the available options for this agreement are more punitive than found in most restorative justice approaches, such as the option of some form of hard treatment. Punitive restoration sheds new light on how we may meet the twin challenges of improving our efforts to reduce reoffending without sacrificing public confidence, demonstrating how restorative practices can be embedded deeper within the criminal justice system.  相似文献

The restorative justice movement has great potential to reform the way society responds to crime and wrongdoing. One might logically assume that the greatest challenge to the new restorative justice paradigm is the traditional punitive criminal justice paradigm itself. A more immediate threat, however, is posed by merging community justice, another approach to reforming the justice system, with restorative justice. Community justice has superficial similarities to restorative justice but relies on the underlying authoritarian assumptions of the existing criminal justice system and on processes that exclude most of those individuals directly affected by the offense. This paper clarifies and contrasts the key elements of both the restorative justice and the community justice paradigms and explains the threat to restorative justice posed by combining and confusing the two.  相似文献

The emergence of restorative justice as an alternative model to Western, court-based criminal justice may have important implications for the psychology of justice. It is proposed that two different notions of justice affect responses to rule-breaking: restorative and retributive justice. Retributive justice essentially refers to the repair of justice through unilateral imposition of punishment, whereas restorative justice means the repair of justice through reaffirming a shared value-consensus in a bilateral process. Among the symbolic implications of transgressions, concerns about status and power are primarily related to retributive justice and concerns about shared values are primarily related to restorative justice. At the core of these processes, however, lies the parties’ construal of their identity relation, specifically whether or not respondents perceive to share an identity with the offender. The specific case of intergroup transgressions is discussed, as are implications for future research on restoring a sense of justice after rule-breaking.  相似文献

Research suggests that restorative justice (RJ) conferences are more just than traditional court processing due to the presence of procedural justice (PJ). These conferences also promote reintegrative shaming which, in contrast to disintegrative shaming, allows offenders to repair their ties with the community. Yet, fairness and the type of shaming experienced may depend on perceptions of the offender. We argue that the personality traits of negative emotionality and low constraint influence offenders' evaluations of the fairness of these conferences, which have implications for their experience of shaming. We test these arguments using data from a sample of 498 offenders involved in the Australian Reintegrative Shaming Experiments. Results reveal that personality traits affect perceptions of PJ and both types of shaming, and that PJ mediates these effects. The findings support the notion that RJ conferences are perceived to be procedurally just and reintegrative for certain types of offenders.  相似文献

This article addresses two distinct but related concerns. The first section argues for adoption of a wide‐ranging conceptualization of restorative justice, one that encompasses concern for community, structural, economic and social levels of attention, as well as personal and direct consideration for parties to crimes and conflicts. It is a view of restorative justice, like that espoused by Sullivan and Tifft, that is transformative in conception, ambition, and operation. It is based on awareness that making distinctions between restorative and community justice may be useful for some purposes but expresses a preference for thinking of these two perspectives as part of a larger whole. The second part of the article highlights 10 values or principles that may help guide the development and implementation of an expansive view of restorative justice. It suggests that a person who wishes to pursue a more peaceful and just world should be ethically engaged, behave in an exemplary fashion, beware of and avoid exploitation, fully embrace equality, be empathic, act so as to empower oneself and others, recognize the entwinement of all people and the earth, select interventions that are effectual while being error‐aware, appreciate that ends and means are enmeshed, and act with earnest enthusiasm.  相似文献

‘Restorative Justice’ reflects a crimino-victim balanced justice system where equal justice to offenders and victims is ensured. There are four potent features of Restorative Justice: repair, restore, reconcile, and reintegrate the offenders and victims to each other and to their shared environments and communities. There are many examples within Indian criminological literature that thoroughly explain the practice of restorative justice in India. The kings who ruled in various parts of the country had practiced restorative justice in a well thought out and traditional manner. Much of Gandhian philosophy and practice is based on restorative justice principles including the participatory practices of fairness and equality. Though there is a limited amount of literature on the present restorative justice practices available in India, this paper attempts to explain restorative justice practices across the continent from the view point of society and legal provision.  相似文献

Abstract. Unquestionably, Restorative Justice (hereafter RJ) has finally gathered some real momentum. It has become a sine qua non topic in many national and international policy and statutory agendas. However, as the restorative practice expands to deal with crimes, ages and situations it has never addressed before (at least in its contemporary version), and as its application starts to make sense not only to national but also to regional and international bodies and fora, new theoretical problems are posed. In the fast‐growing literature many theories and Schools have been evoked to support RJ's claims. This paper will take the discussion a step back by looking at questions of meta‐theoretical character. In particular, the paper will ask: Does RJ have a place in the “world of theories,” and if it does, then what kind of theory is it, and on what level should it be placed? Maloney, Armstrong, and Romig presented a portrait of “Joey,” who was the exemplar of what was wrong with the juvenile justice system, in 1988 when they published The Balanced Approach in this Journal. In response, they reimagined a juvenile justice system predicated on balancing three fundamental goals—protection of community, accountability to victims, and development of competencies to prepare juvenile court‐involved youth for productive roles in their communities. The authors examine the evolution of balanced and restorative justice and re‐imagine how Joey's life may have been different at critical junctures of his juvenile court involvement.  相似文献

This paper aims to evaluate four restorative justice programs in Taiwan: (1) a mediation system; (2) deferred prosecution and conditional suspended sentence; (3) a youth justice system; and (4) the Taiwan Restorative Justice Initiative. In this paper, models proposed in Marshall (Restorative justice: An overview. London: Home Office, 1999) and Braithwaite (British Journal of Criminology 42:563–577, 2002b) are used as criteria to evaluate the four programs. Based on governmental documents, official statistics, and the findings of previous empirical studies, this paper will examine whose needs and power is focused and what types of value are highlighted in those four programs. This paper finds that current restorative justice programs in Taiwan place greater emphasis on offenders than on other parties such as victims and communities. In addition, maximizing and emergent standards that Braithwaite identifies are implemented more in Taiwan’s restorative justice programs than constraining standards. This paper suggests that restorative justice practices in Taiwan need to be more concerned with victims’ needs and interests, and to strengthen constraining types of restorative justice values.  相似文献

Abstract

Restorative justice conferences that operate as sentencing mechanisms involve the making of a trade-off between empowering lay participants to make their own decisions, and the requirements of consistency and proportionality, which are established principles of sentencing. In current restorative justice practice, this trade-off tends to be made more in favour of consistency and proportionality, at the expense of the empowerment of lay participants.

Empowerment is central to key benefits of restorative justice, such as reducing recidivism and increasing victim satisfaction. However, its importance to the effectiveness of restorative justice is not always properly acknowledged. In addition to this lack of acknowledgment, there are both conceptual and practical problems with the principles of consistency and proportionality (particularly in the way that they are presented when considered in relation to restorative justice) that are often overlooked. As a result, the tendency is for assumptions to be made about the necessary supremacy of these principles over empowerment. This paper urges more acknowledgement of the importance of empowerment in restorative justice, together with a greater appreciation of the problems with consistency and proportionality, with a view to challenging assumptions about the way that the trade-off must be made.  相似文献

The purpose of this paper is to explore some questions around the process of engaging in research in restorative justice in the contemporary political and economic climate of the UK. Its key concern is to endeavour to create a framework in which it is possible to develop an understanding of the process whereby restorative justice was transformed from the ‘dead duck’ of the late 1980s to its current popularity. It takes as its example for understanding this transformation the problems and possibilities of engaging in research in restorative justice and how such research needs to be contextualised within a wider understanding of the policy and political process. This paper does not set out to offer any answers to the questions it raises, but is primarily concerned to bring to the fore some of the absences that can be detected within the contemporary embrace of restorative justice in the UK.  相似文献

恢复性司法是一种通过恢复性程序实现恢复性后果的非正式犯罪处理方法。为考察司法人员与公众对待确定未成年人恢复性司法制度态度,对法官、公众等不同群体作问卷调查,结果表明,法官和公众对未成年人司法制度的诸项改革基本认可。该制度的合理性表现在可减少刑事污点对未成年人的消极影响,有利于恢复受损的社会关系,对违法犯罪的未成年人有积极的矫正作用;其局限性体现在难以满足同罪同罚的刑法原则,难以避免替代性的承担责任的现象等。避免局限性的关键在于要解决恢复性司法与正式司法程序的关系问题。  相似文献

In this paper, I argue that scholars such as John Braithwaite and Lode Walgrave rely on fictions when presenting their utopian vision of restorative justice. Three claims in particular are shown to be fictitious. Proponents of restorative justice maintain, first, that the offender and the victim voluntarily attend the restorative conference. Second, that the restorative conference enables the offender and the victim to take on active responsibility. Third, that the reparatory tasks on which the parties agree should not be understood in terms of the intentional infliction of harm. These fictions, so I argue, are not merely a mistake, but instead serve an important function: the various parties need to believe that they adequately capture the reality of the restorative conference as they are more likely to acquiesce if they believe the fictions to be true. I conclude that the fictions are the driving force within the restorative endeavour.  相似文献
