An agreement on climate change mitigation hinges on large-scale international cooperation. Rational agents are supposed to consider the cost and benefits of cooperation, which then determine their negotiation positions. Behavioral economics provides experimental evidence that decision-making in negotiation-like situations is influenced by systematic cognitive biases and social interaction. In this paper, we examine the impact of bounded rationality and social preferences on bargaining in international climate negotiations and illustrate how particular deviations from full rationality affect the incentives to cooperate. Of special interest are fairness preferences for burden-sharing rules and behavioral responses to different framings of climate change and policy, as well as implications of these for communication about climate change. The analysis will further address different levels of representation, including individual citizens, politicians, experts, and (professional) negotiators. The consequences of the most prominent nonstandard preferences and biases for negotiating a climate treaty are assessed, and specific strategies to foster cooperation are suggested.  相似文献

While green criminology may be an effective name or label for the sub-field or perspective within criminology that considers a wide range of environmental issues, it is, in reality, a ‘multicolored green’ – a criminology that engages a spectrum of issues, that reflects the interests of some racial groups more than others, that reveals and analyzes environmental harms which disproportionately impact some racial groups more than others, and that can be approached from a number of vantage points or that can be viewed with variously tinted lenses. This article begins with an overview of climate change, including a discussion of its anticipated impacts and indicators of its already-being-felt effects. It then offers some general comments on the disproportionate impact of environmental threats and harms before turning to a discussion of the present and anticipated distributional impacts of climate change. Here, this article argues that climate change is, in effect, achromatopsic – it is color-blind, in that it affects us all regardless of skin color – but that those impacts will be distributed unevenly/unequally and that various groups are and will continue to be in different positions to adapt to climate change. This article concludes by suggesting that while the environmental harms caused by climate change are real – and the risks and threats they pose tangible and serious – climate change presents an exciting challenge for our creative potential as humans. In the process of reducing our consumption of fossil fuels and stabilizing (or, better yet, reducing) our greenhouse gas emissions, we might better assist those geopolitical regions most at risk (i.e. poor, developing countries) to become more resilient – an approach that is necessary for both the physical health of the planet and the prospects for social justice.  相似文献

The Copenhagen Summit did not conclude the 2 years negotiation process initiated in Bali in 2007. Ten official meetings among parties were not sufficient to reach a conclusion on the future of the international climate change regime after 2012. This paper summarizes the main issues addressed by the parties under the United Nations Framework Convention on Climate Change (UNFCCC) and the Kyoto Protocol tracks in the course of 2009, the longest year ever for climate change negotiations, and tries to explain the reasons behind the Summit's failures. Furthermore, an overview of the main points of the Copenhagen Accord is provided together with its implications and relation with the UNFCCC process.  相似文献

Abstract

With a long history and deep connection to the Earth’s resources, indigenous peoples have an intimate understanding and ability to observe the impacts linked to climate change. Traditional ecological knowledge and tribal experience play a key role in developing future scientific solutions for adaptation to the impacts. This review explores climate-related issues for indigenous communities in the world, including loss of traditional knowledge, forests and ecosystems, food security and traditional foods, as well as water, Arctic sea ice loss, permafrost thaw and relocation. Until the 21st century, indigenous peoples were viewed as victims of the effects of climate change, rather than as agents of environmental conservation. Representatives of indigenous peoples have in fact since 2008 been actively seeking a role in contributing to combating climate change through their participation in international environmental conferences, as well as by means of activism and political engagement at local and national levels. Using examples from the Amazonian region in the east of Ecuador, home to indigenous communities such as the Huaorani, Sápara and Sarayaku Kichwa origin peoples, this article argues that indigenous peoples, particularly forest dwellers, have a dual role in combating climate change. Over the years Bajo tribe have made adaptive mechanisms to cope with climate change. In the last 10?years indigenous peoples representatives have been collectively engaged in lobbying for inclusion in intergovernmental climate change negotiations and to have decision-making power at the United Nations. This article is an attempt to review the role of indigenous people in climate change and their adaptive mechanisms.  相似文献

This paper provides an introduction to the articles and report excerpts included in the special issue of Trends in Organized Crime on ‘Counterfeiting’. The aim of this special issue is to add to the relatively sparse literature currently available that addresses this expansive and complex criminological phenomenon. In particular, the special issue draws together empirical research findings and theoretical accounts on the organization of the counterfeit trade across a broad spectrum of goods, and highlights a number of issues associated with researching counterfeiting.  相似文献

There has been a growing interest in the historical development of criminology(ies) throughout the world. This paper examines the development of criminology in Taiwan (Republic of China) using both questionnaire and interview data. Textbooks, institutional development, and research activity are taken as proxy measures of a criminological tradition. Beginning with criminology in Republican China (1929–1949), the article explores the key features of change in criminology against the background of Taiwan's own particular adoption of social, political and economic ‘modernisation’. Foreign influence and the contemporary meaning of ‘indigenous’ are considered. The article ends with a research agenda for a grounded historical sociology of criminology on Taiwan; key identified research questions relate to sponsorship, research priorities and the production of criminological knowledge; the reception of research by policy communities and practitioners; the relationship between criminological knowledge and politics; and the processes of selective appropriation.  相似文献

Rapidly growing concerns about the adverse effects of climate change are prompting a re-thinking of how companies view their strategies and operations and spurring legal and regulatory responses around the world. The overarching objective of these efforts is to facilitate and accelerate the transition to a more sustainable economy. The green transition will have substantial distributional and structural implications for workers and the workplace across companies and economic sectors. Indeed, the future of work will be significantly shaped by climate change. However, relatively scant scholarly attention has been devoted to the forward-looking legal implications of climate change for work. Similarly, legal scholars writing on climate change have largely neglected the laws governing employment. This article seeks to help fill that gap. How can companies, workers, and society respond to the green transition in a manner that enables better jobs, a safe and stable workplace, and more resilient companies? To answer this question, this article draws on the theory of just transition, which is rooted in environmental justice and labor rights. We offer an interpretation and application of just transition that expands its scope to serve as a blueprint for ethical business conduct and legal reform to improve the world of work and the lives of workers.  相似文献

The relationship between critical criminology and social justice has been well documented, but efforts to provide a unified theory of social justice that cuts across and embodies the various strains of critical criminological thought have not been systematically researched. One useful approach for engaging in such a project comes from existential humanism, which draws attention to a number of life themes (e.g., the struggle to be free, being and becoming, redemption) and is compatible with critical criminology's commitment to radical social change. This article provisionally explores the boundaries of theoretical synthesis, mindful of those complex (and thorny) issues upon which successful conceptual integration depends, including definitions, assumptions, domains of inquiry, and modes of integration. This discussion concludes with an outline of the implications of a commentary for the future of critical criminology and for sustainable, meaningful praxis. For over a century, criminological research has been able to explain a consistently small amount of the variation in crime. It is plausible that the problem with criminological theory is not in the theory but in the analysis. Complex systems science (CSS) attempts to examine data in a different way – often making the most of error data discarded by linear analyses. This paper addresses the viability of using CSS in criminological research. An example is drawn from social disorganization theory to demonstrate the ability of CSS to explain crime at the neighborhood level. The result is a new theory called Ecodynamics Theory, developed by combining the elements of neighborhood research with complex systems analyses. The implications of this theory to increase the efficacy of criminological research are discussed.  相似文献

Cottee (Br J Criminol 54(6):981–1001, 2014) makes the case that criminology has much to contribute to an understanding of theistic violence. However the ‘hubris of positivism’ (Young in The criminological imagination, Polity, Cambridge, 2011) curtails the criminological imagination and this is particularly evident in the debates that permeate contemporary understandings of religious extremism and radicalisation. Using the terrorist attacks in France 2015 as a touchstone, this paper explores the current state of criminological engagement with these issues. First a synopsis of orthodox current criminological talk about religious extremism and violent crime is considered. Next a critical analysis of the events in Paris based around what is ‘known’ about them is offered in the light of this knowledge. Finally, drawing on the work of Young (2011) the implications of this analysis for criminology are considered resulting in a refinement of the biases identified by Cottee (2014).  相似文献

This article argues that a current trend in global sustainable development governance is actively to engage the private sector in participating in the process of implementing global and national policy goals. This trend is based on the notion that the private sector has the ideas, technologies and resources at its disposal that can be channelled to addressing global environmental challenges. This new trend does not, however, take into account the past and present implications of private sector investment in fields such as mining and forestry. Nor does it closely examine how private sector rules will subsequently infiltrate and govern environmental management. On the basis of an examination of current policy developments and contracts in the area of environmental management and their implications for developing countries, this article argues in favour of establishing an authority that oversees the legitimacy and legality of these new contracts, especially in, but not limited to, the area of climate change.  相似文献

The paper begins with the question: how applicable are European and North American criminological theories to the situation in Asia? It takes a transnational and comparative perspective in relating contemporary and historical trends in crime, crime definition and crime control in a variety of Asian countries that comprise the so-called Confucian sphere. It provides a criminological critique of the ‘Asian values debate’ and, through an analysis of trends in crime, crime definition and crime control in China and Japan, of organised crime across the region, as well as selected examples of state-organised crime, seeks to provide a perspective on the developing criminological discourses of ‘the Orient’. The paper argues that, although cultural aspects are important and interesting in understanding the crime situation in the region, ultimately it is changes in politics and governance, economy and society that are most efficacious in explaining current criminological trends and developments.  相似文献

Since the early 1980s, supermax incarceration has emerged as a common feature of the American corrections landscape. This special type of high‐cost housing, which involves extended isolation with little programming or contact with others, remains largely unevaluated and is of interest for three reasons. First, the study of supermax housing offers a unique opportunity to understand the factors related to the successful reentry of offenders back into society. Second, it affords an opportunity to test the claims, many of which are grounded in mainstream criminological theory, that have been made about the putative effects of supermax confinement. Third, it provides an empirical touchstone that can help inform policy debates about the merits of such confinement. Examining data from the Florida Department of Corrections, we test competing hypotheses about the effects of supermax housing on 3‐year recidivism outcomes. We find evidence that supermax incarceration may increase violent recidivism but find no evidence of an effect of the duration of supermax incarceration or the recency of such incarceration to the time of release into society. We discuss the findings and their implications for theory, research, and policy.  相似文献

Many of the debates surrounding the environmental, social, and economic implications of climate change are now well known. However, there is increasing concern over the extent to which those suffering displacement or forced migration as a result of climate change are protected. This article seeks to highlight the plight of such individuals and suggests how the current protection gap might be remedied. Present legal structures, such as the Refugee Convention and the framework for Internally Displaced Persons (IDPs), prove largely inadequate having been constructed for different purposes and being limited in their application. The alternative proposed in this article is a regionally oriented regime operating under the auspices of the UN Climate Change Framework. While both the Climate Change Convention and the Kyoto Protocol currently call for regional cooperation in respect of adaptation activities, it is argued there should be an explicit recognition of so‐called climate change refugees in the post‐Kyoto agreement that allows for, and facilitates, the development of regional programs to address the problem. Employing such a strategy would remedy the current protection gap that exists within the international legal system, while allowing states to respond and engage with climate change displacement in the most regionally appropriate manner.  相似文献

Belknap’s recent call for greater criminological activism in the service of social justice identifies queer criminology as an important site for such activism. Indeed, much of the work undertaken by queer criminologists is already motivated by a concern to address a variety of injustices—whether in the form of discrimination, heteronormativity, gender binarism, or invisibility—experienced by queer communities in the realm of criminal justice, criminology, and beyond. In this paper, I explore the existing and possible future connections between queer criminology and activism. I highlight the ways in which queer politics have always involved social activism, including activism relating to criminal justice issues. I then suggest some possible directions for expanding queer criminological activism within the traditional academic roles of research, teaching, and service. Pursuing such directions, I argue, is necessary in order to set the foundation for further queer criminological activism beyond academia.  相似文献

From 1 to 12 December 2003, the Ninth Session of the Conference of the Parties to the United Nations Framework Convention took place in Milan, Italy. This conference continued the laborious effort of developing an international climate regime by preparing for the Kyoto Protocol’s entry into force. Some two dozen decisions were adopted on a wide range of options for responding to climate change. This paper assesses the progress achieved at the conference on a number of issues. Among these were operational details for implementing forestry projects under the Convention’s Clean Development Mechanism, and guidelines for reporting on greenhouse gas emissions and removals from agriculture, forestry and land-use change. Parties also decided on rules with respect to two funds, the Special Climate Change Fund and the Least Developed Country Fund. With respect to developing countries, Parties continued discussions on rules for building response capacity in light of the expected adverse effects of climate change and transferring environmentally sound technology. They also discussed how to incorporate scientific advice from the Third Assessment Report of the Intergovernmental Panel on Climate Change into the negotiations. Although Russia did not ratify the Kyoto Protocol prior to the conference, Milan demonstrated momentum and interest among Parties to support the climate regime. Nevertheless, it is doubtful whether the detailed discussions were able to contribute to preparing for the long term. To this end, this paper concludes that more discussion and leadership is required to bridge the North/South gap if a post-2012 climate regime is to stand.  相似文献

Advances in technology have transformed fraud against consumers from face-to-face, victim-offender interactions to a crime that now transcends international boundaries. Although consumer protection issues have been of interest to investigative journalists and literary scholars for centuries, the topic has only recently been subject to serious criminological inquiry. Employing the American consumer protection movement as an historical framework, we examine the evolution of consumer fraud. Our review documents that progressive social and legal changes in consumer protection and corporate regulation, as well as developments in criminological research, correspond to prominent literary exposés of the time. In today's technological age, such a reactive response to consumer fraud is neither efficient nor effective. Contemporary criminologists need to simultaneously address the questions of ‘how’ fraud is perpetrated and ‘why’ it occurs. Toward this end, we identify methodological strategies and data sources to promote empirical and theoretical understanding of consumer fraud, and to ultimately contribute to multi-national crime control policy.  相似文献
