The concept of distributive justice and the theoretical and empirical work conducted on it during the past two decades are examined. Three questions provide the structure for this examination: (i) What are fundamental conceptual dimensions of distributive justice and the specific substantive issues to which they are related? (ii) What central questions has recent work on distributive justice addressed? and (iii) What are the most important emerging issues on which work in the near-term future should focus? Much of the theory and research examined in the paper is social psychological in nature, but reference is made to related work in related disciplines, particularly sociology and philosophy.  相似文献

In multiethnic societies, issues of justice and fairness have become the focus of intense public debate. Although current psychological theories of distributive and procedural justice concentrate on multiple normative rules that guide allocation decisions, there is little research that focuses on the particular relationship between immigrants as recipients and members of the host society as allocators. In the present study Germans were asked about their opinions as to what Turkish immigrants in Germany deserve or are entitled to and to which degree they pose a threat to German culture. Political orientation of the allocator turns out to be an important predictor of how distributive and procedural justice concerns are evaluated. Both conservatives and liberals exhibit a different conception of what counts as distributive justice. With regard to procedural justice, however, liberals and conservatives did not differ much. Moreover, perceived threat to German culture is significantly related to distributive justice but not to procedural justice.  相似文献

In contemporary private law theory the relationship between ‘macro’ theories of distributive justice and the ‘micro’ site of interpersonal transactions remains under-explored. In this paper, I draw on the ‘macro’ theory of justice articulated by John Rawls and offer an account of ‘micro contractual justice’ that helps us understand how the micro domains of contracting introduce particular relational constraints on the infusion of distributive considerations into contract law, resulting in constrained conception of ‘relational Rawlsianism’ operating in contractual domains. My framework provides a bridge between the macro and micro, helping us understand how they are in various senses separate yet interlocking, and also provides a ‘third way’ between all or nothing positions on the place of distributive justice in contract.  相似文献

The study proposes a taxonomy that maps and organizes various normative (ought) and empirically oriented (is) theories of distributive justice, with the aim of examining possible relations between these two research traditions. The taxonomy distinguishes between theories according to two shared dimensions of content: (a) microjustice versus macrojustice principles and (b) the unidimensional versus multidimensional character of these principles. The combination of these dimensions yields four groups of theories of distributive justice: unidimensional macro (the utilitarian approach); multidimensional macro (Rawls' theory of justice); unidimensional micro (desert and equity theories); and multidimensional micro (Miller's theory and the multiprinciple approach). A fifth group of hybrid theories is identified (including Walzer's and Jasso's theory of justice), which is built upon the layers of the other taxonomy cells, combining elements of macro- and microjustice and emphasizing the multidimensional character of distributive justice. The analysis revealed that the empirical and normative traditions have much in common. In certain cases, as with the utilitarian approach and Rawls' theory, empirical research has sought correspondence between the ought and the is. In other cases, such as with equity theory and the multiprinciple approach, it has used some basic normative ideas and assumptions as its starting point. Nevertheless, these research traditions often develop in parallel ways without sufficient mutual recognition or interaction. The study concludes by considering possible exchanges that may develop between these two traditions, examining to what extent and how philosophical–normative and empirically oriented research can contribute to one another.  相似文献

Jury service in the United States is both compulsory and yet distributed to some but not others in a nonsystematic way. Concerns about unfairness in this distribution system have led to legal changes; however, there is still little empirical information on how jurors view the jury selection process. This study considers jury selection in terms of participants' perceptions of procedural and distributive justice. I argue that justice in this setting is related to areas of conflict between the decision maker and the prospective jurors, especially over privacy protection, despite strong rhetoric that jurors minimize their own preferences and rights in this setting. Data from interviews of 194 formerly excused and selected jurors support this contention.  相似文献

Using nationally representative data, we test three theories about distributive and procedural justice and their relation to job satisfaction. Our results support the group-value model more than the personal outcomes model by showing that procedural justice is a more important predictor of job satisfaction than is distributive justice. Furthermore, although other research has supported the psychological contract model by showing that experiences with downsizing alter how procedural justice and distributive justice are related to organizational commitment, we find that downsizing does not alter their relationship with job satisfaction.  相似文献

Distributive and procedural justice are of central importance to past and current theories of the psychology of moral development and the social psychology of justice. In order to explicate the relationships among theories, participants responded to both a measure of moral reasoning and a measure of 15 various justice criteria. Analyses showed that each schema of moral reasoning was significantly predicted by different concerns about social justice. Furthermore, individuals' judgments about justice were best represented by four factors, offering a broader definition of justice in relation to moral schemas. The findings were consistent with Kohlbergian theory; moral reasoning appears to proceed from concerns about self-interest to distributive fairness to procedural justice.  相似文献

Objectives

Tyler’s theory of legitimacy identified procedural justice and distributive justice as antecedents of legitimacy, but placed distributive justice in a relatively minor position compared with procedural justice. This has led to researchers paying less attention to distributive justice in the development of theory, despite consistent findings that distributive justice is important to a number of outcomes for criminal justice authorities. This report uses uncertainty management theory to revisit Tyler’s legitimacy model and gain a more nuanced understanding of distributive justice.

Methods

The proposed model is tested using a series of latent variable analyses conducted on a sample of 2169 adults and a factorial vignette design. The vignette design randomly manipulates outcome favorability and officer behavior during a hypothetical traffic stop. Multiple indicator multiple cause (MIMIC) models are then utilized to test the impact of these manipulations on perceptions of procedural justice and distributive justice. This is followed by a structural equation model that tests the relationships between procedural justice, distributive justice, and legitimacy.

Results

Officer behavior is a primary predictor of both procedural justice and distributive justice. Furthermore, the results demonstrate that distributive justice judgments are shaped by perceptions of procedural justice. Accordingly, distributive justice mediates the relationship between procedural justice and legitimacy.

Conclusions

Distributive justice should not be treated as a competing explanation for legitimacy evaluations, but as a concept that contextualizes why procedural justice is important.

The aim of this paper is to formulate new and more precise predictions regarding behavioral reactions to distributive and procedural injustice via insights from resource theory. The three theories share focus on discrepancies between actual and ideal states of existence as well as on psychological and behavioral reactions to discrepancy. But they also differ from each other in their conceptualizations and theorizing about these matters. Equity theory conceptualizes discrepancy as a perceived mismatch between inputs and outcomes; multiprinciple distributive justice and procedural justice theories view discrepancy as a mismatch between expected and applied distribution and procedural rules, respectively. Resulting feelings of inequity/injustice may trigger attempts to restore justice. Within the framework of resource theory, discrepancy concerns an inappropriate match between the nature of the provided and received resources. This leads to frustration which, in turn, may trigger attempts at retaliation. Limitations of the theories are discussed, with particular focus on their inability to match specific discrepancies with appropriate behavioral reactions. Behavioral predictions are based upon established congruence between behavioral reactions and violated procedural rules as well as type of inequity, as determined via their respective resource isomorphism. The most recent explanations for the existence of committee systems in legislative chambers have posited that committees are the agents of one of three very different principal actors: (1) individual members (distributive theory), (2) the full chamber (informational theory), or (3) the major political party (partisan theory). In addition to defining and operationalizing the concept of institutional committee system autonomy, I put forth and test several hypotheses linking these three explanations to committee system autonomy. In the end, the results show empirical support for the informational theory over the distributive and partisan theories.  相似文献

This paper addresses theoretical issues relating to distributive and procedural justice. Specifically, comparisons are made between interpersonal and intergroup situations. Within the realm of distributive justice, two reinterpretations of the ingroup allocation bias are offered. One reinterpretation states that people show this bias to prevent being exploited by the outgroup. The other reinterpretation states that the bias can be regarded as a measure of the perceived worth of the ingroup in relation to the outgroup. The related issue of the procedure used for allocating resources is addressed by extending Tyler and Lind's (1992) Relational Model of Authority to all ingroup members in both interpersonal and intergroup situations. Reinterpretations and extensions offered in this paper lead to new theoretical insights and to several suggestions and predictions for future empirical research.  相似文献

Parole as applied to juveniles is something about which we have generated little systematic knowledge and few theories. The purpose of the present study is to present and assess various perspectives that are potentially fruitful in exploring parole decision-making with juveniles. Material drawn from parole decision research with adults is juxtaposed to that derived from more theoretical sociological perspectives, and both are evaluated in view of the philosophy of the juvenile justice system. Results are presented which suggest that the social service orientation of the juvenile justice system is not very helpful in understanding parole decision-making. Rather, it would appear that an analysis of “normal cases” forms the basis of decisions and that race constitutes a basic sorting variable. Furthermore, it is suggested that different sets of factors are used in decision-making for offenders of different races.  相似文献

The study of distributive justice may be examined using two research perspectives. The first, etic perspective seeks to unveil the common characteristics that characterize the spectrum of distributive justice phenomena across different cultures and circumstances. This perspective focuses on the universal aspects of justice behavior, namely, general laws and causal explanations. The second, emic perspective focuses on the ways in which justice behavior is expressed in specific socio-cultural contexts. This paper proposes a three-part reflection on these two perspectives on distributive justice. First, we review the ways in which the emic, culturally specific perspective has hitherto been incorporated into research on distributive justice; second, we examine the ways which the etic and emic perspectives are employed in two empirical studies on justice perception in Israel; and, finally, we suggest possible ways in which an extended emic perspective can be further incorporated in the study of distributive justice. Drawing on social resource theory, we investigated the evaluation of distributive justice principles in relation to material benefits (monetary rewards in working life) and symbolic benefits (praise at university) in a cross-cultural study. We predicted that the equity principle would be perceived as more just for distributing culturally valued resources, whereas the equality principle would be perceived as more just for resources that are less valued within culture. Moreover, applying uncertainty management theory, we predicted that cross-cultural fairness evaluations would be more pronounced for individuals with higher (vs. lower) uncertainty avoidance or lower (vs. higher) uncertainty tolerance. Data of 608 Canadian and German students were collected in a two-wave survey. As expected, when allocating material benefits Canadians found the equity principle to be more just than did Germans, whereas Germans perceived the equality principle as more just than did Canadians. When allocating symbolic benefits, by contrast, Canadians perceived equality as more just than did Germans, though unexpectedly culture did not influence evaluations of the equity principle. Finally, consistent with uncertainty management theory, some of the cultural differences in the evaluation of distributive principles were more pronounced among people with higher uncertainty avoidance and lower uncertainty tolerance. Implications for cross-cultural research on distributive justice are discussed.  相似文献

Central to equity and distributive justice theories is the assumption that reward inequities produce feelings of distress and that such feelings motivate efforts to reduce the perceived injustice. Physiological arousal under such conditions would provide direct evidence of injustice distress. To date, no such evidence exists. In the present study, a skin conductance measure was obtained for subjects receiving either just or unjust allocations in a pay-forwork setting. As expected, heightened arousal occurred (relative to baseline levels) in underpay and overpay conditions, with no such effect in a just-pay condition. It was also predicted and found that heart rate—more an index of somatic activity than distress—did not discriminate among experimental conditions. The implications of these results for theoretical development and applied research are discussed.  相似文献

There is a paucity of empirical research on the social psychology of justice in educational settings. A few previous studies have predominantly focused on distributive and procedural justice concerns, and knowledge about the role of what have been called informational and interpersonal justice for school outcomes is very scarce. In the present study, data from 227 eighth- and ninth-grade students who participated in a survey study were analyzed to examine the interplay between relational justice concerns (decomposed into procedural, interpersonal, and informational justice), motivation to study, and school achievement. A comprehensive theoretically grounded multi-item measure of informational justice was developed and validated. The results showed that informational justice significantly predicts school grades, and that motivation to study fully mediates this effect. Neither procedural nor interpersonal justice was associated with school grades. The implications of these results for research and practice are discussed in detail.  相似文献
