In this article we present, discuss and try to evaluate initiatives which were recently introduced into the Belgian criminal justice system, aimed at the development of creative answers to crime that avoid the use of traditional prison sentences. We decided to focus this analysis on the practice of mediation as it is actually considered the most innovative approach to the crime problem. Mediation as a problem-solving intervention has to be considered in direct relation to the discussion of the purpose of the criminal justice system. By putting the emphasis on the dialogue between the victim and the offender, a common solution is worked out with the help of a mediator. In this way reparation, redress and sometimes even reconciliation become core values of the penal action.  相似文献

In addition to the more conventional approaches of the criminal justice system, this article suggests that there is a need for restorative justice as another method of addressing sexual crime. In support of this view, the present article explores the possibility of a hybrid justice system based on a complementary relationship between restorative justice and the criminal justice system. An analysis of the limits of the criminal justice system and the need for restorative justice in the contentious area of sexual crime will be followed by a detailed examination of key justice considerations when trying to marry both criminal justice and restorative justice perspectives. Such considerations include: the meaning of justice; legislation; sentencing principles; due process; victims’ rights; and the location of restorative justice within/alongside/outside the criminal justice system. The aim of this article is to determine whether it is possible to reconcile two seemingly juxtaposed methods of justice delivery in the context of sexual crime in order to create a hybrid system of justice that best protects and responds to the rights and needs of victims and offenders.  相似文献

In this paper I propose a transgression theory and a standard theory toward penal abolition. I argue that given the ubiquity of “crime” in human relationships, to speak of “criminal behavior” as deviant nullifies the concept deviance (abnormal, out of the ordinary, etc.). After demonstrating that empirically the opposite is the case, I argue for a transgression theory (that most human beings regularly act in ways that transgress the norms and laws they establish) and propose a standard theory (that human beings are both maintainers and transgressors of the social orders they establish). My paper challenges the foundational language (constructions) of “criminal justice” logic that ignore the continuity of the past in the present (white supremacy, neocolonialism, racial capitalism, and gendering enslavement), and that fortify discourse and practice from recognizing, eliminating and standing accountable by rectifying centuries of white privilege, heteronormativity, and the oppression of nonwhite bodies.  相似文献

This article argues that corrective justice is an adequate principle of criminalization. On my interpretation, corrective justice holds that, in order for an action to count as a crime, there needs to be a plausible normative story about an offender having violated the interests of a victim in a way that disturbs their relationship as equal persons and a subsequent story about responding to crime in a way that corrects this disturbance. More specifically, I claim that corrective justice is concerned with the protection of interests that persons have in owning private goods throughout standard interactions with other persons. The argument proceeds in three steps. First, I specify the subject-matter that principles of criminal law need to ground and provide an outline of the idea of corrective justice. Second, I show that corrective justice can account for the main cases of crime and the salient modes of criminal responsibility. I also argue that corrective justice can make sense of two prima facie recalcitrant types of cases (rape and inchoate offenses). Third, and finally, I address two objections to my corrective justice theory of criminal law. The first concerns the implications corrective justice has for locating criminal law along the private/public law divide. The second objection raises the putatively problematic consequences corrective justice has for understanding the separation between criminal and civil law.  相似文献

Various scholars have noted the priority given to law in the politics of hate violence; violence is the problem and law, more specifically the criminal law, the solution at the ‘heart’ of society. This article seeks to explore some of the gaps and silences in the existing literature and politics that mobilize these ideas and associations. It is the gap sand silences associated with demands for and expectations of criminal justice that will be the particular concern of this article. The demand for law is examined by way of David Garland's recent work on the culture of crime control. His work offers an analysis of the contemporary place of crime control in Anglo-American liberal democracies. A distinctive feature of his analysis is to be found in the way it maps an important paradox of contemporary crime control; its political centrality and an increasing recognition of its limitations. Garland's ‘criminology of the self’ and the ‘criminology of the other’ raise some important challenges for those who advocate resort to crime control. My particular concern is to consider the significance of Garland's work for a contemporary sexual politics that puts violence and criminal justice at the heart of that politics. Feminist, gay and lesbian scholarship first on criminal justice and second, on violence and law will be used to develop a critical dialogue with Garland's analysis and to reflect upon the challenges raised by his insights into contemporary crime control. In this article I place U.S. punishment trends in comparative context, seeking to show that the contemporary penal regime in the United States resembles patterns of governance prevalent throughout Latin America, the world's most economically unequal region. In both the U.S. and Latin America, I argue, neoliberal reforms have produced societies characterized by ever greater divides between the haves and have-nots, and state criminal justice institutions increasingly position themselves to police this boundary rather than mitigate its effects. In this article, I examine these trends through the lens of wars on crime and terrorism, arguing that in societies polarized between a dwindling set of haves and an ever more numerous (and potentially unruly) group of have-nots, an inexorable pull makes criminal justice institutions more aggressive in their enforcement of class and racial boundaries. Hallmarks include a widening of the criminal justice net (by broadening definitions of criminal activity, for example) and a deepening of the deprivations visited on those ensnared within it. The article concludes with reflections on the need for reconfiguring conceptions of human rights and their relation to security.  相似文献

Criminal justice policy faces the twin challenges of improving our crime reduction efforts while increasing public confidence. These challenges are exacerbated by the fact that at least some measures popular with the public are counterproductive to greater crime reduction. How to achieve greater crime reduction without sacrificing public confidence? While restorative justice approaches offer a promising alternative to traditional sentencing with the potential to achieve these goals, they suffer from several serious obstacles, not least their relatively limited applicability, flexibility, and public support. Punitive restoration is a new and distinctive idea about restorative justice modeled on an important principle of stakeholding, which states that those who have a stake in penal outcomes should have a say about them. Punitive restoration is restorative insofar as it aims to achieve the restoration of rights infringed or threatened by criminal offences. Punitive restoration is punitive insofar as the available options for this agreement are more punitive than found in most restorative justice approaches, such as the option of some form of hard treatment. Punitive restoration sheds new light on how we may meet the twin challenges of improving our efforts to reduce reoffending without sacrificing public confidence, demonstrating how restorative practices can be embedded deeper within the criminal justice system.  相似文献

Based on a lecture to policy makers in Brazil, this essay explores lessons that developing nations can learn from US experiences in the fight against violence and crime. A brief summary of trends in crime, criminal justice policy, and criminal punishment in the US over the past four decades is followed by an evaluation of the dominant imprisonment strategy of the 1970s through 1990s. It is argued that benefits of the massive increase in criminal punishment have been few and that costs have been excessive in terms of material, human, and social capital. Nonetheless, the American experience provides inspiration when we consider the broader societal potential for social organization: values and norms; self-interest and involvement in legitimate exchange networks; mobilization of social capital; and diverse mechanisms of social control. These concepts are explained, and specific institutions and mechanisms to control violence and crime are explored under each of them. This paper argues that New Labour's 'tough' stance on law and order has given rise to a criminal justice policy which is based on fundamental contradictions and which involves a substantial retreat from traditional socialist thinking on crime. The continuation of a populist punitive approach ensures the predominance in policy making of a 'criminology of the other' which, in turn, sustains a 'punishment deficit' which fuels public expectations that crime can be controlled effectively by a policy of deterrence through punishment. This populist punitiveness, it is argued, is at odds with another strand of government penal policy, the attempt to secure greater efficiencies and economies by an intensification of managerialism throughout the criminal justice system.  相似文献

ABSTRACT

The purpose of the article is to provide an overview to the trends in crime and crime control in Finland and Sweden during the past 150 years, systematically comparing the two countries. The secondary objective of the study is to introduce a Nordic data collection project aiming to compile coherent comparative criminal justice time series from the early nineteenth century to the present, and to present the first collection of data, the Finnish justice statistics 1842–2015. The study examines the long-term development of homicide, assault, rape, defamation, prison population, and penal severity. Historical statistics provide opportunities to examine the crime trends and the society’s responses to them keeping in mind that the statistics do not necessarily reflect changes in total criminality. As such, the study does not provide conclusive explanations on the development of crime and punishment but rather opens new questions to be answered in future research.  相似文献

There are two fundamental ways to reduce crime: fix crime prevention weaknesses or build on crime prevention strengths. Three crime prevention strengths that have delivered most Asian societies comparatively low and falling levels of violence are considered: (1) war reduction as a path to reduction of common criminal violence; (2) comparatively low levels of inequality; (3) comparatively low ratios of stigmatizing to reintegrative social control that respects human dignity. Transformative justice that addresses the root causes of wars, reduces inequalities of wealth and power, and empowers communities to do their own restorative justice are paths considered for building a nonviolent Asian future.  相似文献

The paper explores the link between penal ideology and international trial justice from the perspective of sentencing. The argument is based on the premise that the perceived legitimacy of punishment is directly related to effective governance in criminal justice. As such, loss of faith, or lack of moral empathy by individuals and communities with the ideologies, processes and outcomes of punishment compromises the ability of criminal trials to function effectively in maintaining the ‘rule of law’. The paper argues that more emphasis should be given explaining the moral foundations that underpin perceptions of ‘justice’ in sociological accounts of the ‘reality’ of sentencing, and proposes an analytical framework for conceptualising this. Adopting this approach, the paper draws on examples from national and international criminal justice to illustrate how the hegemony of penal ideology and its implementation compromises the ability of sentencing outcomes to resonate with the trial‘s ‘relevant audience’. The paper then focuses on how penal ideology influences the construction of the factual basis for sentencing in international criminal trials, and considers the consequences of this for the perceived ‘legitimacy’ of international trial justice.  相似文献

This address has a twofold purpose. First, as the first African American to serve as president of the American Society of Criminology (ASC), I celebrate the contributions of scholars of color to the study of crime and criminal justice and to the ASC. I do so by pointing out the accomplishments of several African American scholars whose contributions are numerous and exemplary. I also emphasize that African Americans are joined in their efforts by scholars of multiple other colors, including, Latinos/as, Native Americans, and Asians. Second, in view of responses to apparent unrest and racial tension in U.S. society that is signaled by lethal violence between police and U.S. residents of color, I offer four recommendations regarding how we might proceed with our research, and report our findings, in ways that improve the likelihood of helping to inform societal debates and policy developments around crime and justice issues. In my conclusion, I encourage the ASC to 1) continue to grow the diversity of its membership and to integrate the research and findings of scholars of color into the mainstream of criminology; and 2) take further steps to conduct research and share findings with diverse audiences to ensure that post‐truth does not become normative regarding crime and justice issues.  相似文献

Estimating the financial costs of criminal violence to victims is important for assessing both the impact of crime on individuals and evaluating the feasibility and utility of various crime prevention, crime control, and criminal justice policies. Traditionally, such estimates focus on short‐term costs: costs connected to the victimization event itself and costs incurred during the immediate aftermath. Although the possibility of more long‐term costs is acknowledged, research has yet to articulate how and to what extent criminal violence impacts socioeconomic fortunes. In this article, I propose a life‐course model for estimating the long‐term costs of violent victimization. Using prospective, longitudinal data from a national sample of American adolescents, and retrospective data from a national sample of Canadians, I use this conceptual model to estimate income losses over the life cycle associated with violent victimization. Three significant results are reported. First, income losses from violent victimization are age‐graded, with the greatest costs occurring for victimization experienced in adolescence. Second, criminal violence experienced in adolescence appears to influence later earnings by disrupting processes of educational and occupational attainment. Third, the total costs of criminal violence over the life course for adolescents are considerable in comparison to estimates provided in previous research. The policy implications of these findings are discussed.  相似文献

This paper addresses criminal justice responses that came on the heels of a traumatic sexual assault in public space in India. The incident referred to as “Nirbhaya,” drew attention to the nation as well as the world the violence against women who on the one hand find themselves in public spaces designed for all denizens in this globalised world, yet, subject to sexploitation and devoid of safeguards and equal protection. In this paper we catalogue modifications to Indian criminal justice as a result of the Nirbhaya case to illustrate how extreme events help drive changes to the system in a large democracy, yet an economically developing one. More specifically, we address changes that have been incorporated in criminal laws, police procedures, and crime prevention efforts, as well as assess the degree to which these efforts have been effective.  相似文献

Advances in forensic techniques have expanded the temporal horizon of criminal investigations, facilitating investigation of historic crimes that would previously have been considered unsolvable. Public enthusiasm for pursuing historic crimes is exemplified by recent high-profile trials of celebrities accused of historic sexual offences. These circumstances give new urgency to the question of how we should decide which historic offences to investigate. A satisfactory answer must take into account the ways in which the passage of time can erode the benefits of criminal investigation, the costs associated with investigating old crimes, and the need to prioritize investigations in the face of limited police resources. This article emphasizes the first of these factors. It begins by considering the moral goals of a criminal justice system and the contribution of criminal investigations to the achievement of these goals, distinguishing between contributions that depend on further steps in the criminal justice process, such as prosecution and punishment, and contributions that can have value independently of these further steps. Using this important distinction, the article then examines a range of factors that relate the passage of time to criminal justice goals, including the seriousness of the crime; deterioration of evidence; death of the offender, victim and others affected by the crime; and diminished psychological connectedness between those affected by the crime and their current selves. While the range and non-uniformity of relevant factors preclude a simple answer to the question of when historic crimes should be investigated and call instead for case-by-case assessment, we find that the analysis does support some general conclusions that can guide such an assessment.  相似文献

ABSTRACT

This article investigates the role of crime scene technicians in the Swedish criminal justice system, and particularly how Swedish crime scene technicians not only examine crime scenes but also facilitate the criminal justice system’s joint production of forensic evidence. It proposes thinking about the criminal justice system as a conglomeration of epistemic cultures, that is, of communities with different ways of producing and understanding forensic evidence. Such a perspective makes it possible to understand interprofessional frictions as epistemic frictions as well as to draw attention to the facilitations, mediations and translations that crime scene technicians perform. This perspective also makes it possible to illuminate how the crime scene technicians’ professionalization – a professionalization from the outside – affects both their future crime scene work and their facilitations.  相似文献
