CRIMINOLOGY, CRIMINAL JUSTICE, AND THE WAR ON CRIME

This detailed assessment reviews the nation's “war on crime” during the past ten years, examines what has heen accomplished in that period, and outlines the likely prospects for the future. Although important and tangible progress in improving criminal justice has been made. it has not produced relief from high crime rates. In fact, “things are worse than ever.” For the future, there will be both more advances and frustrations in the war on crime. It is emphasized that the progress achieved so far has been to create a more efficient and fairer rystem of justice and that we should take pride in this. If not eclipsed by the quarterly release of crime statistics, we can maintain our momentum and gain even more significant improvements in the next decade.     

ON THE ASSOCIATION AMONG SELF-CONTROL, CRIME, AND ANALOGOUS BEHAVIORS

In a paper previously published in Criminology (Paternoster and Brame, 1998), we used data from the Cambridge Study in Delinquent Development to investigate the association between criminal activity and a set of so-called "analogous behaviors" (i.e., excessive drinking, smoking, gambling, involvement in accidents, etc.). Our reading of Gottfredson and Hirschi's (1990) self-control theory led us to hypothesize that both of these outcomes should depend on self-control. It seemed to us that the implication of this position is that self-control should explain any association that exists between involvement in criminal activity and involvement in analogous behaviors. Our analysis suggested that the association between criminal activity and analogous behaviors persisted even after conditioning on our measure of self-control. We drew the qualified conclusion that this result constitutes negative evidence for Gottfredson and Hirschi's self-control theory. In this paper, we reexamine the analytic framework on which we relied in our earlier work.

THE POLITICS,AND PLACE,OF GENDER IN RESEARCH ON CRIME*

The study of gender and crime has grown exponentially over the past 40 years, but in some fundamental respects, it remains underdeveloped. Few scholars have considered both the similarities and the differences in the predictors of offending among males and females and the implication of this for middle‐range theories. Victimization has been put forth as a major explanatory factor for female offending; yet the study of female victimization has been ghettoized because it has failed to address the ways in which it is related to the larger literature of victimization. Female inmates have always been characterized as having special needs, but the basic necessities (housing and employment) inmates require once they are released from prison are in fact gender neutral. These bodies of research all have suggested that the salience of gender varies in different contexts and is intermixed with other forms of stratification. As such, we would do well to attend to those situations and relational processes that foreground gender and focus our efforts on where gender‐based paradigms are important and can have a real impact.     

THE EFFECTS OF DIVORCE AND CUSTODY ARRANGEMENTS ON CHILDREN'S BEHAVIOR, DEVELOPMENT, AND ADJUSTMENT

This article summarizes the consensus among a group of experts from developmental and clinical psychology, sociology, social welfare, and law who sought to evaluate existing empirical evidence regarding the ways in which children are affected by divorce and the varying custody arrangements that follow it. Divorce and/or single parenthood tend to have adverse effects on children's adjustment, with the magnitude of the effects varying depending on the psychological status of the two parents, the extent of conflict between them, and the financial circumstances, particularly after divorce. Children whose nonresidential parents continue to support them financially, those whose custodial parents are psychologically healthy, and those who have and maintain meaningful relationships with nonresidential parents tend to be affected less by the divorce, especially when there is no conflict between the parents. Interventions should thus be designed with these factors in mind.

A NOTE ON PERCEPTUAL DETERRENCE,RELIGIOUSLY BASED MORAL CONDEMNATION,AND SOCIAL CONTROL*

Empirical investigations of social control mechanisms are often limited to single sources of control, such as the efficacy of legal punishments. Because research has produced only moderate support for the hypothesis that perceived risk of legal punishments reduces the likelihood of nonconformity, some have searched sources of control that condition this relationship. such as the degree of moral condemnation individuals hold toward a criminal/delinquent act. However, relevant research has resulted in contradictory findings. Using cross-sectional and panel data, we obtained results that show that moral condemnation of an act conditions the deterrent relationship and that findings from previous studies may have underestimated the effect of legal deterrents given the presence of those in the population who refrain from marijuana use because it is believed to be sin fur. Implications of the findings for the relative deterrability of serious versus minor offenses and the relevance of this distinction for issues of social control are discussed.     

ON BEING A CHILD CUSTODY EVALUATOR: PROFESSIONAL AND PERSONAL CHALLENGES,RISKS, AND REWARDS

Conducting child custody evaluations is one of the most complex, challenging, and sometimes risky professional endeavors that a mental health professional can perform. This article examines the professional and personal challenges which may be encountered by the evaluator. In addition to discussing the role requirements and need to maintain awareness of bias and countertransference, challenges such as coping with state board or ethics complaints and possible risks to personal safety are also addressed. Suggestions for risk management and coping with the demands of these assessments are offered, as well as the benefits and rewards of engaging in this important work.     

THE IMPACT OF CONTINUING EDUCATION TRAINING ON LAW GUARDIAN KNOWLEDGE,EFFICACY, AND PRACTICE BEHAVIORS

There is an increased demand for law guardians in domestic violence cases, especially those involving child witnesses. Training is required for law guardians to meet child clients’ needs. While workshops and conferences are typical venues for continuing education training, their effectiveness is unknown. This pilot study compared law guardians who attended a conference on community violence and children to nonattendees on several training outcomes. Results showed a positive impact on attendees’ feelings of efficacy and intentions to carry out new practice behaviors post‐conference; differences were maintained at follow‐up. Limitations and implications of this pilot study are discussed.
