In a 2×2 table, phi measures the strength of the relationship and relative improvement over chance (RIOC) measures the predictive efficiency. A simplified formula for RIOC is derived. From the linkage between RIOC and the adjusted standardized residual, the variance of RIOC is calculated, thereby allowing its statistical significance to be tested. A disadvantage of phi is that its maximum value can be less than 1. A corrected phi correlation, obtained by dividing phi by the maximum possible phi, is shown to be mathematically identical to RIOC. Hence, there is a linkage between the percentage of correct predictions and the percentage of variance explained. RIOC is unchanged even when the social costs and benefits of the different outcomes are differentially weighted. RIOC is also mathematically identical to a corrected kappa calculated in a similar fashion to the corrected phi. Therefore, RIQC has distinct advantages over phi and kappa.  相似文献

The findings from prior research indicate that positive credentials, or documentation of prosocial accomplishments, can vary in strength and perceived value in mitigating aversions to hiring individuals with criminal records. In the current study, we examine why certain types of positive credentials may be more influential in reducing stigma than others. Using data from a nationwide survey of American adults (N = 3,476), we combine a mediation analysis with content-coding of open-ended responses to identify key themes and patterns in decision processes. The results indicate the factors examined here—employee dependability, trustworthiness, recidivism risk, and workplace crime—explain a large proportion of the total effect across credentials and are the strongest for reference letters. Trustworthiness is the most influential mediator across credentials, whereas general recidivism risk is consistently the lowest. An analysis of open-ended responses provides further context and insight into these patterns. Although policy strategies often target risk reduction on the employer's end, credentials that also relay information about skills, character, and the timeline of recent life events are especially influential.  相似文献

Through two case studies, this essay examines the relationship between the operation and practice of law in Aotearoa New Zealand and the naming of the ‘unlawful’, ‘uncivil’ or ‘disorderly’ within a colonial context. Against the background of the apparent complicity between law and colonial interest and desire in Aotearoa, I argue that, in both the ‘Haka Party’ case (1979) and Mair v Wanganui City Council (1996), the acts of the defendants draw attention to the relationship between the authority of the law and the repression or exclusion of difference. According to the judges in both cases, the dictates of Maori law and custom were in conflict with the principles of ‘law and order’. Read in terms of colonial relations, the perceived relationship between Maori law and custom and the threat to ‘civilization’, law and order reveals the way in which ‘the law’ has operated in a culturally biased manner and has reflected the interests of Pakeha (New Zealanders of European descent). Thus, the perceived threat of the challenge made to the law in either case can be seen as the threat to reveal it for what it is, to expose the violence that maintains it, and thus to open a space for critique. Perhaps more powerfully than any physical attack on the system itself, these acts which expose the law challenge it in the name of justice, making it possible for the law to be seen both as a reflection of a particular cultural interest and hence as co-opt-able, takeable and able to be made to serve another end, that of the other in the name of justice. The predictive accuracy of Static-2002 (Hanson & Thornton, Notes on the development of Static-2002 (Corrections Research User Report No. 2003-01), 2003) was examined in eight samples of sexual offenders (five Canadian, one U.S., one U.K., one Danish; total sample of 3,034). Static-2002 showed moderate ability to rank order the risk for sexual, violent and general (any) recidivism (AUCs of .68, .71, and .70, respectively), and was more accurate than Static-99. These findings support the use of Static-2002 in applied assessments. There were substantial differences across samples, however, in the observed sexual recidivism rates. These differences present new challenges to evaluators wishing to use actuarial risk scores to estimate absolute recidivism rates.  相似文献

The study compared the predictive accuracy of three sex offender risk-assessment measures: the RRASOR (Hanson, 1997), Thornton's SACJ-Min (Grubin, 1998), and a new scale, Static-99, created by combining the items from the RRASOR and SACJ-Min. Predictive accuracy was tested using four diverse datasets drawn from Canada and the United Kingdom (total n = 1301). The RRASOR and the SACJ-Min showed roughly equivalent predictive accuracy, and the combination of the two scales was more accurate than either original scale. Static-99 showed moderate predictive accuracy for both sexual recidivism (r = 0.33, ROC area = 0.71) and violent (including sexual) recidivism (r = 0.32, ROC area = 0.69). The variation in the predictive accuracy of Static-99 across the four samples was no more than would be expected by chance.  相似文献

This article seeks to identify how, and in what ways, the debate over ethnic identity acquired saliency during the different phases of black settlement in England, especially against the backcloth of the socio-cultural processes and the economics of colonialism. It outlines how the ‘other’ was constituted in different discourses, policies, and practices, and how these constructions were appropriated by the criminal justice agencies. Critically, ethnic identity as subordinate and ‘inferior’ was produced by many of the same mechanisms as was developed with regard to the indigenous ‘criminal’ class in Victorian England. Societal reaction, through criminal and civil statutes, established the identity of the ethnic minorities of early nineteenth century England, not just as subordinate strata, but also by a more complex process, as a variant of the newly emergent ‘criminal’ class. It is argued that, caught in the hub of empire, the ‘ayahs’, the ‘lascars’ and the domestic servants (See R. Visram, The Ayahs, Lascars and The Princes (London: Pluto).) in England’s ports found themselves reconstructed as part of the ‘criminal’ class and subsequently subjected to disciplinary measures of social control and surveillance. The author argues with regard to the indigenous population, conceptions of the threat of the non-Western crystallised around the same popular images of ‘savagery’ and of moral degeneracy, a process reinforced in imperial fiction. A desire to ‘civilise’ and improve the peculiar habits of the non-Western followed directly from indigenous precedent.  相似文献

This study drew on a cost–benefit method to compare recidivism between two groups of inmates. Subjects were randomly assigned to serve a 6-month ‘early release’ term in one of two prisons which diverged dramatically in terms of structure, freedom, and staff–inmate interaction style (boot camp versus traditional prison). The study was motivated, in part, by the state of Maryland’s asking whether the ‘extra’ cost of running an early release program at the boot camp rather than a traditional prison was justified. Cost–benefit tools were employed, not only because they addressed this specific question, but also because they provided a platform for describing differences both in the amount and the quality (harm) of recidivism associated with facility assignment. Two themes are emphasized in this paper. First, even without consideration of differences in post-release impact, the boot camp cost less to run per inmate. This may be an important observation for policy makers now wrestling with budget declines and potential cuts; they should not assume that programs which offer more services are necessarily more expensive to operate than alternatives offering less. Second, the boot camp generated substantially less recidivism-harm relative to the traditional prison. This finding held across numerous sensitivity analyses standard to the field, as well as new approaches presented here.  相似文献

Although narrative reviews have suggested that "youth psychopathy" is a strong predictor of future crime and violence, to date no quantitative summaries of this literature have been conducted. We meta-analyzed recidivism data for the Psychopathy Checklist measures across 21 non-overlapping samples of male and female juvenile offenders. After removing outliers, psychopathy was significantly associated with general and violent recidivism (r (w)'s of .24 and .25, respectively), but negligibly related to sexual recidivism in the few studies examining this low base rate outcome. Even after eliminating outliers, however, considerable heterogeneity was noted among the effects, with some of this variability being explained by the gender and ethnic composition of the samples. Effect sizes for the small number of female samples available for analysis were mostly small and nonsignificant, and psychopathy was a weaker predictor of violent recidivism among more ethnically heterogeneous samples. In relation to predicting both general and violent recidivism, psychopathy performed comparably to an instrument designed specifically to assess risk, the Youth Level of Service/Case Management Inventory (Hoge & Andrews, 2002).  相似文献

The article offers a close reading of the famous upanişadic story of Indra, Virocana and Prajāpati from the eighth chapter of the Chāndogya-Upanişad versus Śankara’s bhāşya, with special reference to the notions of suşupti and turīya. That Śankara is not always loyal to the Upanişadic texts is a well-known fact. That the Upanişads are (too) often read through Śan-kara’s Advaitic eyes is also known. The following lines will not merely illustrate the gap between text and commentary but will also reveal an unexpected Upanişadic depiction of ‘dreamless sleep’ and ‘transcendental consciousness’. Suşupti is described here as ‘one step too far’, as a ‘break’ or discontinuity in one’s consciousness; whereas turīya is depicted positively, and surprisingly even in wordly terms. Unlike the third state of consciousness in which there is no ‘world’ nor ‘me’, and which is described through Indra’s character as ‘total destruction’ (vināśa); in turīya, the world ‘comes back’, or rather the ‘renouncer’ returns to the world. Sankara’s position, as far as the story under discussion is concerned, is radically different. For him, the Upanişadic story illustrates the continuity of consciousness in all its states. For him, the identification with merely one of the consciousness-states is an error (adhyāsa) which causes suffering. Consciousness prevails even in suşupti, and turīya has nothing to do with ‘coming back to the world’, since there is nowhere to come back from or to. Turīya, as seen by the Advaitin, consists of all the other states of consciousness together, or as K. C. Bhattacharyya puts it, ‘It is not only a stage among stages; it is the truth of the other stages’. The article is dedicated to Prof. Daya Krishna (1924-2007).  相似文献

Hare's Psychopathy Checklist-Revised (PCL-R) was used to test the hypothesis that psychopathy predicts violent recidivism in a cohort subjected to forensic psychiatric investigation and consisting of male violent offenders with schizophrenia (N = 202). Psychopathy was assessed with retrospective file-based ratings. Mean follow-up time after detainment was 51 months. Twenty-two percent of the offenders had a PCL-R score 26 (cutoff), and the base rate for violent recidivism (reconvictions) during follow-up was 21%. Survival analysis revealed that psychopathy was strongly associated to violent recidivism (log-rank = 17.71, df = 1, p < 0.0001). The area under the curve (AUC) of the receiver operating characteristics (ROC) of PCL-R total score to predict violent recidivism varied between different time frames from .64 to .75. Cox regression analyses revealed that other potential risk factors could not equally well or better explain violent recidivism in the cohort than psychopathy as measured by PCL-R.  相似文献

This research was a cross-validation study of the Domestic Violence Screening Instrument-Revised (DVSI-R), using a diverse, statewide sample of 3,569 family violence perpetrators in Connecticut, assessed in February and March of 2007. It analyzed re-arrest data collected during an 18-month period post assessment. Three issues were central, which have been ignored in previous research on family violence risk assessment: (1) analyzing five refined measures of behavioral recidivism, (2) determining whether perpetrator characteristics and types of family and household relationships (beyond just heterosexual intimate partners) moderate the empirical relations between the DVSI-R and the behavioral recidivism measures, and (3) determining whether structured clinical judgment about the imminent risk of future violence to the victim or to others corresponds with recidivism predicted by the DVSI-R total numeric risk scores. The empirical findings showed that the DVSI-R had significant predictive accuracy across all five measures of recidivism. With one exception, these relations did not vary by gender, age, or ethnicity; and again with one exception, no significant evidence was found that types of family or household relationships moderated those empirical relations. In short, the evidence suggested that the DVSI-R was a robust risk assessment instrument, having applicability across different types of perpetrators and different types of family and household relationships. Finally, the empirical findings showed that structured clinical judgment about imminent risk-to-victim and risk-to-others corresponded with the prediction of recidivism by the DVSI-R total numeric risk scores, but the effects of those scores were significantly stronger than the perceived risk-to-victim or the perceived risk-to-others.  相似文献

Validity (area under receiver operating characteristic curve) reported by Epperson et al. was .77 with 16 items selected. The present analysis yielded an asymptotically unbiased estimator AUC = .58. The present article also focused on the degree to which sampling error renders estimated cutting scores (appropriate to local [varying] recidivism base rates) nonoptimal, so that the long-run performance (measured by correct fraction, the total proportion of correct classifications) of these estimated cutting scores is poor, when they are applied to their parent populations (having assumed values for AUC and recidivism rate). This was investigated by Monte Carlo simulation over a range of AUC and recidivism rate values. Results indicate that, except for the AUC values higher than have ever been cross-validated, in combination with recidivism base rates severalfold higher than the literature average [Hanson and Morton-Bourgon, 2004, Predictors of sexual recidivism: An updated meta-analysis. (User report 2004-02.). Ottawa: Public Safety and Emergency Preparedness Canada], the user of an instrument similar in performance to the MnSOST-R cannot expect to achieve correct fraction performance notably in excess of what is achievable from knowing the population recidivism rate alone. The authors discuss the legal implications of their findings for procedural and substantive due process in relation to state sexually violent person commitment statutes and the Supreme Court's Kansas v. The utility of recidivistic prediction is limited by the false positive problem: predictions of failure (recidivism) that do not occur. False negatives (predicted successes but observed failures) are also worrisome, and together both types of error can be formally evaluated by what Blumstein, Farrington, and Moitra call the civil-libertarian ratio: the ratio of the subjective cost of a false positive to a false negative. Choice of a recidivistic criterion and selection of a proportion of offenders for criminal justice intervention have implications for the evaluation of the disutility or subjective cost associated with various civil-libertarian ratios. Logistic regression models of four recidivistic criteria are evaluated to demonstrate how base rate (observed failure rate) and selection ratio (proportion selected to fail) affect the disutility associated with a range of civil-libertarian ratios. Use of civil-libertarian ratios by criminal justice policy makers is demonstrated. Predictive utility is relatively difficult to achieve for rare recidivistic events if the decisions involve severe deprivation of liberty (incarceration decisions). Predictive utility is easier to achieve for more common forms of recidivism or in decision contexts where there is less concern for false positives, such as for “intermediate sanctions.”  相似文献

In the study of Buddhism it is commonly accepted that a monk or nun who commits a pārājika offence is permanently and irrevocably expelled from the Buddhist monastic order. This view is based primarily on readings of the Pāli Vinaya. With the exception of the Pāli Vinaya, however, all other extant Buddhist monastic law codes (Dharmaguptaka, Mahāsāṅghika, Mahīśāsaka, Sarvāstivāda and Mūlasarvāstivāda) contain detailed provisions for monks and nuns who commit pārājikas but nevertheless wish to remain within the saṅgha. These monastics are not expelled. Rather, they are granted a special status known as the śikṣādattaka. In this paper I explore the rules. concerning pārājika penance and the śikṣādattaka with specific regard to monastic celibacy. Given that five out of six extant law codes recognise this remarkable accommodation to the rule of celibacy, I argue that we must look to Vinayas other than the Pāli Vinaya if we are to arrive at a nuanced and representative view of Indian Buddhist monasticism.

Purpose

Despite a longstanding tradition in criminology to consider the impact of neighborhood context on crime-related outcomes, criminologists have largely ignored the influence of social ecology on recidivism until recently. The purpose of the present study was to examine the main and moderating influences of social ecology on recidivism.

Materials and Methods

The present study used hierarchical nonlinear modeling to estimate the effects of concentrated disadvantage, immigrant concentration, and residential stability on recidivism for a sample of offenders released from custody/supervision in 2006 and nested within Iowa counties. We controlled for individual-level risk for recidivism using the Level of Service Inventory-Revised (LSI-R), a validated risk assessment instrument. We also examined whether the relationship between LSI-R score and recidivism varied across counties, and if so, whether this variation can be explained by social structural characteristics.

Results

Results indicate that residential stability was the only contextual variable significantly related to recidivism. The relationship between individual-level risk and recidivism did not vary across contexts.

Conclusions

The findings suggest that the social structural context has limited influence on recidivism, while the LSI-R is a robust predictor of recidivism across contexts. We discuss the implications of our findings for theory, practice, and future research.  相似文献

Research on recidivism has been confined primarily to a few highly industrialized Western nations (e.g., United States, Great Britain, Canada, and Australia) in which the data and resources needed for such research are readily available. The restriction of recidivism research to such a small number of nations begs the question: Do these results reflect patterns of offending and products of the criminal justice systems unique to these nations, or do they describe patterns of recidivism across a much wider range of social and cultural contexts? In this study I extend the scope of recidivism research by examining levels and patterns of recidivism in the Republic of Malta, a small Mediterranean island that differs considerably from the typical context in which recidivism is studied. Specifically, I examine the likelihood of recidivism among persons released from Malta's only prison between 1976 and 1994. In addition, I examine factors shown in previous research to be strong predictors of recidivism to assess their value as predictors of recidivism among Maltese prisoners. Proportional hazards regression models reveal that levels and predictors of recidivism in Malta approximate those observed in societies that are socially and culturally quite different. The findings suggest that the role of social institutions in reintegrating offenders into society may be more complex than commonly believed.  相似文献

In Sāṃkhya similes are an important means to communicate basic philosophical teachings. In the texts similes are frequently used, especially in the Sāṃkhya passages in the Mahābhārata, in the Sāṃkhyakārikā and in the Sāṃkhyasūtra. This paper compares the similes in these three texts and analyses changes in the philosophy as revealed in the similes. A comparison of the similes of Sāṃkhya texts produced over more than one thousand years reveals changes in the emphasis in this philosophical system. The purpose of the similes in the Sāṃkhya passages of the Mahābhārata is to produce an intuitive understanding of the separateness of puruṣa and prakṛti. The similes are designed to lead the listener to understand this basic dualism. In the Sāṃkhyakārikā the most difficult issues are the relationship between prakṛti and puruṣa and the idea of prakṛti working for the salvation of puruṣa. One whole chapter of the Sāṃkhyasūtra is devoted to similes.  相似文献

In a recent article, Vrieze and Grove (Law Hum Behav, doi: 10.1007/s10979-007-9092-x , 2007) argue that, because of low recidivism base rates and limited predictive accuracy, an actuarial risk assessment instrument (ARAI) may produce decisions about sex offenders that are worse than simply predicting that no one will commit another sex offense. This article examines: (1) the construction and potential overfitting of ARAIs; (2) the meaning, value, and limitations of ROC areas; and (3) the relationship between the operating point that maximizes an ARAI's correct classifications and the legal criterion-"likely to reoffend"-used for sex offender designations. Contrary to what Vrieze and Grove suggest, ARAIs of modest accuracy yield probabilistic information that is more relevant to legal decision-making than just "betting the base rate."  相似文献

This article argues for a new interpretation of the Sanskrit compound gaṇḍa-vyūha as it is used in the common title of the Mahāyāna text the Gaṇḍavyūha-Sūtra.The author begins by providing a brief history of the sūtra’s appellations in Chinese and Tibetan sources. Next, the meanings of gaṇḍa (the problematic member of the compound) are explored. The author proposes that contemporary scholars have overlooked a meaning of gaṇḍa occurring in some compounds, wherein gaṇḍa can mean simply “great,” “big” or “massive.” This general sense is particularly common in the compound gaṇda-śaila (a “massive rock” or “boulder”) and is found in such texts as the Bhāgavata Purāṇa, the Harivaṃśa and the Harṣacarita. Following the discussion of Gaṇḍa, the author examines the term vyūha (“array”) as it is used in the Gaṇḍavyūha-sūtra. The article concludes with the suggestion that a more appropriate translation of the Gaṇḍavyūha-sūtra would be “The Supreme array Scripture.”  相似文献

This paper presents an English translation from the original Tamil of the canonical Saivite hagiographical work, the Tiruttoṇṭar Tiruvantāti of Nampi Āṇṭār Nampi. The date of this work is disputed, but it was probably composed at some point between 870 and 1118 CE. This classical Tamil poem gives in summary form the lives of the sixty three Saivite saints of the sixth to ninth centuries known as the Nāyaṉmār, or Tiruttoṇṭar (“holy servants”, sc. of the Lord Siva). The paper also includes an Introduction, setting out the context of the poem and its place in the Saivite literary tradition from which the Saiva Siddhanta philosophy subsequently developed, and Notes which explain the mythological and other references which the poem contains.  相似文献
