A policy provision in the Criminal Victim Assistance Program in British Columbia excludes the offender from participating in restorative justice approaches with the victim (and other affected parties) during counseling. A historical analysis of victim responses to crime shows that the victim experience to crime is socially constructed. In this regard, this policy act that excludes offenders from the victim healing process is consistent with a traditional approach to justice, which understands the offender to have committed a crime against the state, not the victim; however, separating the offender from the healing process is problematic within a restorative framework of justice where relationality is a central premise. Using a restorative lens, this policy act is contrary to an accompanying statute that has explicit provisions for counseling support for crime victims, as well as other statutes that provide for restorative responses to crime in Canada. The way we counsel and support victims from the harms created by crime cannot be separated from our view of justice.  相似文献

Conclusion In this paper, narrative coherence has been looked at as an institutional strategy in anticipation of the verdict rather than in retrospect of the crime or charge. The analysis of binary notions has been instrumental in the reconstruction of the coherence between the narrative(s) and the theoretical outcomes of the criminal trial. As the abstraction and polarisation of narrative versions focus on the achievement of professional consensus, the verdict, which is almost always based on the selection of a binary option does injustice to any narrative which is unfolded in the court-room. Whether the defendant is acquitted or convicted, therefore, does not make him a winner or a loser, as his personal experience is abducted and institutionalised for the facilitation of smooth institutional decision-making.  相似文献

The present study investigates victim sexual orientation in a sample of 641 violent crime victims seeking emergency medical treatment at a public-sector hospital. Victim sexual orientation was examined as it: (a) varies by type of violent crime and demographic characteristics, (b) directly relates to psychological symptoms, and (c) moderates the relationship between victim and crime characteristics (i.e., victim gender, victim trauma history, and type of crime) and psychological symptoms (i.e., symptoms of acute stress, depression, panic, and general anxiety). Results showed that lesbian, gay, bisexual, and transgender (LGBT) victims were more likely to be victims of sexual assault. Heterosexual victims were more likely to be victims of general assault and shootings. LGBT victims demonstrated significantly higher levels of acute stress and general anxiety. Moreover, victim sexual orientation moderated the association of type of crime with experience of panic symptoms. Also, victim sexual orientation moderated the relation of victim trauma history and general anxiety symptoms. Results are discussed in relation to victimization prevalence rates, sexual prejudice theory, and assessment and treatment of violent crime victims.  相似文献

The question investigated in the presented paper is whether crime is discussed differently in the media of former East and West Germany, how it is weighted and whether the real crime situation provides an explanation for any differences in press coverage. The study showed that there are no significant differences in the press coverage and that violent crime is not overrepresented. Coverage of offences like robbery, damage to property, sexual assaults or bodily injury, which are also categorized as violent crime, was of average frequency, so that again there was no overrepresentation in the newspapers of the two cities compared in this study (Stuttgart and Dresden). Surprisingly, sexual offences such as rape or sexual abuse played a minor role in the daily newspapers. Further interesting results of the analysis were that offences in the field of "intelligent crime" (e. g. white-collar crime) were of no importance in the print media, whereas the number of reports on crimes for which the general public assumes a higher probability to become a victim itself (e. g. burglary and robbery) was disproportionately high in relation to the recorded number of cases. Reports on drug offences played a more important role in the newspapers analyzed by us than violent crime.  相似文献

The larger roles of the community in crime prevention and improvements in technology have increased police–citizen communication and the distribution of information from police departments to private citizens. Combined, these changes have led to the current movement among law enforcement agencies toward sharing both summary reports and maps of crime with community groups. Although the dissemination of crime information is intended to benefit community members, there is a lack of empirical evidence demonstrating the effects of crime mapping on citizen perceptions and fear of crime. This experiment compared three formats for disseminating crime data; two popular types of crime maps (i.e., graduated symbol and density) and the traditional tabular format of crime statistics. A randomized experimental design was used to measure residents fear of crime and their perception of the safety of different areas of Redlands, CA. Overall, residents who viewed either type of map reported less fear than those who viewed tabular statistics. Respondents who viewed graduated symbol maps consistently reported less fear than either density maps or tabular statistics. However, there were differences depending on the type of map. While graduated symbol maps were associated with the lowest levels of fear of robbery, theft or assault; density maps produced different reactions depending on the area of the city. Finally, the maps did not stigmatize high crime areas of Redlands. Where statistically significant differences existed, respondents who were given maps were more likely to recommend someone move into an area than those who were given tabular statistics.  相似文献

This study examines the effects of perceptions of social disorganization on crime perpetration and victimization among a sample of incarcerated adult gang and non-gang members. Using survey data from 2,414 jail inmates, results suggest that gang members are significantly more likely than non-gang members to be both perpetrators and victims of property and personal crimes. Results also indicate substantive similarities and differences between gang members and non-gang members with regard to crime, victimization, and perceptions of social disorganization. Inmates’ perceptions of the level of social disorganization in their neighborhoods are more strongly related to their reported offending behavior than to their reported victimization.  相似文献

Importation and deprivation theories have long been used to explain prison misconduct and victimization among male inmates. However, the key variables from these theories have rarely been tested on female inmates. In addition, many of these existing studies use combined samples of males and females, while ignoring female-only samples of prisoners. Using data from official misconduct reports collected from 2007 to 2012 from a large women’s prison in Ohio, the current study sought to compare the characteristics of perpetrators of inmate-on-inmate misconduct to their victims. Findings reveal that variables from both importation (age, race, and current violent offender status) and deprivation (mental health status and prior violent disciplinary reports) theories were significant in predicting perpetrator vs. victim likelihood. Policy implications and suggestions for future research are discussed.  相似文献

Despite extensive financial losses and other indicators of harm, the American public and legal professionals have historically been ambivalent toward white-collar crime. Recent research demonstrates that public perceptions of white-collar crime and attitudes toward the punishment of white-collar offenders have become more punitive. Along these lines, a neglected area of research concerns those individuals who routinely face white-collar crimes: fraud investigators. Using data collected during the height of recent corporate scandals (2001–02), this study examines the perceptions of 663 fraud investigators and extends prior research by considering the influence of investigator characteristics, organizational context (i.e., size, setting, internal controls, and resource capacity), case characteristics (i.e., offense type, financial loss, and sanction), and offender characteristics on legal professionals’ general and specific punishment perceptions. Results indicate that organizational resources increase the likelihood of both outcomes. Additionally, the correlates of general and specific punishment perceptions are found to differ: government agency context influences general but not specific perceptions. Comparatively, the perception that fraud is increasing and a sanction that includes incarceration each have a significant, positive influence on specific punishment perceptions. Implications of these findings for future research and policy are discussed.

In this contribution, we investigate whether prison sentences for environmental crime are indeed used in practice, how they are used and whether they imply a real threat to violators. To this end we examine previous studies on the role of imprisonment and confront these models with some empirical data. The empirical application summarizes evidence from several countries, but focuses on detailed data for criminal prosecution of environmental legislation in Flanders (Belgium) between 2003 and 2007. Thus we are able to highlight some interesting policy issues and directions for future research.  相似文献

This research takes an interest in the police's capacity to learn and adapt in an ongoing policy failure. Using the literature on organizational learning and adaptation, it investigates how the police combine exploration of new possibilities and exploitation of old certainties. This article delves into the Swedish police's adaptation to a wave of organized and aggravated robberies that in the years around 2005 seemed out of control. It argues that the Swedish police need to create organizational ambidexterity by implementing a mix of exploitation and exploration, as well as engaging societal actors external to the police when old practices run dry. This means that the law and order sector needs to refine their competences, utilize new ideas, and promote innovation from companies and other authorities for dealing with the tasks at hand. Furthermore, the organizational theory tool-box has proven that it has great potential for diagnosing current learning and adaptation efforts within the law and order sector, as they happen.  相似文献

With the twentieth century now ended the Holocaust is surelya leading contender for the title of ``The Crime of the Century.'Although a massive literature exists on the Holocaust, very littleof this literature has been produced by criminologists. Somereasons for this relative neglect are identified and a case ismade for the claim that criminology can contribute to anunderstanding of the Holocaust and that the Holocaust cancontribute to the development of a more profound criminology. Thispaper draws upon an integrative criminological approach toconstruct a framework for understanding the Holocaust. This multi-disciplinary framework links philosophical, sociolegal,sociological, behavioral and criminological dimensions todiscriminate between unique and non-unique aspects of the Holocaustas a case of genocide and as crime. Popular cultures in Western societies have long espoused the notion that phases of the moon influence human behavior. In particular, there is a common belief the full moon increases incidents of aberrant, deviant, and criminal behavior. Using police, astronomical, and weather data from a major southwestern American city, this study assessed whether lunar cycles related with rates of reported crime. The findings fail to support popular lore, which has suggested that lunar phase influenced the volume of crime reported to the police. Future research directions examining qualitative rather than quantitative aspects of this problem may yield further inform the understanding of whether lunar cycles appreciably influence demands for policing services.  相似文献

This article analysed the relationship between crime categories and unemployment rates using a set of panel data for 14 states in Malaysia with data spanning from 1982 to 2008. It is well documented that crime and unemployment are negatively related in Malaysia; the same is the case for both violent and property crime. Increases in unemployment rates cause the consumption expenditure to decrease, especially among households, hence, causing potential earnings from illegitimate activities to drop and discouraging a person from committing a crime. However, the significant properties of the t-statistics indicate that it is important to consider the labour market conditions in employing appropriate policies in fighting crime. That being said, unemployment can indirectly explain hunger, poverty, decreasing standards of life and economic downturn.  相似文献

State crime scholars and radical criminologists have struggled to draw distinctions between state-initiated and statefacilitated state crimes and state-corporate crimes. The first of these, a less contentious concept, denotes an explicit and distinct action by a state for the furtherance of its organizational goals which violates law or produces social injury. State-facilitated and state-corporate crimes have been defined as implicit actions or inactions by the state which facilitate social injury, harm, or violations of law. Here we seek to establish more clearly the parameters of the phenomenon of state crime by creating a multidimensional continuum of state crime complicity. A sample of cases found in the radical-state and state-corporate crime literature are placed on or between the two extremes of the continuum: commission-omission behavior and implicit-explicit policy.  相似文献
