‘Letters aren’t good’: the operation of the right to request flexible working post-maternity leave in UK small and medium-sized companies

This article contributes to existing literature on flexible working at an organisational level by presenting the results of a qualitative study of women employees and managers in small firms who have been involved in negotiating part-time hours on return to work post-maternity leave. The study finds that the right to request flexible working has become embedded in the policies of small firms and that the overwhelming experience of women employees was positive: their requests were accepted because they were perceived as valuable and consequently their managers wanted to retain them. However employees who lacked ongoing managerial support had a less positive experience. The study also examines other aspects of the operation of the right to request such as the efficacy of written policies on flexible working and the extent to which the negotiation process was formalised.     

Accumulating meaning,purpose and opportunities to change ‘drip by drip’: the impact of being a listener in prison

Established in 1991, the Listener scheme, regulated by the Samaritans, is currently the best-established peer support scheme in place to help reduce suicide in prisons. Each prison Listener team is comprised of a group of inmate volunteers who provide face-to-face emotional support to their peers. Although the scheme has been in operation for over 20 years, empirical research on the scheme is limited. A deeper understanding of how being a Listener affects prisoners' attitudes, beliefs, emotions and experiences of imprisonment is needed. The present study is a qualitative analysis on the experience of being a Listener and the impact it has on individuals and their prison experience. Interviews were analysed using interpretative phenomenological analysis. The analysis revealed two main superordinate themes: ‘Listening and Personal Transformation’ and ‘Countering Negative Prison Emotions’. These themes are unpacked and the analysis focuses on their implications for desistance and offender reform. Results suggest that prisoners who adopt Listener roles experience profound internal changes, shifts in self-identity and gain meaning and purpose from prison. Implications for how such schemes may be utilised in the future and suggestions for further research are offered.     

Don’t let them kill you on some dirty roadway: survival,entitled violence,and the culture of modern American policing

The police subculture serves as a means for police officers to cope with the perceived stresses associated with police work, including the belief that their lives are constantly threatened by dangerous ‘others’. As a result, the police subculture is peppered with racialized survivability discourse that reminds police of the possibility of their own mortality, mobilizes them through fear, and facilitates an entitlement to violence in the name of guardianship. Drawing from the author’s past experiences as a police officer, this paper offers insight into how, through this racialized police survivability discourse, police officers come to believe that their lives are more valuable than others, particularly when compared to Black lives. This has not only been demonstrated by the disproportionate killing of unarmed Black men but also by the emergence of the Blue Lives Matter ‘movement’ that arose in direct oppositional response to the subculture’s perceived threat of the Black Lives Matter movement.     

Excellence in Psychological Injury and Law: Book Review of Motor Vehicle Collisions by Duckworth, Iezzi, and O’Donohue (2008)

In several ways, the book on motor vehicle collisions by Duckworth, Iezzi, and O’Donohue (2008) breaks new ground and should be considered a must-read for workers in the area of psychological injury and law. The editors have assembled a team of expert authors who have cogently analyzed the scientific evidence in the area of motor vehicle collisions and their aftermath, while calling for more research. The book is replete with information that will help practitioners understand and deal with cases involving conditions such as chronic pain, posttraumatic stress, and traumatic brain injury. Practitioners will learn about complications in such cases, including threats to validity and legal aspects. The inclusion of chapters from a medical perspective is a welcome innovation. The book is only lacking in that, although assessment is considered throughout, chapters specifically addressing this topic are not included. The book review concludes that the Motor vehicle collisions book by Duckworth et al. should be included as part of the growing list of excellent resources in the area of psychological injury and law.     

Domestic Violence against Women in Cambodia: Husband’s Control,Frequency of Spousal Discussion,and Domestic Violence Reported by Cambodian Women

This study sought to examine the effects of husband’s control and frequency of spousal discussion on domestic violence against Cambodian married women, using the 2005 Cambodia Demographic and Health Survey data. The sample included 1,707 married women, aged 16–49 (M = 35.14). Structural Equation Modeling showed that husband’s control positively predicted both emotional and physical violence. Frequency of spousal discussion positively predicted emotional violence, an association consistent with the idea that a husband holding patriarchal beliefs would interpret women’s more frequent discussion as a violation of Cambodian norms for quiet, submissive wives. Frequency of spousal discussion and husband’s control were positively correlated. The role of gender issues in husband’s control and frequency of spousal discussion are discussed with respect to violence in the lives of Cambodian women.

Yesterday's war; tomorrow's technology: peer commentary on ‘Ethical,legal, social and policy issues in the use of genomic technologies by the US military’

A recent article by Maxwell J. Mehlman and Tracy Yeheng Li, in the Journal of Law and the Biosciences, sought to examine the ethical, legal, social, and policy issues associated with the use of genetic screening and germ-line therapies (‘genomic technologies’) by the US Military. In this commentary, we will elaborate several related matters: the relationship between genetic and non-genetic screening methods, the history of selection processes and force strength, and the consequences and ethics of, as Mehlman and Li suggest, engineering enhanced soldiers. We contend, first, that the strengths of genomic testing as a method of determining enrollment in the armed forces has limited appeal, given the state of current selection methods in the US armed forces. Second, that the vagaries of genetic selection, much like other forms of selection that do not bear causally or reliably on soldier performance (such as race, gender, and sexuality), pose a systematic threat to force strength by limiting the (valuable) diversity of combat units. Third, that the idea of enhancing warfighters through germ-line interventions poses serious ethical issues in terms of the control and ownership of ‘enhancements’ when members separate from service.

Building ‘healthy happy family units’: Aileen Fitzpatrick and reuniting children separated by the Greek Civil War with their families in Australia, 1949–1954

Abstract

This article explores the efforts by Aileen Fitzpatrick, the Australian social worker, who repatriated child refugees from Greece at the height of the Greek Civil War, to reconstruct ‘healthy, happy family units’. I explore several themes. First, Fitzpatrick’s argument for the unification of families echoed the view that the family unit represented democracy and freedom in the post-war period. Second, an appeal to reuniting family became a successful strategy for crossing cold war lines when dealing with several governments. Third, for Fitzpatrick child saving from war and reuniting families was perceived to be essential to democracy, humanitarianism and internationalism. Finally, by taking a biographical approach, the details of the experience of family emerge in new ways. A focus on Fitzpatrick’s strategies suggests family rhetoric could be used to both promote and yet also cross cold war lines. More broadly, this article seeks to embed the history of the family within the general history of the post-war period as a way of highlighting how the ideal of the family was mobilised in rhetoric on freedom, democracy and the future and which in practice revealed the severe challenges facing families after the war.     

Just When You Thought You Understood New Jersey Allocation Law: Implications,Limitations, and Complications in Applying Farmers Mutual Fire Ins. Co. of Salem v. New Jersey Property-Liability Ins. Guar. Ass’n

The New Jersey Supreme Court's recent decision in Farmers Mutual Fire Insurance Company of Salem v. New Jersey Property-Liability Insurance Guaranty Association holding that a 2004 statutory amendment requires all solvent triggered liability policies be exhausted before the Guaranty Association pays statutory benefits for an insolvent's share has created many uncertainties in allocating long-tail liabilities. This article discusses the implications and the significant limitations of the Farmers Mutual decision and the questions it leaves unanswered, and responds to arguments that the decision supports revisiting other situations where New Jersey's Owens-Illinois methodology allocates losses to the insured.
