U.S. professional sports teams are increasingly relying on sophisticated forms of data analysis to identify potential areas of competitive advantage over their league rivals. Indeed, emerging evidence suggests that the most sophisticated teams in this area are using the insights that they derive from data analytics to establish durable and significant gains over their competition on the playing field. At the same time, sports franchises frequently utilize noncompete agreements to protect the resulting, proprietary information that their data analysis yields. Unfortunately, recent academic research suggests that this reliance on covenants not to compete can decrease the rate of knowledge diffusion within an industry, making it more difficult for teams to catch up to early adopters of data analytics. Thus, teams’ growing reliance on data analytics—and their use of noncompete agreements to protect their resulting findings—could have significant, but heretofore unrecognized, ramifications for league efforts to maintain an adequate level of competitive balance amongst their franchises. This article explores this state of affairs, as well as the implications it presents for the governance of U.S. professional sports leagues.  相似文献

In this article, we review the recommendations on corrections made by the U.S. President's Commission on Law Enforcement and Administration of Justice under President Johnson in 1967 and compare these with the changes made in U.S. corrections over the past 50 years. Shortly after the Commission completed its report, dramatic changes occurred that impacted correctional policy and practice as support for law and order and correctional control moved corrections far from the Commission's recommendations for rehabilitation. The results of this research demonstrate that these approaches have not solved the nation's crime problems and have imposed hardships on individuals and communities. A current focus on evidence‐based corrections may provide a model for future decision making depending on whether the “times are ripe” for a return to a philosophy of rehabilitation. Any new commission will benefit from the research evidence that points to successful correctional interventions. Yet, there is much that still needs to be studied and learned. A new commission must be aware of and respond to the broader social conditions and beliefs and opinions of policy makers and the public that will influence receptivity to correctional reform. Recommendations should include clear guidelines for how research findings could be used to answer the still unanswered questions about rehabilitation interventions, as well as for how to ensure quality program delivery and public safety.  相似文献

This article provides an overview of federal litigation involving the largest 2,000 U. S. corporations over the period 1971–91. Reporting from a unique data set of the authors'construction, it finds that althugh the aggregate volume of business litigation grew during the 1970s and early 1980s, it has actually been declining in recent years in all major categories of cases; business-related litigation is heavily concentrated, with an extremely limited number of business "mega-litigants" accounting for most of the activity; this concentration is particularly evident in tort, with the result that the tort trend line outside the concentration is actually flat or declining; a good deal of the growth in litigation outside the tort area can be attributed to business itself; and big business wins overwhelmingly, as plaintiff and defendant, in cases that involve it. The general applicability of these findings is limited by the data's restriction to federal court litigation and the structure of the Integrated Federal Court Data Base from which the authors'data set was constructed. This granted, the report is by far the most comprehensive treatment of U. S. big business litigation to date, and its findings are strikingly at odds with the premises of much current policy discussion.  相似文献

Building on strategic models and the collegial nature of the U.S. courts of appeals, this article assesses the influence of a circuits' composition on individual judges' behaviors and the president's role in shaping the courts. As partisanship is one of the few signals of a nominee's ideology known to an executive administration at the time of appointment, it is important to measure partisan composition as a factor in individual behavior as well as other measures of overall ideology of the circuit. This article finds that the composition of the circuits influences individual behavior, even after controlling for individual ideology, panel effects, and other contextual factors. This remains true whether we examine composition based on partisanship or on more nuanced ideological measures. Noting that presidents, on average, create new partisan majorities within two circuits per four‐year term, these findings suggest turnover on circuit courts may have influences on case outcomes outside of a particular new appointee's voting record.  相似文献

This is a preliminary investigation of hawkish public opinion, understood as criminogenic in that it provides political support for state crimes of aggressive militarism. Our critical criminology approach treats public support for, or acceptance of, state aggression as part of criminogenic political culture. Despite growing interest among critical criminologists in broader perspectives on state crime and the politics of culture, there has been no work on this topic. Our survey of 53 criminal justice students at a liberal arts college finds both hawkish (militarist) and dovish (peaceful) beliefs and preferences regarding U.S. policy and the two major 2008 presidential candidates, Obama and McCain. We investigate whether authoritarianism helps explain hawkish opinions, but find little evidence for that expectation. We find evidence of respondent underestimation of the hawkishness of U.S. politics. We also find extensive evidence of dovish policy preferences, such as approval of diplomacy, a major attraction to Obama.  相似文献

Research consistently finds that if authorities use procedural justice in encounters with the public then this will promote citizen cooperation and compliance with the law. Recently, the importance of people's emotional reactions in response to procedural justice and injustice, and the subsequent effect this has on behaviour have been examined. This paper utilises a multi-method approach to examine the mediating role that negative affect plays in the effect of procedural justice policing on citizen compliance behaviour. Study 1 utilises both cross-sectional and longitudinal field survey data collected from Australian citizens who have had a recent contact with a police officer. Study 2 utilises an experimental vignette study designed to assess the causal mechanisms involved in the procedural justice–emotion–compliance relationship. Both studies find that procedural justice is linked to people's self-reported propensity to comply with police. Study 1 and 2 also find that negative affect mediates this relationship. These findings have important implications for training police to interact with the public in a manner that reduces negative emotions and ensures the highest level of compliance from the public.  相似文献

This article compares the impact of asbestos liabilities in the U.S. with that in the U.K. The maximum exposure to asbestos in the U.S. occurred during the time period from the 1930s to the 1960s. In the U.K., the peak asbestos exposure likely occurred during the 1960s and the 1970s. Asbestos-related deaths are projected to have peaked before 1997 in the U.S. Asbestos-related deaths in the U.K. are projected to peak sometime before 2020—some 20 years after those in the U.S. In the U.S., asbestos-related claims are believed to have peaked around 2002. Given the anticipated peak in asbestos-related disease deaths in the U.K., the peak in asbestos-related claims in the U.K. will likely occur sometime after 2020. There are differences in judicial systems and victim compensation schemes (private and public) between the U.S. andthe U.K. However, trends in recent U.K. court decisions and regulatory activities (as well as increases in victim awareness, litigation, on-going discovery, victim support groups, and claim compensation) suggest that the U.K.'s current asbestos liability situation may be analogous to what the U.S. experienced in the mid-1980s, and that the impact on the U.K. courts and economy may be far from over.  相似文献

With the increasing dispersion of intellectual property comes the intellectual property rights owner's continued desire to retain that part of the equation for which the bargain was struck. In terms of patents, the patentee strikes a deal to disclose the invention to the public in exchange for a monopoly over its use for a limited term. Copyright holders contribute their works to the intellectual pool receiving value by sale, lease or license. In 2012–13, the U.S. Supreme Court was tasked with delineating the realms of two intellectual property exhaustion doctrines and answering the question of where to draw the line with regard to an IP owner's ability to control the protected invention or work via patent or copyright, respectively. In one case, the Court permitted the intellectual property owner to restrict a subsequent purchaser's use of the product subject to protection, while in the other case the Court rejected the intellectual property owner's attempt to control the downstream use or resale of the product. This article discusses the relevant intellectual property exhaustion doctrines, analyzes and reconciles the Court's decisions in these cases, and provides guidance for navigating restrictions on use of U.S. protected products and works around the globe.  相似文献

The issue of racial and ethnic bias in policing has been the focus of legal and criminal justice scholarship, court action, and public debate in the U.S. for a number of years. The issue has also been prominent in criminal justice scholarship, public discussion, and policy making in other countries, particularly the U.K., for an even longer period. This article surveys the history of the issue in the U.S. and attempts to give scholars and policy makers the benefit of the insights gained through the U.S. experience in handling the issue. Among these are the importance of the empirical question of the “hit rate” and how police use of race or ethnicity as a criterion changes it, and the difficulties of dealing with the thorny benchmarking issue. The article also discusses how advocates in the U.S. have attempted to meet and overcome arguments that police and their supporters have made in an attempt to minimize the problem or justify doing little or nothing about it.  相似文献

Scholars often argue that whereas unanimous rulings should boost public support for court decisions, dissents should fuel public opposition. Previous studies on public responses to U.S. Supreme Court decisions suggest that unanimity does in fact bolster support. However, a recent study has also found that dissents may increase support among opponents of a court decision by suggesting evidence of procedural justice. By examining how individuals react to dissents from the Supreme Court of Norway, this article is the first study outside the U.S. context of the public's reaction to unanimity and dissent. Breaking with the common notion of the negative effects of dissent on public support, the article shows that when the Supreme Court handles cases of higher political salience, the formulation of dissenting opinions can be a meaningful way of securing greater support for its policy outputs by suggesting evidence of procedural justice. Contrary to recent studies, however, this positive influence of dissent is irrespective of individuals' ex ante policy views.  相似文献

This qualitative study examined U.S. legal cases where battered mothers living abroad fled with their children to the United States. These women subsequently faced child abduction lawsuits brought by their batterer. The cases are governed by the Convention on Civil Aspects of International Child Abduction (the Hague Convention) which was ratified by the U.S. in 1988. Using content analysis, the study analyzed 47 published U.S. state and federal judicial opinions involving the Convention and allegations of domestic violence. It finds that U.S. courts are reluctant to employ Convention provisions that could prevent children from being returned to their mother's batterer.  相似文献

Scholars of mass incarceration point to the 1970s as a pivotal turning point in U.S. penal history, marked by a shift toward more punitive policies and a consensus that “nothing works” in rehabilitating inmates. However, while there has been extensive research on changes in policy makers' rhetoric, sentencing policy, and incarceration rates, scholars know very little about changes in the actual practices of punishment and prisoner rehabilitation. Using nationally representative data for U.S. state prisons, this article demonstrates that there were no major changes in investments in specialized facilities, funding for inmate services–related staff, or program participation rates throughout the late 1970s and the 1980s. Not until the 1990s, more than a decade after the start of the punitive era, did patterns of inmate services change, as investments in programming switched from academic to reentry‐related programs. These findings suggest that there is a large gap between rhetoric and reality in the case of inmate services and that since the 1990s, inmate “rehabilitation” has increasingly become equated with reentry‐related life skills programs.  相似文献

In the demand of regulatory policy to control salvage of shipwrecks and protect the nation's underwater cultural heritage, the Abandoned Shipwreck Act of 1987 allowed the exception of the admiralty law to give states authority and management of abandoned shipwrecks for the purposes of preservation and recreation. Due to the lack of its regulatory power and vague standards, the Act has been harshly criticized for being ineffectual in resolving conflicts between commercial salvors, and states or protecting illicit salvage. This research will examine the purpose and impact of the policy under the framework of the National Historic Preservation Act, which restrained options in the policymaking. While acknowledging its limitations, this research finds that the Act enabled the inclusion of historic shipwrecks in the nation's preservation system, allowed funding, and promoted its use for public benefits. Studying the Act in the policy context of the U.S. historic preservation can promote the rightful understanding of its policy limitations as well as impact, and support feasible policy improvement.  相似文献

This article extends critical scholarship on the problem of hate crimes in the U.S. into the field of cultural criminology. Highlighting the role cultural production plays in reinforcing identity-based social harms, this study analyzes the cultural construction of the figure of the white hate crimes perpetrator, or “the hater.” The article integrates findings from a comprehensive discourse analysis of major U.S. news sources from 1986 to 2010 with insights from the fields of whiteness studies and critical criminology. The study first finds that the figure of the hater embodies modern day bigotry through terse stereotypes about white poverty, masculinity, hate group membership, and criminality. It then argues that these widely distributed discursive performances create rhetorical opportunities to define bigotry as an individualized problem with law enforcement remedies and to further normalize extreme hate crimes cases. Ultimately, a new theoretical construct, “post-difference ideology,” is mobilized to challenge the hater’s prescribed role as folk devil.  相似文献

The manner in which political institutions convey their policy outcomes can have important implications for how the public views institutions' policy decisions. This paper explores whether the way in which the U.S. Supreme Court communicates its policy decrees affects how favorably members of the public assess its decisions. Specifically, we investigate whether attributing a decision to the nation's High Court or to an individual justice influences the public's agreement with the Court's rulings. Using an experimental design, we find that when a Supreme Court outcome is ascribed to the institution as a whole, rather than to a particular justice, people are more apt to agree with the policy decision. We also find that identifying the gender of the opinion author affects public agreement under certain conditions. Our findings have important implications for how public support for institutional policymaking operates, as well as the dynamics of how the Supreme Court manages to accumulate and maintain public goodwill.  相似文献

A substantial body of research shows that people's legal attitudes can have wide‐ranging behavioral consequences. In this article, I use original survey data to examine long‐term immigrant detainees’ legal attitudes. I find that the majority of detainees express a felt obligation to obey the law, and do so at a significantly higher rate than other U.S. sample populations. I also find that the detainees’ perceived obligation to obey U.S. immigration authorities is significantly related to their evaluations of procedural justice, as measured by their assessments of fair treatment while in detention. This finding remains robust controlling for a variety of instrumental and detainee background factors, including the detainees’ experiences with the legal system and legal authorities in their countries of origin. Finally, I find that vicarious procedural justice evaluations based on detainees’ assessments of how others are treated are as important to detainees’ perceived obligation to obey U.S. immigration authorities as their personal experiences of fair or unfair treatment. I discuss the broader implications of these findings and their contributions to research on procedural justice and legal compliance, and research on legal attitudes of noncitizens.  相似文献

美国针对企业犯罪建立了特殊的审前转处程序,办案检察官可以与涉罪企业签署暂缓起诉协议和不起诉协议,如果企业能够在考察期限内完成协议下的义务,则不会被审判和定罪。在美国经济危机时期,该制度较好地为企业的生存和社会公共利益的维护提供了保障。该制度以美国司法部内部的政策性文件为依据,赋予了办案检察官较大的自由裁量权,法院基本无权干预。美国理论界的争论主要围绕三对冲突关系:社会公共利益维护与企业“大到不用判刑”特权的冲突、检察官的转处裁量权与程序正义的冲突、司法部内部行为与立法/司法管辖权的冲突。在我国面临企业犯罪处理困境的当下,该制度及其相关理论能够为我国“司法行政部门帮扶企业”政策的践行提供经验借鉴。  相似文献

It is well established that children's exposure to television advertising for unhealthy food products contributes to the epidemic of childhood obesity. Given this finding, public health officials recommended that the government restrict unhealthy food marketing to children if the industry does not accomplish that goal voluntarily. Food marketers responded by adopting industry self-regulation several years ago, but this study finds that it has produced only marginal improvements in the overall nutritional quality of foods advertised to youth. Unless federal policy-makers intervene, it appears that unhealthy food marketing to children will continue to contribute to childhood obesity in the future.  相似文献

The federal sentencing guidelines prescribe ranges of sentences to be given to persons convicted of felonies in the federal criminal courts. The U.S. Sentencing Commission wrote the guidelines attempting to make sentences conform to community views of appropriate punishments, along with several other criteria. Employing data from a 1994 national sample of adult Americans, designed as a factorial survey, the degree of correspondence is shown between guidelines sentences and those desired by the American public. Although at the individual level only a modest degree of concordance was found, the central tendencies of public opinion (median sentences) were found to correspond quite closely to the guidelines sentences. The major points of disagreement centered around drug trafficking crimes: the guidelines prescribed very long sentences for those crimes and distinguished sharply among trafficking in heroin, powder cocaine, and crack, whereas median sentences desired by the public were much lower and did not distinguish sharply among trafficking in those drugs. We interpret the findings as indicating that the guidelines sentences conform reasonably closely to American normative consensus concerning the sentencing of federal felons.The research reported in this article was commissioned by the U.S. Sentencing Commission. In this article we examine the rate at which patent applications are granted as a function of the inventor's race and gender. Empirical analysis of more than 3.9 million U.S. applications finds minority and women applicants are significantly less likely to secure a patent relative to the balance of inventors. Further analysis indicates that a portion of this bias is introduced during prosecution at the Patent Office, independent of the quality of the application. Mechanisms underlying these disparities are explored. The article concludes with a discussion of our results and their interaction with patent law, innovation policy, and employment trends.  相似文献
