卧底侦查的相关法律问题

卧底侦查是侦破有组织犯罪、团伙犯罪等案件的有效手段 ,阻却违法事由的紧急避险是其刑法理论基础。卧底侦查不同于教唆陷害 ,卧底警察具有不完整的教唆故意 ,欠缺可罚性。卧底警察在侦查中的犯罪行为合法化 ,不具有可罚性。卧底警察不应作证 ,其提供的材料不能作为证据。     

卧底警察陷害教唆可罚性探讨

为了破获案件卧底警察实施陷害教唆,包括唆使他人实施未遂的犯罪,唆使既遂但尚未完成的犯罪,唆使犯罪既遂且完成的犯罪.卧底警察实施不同的陷害教唆诱使他人犯罪,由于其行为不符合教唆犯的主客观条件因而不具有可罚性,不能构成刑法上的教唆犯.     

论未遂教唆

未遂教唆不同于教唆未遂。未遂教唆是西方大陆刑法理论中的一个饶有趣味但又令人头疼的问题。本文在评述了西方大陆刑法理论关于未遂教唆的观点之后,论证了未遂教唆的可罚性,探讨了未遂教唆的犯罪形态并分析了未遂教唆与教唆未遂的异同点。     

论“教唆”他人违反注意义务行为的刑事责任

过失犯的本质是违反注意义务,作为一种客观存在的现象,故意"教唆"他人违反注意义务引起过失犯罪的行为,其可罚性已经得到了司法解释的认可;但是在现有的刑法理论框架内,为教唆人找到处罚依据似乎还存在一定的障碍。我国共同犯罪理论强调行为人之间的犯罪意思联络,以共同故意为其成立条件,因此过失共同犯罪这种犯罪类型被拒之门外;如果认为教唆人与被教唆人以各自的行为成立过失犯,单纯的教唆行为是否具有过失犯的实行行为性存在疑问。在立法层面,不管是共同犯罪的规定还是教唆犯的规定,都为处罚"教唆"他人违反注意义务的行为设置了障碍。考察国外的立法规定,应修正我国有关共同犯罪的立法规定,为处罚过失共同犯罪扫清障碍。

解读诱惑侦查
