Executive Environmental Law

The Draft Environment (Principles and Governance) Bill published by DEFRA in late 2018 is part of a process of reimagining environmental law in light of Brexit. The Draft Bill creates frameworks for policy statements on environmental principles and environmental implementation plans, as well as creating a new enforcement body – the Office for Environmental Protection. This Draft Bill is, at the very least, an ineffectual response to the challenges of environmental law post-Brexit. More alarmingly, it raises the possibility of a legal future in which the executive dominates how the norms, ambitions, and accountabilities of environmental law are defined. These are matters of concern for environmental and public lawyers alike.

软法在中国环境法领域大量存在,并且呈现不断发展、增长的态势,它配合着由国家法构成的硬法机制,分别和共同发挥调整环境领域社会关系的功能.本文阐述了软法在中国环境法中的存在形式,以及迅速发展的原因,肯定了软法的存在是为了满足环境之治现实的需要,并且进一步对软法的作用进行了客观评析,提出中国环境法要充分发挥和利用软法的积极作用,抑制其消极作用,就必须通过对环境软法的创制和实施进行规范研究,全面提升环境软法的理性精神,从而全面实现环境法治的目标.     

环境法的概念

环境法在不同国家和不同时期有着不同的称谓,这是人类对环境问题认识水平不断提高的具体反映。不同国家不同学者对环境法的概念虽有着不同的表述,但应将可持续发展与环境法的概念联系起来,为环境法的概念作出更为科学的界定。     

Environmental Impact Assessments in International Law

The purpose of this article is to assess what the current state of play with regard to environmental impact assessments (EIAs) is in international law. This question is posed because of the casual use of the term, and the often fundamental misunderstandings of what EIAs can and cannot do. This paper aims to clarify the current strength of EIAs in the international context, and provide guidance on how they may be applied.     

论环境政策与环境法律的环境保护合力作用

我国的环境保护工作起步于环境政策,在建设法治国家进程中环境政策与环境法律的并存是客观实际的需要。环境政策和环境法律是我国保护环境的两种有效手段,二者有着共同的利益基础,二者并不矛盾,应当协调配合,共同发挥环境保护的合力作用。本文分析了环境政策与环境法律协调发展的理论基础,提出在现阶段环境政策和环境法律应当并存,进而提出正确处理环境政策与环境法律的协调配合关系。     

Law clinics in England and Wales: a regulatory black hole

There has been very limited consideration to date of how the regulatory environment in England and Wales impacts on university law clinics and the solicitors who run them. This paper sets out the current regulatory framework pertaining to university law clinics and explains the restrictions and limitations it poses. It highlights the current failure on the part of the regulators to meet their statutory duty to promote access to justice in relation to university pro bono services and sets out a series of recommendations as to how clinicians and regulators can secure a more certain and enabling future for clinics.     

Cohabitation in Twentieth Century England and Wales: Law and Policy

This article reviews the complex, and sometimes conflicting, policies adopted by the law of England and Wales over the course of the twentieth century. Its aim is to highlight the fact that cohabitation is not merely a modern legal issue, but one with which both the legislature and the courts have had to grapple for decades. It argues that reform has been piecemeal and context-specific because the courts and legislature have not adopted a coherent policy toward cohabiting relationships.

2005年环境资源法学学术研究回顾

一、学术研究概况 本年度环境资源法学界的主要学术活动有:2005年8月5日-9日,全国人大环资委、中国法学会环境资源法学研究会和江西理工大学在江西赣州举办了2005年环境资源法学年会.本次年会有200多人参加,收到论文258篇,主题为水污染防治立法和循环经济立法研究,也包括环境资源法理论与实践其他问题研究.

论环境法上的强制缔约

环境法上的强制缔约重构了“政府——环境服务商——企业”的三元型环境行政管制框架.现行立法例中船舶污染清除协议、可再生能源强制并网收购协议、强制交售报废机动车协议等制度设定与执行需注意法律正当性问题.强制缔约制度移植的重心不在于“强制”,而在于将“缔约”或“合同”作为一种私法工具,以“自治”达到“管制”的目标.建议以倡导性规范或选择性规范将“环保商事合同”嵌入到《环境保护法》中,对相关条款进行修改;强制缔约可作为环境污染第三方治理的实施机制.
