While sex offender registration laws with notification provisions are now over a decade old, little is known about how these policies influence the prevention of sex offending. Very few studies have considered the impact of notification on sex offender recidivism or the effect of these laws on sex crimes, generally. This study considers the effectiveness of offender tracking and declaration at the state level through evaluation of current sex offender laws in Arkansas. Using a quasi‐experimental regression‐discontinuity design, this research evaluated the recidivism of the first three waves of sex offenders registered in the state (1997–1999) vs. a comparison group of sex offenders from a decade earlier (1987–1989). Findings indicate there is no statistically significant difference between the two groups in terms of recidivism. Policy implications are discussed.  相似文献

Abstract

Since the early 1990s, many states in the USA have attempted to control sexual offending and, more narrowly, sexual recidivism by implementing longer prison sentences for sex crimes, sex offender registration and notification, residency restrictions, involuntary civil commitment and lifetime probation and parole. The early 1990s also marked the beginning of a decline in official rates of sexual offending, including sexual recidivism. This study reviews recent research conducted on Minnesota sex offenders in an effort to identify which policies, programmes and practices might have contributed to the drop in sexual recidivism rates that have been observed over the last few decades. By assessing what has, and has not, worked with Minnesota sex offenders, this study discusses how lessons learned from the Minnesota experience may apply to broader efforts within the USA and abroad to control sexual offending.  相似文献

Sex offender recidivism risk is a multifaceted phenomenon requiring consideration across multiple risk factor domains. The impact of treatment involvement and subsequent recidivism is given limited attention in comparison to other forensic mental health issues. The present analysis is a retrospective study of sex offenders treated at a secure facility utilizing a cognitive-behavioral program matched with an untreated correctional sample. Variables studied included demographic, criminal history, offense related, and treatment progress. Recidivism was assessed through arrest data. Multivariate analysis suggests that recidivism is significantly related to quality of treatment involvement, offender demographics, offense characteristics, and criminal history. Successfully treated offenders were significantly less likely to subsequently reoffend. Recidivists were also significantly younger, less likely married, had engaged in more victim grooming or less violent offending behavior, and had significantly more prior property charges. The authors discuss the clinical and policy implications of the interrelationship between treatment involvement and recidivism.  相似文献

ABSTRACT

As criminal justice professionals are asked to assign risk levels and treat females who sexually offend, identifying risk factors for recidivism prediction and treatment targets is important. Although the majority of risk and treatment studies have focused on males, general female offender research and developing research with female sex offenders both provide some evidence for possible factors related to sexual offending behaviour in women. The purpose of this study was to explore what possible factors were related to treatment selection in a sample of 506 females serving prison sentences for a sexual offense, and, in turn, to examine which factors predicted non-sexual and sexual recidivism. Results demonstrated that exploratory variables were significantly related to treatment selection, as opposed to variables previously supported in research. Furthermore, living with a significant other for more than two years, and prior sexual offending arrests predicted sexual recidivism, while decreased age and treatment participation predicted non-sexual recidivism. These findings indicate that while similarities between male and female sexual offenders exist, females still demonstrate gender-specific risk factors.  相似文献

International literature on prison effects on recidivism tends to find little evidence of specific deterrence. If anything, imprisonment seems more likely to increase than decrease rates of offending. The present study adds to this literature by examining imprisonment and recidivism in Finland, a nation characterized by an exceptionally moderate penal culture. It has been suggested that severe sanctions need to be imposed selectively in order for them to be effective. In this research, we estimated the impact of first imprisonment on recidivism in comparison with offenders sentenced to either suspended imprisonment or community service. Using data from government population registries, we controlled for a large number of legal and extra-legal confounding factors, including criminal history and socio-demographic characteristics. We found no evidence of reduced recidivism as a result of imprisonment. Instead, consistent with prior research, we find evidence of increased recidivism in certain offender categories. We conclude with a discussion of policy implications.  相似文献

The present investigation examined the predictive accuracy of the Youth Level of Service/Case Management Inventory (YLS/CMI) for youth and adult recidivism in a Canadian sample of 167 youths (93 males, 74 females) charged with serious offenses who received psychological services from a community mental health outpatient clinic. Youths were followed for an average of 7 years in the community, and predictive accuracy was examined for several recidivism outcomes as a function of gender, ethnicity, and developmental age group. YLS/CMI total scores significantly predicted all recidivism categories in the overall sample (area under the curve values ranged from 0.66 to 0.77) although the instrument as a whole, and its criminogenic needs, demonstrated somewhat stronger and more consistent predictive accuracy for youth outcomes. The YLS/CMI also demonstrated significant predictive accuracy within demographic subgroups. The implications of these findings are discussed in terms of the use of risk-need assessment tools in providing clinical assessment, treatment, and case management services to diverse young offender groups. Previous criminological studies comparing institutional youth populations with community samples have for the most part focused on youths institutionalized primarily as a result of involvements in delinquency. The present study compares levels of social disadvantage and criminal involvement within a nationally representative sample of Swedish schoolboys with those of a national population of institutionalized males that includes both serious young offenders and youths institutionalized for other reasons. Whilst at the aggregate level, mean levels of offending are higher within the institutional sample, the institutional population includes youths from across the entire range of levels of offending. Levels of social disadvantage are substantially elevated among the institutionalized males by comparison with the school sample. The study notes that institutionalized samples, where these include both young offenders and youths institutionalized for other reasons, may provide a fruitful ground for life‐course research into the way involvements in crime interact with other indicators of social disadvantage to affect the likelihood of continued marginalization into adulthood.  相似文献

The following paper is a reconviction study of 183 sex offenders treated by the Thames Valley Project between 1995 and 1999. Some demographic details are provided about the sample. Subjects were monitored for a mean of 3.9 years. A total of 10 subjects (5.4% of total) were reconvicted for a further sexual offence. A further 19 men (10.3%) either had allegations made against them or committed a behaviour that may have involved or been the preparation for further sexual offending, defined here as “recidivism”. Details about post-treatment behaviour were drawn from three sources: two national police databases which indicated any formal sexual reconviction and the files kept on each sex offender registered with Thames Valley Project (TVSOGP), a multi-funded community-based sex offender treatment programme. The pre-treatment re-conviction risk status of each man was calculated using part one of the Risk Matrix 2000 algorithm (static factors). Risk levels were compared for those where reconviction, re-offending or recidivism was identified and those where it was not and a correlation was found in the predicted direction although this was not statistically significant. The advantages and limitations of this kind of follow-up study are discussed, together with some recommendations for future research.  相似文献

Linking emotions to offender decision-making has only recently become of theoretical interest to criminologists, but empirical work in this area has not kept pace nor has such research examined the role of emotions to offending in offender-based samples. Recently, Warr outlined regret as one such emotion that may be useful in thinking about offending. Specifically, he argued that regret may be related to discontinuity in offending, or conversely that a lack of remorse may be related to continuity in offending. This paper uses data from a sample of serious adolescent offenders followed for seven years to investigate this hypothesis. Results provide support for Warr’s hypothesis that remorse-resistant adolescents incur a higher number of re-arrests, while remorse-prone adolescents incur fewer re-arrests, even after controlling for other relevant risk factors.  相似文献

A very small number of studies has observed that persons who perceive an early age-at-death report a higher risk of offending. This literature, however, is limited by the use of general population samples, cross-sectional data, and the failure to consider both the determinants of perceived age-at-death, as well as some of the mediating processes associated with the relationship between perceived age-at-death and offending. Using data for a large sample of serious youthful offenders from two urban cities and who were followed for seven years, the current study attends to these concerns. Results show that gender, race/ethnicity, and adverse neighborhood conditions influence the perceived age-at-death; this perception distinguishes between distinct trajectories of offending, and such perceptions also influence both perceived risks and perceived rewards as well as one’s impulse control.  相似文献

This study assessed whether pre-treatment responsivity (psychopathy, motivation to attend treatment, denial and minimisation of offending behaviour, and feelings of guilt or shame) predicted violent recidivism and/or moderated the effectiveness of a violence intervention programme. Participants were 114 male violent offenders who were referred to a structured violent offender group treatment programme; 84 offenders commenced the programme. Results showed that treatment completion did not have a significant main effect on recidivism but that psychopathy scores moderated the effects of treatment. Offenders with high scores on the Psychopathy Checklist: Screening Version (PCL:SV) who were rated as having good engagement with treatment, or who completed treatment, had similar violent recidivism rates compared to offenders with low PCL:SV scores. In contrast, offenders with high PCL:SV scores who dropped out of treatment or were poorly engaged had significantly higher rates of violent recidivism. These findings indicate that treatment effectiveness could be enhanced, and greater reductions in recidivism achieved, if programmes find ways to engage and maintain psychopathic offenders in treatment.  相似文献

This study examined the relationship between psychometric test scores, psychometric test profiles, and sexual and/or violent reconviction. A sample of 3,402 convicted sexual offenders who attended a probation service-run sexual offender treatment programme in the community completed a battery of psychometric tests pre- and posttreatment. Using Cox regression, posttreatment scores on measures of self-esteem, an ability to relate to fictional characters, and recognition of risk factors were, individually, predictive of recidivism. When psychometric tests were grouped into dynamic risk domains, only the pretreatment scores of the domain labelled socioaffective functioning (SAF) predicted recidivism and added predictive power to a static risk assessment. The number of risk domains that were dysfunctional pretreatment also predicted recidivism outcome; however, this did not add predictive power to a static risk assessment tool. Possible explanations for the superiority of pre- over posttreatment scores in predicting reconviction are discussed, and directions for further research considered.  相似文献

Abstract

Most studies that have explored the impact of youth sexual offender treatment on recidivism have not assessed whether effectiveness varies for important subgroups. The present study evaluated the impact of treatment provided by the Griffith Youth Forensic Service (GYFS) on 104 adjudicated youth sexual offenders referred between 2006 and 2012. Sexual, violent and “other” offending outcomes were examined, based on Australian Indigenous cultural heritage and whether the youth resided in a remote community, over an average 2.5-year follow-up timeframe. The findings indicated that GYFS treatment was equally effective for Indigenous and non-Indigenous youth for preventing sexual recidivism and, for youth residing in remote and non-remote locations, for preventing sexual, violent and “other” recidivism. Treatment was less effective in preventing violent and “other” recidivism for Indigenous youth. The core components of the GYFS treatment programme therefore appear particularly well suited for reducing sexual recidivism by Indigenous offenders and those residing in remote communities.  相似文献

Abstract

Whilst the overall effectiveness of offender rehabilitation programmes in reducing recidivism is now well established, there has been less discussion of the reasons why rehabilitation programmes may be unsuccessful for some offenders. In this paper we suggest that models of change developed in counselling and psychotherapy may have utility in explaining how offender rehabilitation programmes bring about change, and argue that the dominance of cognitive–behavioural treatments in the rehabilitation field means that those offenders who have particularly low levels of problem awareness may be at increased risk of treatment failure. Understanding more about the mechanisms by which programmes help offenders to desist from offending is likely to lead to the development of more responsive and, ultimately, more effective programmes. Some suggestions for those involved in the delivery of offender rehabilitation programmes include: being mindful of the sequence of components of programmes, the development of preparation (or readiness) programmes and offering a broad suite of programmes to cater for different stages of problem awareness and assimilation among offenders.  相似文献

Both desistance research and strengths-based approaches to offender rehabilitation suggest that attempts to reduce sex offender recidivism should attend to an offender's release environment. Recent research has demonstrated that better quality release planning is associated with reduced recidivism; however, whether release planning contributes significant incremental validity in predicting recidivism over and above static and dynamic risk factors is unclear. In the present study, release planning was retrospectively assessed for a sample of child molesters (n = 196) who had been released into the community following completion of a prison-based treatment program and its relative contribution to recidivism risk prediction was investigated. The average follow-up period was 11.08 years, during which 13.3% of the sample were convicted of a new sexual offence. Hierarchical Cox regression analyses showed that release planning contributed additional predictive validity for sexual recidivism after controlling for static and dynamic risk factors. Findings suggest that assessment of release planning might improve accuracy of sex offender risk assessments and that improved release planning should contribute to reductions in recidivism.  相似文献

Objectives

An enduring legacy of the 1980s “war on drugs” is the increased use of imprisonment for drug offenders. Advocates anticipated, in part, that prison is more effective than community sanctions in reducing recidivism. Despite the contribution of drug offender incarceration to prison growth nationally, and debates about whether this approach should be curtailed, only limited rigorous research exists that evaluates the effect of imprisonment on drug offender recidivism. To address this gap, this paper uses sentencing and recidivism data from a cohort of individuals convicted of felony drug offenses in Florida to examine the effect of imprisonment—as compared to community sanctions—on recidivism.

Methods

Regression discontinuity analyses are used. These minimize potential selection bias by exogenously assigning cases to conditions based on a rating variable and a cut-off score.

Results

Results indicate that prison has no effect on drug offenders’ rates of reconviction. This finding holds across a range of offender subgroups (racial and ethnic, gender, age, and prior criminal justice system involvement).

Conclusions

Imprisoning individuals convicted of marginally serious drug offenses—that is, those close to a cut-off score for being sent to prison—did not reduce subsequent offending. This finding suggests that curtailing the use of imprisonment for such individuals will not appreciably affect future criminal activity and may have the benefit of reducing correctional system costs.

The present investigation examined the risk, need, and responsivity (RNR) correlates of MMPI-2 scores in a Canadian sample of 349 federally incarcerated sex offenders, followed up prospectively 19 years post-release. In terms of responsivity indicators, more serious profile patterns were associated with younger age, single marital status, lower education, and lower cognitive ability; the scales generally had weak associations with sex offender treatment completion or change. With respect to criminogenic risk and need, Scales F, 4, 6, 8, and 9 and combinations therein had significant associations with structured measures of sex offender risk, and in turn, consistently predicted sexual or violent recidivism over 5 and 10-year follow-ups. Several of these predictive associations were maintained even after controlling for static and dynamic risk factors. Finally, model based clustering of the MMPI-2 scales generated three clusters termed disordered, emotionally distressed, and predominantly antisocial (non-disordered) subtypes. Although comparatively higher rates of violent recidivism were found with the disordered subtype, this group did not have higher levels of risk and need, broadly speaking, than the other subtypes. The RNR implications of the results are discussed in terms of forensic applications of MMPI-2 with sex offender populations.  相似文献

The perceptions and attitudes that policymakers and criminal justice practitioners have about sexual offending and sexual victimization affects how state lawmakers respond to sex crimes, and how practitioners implement sex offender legislation. Policymakers continue to create new sex offender laws and, as such, the number of convicted sex offenders continues to rise. Thus, policymakers and criminal justice practitioners are increasingly important players in the public policy response to sexual criminals. To better understand the motivation, rationale, content, and purpose of statewide sex offender laws, and their role in the day-to-day management of convicted sex offenders, a non-probability sample of policymakers (n?=?61) and criminal justice practitioners (n?=?25) from across the country were interviewed. Results indicated that nearly all respondents from both groups were familiar/very familiar with their state-level sex offender laws. Policymakers and practitioners also mentioned the influential role that specific victimizations play in creating a perceived need for more sex offender legislation. The politicians and the practitioners view the laws as effective public safety mechanisms. Still, both groups noted serious problems with the laws. Furthermore, policymakers had a more negative attitude about the efficacy of sex offender therapy than criminal justice respondents. Suggestions for future research and policy implications are offered.  相似文献

Detaining and incarcerating juvenile delinquents is ineffective and costly juvenile justice policy. These placements, indicative of the “tough on crime” approach, become problematic for many of these youths who do not have the advantage of legal counsel because they waive this right. In addition, a majority of these youths have a mental health or special education disability that does not get addressed in correctional facilities. Alternatives for Youth's Advocacy Program (AFY) in Cleveland, Ohio (Cuyahoga County) is addressing these issues using a holistic approach that includes the provision of civil legal representation to assist youths in accessing disability services and defense attorney support in dispositional planning to reduce juvenile offender placements. This article reports the results of an experimental design pilot study evaluation of AFY that randomly referred and evaluated 82 felony‐offending youths over 21 months. This initial review of the AFY program found it reduced detention center placement days by 47% and decreased state facility incarceration days by 74% (total cost savings $625,898). With 3,000 youths detained in the Cuyahoga County, Ohio, Detention Center and 1,800 incarcerated in Ohio state facilities annually, policy implications and recommendations are set forth.  相似文献
