Wives are Told: Don't Blame the Bank, Sue Your Solicitor: Royal Bank of Scotland v. Etridge (No. 2) and other appeals [1998] 4 All E.R. 705

This case note considers the Court of Appeal decision in Royal Bank of Scotland v. Etridge (No. 2) and other appeals [1998] 4 All E.R. 705. It concerns the familiar scenario of a wife jointly mortgaging (or providing a guarantee for a mortgage of) the family home in order to secure financial support for a business run by her husband. The House of Lords decision in Barclays Bank v O'Brien [1994] A.C. 180 has given rise to a range of litigation in this area, and the spotlight has now moved from the banks to an examination of the quality of advice given by solicitors. The banks have heeded the warnings in O'Brien and now insist that wives are told to obtain independent legal advice. It will be seen that, following Etridge, if the bank tells the solicitor to give the wife legal advice upon undertaking the transaction, that will be sufficient to protect the bank, notwithstanding that the advice was either inadequate or even not actually given. The onus to ensure that proper advice is given is shifted squarely on to the solicitor. The note concludes that the decision is indicative of the shift of judicial opinion against wives seeking to avoid charges over matrimonial homes and in favour of banks. Labor rights are civil rights: inter-racial unionism and the struggle to unionize Nissan in Canton,Mississippi

Abstract

On 4 August 2017, workers at Nissan’s plant in Canton, Mississippi, voted 2244 to 1307 against being represented by the United Automobile Workers of America (UAW). The organizing campaign in Canton – which began shortly after the plant opened in 2003 – was one of the most important in recent labor history, and it attracted national and international media coverage. It also mobilized some high-profile supporters, including actor Danny Glover, musician Common, Democratic National Committee chair Tom Perez, and presidential contender Bernie Sanders. This article uses interviews with Nissan workers and UAW staffers, together with the records of the long organizing drive, to provide the first detailed examination of this landmark campaign, revealing problems that press accounts did not cover. While the UAW and its supporters blamed Nissan’s fierce opposition for the outcome, this article reveals that the reasons for the loss were more complex. Apart from corporate opposition, community hostility, the increasing number of temporary workers – who were unable to vote in the election – and racial divisions were all important factors. Most of the UAW’s supporters were African-American, and they were mobilized by a campaign that declared that, ‘Labor Rights are Civil Rights.’ This slogan alienated many whites, however, weakening the union. While the UAW pledged to fight on, the defeat was another blow to its long campaign to organize foreign-owned automakers in the U.S., an increasingly important sector.

An eclectic montage of literary analysis, autobiography, and reader response, taking the form of personal anecdotes and autonomous essays, The Woman in the Red Dress takes the reader on a journey in which Minrose C. Gwin analyzes both metaphoric and physical personal space. As Gwin defines it, space is "not an entity that contains something else but [is] the swirl of social relations and productions in particular locations, whether these locations be material, cultural, or even psychological" (6). The purpose of Gwin's work, as she says, perhaps too repetitively is: "to dramatize textual encounters in which narrative, space, and gender inscribe themselves on one another and their readers" (38). The title of this volume refers to the first work Gwin discusses in her introduction: Native American poet Joy Harjo's poem, "Deer Dancer," about a woman in a stained red dress who dances naked on a bar, changing not just the lives of those present, but also those who, like the narrator, merely hear the story (6-7).     

What Friends are for: The Relationships Between Body Image, Substance Use, and Peer Influence Among Finnish Adolescents

The study investigated the relationships between substance use, body image, and peer influence among Finnish adolescents. The participants (N=488, 240 boys and 248 girls), were eighth-grade high school students. The data were gathered using a questionnaire. In addition to background information, the study covered risk behaviors frequency, body satisfaction, and peer relationships. The results indicated that the levels of body satisfaction among the adolescent girls studied were lower than those among the adolescent boys. It was found that the girls engaged in more discussion with peers than the boys concerning both intimate and general matters. Moreover, having an intimate relationship with one's peers was associated with a greater tendency to drink purely in order to get drunk. However, a slightly more distant relationship with friends was associated with a greater risk for smoking. In general, dissatisfaction with one's physical appearance seemed to relate to substance use. By highlighting the relationships between adolescents’ body image, substance use, and peer influence the study gives pointers for further research, and may be suggestive in terms of the kinds of social policies that ought to be pursued in the future.MA (Educational Sciences) from the University of Turku.
