Towards an internal health market with the European court

This article examines the process through which a European healthcare dimension has been established and which has gradually extended the rights of European patients to cross-border healthcare. The integrative course has been charted by the legal activism of the European Court of Justice, whereas political voice has largely been absent. Judicial activism alone has applied the principle of the free movement of services to the policy field of healthcare, and thereby further energised the process. The political impact of this specific process of integration through law is, however, clear. The dynamic evolution of Community law has increasingly challenged the national instrument to retain health supply within own borders. Furthermore, the position of the European patient has been empowered by new individual rights, emanating from a supranational locus of rights against which the discretion exerted by national authorities can be challenged. Through the indeterminacy of European rules, open to continuous contestation and clarification, healthcare institutionalisation has proceeded and the European Union has extended into the core of the welfare state.

INFORMING WILDERNESS POLICY: THE DISTRIBUTIONAL IMPLICATIONS OF WILDERNESS CONSERVATION1

Abstract: Over the last two decades wilderness conservation has resurfaced to become one of the most contentious issues currently on the public agenda. The "politics" of wilderness preservation has been extensively reported in the media, but academic analysis has been on a superficial level and usually by the supporters of "conservation". This analysis has not proved particularly helpful for policy practitioners in this field.     

Decentralization and Development in Contemporary Uganda

Abstract

There has long been an emphasis on the importance of decentralization in providing better quality public services in the developing world. In order to assess the effectiveness of decentralization I examine here the case study of Uganda, which has seen major decentralization of power over the last quarter-century. In particular the current government has introduced a five-tiered local government structure, decentralized both fiscal and political power to local governments and introduced regular local government elections. However, initial excitement about Uganda's decentralization programme has tapered off in recent years due to a number of problems outlined here. In particular, I show that decentralization in Uganda has suffered from a lack of independence from central government control, which has led to a lack of effectiveness in the provision of high quality public goods.

China has rapidly expanded its spending on defence over the past decade, at a pace that has closely mirrored its economic growth. However, a slowdown in growth over the past year has raised new questions over the implications for defence spending.

New Labour has always claimed consistency in its euro policy, yet its position has undergone significant modification since Blair became party leader: early enthusiasm has given way to uncertainty. Labour's shift is commonly ascribed to political factors. This article argues the primacy of economics. Labour has a better understanding of Europe's importance to Britain than perhaps any post-war administration but, as its euro policy demonstrates, its 'new' approach to Europe is substantially a traditional one.     

The Spanish peace movement in a European context

Since the late ‘sixties the Italian Socialist Party has abandoned its attempt to isolate the Communist Party and instead has sought to re‐integrate it into the group of so‐called ‘democratic’ parties. This process has culminated in the P.S.I.’s proposal for a ‘Socialist Alternative’ government, to replace Christian‐Democrat rule. The Communist response has been to accept the legitimacy thus bestowed, but to use it to impose its own solution: the Historic Compromise—a grand coalition of Communists, Socialists and Christian Democrats. The consequence has been a partial reversal of the conventional roles of the two parties of the Left.

Small-scale administration in St Martin: Two governments of one people

Divided between France and Holland since 1648, the small island community of St Martin has grown and prospered in recent decades largely because of tourism. France which incorporates its part, Saint Martin, as a municipality in the Department of Guadeloupe has been generous with public funds and tax concessions to those who invest in the dependency. The Kingdom of the Netherlands, the governments of its constituent parts (Holland and the Netherlands Antilles), has been more generous with authority than with money. So Dutch Sint Maarten has enjoyed much greater political and administrative autonomy than its northern neighbour, but it has to depend on investment from private interests, American and European. Indeed, it has lacked sufficient public capital even for infrastructure and social services, including education. The governments of both sides have neglected joint planning and other coordinated efforts to develop the island. The Dutch side has been committed to laissez-faire private enterprise and so personnel development in the public service has been minimal. This has disposed the government of the French side to limit joint ventures with the Dutch government. The population is large enough and the revenues are high enough to provide adequate numbers of public officials, but tourism has attracted, in the 1970s and 80s, many of the more able and ambitious. These considerations set the two sides of St Martin apart from other West Indian micro-states, most of which have not experienced as much success in developing and maintaining tourism. St Martin is unique in another way. It is different from other English-speaking islands because of its French and Dutch institutions. It is quite different from other French and Dutch islands (Saba and St Eustatius excepted) because of the English language and other cultural influences.

Increasing Canada's Foreign Intelligence Capability: Is it a Dead Issue?

Despite the fact that the issue of whether Canada should develop a greater foreign intelligence capability has been broached numerous times, in various guises, over more than a century, those who have followed the development of the country's intelligence architecture will know it has never had a foreign intelligence service like its close allies. They will also be aware that on each occasion on which the issue has been raised, the Canadian government has declined to proceed. If history is any guide, there is a strong likelihood that the idea of Canada developing a more robust capability will again engage politicians, former intelligence officials, academics, the media, and think tanks in the not too distant future. The view adopted in this paper is that the public discourse has become sterile, and that if it is to advance, aspects of the counterfactual case – why has a foreign Humint capability not been developed? – may prove more fruitful.     

Thailand: an old relationship renewed

The relationship between Thailand and China has been both long and complicated, with periods of conflict associated with, for example, the cold war. In recent years, and especially following the Asian Economic Crisis, there has been a blossoming of the relationship, built on careful diplomacy, a renewal of interest in ethnicity and expanding business dealings and rising bilateral investment. In the contemporary period, the relationship has reached a new high. Since Thailand's military junta came to power in 2014, China has been a significant diplomatic, economic and strategic partner. Part of the explanation for this has to do with the junta's inability to deal with the USA following the coup. This article suggests that the turn to China has much to do with Thailand's turbulent domestic politics. In examining this bilateral relationship, this article addresses issues related to infrastructure, business and trade, military co-operation and cultural relations.
