Research on crime victims and their experiences with the criminal justice system suggests that victims' rights (e.g., victim impact statements) and victims' services (e.g., crime victims' compensation, counseling) have not significantly improved victims' satisfaction with the criminal justice system or their recovery from the crime. Thus, we appear to know little about how to satisfy and assist victims of crime. This study uses the symbolic interactionist perspective to examine victims' experiences with law enforcement workers (e.g., detectives, counselors) with a focus on people who have lost a loved one to murder ("bereaved victims"). The data come from in-depth interviews with thirty-two bereaved victims, seven law enforcement workers, and three crime victims' advocates in Union County (pseudonym). Bereaved victims define the victim role differently from law enforcement workers, creating two main points of conflict with workers: (1) a conflict over their deceased loved one's body, and (2) a conflict over the flow of information in the case. Bereaved victims' frustrations over these conflicts created problems for their recovery. Bereaved victims' efforts to see their deceased loved one's body, guide detectives' investigation, and learn information about the murder and the investigation took a back seat to detectives' interests in protecting the integrity of the investigation and building a strong case for the prosecution. This paper is concerned with the satisfaction of burglary victims with the service provided by the U.K. police. The study, funded by the U.K. Home Office's Police Research Group, was conducted in the West Midlands and considers the role of police actions, victims' characteristics, and victims' perceptions in shaping victim satisfaction. Victim satisfaction, which was lower than in a number of previous studies, depended on how well police actions and outcomes of cases met victims' expectations. Satisfaction was dependent to a great extent on the manner of the first officer to reach the burglary scene, and also on keeping victims informed about the outcome of investigations, activities which the force can readily address. Improved detection rates and better property recovery would also boost satisfaction, but these are influenced in part by factors both under police control, and are less likely to be easily achieved. Methodologically, the study demonstrates the importance of relating police records to victims' expressed satisfaction, and their perceptions of police actions when framing policies aimed at meeting victims' preferences.  相似文献

Over the last several years, the criminal justice system has encouraged survivors of domestic abuse to report their victimization to law enforcement authorities. While some pieces of evidence suggest that police are more sensitive to the plight of domestic survivors, law enforcement response remains incomplete and problematic. This article explores this issue, focusing on police civil liability for inappropriate response to domestic violence. It discusses a specific legal remedy—the equal protection clause of the Fourteenth Amendment—highlighting the circumstances under which police are held liable when they fail to prevent victims' injuries because of their inappropriate response to domestic violence. The article concludes that police need more training and education on family abuse so they can become more responsive to victims of domestic violence.  相似文献

The purposes of this study were to assess (a) the extent of attrition in the processing of sexual assault cases in the legal systems, (b) factors associated with attrition at various stages in the process, and (c) victims' experiences in the legal system and the relations between these experiences and recovery. Our results suggest that substantial attrition continues to occur in the prosecution of rape cases, that more severe assaults are prosecuted more vigorously, that victims are generally satisfied with the police (but not with the legal system in general), and that neither attitudes nor case outcomes are associated with victims' postrape recovery. Research and policy implications are discussed.  相似文献

There is little documentation about how nuisance property laws, which fine people for excessive 911 calls, affect victims of domestic violence. In St. Louis, we found that police and prosecutors believe that the law benefits victims of domestic violence by providing them with additional services. By contrast, advocates for domestic violence victims believe that the law undermines battered women's access to housing and discourages them from calling 911. Using qualitative data, we analyze how the organizational structures and dynamics within which each group works give rise to different stocks of working knowledge. We conclude that law enforcement officials are unaware of these harms because women's voices and experiences are marginalized during the enforcement process. This research reveals mechanisms through which law enforcement policies reinforce gender inequality, and illustrates some ways in which gender relations and power come into play in what, on their surface, appear to be gender‐neutral laws.  相似文献

A statewide assessment was conducted of assaults, experiences, needs, and recommendations of 125 adult victims receiving care at 19 sexual assault centers (SACs) in the State of Maryland. More than one half of the victims (55.6%) waited years before disclosing, with delays in reporting especially likely if the assault was perpetrated by a family member (the most frequent perpetrators at 42.4% of respondents). About one half of the victims (51.3%) had been previously sexually assaulted, yet only 9% of these victims had sought treatment. The majority of respondents (69.4%) indicated they would not be filing charges against perpetrators, and of those who did, 46.2% reported dissatisfaction with the interview with police. Psychological symptoms such as depression and anxiety were the most common reasons for seeking care at the centers. Nearly all of respondents rated the care they received at the centers as very good or excellent. Respondents recommended more SACs, better advertising of their services, more mental health care within them (especially group therapy), and improved laws and law enforcement of perpetrators.  相似文献

This study looks at the experiences and perceptions that domestic violence victims reported with Mills's power model. The victims' partners were the primary research participants in an arrest experiment. The following were empirically examined: the occurrence of violence following suspect arrest, victim perceptions of personal and legal power, victim satisfaction with the police, and victim perceptions of safety following legal intervention. Race and two victim resource measures (i.e., employment status and income advantage) explained variance in perceptions of independence. A police empowerment scale was used to measure legal power. It was found that arrest affected the probability of re-occurring domestic violence. Suspect arrest and the victim's perceptions of legal power were related to perceptions of safety following police intervention. The study concludes with some implications for domestic violence research, programs, and perspectives.  相似文献

Increasing efforts are made by police forces all over the world to optimize the use of technology in policing and remove any obstacles as new and existing technologies provide new opportunities for law enforcement, criminal investigation and prosecution. This contribution describes results of research on which technologies are currently used at police forces and other criminal investigation organizations in the Netherlands, their experiences with these technologies and their needs and preferences in this regard. For existing opportunities the prevalence and satisfaction of several technologies in policing, including wiretapping, fingerprints, DNA research, database coupling, data mining and profiling, camera surveillance and network analyses were investigated. For new opportunities the most promising technologies (i.e., promising according to the police forces) were mapped. Furthermore, an inventory was made of the legal, technological and organizational obstacles police forces encounter when using different technologies for purposes like law enforcement, criminal investigation and prosecution.  相似文献

The current study will add to the literature on public attitudes toward law enforcement by assessing the individual and contextual-level predictors of one of the key concepts in police legitimacy literature: trust. Examining individuals nested within zip code results showed a significant equalizing effect of structural resource deprivation on both White and Black respondents' perceptions of trust in the police. Additionally, results found respondents who perceived racial profiling to be widespread had a universally decreased likelihood of having trust in the police, and these disparities were exacerbated as structural resource deprivation increased.  相似文献

ABSTRACT

Despite the fact that LGBTQ individuals are at greater risk of victimization than the average citizen, the LGBTQ community’s relationship with law enforcement has been a turbulent one. Using a mixed-methods approach, including surveys, semi-structured interviews and observations of town hall meetings, and following the participatory action research framework, this study examines the interactions between the LGBTQ community and law enforcement, and the perceptions of police within the LGBTQ community. The current study demonstrates how members of the LGBTQ community continue to have negative experiences with police that adversely impact their perceptions of law enforcement. Moreover, the findings underline the importance of examining how multiple identities impact an individual’s experiences with and their perceptions of law enforcement. Expanding past research on this topic, this study offers an analysis based upon suggestions of the study’s participants of what steps must be taken in order to improve relations between these two groups.  相似文献

Much of the research which has been conducted to date regarding stress and police officers has focused on identifying the presence of stress, associating stress with specific stressors, and comparing levels of stress between police officers and members of other professions. This project focused on the influence of one potential mediator of stress—religious activity. Data were collected from a population of law enforcement officers from a medium sized city and from a comparison group of firefighters from the same city. The data indicate that religiosity has two factors (1) traditional beliefs and activities and (2) religious satisfaction and perceived influence of religion on subject’s everyday lives. The second factor was found to be negatively related to stress for police officers. As religious satisfaction and perceived influence increase, stress increases.  相似文献

Abstract

Human trafficking in its various forms continues to offer significant challenges for law enforcement agencies. There is a growing body of research that addresses some of the police governance and management issues associated with the prevention and control of human trafficking and the protection of victims of this type of crime. This article reviews the literature on the implementation of effective detection, investigation, prosecution, and victim protection strategies; the need for more effective international cooperation; and, the struggle to keep up with the illusive criminal organizations and networks that often defy law enforcement tactics. It also considers some of the specific challenges that result from the frequent conflation of human trafficking enforcement with immigration control strategies. It offers a few suggestions on how these issues may be addressed from a police governance standpoint and concludes with a call for better data on human trafficking and the relative effectiveness of different law enforcement strategies.  相似文献

Growing attention to the unique ways in which women of color’s bodies are racially profiled and policed has prompted questions concerning gender-specific impacts of law enforcement practices. Arrest statistics, patterns of enforcement, and high-profile cases of police violence against Black women and other women of color suggest that gaps in policy and implementation will disproportionately affect women of color. In the current research, the policies of 36 police departments across the country were examined to ascertain the degree to which they address profiling, police sexual misconduct, and other gendered experiences of policing. The findings reveal considerable divergence in attention to regulating police behavior in the context of interactions with women and lesbian, gay, bisexual, and transgender (LGBT) people, exposing important gaps in police policies, and highlight a need for further research and action specifically focused on intersectional factors at play in the context of policing women’s bodies.  相似文献

Police attitudes towards partner violence against women (PVAW) can play an important role in their evaluation and responses to this type of violence. The present study aims to examine ambivalent sexism and empathy as determinants of male police officers' law enforcement attitudes towards PVAW. The study sample was composed by 404 male police officers. Results suggested that male police officers scoring low in benevolent sexism expressed a general preference for unconditional law enforcement (i.e. regardless of the victim's willingness to press charges against the offender), whereas those scoring high in benevolent sexism expressed a preference for conditional law enforcement (i.e. depending on the willingness of the victim to press charges against the offender). Results also showed that police officers scoring high in empathy and low in hostile sexism were those who expressed a general preference for unconditional law enforcement. The presence of sexist attitudes and low levels of empathy among some police officers, and their influence on law enforcement attitudes, highlights not only the importance of specific training, but also the need to pay attention to the selection process of police officers dealing with PVAW.  相似文献

Legal systems differ markedly on how they treat the emotional harm suffered by close family members of crime or accident victims. This paper reports the results of two empirical studies examining how citizens whose child, partner, or parent was killed or seriously injured as a result of violent crime or tort (secondary victims) perceive a monetary award for their own non-economic harm relating to the death or injury of their loved one. The objective of our research was to test the Dutch legislator's assumption that a (modest) monetary award for secondary victims' emotional harm can have a meaningful symbolic value by providing recognition and satisfaction. Until then, no compensation was available for such harm under Dutch law. In addition, we examined whether victims' relatives preferred standardization or individuation in determining the amount of the award, how they evaluated the amount, and the manner in which such awards might be offered. In a first quantitative survey study conducted in the Netherlands, 726 secondary victims were asked for their evaluations of such awards for the emotional harm they suffered as a result of the death or injury of their family member. We also asked our representative sample about their actual experience of the legal process in order to put their evaluations of such awards into context. In a second qualitative study, conducted in Belgium, interviews were held with 14 secondary victims who had actually received an award for their own emotional harm under Belgian law (study 2). Results suggest that secondary victims regard an award for emotional harm as a positive gesture and may interpret it as helping to satisfy relatives' psychological concerns by seeing it, for example, as an acknowledgment of loss and responsibility. Overall findings suggest that victims' relatives may be seeking acknowledgement of their emotional losses and the norm violation.  相似文献

Popular in the law enforcement literature, the concept of the “police subculture” traditionally has been predicated on homogeneous personnel selections. Although female and minority representation has increased in law enforcement, the impact of females and minorities on the police subculture has not been empirically evaluated. Traditional research in this area has suggested that the socialization process is so intense and the subculture so strong that individual characteristics are quickly overwhelmed. However, these studies were undertaken prior to the mandated introduction of female and minority officers. Results of this study show no significant relationship exists between occupational identification and demographic characteristics; however, level of socialization does show a significant relationship to demographic variables. The sample consisted of four regularly scheduled academy classes with varying levels of police experience. This sample was selected due to the diversity in the level of police experience among respondents. It was hypothesized that demographic variables, such as race, gender, age, military experience and level of police experience, would not significantly affect occupational identification or levels of socialization. The data indicated that individual characteristics, such as race, gender, age, military experience, and level of police experience, did not appear to have a significant effect on occupational solidarity. These individual characteristics, however, were found to display significant relationships with level of socialization.  相似文献

Controversies have surrounded law enforcement intelligence because of past instances where the police maintained records of citizens' activities that were viewed as suspicious or anti-American, even though no crimes were being committed. This, of course, violates fundamental constitutional guarantees and offends the American sense of fairness with respect to government intrusiveness. Unfortunately, the boundary is not precise regarding the types of information the police can collect and keep. Some legal guidelines appear contradictory and the application of law to factual situations is often difficult. Beyond the legal ramifications, early intelligence initiatives by the police typically lacked focus, purpose, and process. Important lessons can be learned from these historical experiences that provide context and guidance for law enforcement intelligence today. Aggravating the [kinds of factors referred to above] has been the tenuous relationship between law enforcement intelligence and national security intelligence that has changed continuously since the mid-20th century. These changes have been both politically and legally controversial, responding to changing socio-political events in American history and most recently through post-9/11 counterterrorism efforts. As a result, there is value in understanding selected portions of history from both types of intelligence to gain context and understand the lessons learned.  相似文献

This paper examines limitations in how law enforcement and public health systems respond to domestic violence in Kyrgyzstan. Findings from interviews with domestic violence victims show that these women are subject to ineffectual practices and negative attitudes that tend to minimize domestic abuse and disempower victims. The findings reveal several problematic issues: inconsistencies in the implementation of the law, impunity for abusers because of both personal attitudes and social affinities between the police and abusers, ineffective enforcement of protective orders, and superficial processing of domestic violence cases by the legal system. Additional barriers to help-seeking include a lack of institutional support and guidelines for offering mental health services for victims as well as a scarcity of housing, childcare, and employment opportunities for women seeking to break the cycle of abuse. The findings underscore the need for society-wide changes in attitudes toward domestic violence, stricter mechanisms for enforcing the law, and mandatory training for service providers to facilitate the provision of more accessible and affirmative support to victims.  相似文献
