While benefit–cost analysis (BCA) is now a permanent part of the regulatory process in the United States, and many other countries around the world as well as the European Union have adopted it or are moving toward it, there have been few empirical attempts to assess either whether its use improves regulations or how BCA interacts with the political environment. We use a unique US database of the costs and benefits of 109 economically significant regulations issued between 2000 and 2009 to examine whether the amount of information provided in the BCA or political factors surrounding the regulation better correlate with the net benefits of the regulation. We find that there is little correlation between the information provided by the analysis and the net benefits. However, we find that regulations that receive few public comments and are not issued at the end of an administration, have the highest net benefits. These are the regulations that are the least politically salient. This interaction between the political environment and the economic performance of a regulation has been under‐examined and deserves further study.  相似文献

Abstract

This paper examines the developing body of Chinese prostitution law, and the nature of its implementation, with reference to mainstream media controversy surrounding the case of a male academic penalized as a buyer of commercial sexual services in late 2004. It argues that the protagonist's highly public ‘fall from grace’ may owe more to the Chinese media's new capacity to act as part of a disciplinary apparatus that extends beyond the purview of the Party-state – via its claim to promote freedom of information – than the presumed repressive ethos of the Chinese Communist Party.  相似文献

In recent years, numerous countries have undertaken administrative reforms to implement New Public Management (NPM) postulates. The implementation of NPM involves new information needs for decision taking by public managers. In this context, public sector accounting plays a key role as an information system for the successful implementation of NPM. The International Federation of Accountants (IFAC) is undertaking an international accounting harmonisation project to establish high‐quality public sector standards to meet the new information requirements under NPM worldwide. This article examines the capability of IFAC accounting measurement bases to meet information needs under NPM postulates, in both developing and developed countries, analysing the differences between these types of countries. The National Accounting Standard Setters (NASS) of 47 countries were asked about the usefulness and viability of Fair Value Accounting (FVA) to implement NPM postulates, especially those concerning improved efficiency, enhanced information transparency and benchmarking analysis. In the context of increasing numbers of vulnerable migrants in Europe, many churches and other faith-based organizations have provided sanctuary to those at risk of deportation. This paper sheds light on the rationalities and practices of actors such as these, and in what ways their beliefs may be different from liberal norms. Investigating both liberal and faith-based understandings of space, time, and freedom I look at the ways that multiple webs of belief intersect to form new constellations of power in humanitarian governance.  相似文献

对世界各国社会保障供款征缴的"分征""代征""混征"这三个模式进行了实证分析,并利用第一手资料对每个模式做了案例研究;在此基础上对社保部门、税务部门和私人部门三个不同征缴主体在三个不同征缴模式中的职能作用与协调配合问题做了考察;对中东欧转型国家征缴模式的改革取向及其原因做了分析.针对中国目前存在的社保部门和税务部门"双重征缴"体制的现状,认为,中国面临着二元化经济结构和统账结合制度特征的现实国情,由此决定了社保制度扩大覆盖面工作的长期性和艰巨性.中国国情的特殊性是任何发达国家和中东欧转型国家都不具有的,这就要求社保制度要不断进行自我完善,适应社会经济既定条件,以完成十六届六中全会提出的到2020年基本建立覆盖城乡社保制度的目标,否则,就难以实现这个目标,或即使实现了也是一个碎片化的社保制度,而不利于构建和谐社会.指出:中国选择征缴模式的替代方案应以分征模式为最优,代征模式不利于实现2020年的目标,目前存在的"双重征缴"体制不利于实现这个目标,并提出了征缴体制转型的"两步走"的改革设想.  相似文献

Over the past few years, price caps have replaced rate-of-return regulation in many sectors of telecommunications. This article focuses on the key implementation issues raised in the Federal Communications Commission's formulation of price cap plans for AT&T and the local telephone exchange carriers. Specifically, it discusses company cost changes over time and the formulas employed to track costs; the multiplicity of prices and the structure of regulations designed to cap them; and the inevitability of errors in the long run and the disincentives likely to result from efforts to correct such errors. It concludes with an evaluation of the performance of these price cap plans, noting how the resolution of these various issues has affected plan success.  相似文献

The US Office of Management and Budget introduced in 2003 a new requirement for the treatment of uncertainty in Regulatory Impact Analyses (RIAs) of proposed regulations, requiring agencies to carry out a formal quantitative uncertainty assessment regarding a regulation’s benefits and costs if either is expected to reach $1 billion annually. Despite previous use in other contexts, such formal assessments of uncertainty have rarely been employed in RIAs or other regulatory analyses. We describe how formal quantitative assessments of uncertainty – in particular, Monte Carlo analyses – can be conducted, we examine the challenges and limitations of such analyses in the context of RIAs, and we assess how the resulting information can affect the evaluation of regulations. For illustrative purposes, we compare Monte Carlo analysis with methods typically used in RIAs to evaluate uncertainty in the context of economic analyses carried out for the US Environmental Protection Agency’s Nonroad Diesel Rule, which became effective in 2004.  相似文献

Abstract

The Association of Southeast Asian Nations (ASEAN) has agreed to establish an ASEAN single-shipping market (ASSM) by 2015. This paper aims to assess the impediments in achieving this vision and how they can affect the pace of integration. These impediments include the differences in their national shipping capacity, national shipping policies and regulations, and in their quality of shipping-related infrastructure and institutions. Due to these differences, the economic implications are likely to vary and raise important conceptual and implementation issues. The ASEAN experience could contribute to the understanding of shipping market integration and provide some lessons for other countries.  相似文献

What is the impact of performance-based budgeting (PBB) on governmental spending? Do various PBB implementation strategies result in different outcomes? The authors, Jack Yun-jie Lee of National Open University in Taiwan and XiaoHu Wang of the University of Central Florida, gathered data from the United States, Taiwan, and China (Guangdong Province) to explore the possible intermediate- and long-term results of PBB. Governments enact environmental regulations to compel firms to internalize pollution externalities. Critics contend that regulations encourage technological lock‐ins and stifle innovation. Challenging this view, the Porter‐Linde hypothesis suggests that appropriately designed regulations can spur innovation because (1) pollution reflects resource waste; (2) regulations focus firms’ attention on waste; and (3) with regulation‐induced focus, firms are incentivized to innovate to reduce waste. This article explores the regulation–innovation linkage in the context of voluntary regulations. The authors focus on ISO 14001, the most widely adopted voluntary environmental program in the world. Examining a panel of 79 countries for the period 1996–2009, they find that country‐level ISO 14001 participation is a significant predictor of a country's environmental patent applications, a standard proxy for innovation activity. The policy implication is that public managers should consider voluntary regulation's second‐order effects on innovation, beyond their first‐order effects on pollution and regulatory compliance.  相似文献

For over fifty years, efforts have been made to measure the results of government activities. Most recently, performance measurement and evaluation have been key components of government reforms in many countries in reaction to loss of confidence in governments and budget stringency. Emphasis is on measuring outcomes or results within a general framework of strategic planning and objective setting, and in a context of devolution, managerial decentralization, and privatization. While it seems reasonable that governments should justify their use of public funds by demonstrating the effectiveness of their programs and activities, performance measurement in practice is by no means straightforward and demands considerable thought in its design and implementation.  相似文献

Cost effectiveness is a key principle of climate policies in industrialised countries, yet there are significant political barriers against its implementation. The Norwegian case demonstrates that differences in the climate policy instruments targeting different sectors cannot be explained by the sectors' relative significance in the national economy. Whereas the economically insignificant energy‐intensive industries (EIIs) successfully resisted mandatory greenhouse gas (GHG) regulations until 2008, the offshore petroleum industry (the most important sector for Norway's gross domestic product) has paid NOK 300 per tonne of CO2 since 1991. What explains why some sectors successfully resist GHG regulations while others do not? This analysis indicates that a key determinant is interdependence between target groups and decision makers in winning coalitions. EIIs were capable of issuing relevant and credible threats to shut down and relocate if costly GHG policies were imposed. In contrast, decision makers did not perceive as credible the offshore petroleum industry's claim that a CO2 tax would undermine its competitiveness. Moreover, when target groups can issue effective threats, private information becomes more relevant and reinforces decision makers' dependence on target group cooperation.  相似文献

Despite the existence of rigid civil service systems in many developing countries providing relative stability of public officials, staff posting and transfers are often based on short‐term political criteria. This means high staff circulation in key government posts, leading to a situation of ‘instability within stability’. This article analyses high staff circulation in the government health services in Balochistan, Pakistan. The analysis is based on literature review, a small pilot study and authors' experience in the province. The article notes that high staff turnover and, more specifically, circulation are context‐specific. Four issues are raised. Firstly, the extent of staff turnover is analysed and references are made to its frequency, the organization and cadre. Secondly, the social and political underpinning of high staff circulation is outlined: political patronage, low implementation of rules, staff preferences and public sector control. Thirdly, the problems of staff turnover are raised with specific reference to the problems of continuity, change and participation. Fourthly, the issue of solutions is raised at two levels: structural change to lessen high staff turnover, and dealing with it on a day‐to‐day managerial level. This article illustrates the degree to which new areas of consensus are emerging in the implementation of civil service reforms. A crucial development in Commonwealth countries has been the change in the strategies being pursued by most governments in achieving economic growth and developmental objectives. The need to change the role of the State for improved economic efficiency is finding greater acceptance in most countries. The article highlights several common themes emerging in the introduction of civil service reform programmes with remarkable similarity about the concerns and changes taking place in very different settings. The article also identifies a set of key strategies that have emerged as major instruments for the implementation of the reform process, such as securing leadership for change, enhancing policy development capacity, improved human resource and financial management systems, establishing efficiency and quality management programmes, harnessing information technology and mobilizing external and internal advice. The article concludes that there is no unique solution and each country would need to identify key strategies drawing on experiences of other countries and keeping in view national priorities. The article hence provides a useful framework for sharing of experiences and cooperation among Commonwealth countries.  相似文献

The current climate of neoliberalism in the executive branch is attended by active deregulation and distrust of the administrative state. As protections are rolled back, there is concern that individuals may be susceptible to information asymmetries that will influence their decision making, leading to detrimental outcomes for both their own and the general welfare. Behavioral public administration—the bureaucratic conception of “nudge” theory—offers ways to counter the pitfalls that come with greater freedom of choice, as promoted by the neoliberal agenda. Public administrators may employ alternative mechanisms, such as choice architecture, to help people make better decisions in the absence of explicitly protective regulations. After laying out the argument for a behavioral approach, this article analyzes several neoliberal agenda issues with potential nudge responses for practical implementation, as well as a justifiable call for action to protect the public welfare in the absence of policy guidance.  相似文献

This paper uses the Wright ratings of economic freedom to investigate the relationship between economic freedom and economic development for most countries in the world. This relationship is apparently strong and direct for such economic freedoms as freedom of property and freedom of movement but inverse for freedom of association. These findings appear to be independent of the type of economic system or civil liberties, as measured by the Gastil ratings, which have their own important effects on economic development.With the statistical assistance of Laurie D. Chinese elections for village leaders have been conducted since 1988, but processes by which elections have been conducted leave room for improvement. This study shows that despite progress made in Chinese village election laws, there exists considerable variation in rules and procedures stemming from vagueness in the laws and in various implementation methods. These issues are addressed and ways are proposed to improve village elections. In particular, an argument is made in favor of standardization and synchronization of village election rules and procedures.  相似文献

The emergence of a worldwide environmental movement in the early 1960s accompanied an international expansion of economic activity and applied technology. The principal medium through which this expansion progressed was trade. In 1947, following World War II, a series of international agreements were negotiated to regularize international relations in finance, monetary policies, and trade. The General Agreement on Tariffs and Trade (GATT) was negotiated without anticipation of an international environmental movement and new policies at the national level that did not reflect, and might be inconsistent with, economic values. Conflict between policies for freedom of trade and environmental protection did not immediately emerge. With the adoption of numerous environmental protection measures in the United States and many other countries after 1969, the incompatibility of some trade and environmental policies became political issues. Trade policies are not confined to economic changes. Policy issues developing around the agreement and environmental protection are complex, and frequently involve technological issues, as in the Mexican tuna controversy discussed in this paper.  相似文献

In new democracies party systems are often young, so partisan cues and roots in the electorate tend to be weak. The results, in many instances, include volatile campaigns with comparatively high degrees of short-term preference change among voters. We explore the mechanisms of voter volatility and, more broadly, the ways in which citizens learn about issues and candidates in weak-party systems. We claim that citizens in such settings rely heavily upon persuasive information gathered from their immediate social contexts. Utilizing a unique panel survey implemented during Brazil's historic 2002 presidential election, we demonstrate the importance of political discussion within social networks and neighborhood context for explaining preference change during election campaigns. We also demonstrate the concrete political consequences of social context by showing how candidate momentum runs can be driven by waves of discussion.  相似文献

How do voter preferences come into focus over the electoral cycle in different countries? Do they evolve in patterned ways? Does the evolution vary across countries? This article addresses these issues. We consider differences in political institutions and how they might impact voter preferences over the course of the election cycle. We then outline an empirical analysis relating support for parties or candidates in pre‐election polls to their final vote. The analysis relies on over 26,000 vote intention polls in 45 countries since 1942, covering 312 discrete electoral cycles. Our results indicate that early polls contain substantial information about the final result but that they become increasingly informative over the election cycle. Although the degree to which this is true varies across countries in important and understandable ways given differences in political institutions, the pattern is strikingly general.  相似文献
