本文从司法鉴定机构设置、司法鉴定活动启动以及司法鉴定意见审查三个方面论述了司法鉴定“守门人”问题。通过对两大法系国家各自司法鉴定制度的分析,梳理司法鉴定“守门人”的三道防线。同时有针对性地比较和讨论了我国司法鉴定制度缺陷,明确司法鉴定制度改革不能以牺牲鉴定意见“守门人”功能为代价。指出建立国家所属的具有公益性、中立性的司法鉴定机构是发展的必由之路。  相似文献

Recent studies have found that the general public perceives forensic evidence to be relatively inaccurate and to involve high levels of human judgement. This study examines how important the general public finds forensic evidence by comparing decisions on guilt and punishment in criminal cases that involve forensic versus eyewitness testimony evidence and examining whether a CSI effect exists. Specifically, this experimental survey study utilized a 2 (crime type: murder or rape) × 4 (evidence type: DNA, fingerprint, victim eyewitness testimony, or bystander eyewitness testimony) ? 1 (no victim testimony for murder scenario) design, yielding seven vignettes scenarios to which participants were randomly assigned. Results indicate that forensic evidence was associated with more guilty verdicts and higher confidence in a guilty verdict. Forensic evidence did not change the expected sentence length and did not generally affect the ideal sentence length. However, for rape, respondents believed that the defendant should receive a longer sentence when forensic evidence was presented but forensic evidence did not alter likely sentence that respondents expected the defendant to receive. The results of this study did not support a CSI effect. Overall, this study suggests that forensic evidence – particularly DNA – has a stronger influence during the verdict stage than the sentencing stage.  相似文献

Abstract:  Collection and interpretation of forensic intelligence (primarily through DNA and fingerprint identifications) is an integral part of the investigation of criminal offenses ranging from burglary and vehicle crime to major crime. The forensic contribution depends not only on the successful recovery of material, but also the ability to identify potential offenders and apply this intelligence to solve the crime. This study examines burglary and vehicle crimes investigated by Northamptonshire Police (U.K.) by analyzing relationships between deprivation of a crime location and the recovery and identification of DNA and fingerprint material. The results show that, for stolen vehicles, although significantly more forensic material (both DNA and fingerprints) is recovered and identified in more deprived neighborhoods, this does not lead to a corresponding increase in solved cases. These findings are considered in relation to previous studies, which have advocated the prioritization of resources at crime scenes most likely to yield forensic material.  相似文献

When the forensic toolmarks laboratory receives for examination and comparison a tool that is suspected of having been involved in a crime, the expert performs tests designed to determine whether or not the specific tool generates the same toolmarks as those found at the crime scene. This is performed by testing tool striation on a piece of soft metal, such as lead, and examining the marks left by the tool. Studies have shown that wax may be an optimal material for this purpose. This study examines the use of wax at different temperatures and shows that quality of results is better when the wax is cooled (recommended temperature is ?18°C). At this temperature, the wax is flexible enough but does not smear and is not sticky. This makes the obtained marks clearer and of better quality.  相似文献

What drives public beliefs about the credibility of a scientific field? This question is increasingly important, with recent discussion of a “reproducibility crisis” affecting many fields. Such discussions are vital in forensic science, a discipline that has experienced severe scrutiny from both the media and large oversight bodies. In this paper, we make three contributions to this discussion. First, we bring together and compare several studies in which laypeople were asked about the reliability of forensic science practices. This review suggests that forensic practices do not enjoy uniformly high reliability ratings from the public and these ratings are not calibrated with the scientific consensus. We then review three empirically-tested ways that other fields are dealing with their own crises, all centred around transparency and openness. Finally, we make recommendations for how forensic science can leverage transparency and openness to improve and maintain its long-term credibility. As part of these recommendations, we find that empirical research supports the Houston Forensic Science Center’s recent claims that it has improved its credibility through openness and transparency.  相似文献

Forensic anthropologists have played key roles in the historical development of forensic science applications to global humanitarian and human rights issues. These anthropological initiatives can be traced back to the Smithsonian seminar organized by T. D. Stewart in 1968 and published in 1970. Key developments include the 1984 delegation sent by the American Association for the Advancement of Science to Argentina and the formation of the Argentine Forensic Anthropology Team. Subsequent highlights include major anthropological involvement in support of investigations by international criminal tribunals, formation of forensic anthropology teams in different countries and activities of the International Commission of Missing Persons and the forensic unit of the International Committee of the Red Cross. Recent developments feature the formation of the Humanitarian and Human Rights Resource Center of the American Academy of Forensic Sciences and its support of worthwhile projects in many countries. Forensic criminology examines the use of forensic science in society. Justice can be hampered, for example, if the communication of forensic scientific findings is unclear or misleading, even if unintentionally. Although various recommendations guide the communication of forensic science, it is unclear whether they are reflected in practice. This study explored the communication of forensic biology in 10 cases of major crimes against the person heard in the Tasmanian Supreme Court, where the standard practice is to issue brief summary reports in the first instance. The content of expert reports and corresponding testimony was analysed to determine its adherence to recommendations outlined in standards, practice notes, and research. While reports were found to be very brief, testimony elaborated on all major elements. Mostly elicited by the prosecution, some elements were volunteered by expert witnesses, or raised by defence. Overall, expert evidence in courts—but not reports (due to the use of brief summary reports)—largely adhered to recommendations. Further research is needed to determine the prevalence and effectiveness of alternative approaches to communication that were identified in certain cases.  相似文献

Preliminary tests for the detection of stains at crime scenes aim to focus the police work making them more efficient in the combat of criminality. The application of the luminol chemiluminescence reaction (3-aminoftalhidrazida) in presumptive tests for the detection of bloodstains is known for more than 40 years in forensic science. This reaction is based on the emission of light through the chemical reaction of luminol mixed with hydrogen peroxide and a hydroxide in the presence of a catalytic molecule (iron from the hemoglobin) (Laux [1]).This work evaluates the luminol interference and its effect on subsequent serological and DNA testing. Samples prepared with blood and different concentrations of luminol solution containing luminol, peroxide of hydrogen and sodium carbonate, were analyzed. Additionally, samples of serial dilutions of standard DNA mixed with luminol solution were also analyzed. Although presumptive tests with luminol do not establish the characterization and identification of stains at crime scenes, preliminary results indicated that it is suitable for the detection of invisible bloodstains for forensic analysis, with few detrimental effects on the serological tests and subsequent DNA recovery and typing.  相似文献

瘢痕鉴定是法医工作中重要的一项任务,对瘢痕的纹理、位置和长度等信息都有着细致的规定和要求。通过三维扫描仪可以便捷地获取点云数据,还原瘢痕区域的具体结构,为瘢痕鉴定提供新的工具。本文基于三维点云数据,提取瘢痕的趋势线,进行瘢痕长度测量。该方案首先对三维瘢痕数据进行投影,在二维平面上提取瘢痕的端点和关键点。然后在三维曲面上通过近邻搜索和向量内积的方法,依次连接所有关键点得到沿瘢痕表面的趋势线,计算瘢痕的长度。本文实验中使用的三维瘢痕点云来自某法医司法鉴定中心的工作内容,通过三维扫描仪提取。在实验数据上的应用结果显示,提取的趋势线在瘢痕表面贴合程度较好,可以跟随曲面进行弯折,可靠性很高。以点为核心的计算方法,在后续测量功能改进中也有较大的空间。  相似文献

Papaver somniferum, commonly known as opium poppy, is the source of natural opiates, which are used as analgesics or as precursors in the creation of semi-synthetic opioids such as heroin. An increase in opioid addiction in the United States has resulted in high rates of illicit opioid use and overdoses. It has recently been shown that P. somniferum DNA suitable for genetic analysis can be recovered from heroin samples. The development of a comprehensive genetic individualization tool for opium poppy could serve to link cases and strengthen programs such as the Drug Enforcement Administration’s (DEA) Heroin Signature Program, which seeks to combat rising opioid use.The purpose of this study was to develop a quantitative real-time PCR (qPCR) method for the quantification of opium poppy DNA, compare three commercial DNA extraction kits for their ability to isolate DNA from poppy seeds, and evaluate nineteen opium poppy short tandem repeat (STR) markers for their use in a forensic identification panel. Such a panel could be used for individualizing samples and determining the geographic origin in heroin or poppy seed tea cases. The qPCR method was proven to be reproducible and reliable, specific for P. somniferum, and sensitive enough for forensic case-type samples. Of the three kits tested, the nexttec™ one-step DNA Isolation Kit for Plants was the optimal method and facilitated rapid extraction of DNA from poppy seeds. The majority of evaluated STR primer sets were unreliable or had low discriminatory power, limiting their use for individualization of poppy samples. A six-locus STR multiplex was developed and evaluated according to Scientific Working Group on DNA Analysis Methods (SWGDAM) and International Society of Forensic Genetics (ISFG) guidelines, including the use of a sequenced allelic ladder. The multiplex was found to have low discriminatory power, with greater than two-thirds of samples analyzed having just two different genotypes. The multiplex was determined to be unsuitable for individualization; however, a genotype map was developed as a proof of concept that these markers may be useful for determining the biogeographical origin of samples. Searching the poppy genome for new STR markers and developing new primer sets may be necessary for the creation of a powerful genetic tool for the individualization of P. somniferum.  相似文献

For comparative glass examinations, the refractive indices (RIs) of recovered glass fragments are often compared to a test interval defined by measurements from a broken glass object. RI measurements from five modern float glasses were used via resampling to assess the frequencies of false exclusion errors for eight test criteria as functions of the number of measurements. The test criteria were based on ranges, fixed intervals, and multiples of standard deviations of the known source measurements. The observed error rates for the eight tests studied are between zero and c. 35%, depending upon the match criteria, the number of measurements, and the RI distribution for a glass source. The results of this study can be used to predict the false exclusion rate for a test criterion under a given set of conditions or to select test criteria that result in a desired error rate for these typical sheet glasses.  相似文献

Forensic anthropology in South Africa is well developed in the higher education sector, with advanced training and research programmes. Despite this and decades of academic involvement in casework, forensic anthropology still lacks a defined framework and mandate at a governmental level. Therefore, the involvement of forensic anthropologists’ expertise varies markedly between cases, provinces, and among various stakeholders within the country, to the detriment of dispensation of social and criminal justice. The lack of clearly defined guidelines for the rendering of the service was exemplified and demonstrated through a recent forensic case. Here, contextual information was absent, and the remains posed a challenge to analyse, ostensibly due to missing information. Numerous questions were raised during the analysis of the remains, and broader concerns about the investigative involvement of a forensic anthropologist within South African casework were brought to the fore. Through the analysis of this case, we describe the deductive processes that led to the formation of an opinion that the skeletal linear defects were the result of taphonomic changes. In addition, we highlight how these efforts where constrained and each step in the process unnecessarily hindered. Finally, we demonstrate the capacity and willingness of forensic anthropology practitioners to be involved, and how, without governmental support, it is a great potential lamentably untapped.  相似文献

目的 评估PowerPlexTM16体系在亲子鉴定中的检验能力。方法 以633例亲子鉴定案例为基础,调查PowerPlexTM16体系15个STR基因座的群体遗传学数据资料,并对该体系在亲子鉴定中的排除能力及遗传稳定性进行评估。结果 879名无关个体共检出197个等位基因,739种基因型,累计个体识别力为1×10-30,累计非父排除率为0.999999999999987。633例亲子鉴定案件中有95例确定为排除亲权,平均排除指标为6个。18例表现出1个STR基因座突变的现象,1例表现出2个STR基因座突变的现象。结论 PowerPlexTM16体系应用于亲子鉴定是高效、可靠的。  相似文献

Cannabis sativa L. is a plant cultivated worldwide as a source of fiber, medicine and intoxicant. Traditionally, is divided into two main types: fiber type (hemp) and drug type (marijuana). Marijuana differs from hemp by the presence of a high quantity of the psychoactive drug, Δ9-tetrahydrocannabinol. The development of a validated method using short tandem repeats (STRs) could serve as an intelligence tool to link cases by means of genetic individualization or association of cannabis samples. For this purpose, a 13-locus STR multiplex method was developed, optimized, and validated by the Department of Forensic Science at Sam Houston State University (SHSU) according to relevant ISFG and SWGDAM guidelines. The European community considers C. sativa plants illegals, even though its consumption is accepted in precise and limited places (coffee shops or cannabis clubs in Netherlands and Spain). However, there are different gaps in the legislation of some European countries. For instance, in Italy, “weed” possession is decriminalized. Although trafficking and sale are prohibited, possession of small quantities of marijuana is considered only a civil offense. In order to proceed with the kit evaluation and inter-laboratory comparison, SHSU DNA laboratory sent blind cannabis DNA samples of known genotypes. Blind DNA samples were analyzed in different laboratories with different sequencers and analysis conditions. In this article, the goals were: a) to demonstrate that 13-locus STR kit for C. sativa is robust enough and reproducible, in all forensic laboratories, and b) to show the applicability of the STR system in association with Cannabis sativa cases for intelligence purposes to link multiple cases by means of genetic individualization or association of cannabis samples.  相似文献

The transfer, persistence, prevalence, and recovery of DNA (DNA-TPPR) can be highly relevant in forensic investigations to evaluate the presence and/or actions of a person of interest (POI). Whilst the DNA-TPPR-related research has increased significantly over the last decade, there is a lack of data on companion animals and their relationship to human DNA transfer. Given the commonality of cats and dogs in households around the world, companion animals as receptors and vectors for DNA transfer can be highly relevant in cases involving animals as victims of a criminal offense, or cases requiring activity level evaluations. Samples were collected from an external area on the right side of 20 cats to determine the prevalence and sources of human DNA on this area. Preliminary data shows that human DNA is present on household cats, its source is mainly from household inhabitants. Further studies are required to elucidate the means and level of transfer of human DNA to and from cats and other household animals. This knowledge can be relevant to sample targeting in specific case circumstances and/or when considering possible means of the presence of a person’s DNA at the crime scene location.  相似文献
