Effectively addressing environmental challenges such as climate change will require adopting policy measures that have some impact on collective human behavior. The present research examined attitudes toward different environmental policies, specifically focusing on the role of perceived justice. Justice was measured in two ways: as an assessment of the fairness of a particular policy and as a general tendency to endorse statements related to environmental justice. Because justice judgments can be context specific, policies were presented in four conditions, in a 2 × 2 design manipulating the type of impact described, ecological or societal, and the level of focus, individual or collective. The roles of political ideology and environmentalism were also investigated. Results from an online sample of 162 US residents showed that non-coercive policies, overall, were rated as more acceptable. Environmental justice statements were strongly endorsed, and justice in both its specific and general forms was a determinant of policy acceptance. In particular, ratings of the fairness of specific policies were a stronger determinant of acceptability than perceived effectiveness of the policy. Type of impact had little effect, but policies tended to be rated as more acceptable when they were framed in terms of the collective rather than the individual. Although a liberal ideology was associated with acceptance of environmental policies in general and with endorsement of environmental justice, controlling for endorsement of environmental justice eliminated the effect of political ideology in most, but not all, cases. This study examines the relative importance of six policy outcomes related to different fairness principles for the perceived fairness and acceptability of pricing policies aimed at changing transport behaviour. The fairness and acceptability of six different types of transport pricing policies were systematically higher if policy outcomes were related to environmental justice and equality. The policy measures were evaluated as more acceptable and fair when respondents believed that future generations, nature and the environment were protected (reflecting environmental justice), and to a lesser extent, when everybody was equally affected by the policy outcomes (reflecting equality), irrespective of absolute differences in fairness and acceptability of the policies. Policy outcomes reflecting egoistic concerns (e.g. being financially worse off and being worse off than others) and equity (e.g. proportional to people’s income and contribution to problems) were related to the fairness and acceptability of some policy measures, but no systematic pattern was found across six policy measures. This suggests that policy outcomes related to distributions that focus on collective considerations appear to be more important for the fairness and acceptability of transport pricing policies than those focusing on individual interests. Theoretical and practical implications of these results are discussed.  相似文献

The uncertainty management theory (Lind and Van den Bos, Research in organizational behavior 24, 181–223, 2002; Van den Bos and Lind, Advances in experimental social psychology, pp. 1–60, 2002) proposes that perceived fairness decreases experienced uncertainty, and, thus, the importance of fairness is enhanced under higher uncertainty. For example, the six procedural justice principles (Leventhal, Social exchange: advances in theory and research pp. 27–55, 1980) can be seen to reduce uncertainty in the long run by producing higher quality decisions. However, the decision-making process itself also may cause uncertainty, especially when the process is prolonged. Thus, we bring the speed of the decision-making process into discussion as one justice principle. We suggest that people use speed-related information as heuristic information and substitute lacking procedures-related information by drawing inferences from the speed of the decision-making. We propose that the speed of decision-making has a twofold effect on perception of procedural fairness: very fast and very slow decision-making processes are perceived to produce more uncertainty than moderate time processes, and consequently, a moderate process is expected to be related with more positive fairness perceptions than very slow or very fast processes. The statement was further tested by examining the mediating role of procedural fairness perceptions in the relationship between speed and its one consequence, perceived legitimacy, with a survey sample (N = 846) in the context of Finnish forest policy. The analysis confirmed the hypotheses. The role of speed as a justice rule and its contribution to the uncertainty management theory is discussed.  相似文献

A key problem in trying to manage diverse societies is finding social policies that will be acceptable to all individuals and groups. Studies suggest that this problem may not be as intractable as is often believed, since people's acceptance of policies is shaped to an important degree by the fairness of the procedures used by authorities to make policy. When policies are fairly made, they gain widespread support, even among those who may feel that the consequences of the policy for them or their group are undesirable or even unfair. These findings support an optimistic view of the ability of authorities to manage diverse societies. On the other hand, research suggests that the ability of procedural justice to bridge differences among individuals and groups may not be equally strong under all conditions. People's willingness to accept policies is more influenced by procedural justice judgments when they identify with the society that the authorities represent and view them as representing a group of which they are members. They are less influenced by procedural justice judgments when they identify more strongly with subgroups than with society and/or view the authorities as representatives of a group to which they do not belong.  相似文献

Research suggests that restorative justice (RJ) conferences are more just than traditional court processing due to the presence of procedural justice (PJ). These conferences also promote reintegrative shaming which, in contrast to disintegrative shaming, allows offenders to repair their ties with the community. Yet, fairness and the type of shaming experienced may depend on perceptions of the offender. We argue that the personality traits of negative emotionality and low constraint influence offenders' evaluations of the fairness of these conferences, which have implications for their experience of shaming. We test these arguments using data from a sample of 498 offenders involved in the Australian Reintegrative Shaming Experiments. Results reveal that personality traits affect perceptions of PJ and both types of shaming, and that PJ mediates these effects. The findings support the notion that RJ conferences are perceived to be procedurally just and reintegrative for certain types of offenders.  相似文献

Abstract

The current study explored how gender, group membership and different emotional reactions to the crime of domestic violence predict attitudes and endorsement of restorative or retributive justice practices. The experiment consisted of a 2 (victim group membership: Muslim- or Anglo–Australian)×2 (offender group membership: Muslim- or Anglo–Australian)×2 (Sex of participant) between-participants factorial design. Anglo–Australian participants (43 men; 50 women) were randomly assigned to one of the four manipulated conditions, and completed an online questionnaire that involved viewing a short video clip of a woman describing her experience as a domestic violence victim. Results revealed strong preferences for restorative justice in dealing with domestic violence, with women supporting this practice more than men. The crime was perceived as most severe and retribution was endorsed most strongly when the victim was Anglo–Australian (i.e. an in-group member). Intra-group violence was also perceived to be a greater breach of shared Australian values than inter-group (i.e. cross-cultural) domestic violence. Emotional reactions further predicted participants' responses, with hatred predicting stronger support of retributive ideals and sympathy for the victim predicting greater endorsement of restoration.  相似文献

In recent decades, the number of women under criminal justice supervision has increased considerably, many of whom are serving time for drug offenses. Furthermore, women in prison are more likely than their non-institutionalized counterparts to suffer from a substance abuse disorder. While there is a growing body of research concerning women offenders’ drug abuse and treatment needs, few studies have examined the substance abuse treatment outcomes of women in the criminal justice system. Using data from Outcome Evaluation of the Forever Free Substance Abuse Treatment Program, this study compared women’s self-reported drug use twelve months after participation in high-intensity (n = 101) and low-intensity (n = 81) prison-based substance abuse treatment programming (N = 182). Women who perceived high levels of emotional social support were less likely to report substance use at 12-month follow-up. Furthermore, perceptions of emotional social support and treatment intensity interacted in their association with relapse, such that the protective effect of social support was strongest for women who participated in high-intensity programming. The results of the analyses highlight the importance of perceived social support for women with substance abuse disorders who are transitioning from prison-based substance abuse treatment programming to the community.  相似文献

We examine the impact of an Australian state government's decision to appoint a considerable number of women to its previously all-male Magistrates' Courts. Interviews with a sample of 30 male and female magnistrates revealed ready acceptance of this major change, probably because of organizational peculiarities of the jurisdiction. The advent of women as judicial decision makers was perceived to have improved the work environment of the courts. Comparison of the ways in which male and female magistrates perceive aspects of their job (e.g., judicial role, adjudication, sentencing, and the conduct of informal proceedings) suggests that most of the apparent gender differences are more likely the product of age and background than evidence of justice “in a different voice.” Changes in court ideology suggest that the appointment of women may have been used to further more general political objectives. A critical question for feminist research might be: When and why do conservative institutions adopt strategies that apparently promote women's interests?  相似文献

Public recourse to vigilante self-help has often been attributed to a lack of effective state intervention; less attention has been given to the character of this intervention. Using the Tylerian procedural justice perspective, I argue in this article that perceived procedural injustice contributes to increased public support for violent self-help mechanisms such as vigilante violence. The current study tests this theoretical argument using survey data of 374 residents of Accra, Ghana. The results show that age, education, and police trustworthiness were the most significant predictors of support for vigilante self-help. The impacts of procedural fairness were found to be embraced within police trustworthiness, but perceptions of police effectiveness and experience of police corruption were not statistically significant predictors of vigilante support.  相似文献

Two correlational studies test the hypothesis that procedural justice, or fairness of process, plays a role in acceptance of agreements reached through bilateral negotiation. Both studies test the relationship between the fairness of the process used to resolve a dispute, objective monetary outcomes, subjective assessments of outcome favorability, and subjective assessments of outcome fairness. Additionally, the second study tests the hypothesis that negotiations characterized by greater procedural justice result in more potential for integrative bargaining. The results suggest that procedural justice encourages the acceptance of negotiated agreements, as well as leading to the opportunity for increased integrative bargaining.  相似文献

The focus of this study is to examine citizen satisfaction with the police. Specifically, the authors aim to understand the factors that determine citizen satisfaction with police services in India, a former English colony and a relatively new republic that has achieved a significant economic development in recent decades. Findings from analysis of a convenience sample (N = 845) obtained from four Northern states in India suggest that perceived procedural fairness, fear of crime, and age of the respondents predict satisfaction with police services. Moreover, perceived professionalism of police officers is found to increase their perceived procedural fairness.  相似文献

There is little research on the associations between acceptance of and experiences with intimate partner violence (IPV) in rural samples, which may be different from associations in urban areas due to the higher prevalence of IPV in rural areas and the social and physical environment issues related to seeking help. The purpose of our study was to determine the proportion of participants who reported accepting male- and female-perpetrated IPV and the associations between experiences of IPV and acceptance of IPV. Data were collected from a cross-sectional survey of rural residents in one Midwest state. Approximately 4 % of participants reported it is ever acceptable for a male to hit his partner. Approximately 20 % of males and 12 % of females reported it is ever acceptable for a female to hit her partner. A higher proportion of individuals who were victims or perpetrators of IPV reported accepting retaliatory IPV (i.e., when partner hits first) perpetrated by individuals of their own gender. This finding suggests the previously reported high rates of bidirectional IPV in rural areas may be fueled by this acceptance of physical retaliation. Interventions to break this cycle of IPV may be guided by qualitative research into the specific ways the rural environment contributes to acceptance of retaliatory aggression.  相似文献

Compared to extant studies, this study uses more rigorous analyses to describe social justice attitudes and their correlates among a nationally representative sample of 2,811 U.S. ninth-graders. Females and adolescents with more educated mothers tended to express more support for social justice. Strikingly, about 90 % of adolescents believed that equal opportunity to obtain a good education exists in the U.S. Adolescents were also more likely to support abstract social justice principles rather than solutions that promote social justice: about 80 % agreed that all races and genders should have equal opportunities, but only 55 % reported that government should be responsible for individuals’ economic needs. Differences between U.S. adolescents’ and adults’ attitudes are noted, and implications for future research are presented.  相似文献

Objectives

This study tests the generality of Tyler’s process-based model of policing by examining whether the effect of procedural justice and competing variables (i.e., distributive justice and police effectiveness) on police legitimacy evaluations operate in the same manner across individual and situational differences.

Methods

Data from a random sample of mail survey respondents are used to test the “invariance thesis” (N = 1681). Multiplicative interaction effects between the key antecedents of legitimacy (measured separately for obligation to obey and trust in the police) and various demographic categories, prior experiences, and perceived neighborhood conditions are estimated in a series of multivariate regression equations.

Results

The effect of procedural justice on police legitimacy is largely invariant. However, regression and marginal results show that procedural justice has a larger effect on trust in law enforcement among people with prior victimization experience compared to their counterparts. Additionally, the distributive justice effect on trust in the police is more pronounced for people who have greater fear of crime and perceive higher levels of disorder in their neighborhood.

Conclusion

The results suggest that Tyler’s process-based model is a “general” theory of individual police legitimacy evaluations. The police can enhance their legitimacy by ensuring procedural fairness during citizen interactions. The role of procedural justice also appears to be particularly important when the police interact with crime victims.

The perceptions of 460 Finnish forest owners regarding national forest policy were examined with a questionnaire measuring institutional legitimacy, procedural justice, perceived uncertainty, and satisfaction with decisions. Research hypotheses, which were derived from the group-value theory and the system justification theory, were tested. The results showed that high institutional legitimacy reduced the effect of procedural justice on the satisfaction with political decisions. Procedural justice predicted the acceptance of decisions only when institutional legitimacy was low. Moreover, perceived uncertainty increased the perception of legitimacy. The implications of these findings for a social psychological theory of legitimacy and policymaking are briefly discussed.  相似文献

Just world research has shown that observers derogate victims more for their misfortunes if the perpetrator is not harshly punished (Lerner in J Personal Soc Psychol 1(4):355–360, 1980). However, few studies have investigated minority group derogation as a just world preservation strategy after instances of intergroup harm-doing. This study is among the first to demonstrate the derogation of both individual victims and of the victim’s minority group experimentally, using the context of a racist hate crime in Australia. In the present experiment, participants (N = 110) read a news article describing a hate crime against an Aboriginal Australian teenager and were informed that the perpetrator was harshly or leniently punished (secure vs. justice threat condition). Our results show that in the justice threat condition, participants not only derogated the individual Aboriginal Australian victim more after his death, they also expressed greater racism toward the victim’s group. An indirect effect of the justice threat condition on modern racism via individual victim derogation was observed, along with moderating effects of individual differences in belief in a just world. These findings provide support for the alarming hypothesis that racist hate crimes are not only the manifestation of a racist society, but may also bolster racial prejudices if leniently treated. The results highlight the important role of political and judicial authorities, whose response or non-response to a hate crime can exacerbate or ameliorate existing prejudices.  相似文献

Abstract

Access to justice is a key theme in the family justice system, especially for those with particular vulnerabilities. Autism, a development condition characterised by difficulties in social communication and interaction, and the presence of rigid, repetitive behaviours, presents particular challenges in this area. This paper reports the findings of a mixed-methods study with legal professionals working in the family justice system, asking about their knowledge of autism, their perceived self-efficacy when working with autistic clients, and their experience of cases involving autistic litigants. The study reports high levels of knowledge, but low levels of confidence, by legal professionals (N = 204), and addresses the experiences of particular cases in follow-up discussions (N = 10). The paper concludes by making a series of recommendations for legal professionals to assist autistic people to engage fully in family court proceedings.  相似文献

Justice is an increasingly important concept to examine with regard to decisions about environmental conflicts. But justice can be defined in a number of ways. This paper argues that the perceived importance of different principles of justice to environmental decisions is affected by the position argued, by contextual manipulations, and by individual difference variables. Literature is reviewed in support of the first of these points, suggesting that environmentalism is more congenial than antienvironmentalism to macrojustice principles. Data are presented to show that the way in which a conflict is described, in general or specific terms, affects the perceived importance of some justice principles, and that subject gender and environmental ideology are also related.  相似文献

In analyzing the data from a structured interview survey with Japanese litigants of civil trials, we examined the relationships between their perceptions of outcomes and process of the trials, responses to the trials, and evaluation of the judicial system. The results showed that both favorability of trial outcomes and procedural fairness of trials increased satisfaction with the trial outcomes and evaluation of the judicial system. Satisfaction was largely determined by perceived favorability, while the evaluation of the judicial system was largely determined by perceived procedural fairness, suggesting a justice bond effect that justice fortifies people's societal commitment. Consistent with procedural justice theories, the perception of procedural fairness was increased by the sense of control and the appraisal of relational factors, though both were affected by favorability.  相似文献

Defendants'perceptions of the fairness of their criminal processing outcomes have been the stated concern of some criminal justice reformers. Past research has suggested that these perceptions are influenced by characteristics of the outcome received as well as by characteristics of the process through which the outcome is imposed. This analysis tests a theoretical path model of perceived outcome fairness, which examines the relative influence of both outcome and process characteristics, using survey data collected from 619 prison inmates incarcerated in Minnesota and Illinois. The results indicate that factors related to both outcome and process significantly influence sample inmates'perceptions of their criminal justice processing outcomes and together explain a substantial portion of the total variance. However, two process-related characteristics are found to be the most powerful predictors of perceived outcome fairness. Inmates'perceptions that they are fairly treated by their lawyer, judge, and prosecutor are the strongest correlates of perceived outcome fairness, followed by the mode of disposition through which their outcomes are imposed; inmates who plea bargain are more likely than those who go to trial to perceive their outcome as fair.  相似文献
