There is increasing consensus that the perspectives of children need to be taken into account in decisions made by divorcing parents and the courts and that young adults who have lived through their parents' divorces can be an important source of information about children's perspectives. In this study, the authors assessed the perspectives of 820 college adults from divorced families on the issue of children's living arrangements after divorce. Respondents wanted to have spent more time with their fathers as they were growing up, and the living arrangement they believed was best was living equal time with each parent. The living arrangements they had as children gave them generally little time with their fathers. Respondents reported that their fathers wanted more time with them but that their mothers generally did not want them to spend more time with their fathers.  相似文献

Over recent years, concern has mounted at the unstable natureof cohabiting relationships compared to marital ones, and alsoabout the fact that any children from these relationships aremore likely to experience the separation of their parents thanthe children of a marital union. The discourse of the FamilyLaw Act 1996 holds that separating parents should behave ina conciliatory and reasonable way to each other, maintain contactwith their children and continue to be involved in their upbringing,and ensure that financial obligations are met. This articleuses data obtained through interviews with previously cohabitingparents who have attended pilot group meetings designed to educatethem about the needs of their children on separation, to examineto what extent parents internalize this discourse when negotiatingpost-separation parenting. The article concludes that whileparents may take on board the principles of this socially acceptablediscourse, they have their own moral rules derived from theirown histories and experiences of what it is to live their lifeand parent their child that they must marry with this discourse.The extent to which current family policy discourses and legislativeframeworks can influence the behaviour of parents is thereforemitigated by their own interpretations within the context oftheir own lives.  相似文献

The debate about the benefits and drawbacks of overnight schedules for young children is hotly contested in family law. This study investigated connections between occurrence of overnights, schedule consistency, number of caregivers, and young children's adjustment to parental separation and divorce. Families ( N = 161) with children aged 6 years or younger were recruited at the time of filing for divorce or child custody (if unmarried); follow-up data were obtained from 132 families 15 to 18 months later. Results indicated that parenting plan variables are related to children's social, cognitive, and emotional behavior, with caregivers and schedule consistency more salient than overnights. Girls benefited from overnights and more caregivers, whereas boys did not. Overnighting children aged 4 to 6 years when their parents filed manifested fewer problems 1.5 years later than did younger children. Even when controlling for parental conflict and parent-child relationship variable, the constellation of parenting plan variables contributed to young children's adaptation.  相似文献

This article outlines the views of children and parents involved in family law disputes, about the need for and appropriateness of children's participation in decisions regarding residence and contact arrangements. Ninety parents and 47 children (ranging in age from 6 to 18 years) who had been through parental separation, were interviewed. Both parents and children had a range of views about the general appropriateness and fairness of children being involved, but the great majority, particularly of parents, thought that children should have a say in these matters. Core findings of the study include the considerable influence that older children had over the arrangements either in the aftermath of the separation or in making further changes over time, and the higher stated need of children who had experienced violence, abuse, or high levels of conflict to be heard than those in less problematic and noncontested matters. Parents involved in contested proceedings supported the participation of children at a younger age than those who were not. There was a reasonable degree of agreement between parents and children about the need for children to be acknowledged and the value of their views being heard in the decision‐making process. Parents, however, expressed concern about the pressure and manipulation that children can face and exert in this process, whereas children were generally more concerned about the fairness of the outcomes, and maintaining their relationships with their parents and siblings.  相似文献

Parents who experience great amounts of legal conflict as they dissolve their relationship and arrive at their parenting arrangements require an outsize proportion of courts’ time and resources. Additionally, there is overwhelming evidence that conflict has a deleterious effect on their children. We partnered with the family court to conduct a study comparing the effectiveness of two programs for families deemed by their judge to be high conflict and thereby mandated to a program. Both involved one 3‐hour session; the existing program, Parent Conflict Resolution (PCR), used exhortational lecture and video; the newly designed experimental program, Family Transitions Guide (FTG), based on motivational interviewing, employed exercises attempting to get parents to decide for themselves what they needed to do for the sake of their children. Parents were assigned at random to one of the two programs (the literature often terms this a randomized clinical trial) and were interviewed just before it began and 9 months later, as was a child. Results showed that child's report of their own well‐being was significantly improved by FTG as compared to PCR and that these effects were mediated by children feeling less caught in the middle. On several variables, parent report showed that parents in PCR as compared to FTG felt decreased problems in co‐parenting and less interparental conflict, although the effects were not consistent across mother and father report. There was also evidence of diminished legal conflict over 9 months in FTG as compared to PCR.  相似文献

This article touches upon theories accounting for the rise in adolescent anxiety and depression and how the prevalence of adolescent anxiety and depression affects how we navigate parenting plan evaluations. This article also discusses the importance of screening youth for depressive and anxious symptoms and assessing family, parental, and youth risk and protective factors related to adolescent depression and anxiety. This article also highlights the importance of assessing for mediating factors that increase the risk of anxiety and depression in youth in the context of parental separation, such as interparental conflict, financial difficulties, and limited contact with one parent. This article also identifies various methods of assessing depression and anxiety, including the adolescent interview, observations during the interview, and self-report measures. Additionally, this article discusses potential interventions that address mediators of the impact of divorce, such as parenting problems, family conflict, or the parent–child relationship.  相似文献

In correspondence with terror management theory, the findings of two experiments show that reminders of death lead to stronger effects of perceived fairness on ratings of negative affect. Furthermore, in line with the theory's self-esteem mechanism, results of Experiment 1 suggest that state self-esteem may mediate this relationship between mortality salience and fairness. In further correspondence with the self-esteem mechanism, findings of Experiment 2 reveal that introducing an activity (after reminders of death and before the fairness manipulation) with which people can reaffirm positive conceptions of themselves leads people to react less strongly to variations in fairness than not introducing such a self-affirmation activity. These findings suggest that people react especially strongly to perceived fairness when they are in need for a boost in their self-esteem. Implications for the psychology of fairness are discussed.  相似文献

This article describes a parent education program for high-conflict families in the Multnomah Country Circuit Court, Portland, Oregon. The method emphasized an educational approach teaching conflict resolution skills. This course was rooted in the tenets of cognitive restructuring: if parents think differently about the other parent and their shared task of raising their children, they will feel differently, and they will act differently. The authors beleived many of the difficulties between parents were caused by the negative perception of the other parent created during the spousal relationship. They also believed the key to successful co-parenting is to reframe these perceptions emphasizing cooperation and joint problem-solving. Furthermore, they believed as the cooperation and joint problem-solving improvement would have a positive, reinforcing effect. Finally, the authors believed parents must learn to separate conflict in the spousal role from conflict in the parenting role.  相似文献

The lack of an articulated model of parenting competence and the limited use of empirically based assessment procedures is a weakness of current parenting capacity assessment protocols. The current article attempts to address this issue through the application of attachment theory and research in assessing one of the most critical components of parenting capacity assessments: the parent–child relationship. New empirically and attachment‐based assessment tools and procedures, well suited for the assessment of parental fitness, are presented, along with recommended practice guidelines to enhance the assessment of the parent–child relationship in cases of young, maltreated children (under 6 years of age).  相似文献

It is increasingly common that children of divorce are geographically separated from one of their parents. This article considers the challenges that arise from that reality by exploring this problem from a variety of perspectives and by providing practical tips to minimize the impact of the distance. A review of the Ontario caselaw and Arizona Guidelines reveal that certain factors are important in the resolution of these disputes, including: the age of the child, mode of transportation between homes, distance, prior contact, and feasibility of virtual access. Court‐ordered access may include remedies that, absent the distance issue, may be considered extreme, including moving to overnight/extended access periods for young children, permitting children to travel unaccompanied, favoring the nonresident parent for holidays and vacation time, allowing children to decrease contact with the nonresident parent, and decreasing or terminating child support. Where distance dictates the in‐person and virtual access schedules, creative solutions are critical to the successful resolution of these cases. Forward thinking family law professionals can meaningfully help parents to achieve better outcomes for children.  相似文献

This article reviews the available literature to give an overviewof what is currently known about the situations and experiencesof mothers who become the non-resident parent post-separation/divorce.Comparisons are made with non-resident father literature wherepossible in order to explore the similarities and differencesin women and men’s experience of parenthood across households.The principal question explored is: to what extent do the experiencesof non-resident parents relate primarily to gender, or to theirstatus (as non-resident parent), or a combination of the two?Findings indicate that there are many similarities in womenand men’s experience regarding the difficulties they eachencounter when parenting at a distance. However, dominant culturalnorms, which indicate that mothers should be co-resident withchildren, make the experience of non-resident motherhood a differentpsychosocial phenomenon from non-resident fatherhood. It isargued that more information is needed regarding the distinctexperiences of both mothers and fathers if there is to be amore comprehensive understanding of non-residential parenting.Also, the steady rise in the number of non-resident motherssuggests a need for further investigation of parental role-reversalpost-divorce parenting arrangements. Specifically how this typeof arrangement impacts upon child welfare and whether this typeof post-divorce parenting arrangement is acceptable to men andwomen as individuals and also to society in general.  相似文献

Following uncertainty management theory, we argue that when people face increased uncertainty, fairness becomes more important to them and judgments of fairness affect their reactions more strongly. The organizational field study reported here examines the effects of uncertainty about performance standards and appropriate behaviors on the relationship between fairness and job satisfaction. Results reveal that uncertainty moderates the positive relationship between fairness perceptions and job satisfaction such that the more uncertain people are about performance standards and appropriate behaviors, the stronger the relationship between fairness and job satisfaction. Further results reveal a significant moderating effect of uncertainty specifically for procedural fairness and interactional fairness. We discuss the implications of our findings for the uncertainty management model.  相似文献

Divorce and the resultant process of child custody decision making impact heavily on the lives of children. Increasingly, parents and professionals have realized the importance of encouraging shared responsibility in child rearing following separation and divorce. This shared responsibility must continue throughout a child's life and into young adulthood. This article introduces a comprehensive child-and family-focused model of decision making. The goal of this model is to assist professionals in their work with parents and to help parents formulate parenting plans that reflect the ever-changing developmental needs of each child and that specify how each parent will meet the particular needs of each child in the family. Through the use of educational parenting seminars and the completion of a Needs Assessment for each child, flexible parenting plans are created and positive co-parenting skills develop.  相似文献

We report on a sample of 90 child custody evaluators in the United States, who completed an online questionnaire on their attitudes and beliefs in child custody relocation cases. Findings indicated that the vast majority of participants relied on relevant professional literature and utilized a relocation risk assessment forensic model. Participants found many risk, protective, and specific relocation factors important, but the triad of past parental involvement, support for the other parent, and child's age were afforded the most importance. Participants also reported that the moving parents sought relocation for educational/vocational reasons, to receive support of their extended family, or to remarry, while the nonmoving party most commonly opposed relocation due to fears of interference/damage to the nonmoving parent–child relationship, restrictive gatekeeping, and alienation. A common trend among participants was concerns over the possible detrimental impact of any relocation on the nonmoving parent–child relationship and quality of co‐parenting. The vast majority of participants reported that they made specific recommendations to the court about relocation, and the court agreed with their recommendation the overwhelming majority of the time. Premised on the understanding that domestic violence is a broad concept that encompasses a wide range of behaviors from isolated events to a pattern of emotional, physical, and sexual abuse that controls the victim, this article addresses the need for a differentiated approach to developing parenting plans after separation when domestic violence is alleged. A method of assessing risk by screening for the potency, pattern, and primary perpetrator of the violence is proposed as a foundation for generating hypotheses about the type of and potential for future violence as well as parental functioning. This kind of differential screening for risk in cases where domestic violence is alleged provides preliminary guidance in identifying parenting arrangements that are appropriate for the specific child and family and, if confirmed by a more in‐depth assessment, may be the basis for a long‐term plan. A series of parenting plans are proposed, with criteria and guidelines for usage depending upon this differential screening, ranging from highly restricted access arrangements (no contact with perpetrators of family violence and supervised access or monitored exchange) to relatively unrestricted ones (parallel parenting) and even co‐parenting. These studies were designed to assess ethnocentrism and stereotypes as possible mediators of intergroup fairness biases. In Study 1, subjects wrote fair and unfair behaviors about their own sex (the ingroup) and the opposite sex (the outgroup). More fair and fewer unfair behaviors were written about the ingroup than about the outgroup, supporting the ethnocentric hypothesis. In Study 2, subjects rated the fairness and frequency of random samples of each item type. Half the subjects rated these items as they were originally written, and half rated them with the gender of the actor reversed. Ethnocentrism was evident in ratings of ingroup actors as more fair than outgroup actors when both performed fair behaviors, but this bias was reversed in favor of outgroup actors for ratings of unfair behaviors. In addition, the items written about women were rated more fair than those written about men, and men rated the reversed gender items less fair and less frequent than did women, supporting the influence of gender stereotypes in intergroup fairness biases.  相似文献

This article describes a court‐community model program for high conflict divorced families that is designed to reduce the level of inter‐parental conflict including: a) child exposure to inter‐parental conflict; and b) the frequency of re‐litigation over residential arrangements and parenting plans. The six‐session (16‐hour) program combines conflict resolution and group/community support. The program provides a “Personal Support Team” and “Personal Plan of Action” to help each parent control emotions and maintain agreement. The results of research conducted to explore the effect of the program on level of triangulation and inter‐parental conflict, as well as the frequency of re‐litigation over parenting plans, residential arrangements, and parenting time are reported.  相似文献

We provide evaluation results for Kids' Turn, a community‐based divorcing parent education program. Based on pre‐ and post‐test results from 61 parents, we found that parents reported improvements over time in interparental conflict, the number of topics parents argue about, parental alienation behaviors, parent anxiety and depression, and children's internalizing behaviors. These changes over time remained after we accounted for child sex, parent and child age, and time since separation. However, we did not observe any change in parenting behaviors. We discuss these results in light of factors influencing the ability of community‐based programs to affect change in families after divorce.  相似文献

In a qualitative study, 302 homeless young people (aged 12 to 20 years) were asked to discuss their reasons for leaving home. Some 103 youth cited physical violence by a parent or stepparent, and of these, 39 cited their mother's or stepmother's violence as the reason for leaving home. Females were more likely than males to report being the target of violence by their mother; however, the converse was true for stepmothers. Several discrete reasons for maternal violence were identified, including maternal personal characteristics and behaviors, issues associated with blended families, or young people's own behavior. In some cases, young people reported violence by both parents. Their attributions of maternal violence centered on a single dimension of the mother/stepmother or her relationship with a partner. They rarely discussed the contribution that they had made to the conflict or acknowledged the social context that may have been a catalyst for violence.  相似文献
