There is a widespread view that one does either theory or empirical work, and that theory and empiricism represent distant concerns, opposing worldviews, and perhaps distinct mentalities or personalities. This prevalent view has deep roots and is also the result of pragmatic and understandable tendencies toward division of intellectual labor. Against this view, this essay suggests that the relations between theory and empirical study ought to be understood as more intimate and that making legal theory an explicit focus can improve empirical scholarship. We pursue this claim by articulating a basis for legal theory and by showing how that basis illuminates both the application and design of empirical research on law. Legal theory, we argue, follows jurisprudence in interrogating the law as a set of coercive normative institutions. The upshot of this approach is a recognition that an interdisciplinary analysis of law must rely on both a theory (explicit or implicit) of the way law's power and its normativity align and an account of the way in which this discursive cohabitation manifests itself institutionally. We thus argue that legal theory is necessary in order to draw fruitfully on empirical research and further claim that legal theory provides guidance both for setting up an empirical research agenda on law and for designing research into specific topics.  相似文献

Abstract

Despite the fact that part‐time law students comprise a significant proportion of law undergraduates, there continues to be an absence of legal research that considers the experiences and aspirations of such students as a distinct group. Against this backdrop, it is argued that these students require further research and attention for a number of reasons. First, their location allows a consideration of the extent to which broader governmental objectives for higher education are being met within law schools. Second, the extent of their presence in higher legal education places an important obligation upon law schools to explore the specific needs of this cohort and to consider the extent to which part‐time law students can be legitimately subsumed into the undergraduate cohort in terms of resources and planning. Third, the legal ambitions of many part‐time law students require a fresh consideration of the expectations of the recruiting legal profession and the legal profession's commitment to broadening social diversity within its ranks. Finally, as the experiences of part‐time and full‐time students become closer, a proper analysis of part‐time law students may provide invaluable information as to how law schools could adapt to meet the needs of all students in the future.  相似文献

Law students’ future clients and employers, and the broader community, all deserve graduates to be equipped with not only substantive legal knowledge, but also a range of skills and practical knowledge. However, most law schools face resource pressures that mean that traditional skills development methodologies (which are often resource intensive) can only be used judiciously. In this resource-poor environment, skills development methodologies which incorporate new technologies can be one way to assist law students to develop the professional skills they require. Online learning tools have the potential to be resource friendly, and law schools may therefore be able to utilise them to ensure that maximum learning potential is achieved from the limited resources available. Considering an online or blended skills development framework is also supported by evidence that new technology learning tools can usefully contribute to skills development. In this article the potential for online learning to replicate aspects of an apprenticeship model of learning is explored, as a means of explaining this contribution. This analysis is intended to facilitate consideration of a broad panoply of learning tools for skills development, and inform educators considering adding a new technology component to student skills development.  相似文献

Much extant research suggests that students who enter law school highly enthusiastic about public interest law and pro bono work often take mainstream jobs with minimal participation in pro bono activities. Frequently, these studies place some of the blame on law schools. This study, however, suggests that law schools, as well as mentors in first post-graduation jobs, might positively affect attorneys' level of commitment to pro bono work. This longitudinal study is unique in that it includes measures of students' attitudes during law school and in mid-career. It raises the possibility that attorneys whose level of commitment to pro bono work did not decrease since law school were substantially influenced by their law school training and early career mentors. Although some students will leave law school with less dedication to public interest law and pro bono work, this study offers hope that, through legal education and mentorship, other students will maintain their strong commitment to helping poor clients.  相似文献

The present paper critically analyses the essence of legal education in the training of medical professionals in Ghana. It argues that health professionals lack the requisite knowledge in law, especially the legal implications of medical malpractice, and calls for legislative and curricular reforms in institutions engaged in the training of health professionals to reflect a legal education component. The authors opine that the basic medical law curriculum should be focused on the kinds of legal problems that physicians encounter most frequently in practice rather than on sensational cases. The authors are of the view that the curriculum should address the clarification of central concepts in law, the ability to apply the concepts, decision‐making procedures, acquisition of legal knowledge in tortuous and criminal matters relevant to the medical profession. This view sets objectives for teaching medical law to medical students and young doctors.  相似文献

This paper examines Sustainable Development Goal 16.9 on legal identity for all. It considers notions of legal identity in international law and looks at legal frameworks for legal identity in Commonwealth member countries, including in respect of birth registration, national identity registers and cards, legal identity requirements for transactions and services, and new forms of digital identity. The paper examines specific legal issues relevant to identity, including privacy and data protection, identity theft and property rights. It concludes by reviewing the latest developments in concepts of identity, and applicable emerging technologies. It makes recommendations in respect of legal and policy reform that Commonwealth member countries may undertake with a view to meeting SDG Target 16.9.  相似文献

In this article, I discusssimilarities and differences between legaltranslators and legal interpreters. Thediscussion is centred around the impact thatthe choice of background assumptions as tomeaning of linguistic items in legal texts hason the way lawyers and translatorsconceptualise their own work, respectively. Thedispute between proponents of a strong and aweaker approach to legal meaning in legalinterpretation is presented and the relationsto legal translation is investigated.
