A planned approach for transferring research knowledge

Several sources are quoted that substantiate the concept that for technology to be effectively used it is necessary to disseminate the technology using a variety of means. The paper then goes on to describe in detail the Forest Service approach to technology dissemination. Some data is shown that substantiates the effectiveness of the Forest Service planned approach to the transferring of research knowledge.     

Center for Biological Diversity v U. S. Forest Service: A New Type of Claim or Just Another Step in the Chain of Causation?1

Abstract

This article discusses what it means to “contribute” to waste disposal as that term is used in section 7002 of the Resource Conservation and Recovery Act. More specifically, the article examines whether the US Forest Service can violate section 7002 by not regulating hunting. Among the issues addressed are whether one can contribute to waste disposal passively, whether one can contribute to waste disposal without taking any action that addresses waste disposal and the extent to which the statutory term “contribute” is analogous to the common law concept of causation.     

The postmortem fate of Pat Gregory: a disinterred Native American

In late June 1990, the Mono County Sheriffs Department in Bridgeport, CA contacted the Physical Anthropology Human Identification Laboratory (PAHIL) at California State University, Chico to seek assistance in the identification of a recently discovered skull. To assist with possible identification, the cranium received a classic physical anthropological/morphological analysis to suggest the decedent's sex, age at death, ancestral affiliation, and uniqueness. It was concluded the cranium was that of an older male, and someone with mixed ancestry, probably Native American/White. Suggested uniquenesses were an eroded and greasy texture, with adhering white sand, evidence of healed antemortem nasal fractures, and a bifid left occipital condyle. The cranium was confiscated from a man suspected of vandalizing a Native American cemetery just south of the community of Lee Vining. The cemetery was established in the mid-1800's by local Native American tribes. Although ownership of the land was disputed by the US Forest Service (the Inyo National Forest), and the Los Angeles Department of Water and Power (LADWP), county authorities claimed that because the incident involved the desecration of a cemetery and human remains, it was a legal issue, and therefore, the Sheriff's Department had jurisdiction over the case if not the land. The suspect pled guilty to the possession of Native American remains but claimed not to have desecrated a grave. Over the next year and a half, members of the Native American community representing various tribes sought the return of the cranium, while also seeking assurance that it belonged to the vandalized grave. While county, US Forest Service, and LADWP officials continued to argue over whom had jurisdiction of the remains the superior court judge ordered the county to pay for any analysis necessary to determine if the cranium belonged to the decedent in question. This report addresses the conclusions of that analysis and the disposition of the case. Furthermore, the report addresses the forensic value to Native Americans of the continued study of a wide variety of human skeletal remains.

Verification of eligibility for public benefits--INS. Proposed rule

This rule amends the Immigration and Naturalization Service ("Service") regulations by establishing a new part requiring certain entities that provide Federal public benefits (with certain exceptions) to verify, by examining alien applicants' evidence of alien registration and by using a Service automated verification system that the applicants are eligible for the benefits under welfare reform legislation. The rule also sets forth procedures by which a State or local government can verify whether an alien applying for a State or local public benefit is a qualified alien, a nonimmigrant, or an alien paroled into the United States for less than 1 year, for purposes of determining whether the alien is eligible for the benefit. In addition, the rule establishes procedures for verifying the U.S. nationality of individuals applying for benefits in a fair and nondiscriminatory manner.     

世界贸易组织补贴规则研究

世界贸易组织法律体系中关于补贴问题主要规定在三个法律文件之中,即《补贴与反补贴措施协议》(以下简称《补贴协议》)、《农业协议》和《服务贸易总协定》。《补贴协议》只处理影响货物贸易的补贴,《农业协议》对农产品的补贴在《补贴协议》的大框架内有一些特殊规定,《服务贸易总协定》则另外规定了关于服务贸易的补贴。由于发达国家与发展中国家的经济实力的巨大悬殊以及它们对农业补贴的不同政策,从而导致了在货物贸易的补贴规则方面,两类国家之间存在着尖锐的利益不平衡,发展中国家必须为实现其与发达国家实质上的平等而继续奋斗。

论网络服务提供者的版权侵权责任

网络版权侵权现象目前发生得非常普遍，针对这一问题，我国进行了相关的专门立法活动。但是，如何从根本上理清网络服务提供者的侵权责任，仍是一个非常值得研究的问题。笔者对网络服务提供者的概念和范围重新加以梳理，根据网络版权法律关系的要求，辩明了各种网络服务提供者的基本属性，明确了网络服务提供者的法律地位，并为实现网络版权侵权责任的明晰化，创见性地将网络服务提供者划分为网络技术服务提供者和网络作品传播者，分别阐述其应该各自承担的版权侵权责任。     

Statistical Approaches to Type Determination of the Ejector Marks on Cartridge Cases

While type determination on bullets has been performed for over a century, type determination on cartridge cases is often overlooked. Presented here is an example of type determination of ejector marks on cartridge cases from Glock and Smith & Wesson Sigma series pistols using Naïve Bayes and Random Forest classification methods. The shapes of ejector marks were captured from images of test‐fired cartridge cases and subjected to multivariate analysis. Naïve Bayes and Random Forest methods were used to assign the ejector shapes to the correct class of firearm with success rates as high as 98%. This method is easily implemented with equipment already available in crime laboratories and can serve as an investigative lead in the form of a list of firearms that could have fired the evidence. Paired with the FBI's General Rifling Characteristics (GRC) database, this could be an invaluable resource for firearm evidence at crime scenes.

In response to a petition, the Commission proposes the reallocation of forty-eight 25 kHz channels in the 928-929 and 952-960 MHz band segments to the Private Operational-Fixed Microwave Service and the Domestic Public Land Mobile Radio Service for distribution automation and wide-area control and repeater operations, respectively. The spectrum from 928 to 929 MHz is presently reserved for Land Mobile. The 952-950 MHz band is currently allocated to the Private Operational-Fixed Microwave Service and the International Control Services.

Part H, chapter HG (Indian Health Service) of the Statement of Organization, Functions, and Delegations of Authority of the Department of Health and Human Services, Public Health Service (PHS), chapter HG, Indian Health Service (IHS), 52 FR 47053-67, December 11, 1987, as most recently amended at 56 FR 22015-16, May 13, 1991, is amended to reflect the establishment of an organizational substructure for the Bemidji Area Office to more accurately reflect current activities in the Area Office.     

Public Health Service--Health systems agency and state health planning and development agency reviews: certificate of need programs. Final regulation

These rules amend the Public Health Service regulations on health systems agency and State health planning and Development agency (State Agency) certificate of need reviews. These final regulations implement changes to Title XV of the Public Health Service Act made by the Health Planning and Resources Development Amendments of 1979 (Pub L. 96-79). Under the amended provisions of the Public Health Service Act, the planning agencies are required to review and determine the need for proposed capital expenditures, institutional health services and major medical equipment. These regulations set forth the minimum requirements for satisfactory certificate of need programs.     

The Service Conception: Just One Simple Question

It is crystal clear that the Service Conception includes at least three conditions, what I shall call: the ‘normal justification condition’, the ‘independence condition’ and the ‘dependence condition’. The overarching rationale of these conditions is that they ensure that authority is only justified when it provides the best means for the subject to conform to the reasons for action that she actually has. However, it is difficult to clarify whether Raz implicitly presupposes a fourth necessary condition. This condition might be called a ‘reliable belief condition’, that is, that the putative subject must reliably believe that the putative authority-agent satisfies the Service Conception (or more precisely, its other three conditions). In sum, the purpose of this paper is to pose Joseph Raz one simple question: is it a necessary condition of your Service Conception, that the subject believes that the authority-agent satisfies the Service Conception? As a matter of interpretation, different parts of Raz’s work appear to lead in entirely opposite directions: some parts clearly support the reliable belief condition, others do not. Regardless of Raz’s ultimate answer, however, the question reveals a broader inconsistency. Only if the Service Conception does include the belief condition will it support Raz’s claim that authority is consistent with one’s rational ‘self-reliance’, that is, acting upon one’s own judgement (including, as to who has authority). Only if the Service Conception does not include the belief condition will it support Raz’s perfectionist account of government. It seems Raz must choose between one or other.     

Public Health Service--National Health Service Corps Scholarship Program. Final regulations

These regulations set forth the requirements for the award of scholarships under the National Health Service Corps Scholarship Program to students receiving academic training in medicine, osteopathy, dentistry, and other health professions in order to assure an adequate supply of trained health professionals for the National Health Service Corps.     

New Privacy Concerns: ISPs,Crime Prevention and Consumers' Rights

In November 1998, Cyber-Rights & Cyber-Liberties (UK) authored a 'privacy letter' to be sent from a subscriber to an Internet Service Provider (ISP) addressing concerns over privacy of communications through a UK ISP. The letter was drafted from the consumers' perspective and raises important issues in relation to ISP privacy policies. The 'privacy letter' was partly developed as a response to the Association of Chief Police Officers (ACPO), the ISPs and the Government Forum's initiatives in relation to developing 'good practice guidelines' between Law Enforcement Agencies and the Internet Service Providers' Industry. These guidelines describe what information can lawfully and reasonably be provided to Law Enforcement Agencies, under what circumstances such information can be provided, and the procedures to be followed in such cases. The process initiated by the ACPO Forum has so far excluded the views of concerned citizens and civil liberties organizations. This article will provide an insight into the activities of the ACPO/ISPs/Government Forum and will argue that procedures can only be properly designed within a legal context that takes due account of individual rights and liberties.     

Forensic limbo: Towards subverting hard disk firmware bootkits

We discuss the problem posed by malicious hard disk firmware towards forensic data acquisition. To this end, we analyzed the Western Digital WD3200AAKX model series (16 different drives) in depth and outline methods for detection and subversion of current state of the art bootkits possibly located in these particular hard disks' EEPROMs. We further extend our analysis to a total of 23 different hard drive models (16 HDDs and 7 SSDs) from 10 different vendors and provide a theoretical discussion on how hard disk rootkits residing in the firmware overlays and/or modules stored in the special storage area on a HDD called the Service Area could be detected. To this end, we outline the various debug interfacing possibilities of the various hard disk drives and how they can be used to perform a live analysis of the hard disk controller, such as dumping its memory over JTAG or UART, or how to access the Service Area via vendor specific commands over SATA.     

Public Health Service-Criteria for designation of health manpower shortage areas. Final regulations

These regulations set forth the criteria for designation of health manpower shortage areas under section 332 of the Public Health Services Act. Entities in these areas are eligible to apply for assignment of National Health Service Corps Personnel. These areas are also eligible areas for certain loan repayment, scholarship, and other Public Health Service programs.     

Blood Donor Locator Service--Social Security Administration. Final rules

We are issuing these final regulations to govern the Blood Donor Locator Service, which we will establish and conduct, as required by section 8008 of the Technical and Miscellaneous Revenue Act of 1988 (Pub. L. 100-647). Under these regulations, we will furnish to participating States at their request the last known personal mailing address (residence or post office box) of blood donors whose blood donation shows that they are or may be infected with the human immunodeficiency virus (HIV) which causes acquired immune deficiency syndrome, if the State or an authorized blood donation facility has been unable to locate the donors. If our records or those of the Internal Revenue Service (IRS) contain an adequate personal mailing address for the donor, we will provide it to the State so that the State or the blood donation facility can inform the donor that he or she may need medical care and treatment.
