Legal origin and intellectual property rights: an empirical study in the prerecorded music sector

This article aims at identifying differences in copyright protection in prerecorded music markets, and more specifically the impact of the legal system on the demand for original music CDs. To this end, we use a panel of 28 OECD countries in the period 1999–2005. After testing alternative specifications, our results show that differences in legal origin lead to differences in intellectual property rights enforcement. Our results also consistent with previous studies that find that common law countries have more secure property rights.

Posting of workers across the EU: an empirical investigation

This paper investigates the effects of the intra-European posting of workers on domestic labour markets in the years 2007–2009. Instrumental variables related to neighbouring countries’ populations are used to address the endogeneity between posting and labour market features. Contrary to conventional wisdom, we find that an intensification of posting inflows is not likely to displace domestic workers, at any educational levels. Instead, an increase in posting from abroad may raise domestic labour costs. No significant effects are found on sending country labour market variables. Results point towards the development of possible synergies between domestic and posted workers, so that posting can actually improve labour efficiency and put upward pressure on labour costs.     

Listening to children: Participation rights of minors in Italy and the United States

This article compares laws and policies in Italy and the US regarding children's right to be heard and to engage in the life of the community. Italy has adopted a strong children's rights perspective, informed by the principles of the Convention on the Rights of the Child (CRC). The US, with its pre-modern constitution and resistance to international law, has been slow to recognise children's rights to voice and agency. The US Supreme Court has extended some due process rights to children in criminal court proceedings, but the US lags far behind Italy in recognition of children's rights to participate in civic life and collective decision-making. Child well-being rankings may reflect these differences in attitudes towards children's rights. Italy ranks significantly higher than the US on objective measures of child well-being and Italian children report superior peer and family relationships.     

Mental health policy in the liberal state: the example of the United States

Mental health policy arises out of the interaction of many different variables. These include (but are not limited to) the composition of the population of persons with severe mental illnesses; the means of dealing with disease and dependency; concepts of the etiology and nature of mental disorders; the organization and ideology of psychiatry; funding mechanisms; and existing popular, political, cultural, and professional values. But an often neglected but crucial factor in shaping policy is the very structure of the American political system, which played a crucial role in shaping mental health policy. Rather than emphasizing the neo-liberal theory and its accompanying hostility toward "unsuccessful" people and disdain of welfare, this article suggests that an understanding of mental health policy in the latter half of the twentieth century is better served by an examination of what actually happened. Theory, however attractive, rarely can encompass the messy data of reality.

Proof of Concept Centers in the United States: an exploratory look

In this paper we identify the population of 32 US university-related Proof of Concept Centers (PoCCs), and we present a model of technology development that identifies the economic role of PoCCs within that model. We examine the broad technology transfer challenges that PoCCs have been established to address. Further, we argue that PoCCs are a growing technology infrastructure in the United States, and they are important as a possible element of our national innovation system.     

Child fosterage in the United States: Signs of an African Heritage

In the course of the twentieth century, African American families have been the objects of a great deal of debate and commentary in social science fields, as well as in popular discourse. The article considers the basis for this discussion: the presence of significant numbers of family and household structures among African Americans that differ from traditional Euro-American models. Western nuclear families are typically centered around marriage, while African, and to a significant degree African American, families are structured around children. The recently developed U.S. Census public use samples and measures oriented to the practices of informal child fosterage are used to examine and compare these different bases of family life. Data from the turn of the century provide some historical distance from previous explanations of difference centered on slavery, or explanations that focus on contemporary social issues such as urban problems or the welfare state. Comparisons with studies of the contemporary U.S., Africa, the Caribbean, and historical materials give broader scope to fosterage analysis and to the consideration of cultural family differences.     

Assassination in the United States: an operational study of recent assassins, attackers, and near-lethal approachers

This study is the first operational exploration of the thinking and behavior of all 83 persons known to have attacked, or approached to attack, a prominent public official or public figure in the United States since 1949. In addition to data about each attack or near-attack and each subject's demographic and background characteristics, information was gathered about each subject's ideas and actions in the days and weeks before their attacks or near-lethal approaches. Questions were examined about each subject's movement from the idea of attack to actual attack, motives, selection of targets, planning, communication of threat and intent, symptoms of mental illness, and significant life experiences. In every case, the attack or near-attack was the end result of an understandable, and often discernible, process of thinking and action. Implications for protectors, investigators, and researchers are discussed.
