The Family Court of Australia provides conciliation counselling to couples who are involved in disputes regarding their children following separation. In cases where domestic violence is involved, the appropriateness of providing counselling has been seriously questioned. This study is an extension of earlier work completed by the authors that specifically examined client satisfaction with counselling in cases involving domestic violence. This article examines client and counsellor perceptions of the counselling process and its outcomes.  相似文献

A high correlation has been found between domestic violence and stalking. However, very few studies have examined what factors predict the occurrence of stalking in relationships characterized by domestic violence. Using in-depth interviews with victims of domestic violence whose cases have gone through the criminal justice system, this article explores this issue. It was found that experiences of stalking by their abusers were very prevalent in this group of domestic violence victims. In terms of predicting stalking, domestic violence victims who were not in a relationship with their abuser, whose abusers had an alcohol or drug problem, who experienced more controlling behaviors by their abusers, and who had experienced prior stalking by their abusers were at the greatest risk of experiencing more severe stalking. Abstract

Summary. Domestic violence is a major societal problem that affects millions of people. The American legal system is attempting to assist victims of domestic violence by designing laws that offer various types of protection. The civil laws have been expanded to provide protection to more people, such as dating partners, same-sex couples, and people who offer help to victims. In addition, a victim of domestic violence can seek a particularized form of relief, designed for their specific situation. The laws will vary between jurisdictions, but the movement is towards more complete and effective laws that assist people who are in violent situations.  相似文献

This study compares two groups of women in South Korea: one group incarcerated for the deaths of their male partners and the other staying in a shelter for battered women. The analysis serves to answer two questions: First, are the findings regarding women who kill their intimate partners in Western societies generally applicable to their counterparts in South Korea? Second, how are abused South Korean women who resort to lethal violence against their abusers different from those who do not? Regarding both abused and nonabused women incarcerated for criminal homicide against their partners, results indicate that they have less experience of psychological and physical abuse by their partners and that they are less educated, underemployed, and more supportive of traditional patriarchal norms than are the women who utilize domestic violence shelters. This research explores implications for intervention strategies to encourage abused women to seek help from legal and extralegal sources.  相似文献

Studies show that domestic violence among same-sex couples occurs at approximately the same statistical frequency and has many of the same characteristics as domestic violence among heterosexual couples. In addition to the elements involved in domestic violence among heterosexual couples, gays and lesbians face a series of highly specific forms of abuse perpetrated exclusively in same-sex relationships. Yet a severe disparity exists in the services that are available to victims based on which of the two types of relationships they are involved in. In the vast majority of states, family is narrowly defined within domestic violence statutes, precluding gays and lesbians from seeking civil redress for crimes perpetrated against them by their partners. For this reason, it is imperative that state legislatures react to this discrepancy by redrafting domestic violence statutes and defining family more inclusively to provide appropriate protections to victims of same-sex domestic violence.  相似文献

Domestic violence victims often have economic and employment needs that either directly or indirectly stem from their victimization. In their efforts to seek services, victims may turn to benefits workers who are given the task of providing clients with short-term financial help, job training, access to health care, and assistance in obtaining a job. It is not clear whether benefits workers are adequately prepared to help domestic violence victims. In this study, 189 social services workers from the Commonwealth of Virginia were surveyed to assess the training needs of all social services workers. This article focuses on the specific training needs of benefits workers and draws comparisons between benefits workers’ training needs and other workers’ needs. The findings suggest that benefits workers are perceived as knowing less about domestic violence than other social services workers. Implications are discussed. This study examines access to legal services among clients of three Calgary-area domestic violence shelters. The study samples the views of staff and clients at three domestic violence shelters with the goals of improving understanding of clients’ legal service needs, understanding the challenges clients attempting to access legal services encounter and making recommendations for improvement. The authors conclude that clients’ service needs are complex and often involve legal problems, yet shelters face specific organizational barriers to coordinating legal services. The authors recommend that a further analysis be undertaken to examine the legal access patterns of women experiencing domestic violence, to assess the prevalence of the barriers identified in the study and to determine whether further barriers are present in other shelters.  相似文献

The current study takes a consumer perspective to examine the impact of legal and mental health systems on couples who are experiencing problems with domestic violence. Unfortunately, their thoughts and wishes are rarely considered when planning for change in their lives. The study asks couples what they think happens to cause abusive episodes, what happens to them when someone finds out about the abuse, and what their thoughts are about the interventions they receive. The specific interventions in this study were a pro-arrest policy and solution-focused brief therapy.  相似文献

Until now, research into the effects of domestic violence on the formation of relationships between women and their babies has been from an attachment theory perspective. The research reported in this article takes a different approach. Innovative qualitative research methods are used to uncover knowledge about the formation of such relationships from the lived experiences of sixteen women who have mothered babies while enduring domestic violence. Analysis of the findings in this study identifies domestic violence constitutes an environment of sustained hostility where women respond with maternal protectiveness to maximise their babies’ physical and psychological safety whether or not they had attained a secure relationship. However, women recognize domestic violence constricts space to form close mother/baby relationships. Supported by these findings, this research suggests policy and practice concerned with relationships between women and babies subjected to domestic violence address protectiveness and space to attach. This paper examines individuals who were victims of domestic violence in Illinois between 1990 and 1995, comparing the traits and service needs of those who received assistance in an urban county over the 5-year period with those who were served by domestic violence programs in rural areas. Analysis focuses on the demographic characteristics of clients in each region, their relationship to the abuser, type of abuse, referral source, and need for both concrete and supportive services. In addition to looking at variations by region, analysis examines differences between African American and White clients within and across geographic areas so that the interaction of race and location is highlighted. Results indicate that apart from demographic differences related to race, there is little difference in the circumstances of abuse when victims in the urban region are compared to rural victims of violence. However, those in rural environments regardless of race, have more service needs. Differences in service needs also exist in relation to race, and for some services, both race and location are important. The implications of these findings for policy, practice, and future research are examined.  相似文献

Approximately 50% of couples who have separated report being victims of violence and/or emotional abuse by their former intimate partners. Family courts can make an important contribution toward reducing the number of intimate partners who report being victims of domestic violence and abuse during and following their participation in divorce proceedings in three ways. First, increase opportunities for participation in nonadversarial procedures. Second, implement mandatory assessment/screening for domestic violence using field‐tested instruments that link subscores on sets of items (e.g., control motivated violence, conflict instigated violence/abuse, substance abuse associated violence/abuse) with appropriate community‐based treatments and/or resources. Third, educate family court judges, lawyers, mediators, and other court personnel in the dynamics of domestic violence generally, as well as the dynamics associated with separation/divorce.  相似文献

Scholarship, policy and practice relating to domestic violence have all seen many changes in the recent past. The definition of domestic violence is often wide ranging describing physical violent within an adult (married) couple to the inclusion of intergenerational abuse and violence. As a result of feminist interventions a gender-based approach to domestic violence is now well established. Most research using this model shows that the majority of victims are women and most perpetrators are men. This impacts upon the policies, initiatives and service provision. One consequence is that it fails to explore the possibility of women’s different experiences of domestic violence. The point of departure for this paper is that it fails to take account of domestic violence in lesbian partnerships. Using data generated by way of an annual analysis of counselling cases of generated by a German lesbian specific social services agency and data from focussed interviews with 20 lesbians who have been violent to their lesbian partners this article offers a range of new insights into the nature and experiences of domestic violence in same sex domestic relationships and considers the significance of this data in relation to policing and other modes of intervention to bring that violence to an end.

Researchers have not investigated mental health outcomes among couples who are reciprocally violent towards each other. The present study investigated differences in partner violence (psychological, physical, and sexual) and mental health symptoms (depression, anxiety, hostility, and somatic) between two types of reciprocally violent couples: situational couple violence (SCV) and mutual control violence (MVC). SCV couples use violence to address stressful family conflicts, while MVC couples use violence as a tool to control each other. Participants (N = 609) completed surveys that contained several instruments that measured past violence, coercive behaviors, physical injuries, and mental health symptoms. Results revealed that MVC reported significantly higher levels of violent perpetration and worse physical and mental health than SCV. These findings have implications for understanding the role of coercion in partner violence and mental health, which can be used for the development of appropriate mental health services for couples who are mutually violent towards each other.  相似文献

This study determines the frequency of the spousal domestic violence among 1,178 married women who applied to some first level medical institutions located in Ankara, the capital of Turkey. 77.9% (n = 918) of the women who participated in the study have stated that they have been exposed to at least one of the types of spousal violence during their lifetime. The most reported type of domestic violence suffered by women throughout their lives is economic violence (60.4%). The prevalence of controlling behaviors, emotional violence, physical and sexual violence are 59.6%, 39.7%, 29.9% and 31.3% respectively.  相似文献

Mediation is an essential component of custody evaluation and reconciliation services in domestic courts. Data from 306 couples with and without a reported history of domestic violence (DV) who were ordered to attend an assessment for mediation were analyzed to determine differences in the mediation process. More than one third reported a history of DV. Chi-square analysis showed that differences in the mediation process exist between couples reporting DV and couples reporting no DV. A greater proportion of couples with reported DV (a) actually attended the court-mandated assessment session, (b) were deemed unsuitable to participate in the mediation process, (c) were in default of child-support payments, and (d) reported drug and alcohol abuse. No significant differences were found between the two groups in the measured mediation outcomes. Implications for the use of mediation with couples who reported DV and recommendations for future research are discussed.  相似文献

American Indian women across all ages are significantly more likely than women of other ethnic groups to be victims of domestic violence, sexual assault, and stalking. Despite their increased risk of interpersonal violence, there are few published studies or reports that explicitly examine the needs of victimized American Indian women. Therefore, both researchers and service providers know very little about the multifaceted needs of victimized American Indian women and whether current community services are meeting the needs of victimized native women. Identifying such needs is a logical next step so that victim service agencies can develop and effectively provide services tailored to victimized American Indian women. This commentary addresses these gaps by (1) identifying the needs of American Indian women in a domestic violence shelter in Arizona, and (2) highlighting the researcher-practitioner partnership that made it possible to gain access to these victims. Drawing on survey responses from 37 American Indian female clients and interviews with 10 staff members, the findings reveal that the domestic violence agency service provider is meeting many of their needs. Findings also indicate that clients have a wide variety of specific personal needs (e.g., safety, housing, transportation), needs relating to their children (e.g., safety, education, socialization), community needs (e.g., relating to their tribe), as well as legal needs (e.g., help obtaining a restraining order or divorce). These multifaceted needs are discussed and specific recommendations are provided for successful researcher-practitioner partnerships.  相似文献

Recent studies of police response to violence in which men attack women with whom they have a history of shared intimacy have not addressed the issue that inspired research in the first place: the “leniency thesis” that police treat men who beat their spouses less punitively than other violent offenders. In addition, research examining the deterrent effects of various police treatments of misdemeanor domestic violence is not responsive to complaints that abused women are denied protection of law when they have been victims of serious, felony-grade, abuse by their spouses. This research analyzes the response of the Chester, Pennsylvania, police to 392 consecutively reported felony-grade assaults by persons whose identities were known to victims and police. Results confirm the leniency thesis. Tabular analysis demonstrates that arrests occurred in 13% of male-on-female spousal assaults and 28% of other assaults. Logit analysis indicates that this difference in police response is not attributable to other variables that might be expected to result in differential treatment. We conclude that the practices and results reported by research conducted in progressive police jurisdictions that volunteer to participate in studies of police response to violence against women may not be generalizable to the great majority of U.S. police agencies that have not welcomed such study.  相似文献
