Utilizing a sample of 8,461 cases involving heterosexual intimate partner violence, this paper examines the role of suspect gender in prosecutorial decision‐making. Four decision points are assessed: the decision to file charges (versus rejection for insufficient evidence); to file as a felony (versus a misdemeanor or probation violation); to dismiss for insufficient evidence (versus full prosecution); and to reduce felony charges to a misdemeanor or violation of probation. Suspect gender was found to be statistically significant in relation to all four outcomes in favoring female over male suspects. Numerous interaction effects were observed between gender and measures of prior arrest and offense severity in particular, suggesting that prosecutors distinguish between male and female suspects across these variables. We suggest that these data provide some support for recent qualitative research suggesting that court personnel are responsive to the gendered asymmetry of intimate partner violence, and may view female intimate violence perpetrators more as victims than offenders.  相似文献

Purpose

This field trial examined the process of assigning drug-involved offenders to dispositions based on their criminogenic risks and needs.

Methods

Probation officers administered the Risk and Needs Triage (RANT)™ to 627 felony drug and property offenders at the pre-trial stage or shortly after sentencing to probation. The RANT™ was evaluated for internal scale consistency, factor structure, and predictive validity for re-arrest and re-conviction rates within 12 months of case disposition. Exploratory analyses examined whether recidivism was lower for participants who were assigned to an appropriate disposition given their assessment results.

Results

The RANT™ demonstrated acceptable internal consistency and factorial validity, and significantly predicted re-arrest and re-conviction rates within 12 months of case disposition. There was no racial or gender bias in the prediction of recidivism. Non-significant trends favored better outcomes for participants who were assigned to the indicated dispositions.

Conclusions

The results lend support for the RANT™ as a dispositional triage tool for drug-involved defendants and probationers at or near the point of arrest. The results also lend tentative support to the hypothesis that outcomes might be better if drug-involved offenders were matched to appropriate dispositions based on their risk-and-need profiles. Directions for future research are discussed.  相似文献

The effectiveness of harsher sanctions for domestic violence offenders is an important topic given legislative trends in “getting tough” with these offenders. This article takes a rare look at felony domestic violence, specifically felony assaults on female intimates, with an analysis of whether conviction, jail, and imprisonment are related to the odds of subsequent charges among 353 male defendants from twenty-four Ohio trial courts of general jurisdiction. Each defendant was followed up for two years after his original case was closed and his sentence (if any) was served. Conviction and jail sentences were both related to significantly lower likelihoods of recharging for intimate assault, but prison sentences were not related to these odds. These findings are discussed in relation to the potential importance of reducing short-term opportunities for violence in order to prevent future harm.  相似文献

Using data on cases of intimate assault, we offer a relatively rare examination of disparities in court dispositions across multiple stages of case processing. In this context we introduce the theoretical and empirical relevance of considering the characteristics of defendants' neighborhoods as possible extralegal influences on disposition severity. Bilevel analyses of 2,948 males arrested for misdemeanor assaults on intimates in Cincinnati reveal significant disparities based on neighborhood socioeconomic status (SES) in decisions related to charging, full prosecution, conviction, and incarceration, even when adjusting for compositional differences in defendant's race and SES across neighborhoods. Implications are discussed for the broader literature on extralegal disparities.  相似文献

This study assesses key actors’ “worlds of fact” regarding jail overcrowding in California through an examination of their perceptions of causes and effects, support for different solutions, and adherence to major punishment ideologies. How policymakers define and structure a specific problem Gail overcrowding), can influence how policy options are differentially weighed as well as how existing policy processes can be improved. A mail survey was sent to two key decision making groups who largely regulate the intake and outflow of local jails: sheriffs and chief probation officers of the 58 California counties. Group differences in responses were predicted from the perspectives of blame avoidance, domain dissensus, and punishment theory. Relationships were examined among perceived causes, effects, solutions, and punishment ideologies. While both sheriffs and probation chiefs advocated highly similar “control-oriented” punishment ideologies, probation chiefs advocated more “progressive” solutions to jail overcrowding. Perceived causes and effects of jail overcrowding, along with support for deterrence ideology, were strongly related to elite support for three potential solutions: building more institutions, passing tougher laws to deter potential offenders, and using shorter sentences for low-risk offenders. Implications of these results for understanding jail overcrowding and policy processes are discussed.  相似文献

Following implementation of the Young Offenders Act (YOA) in April 1984, it was believed that a shift had occurred from an emphasis on rehabilitation and indeterminate sentences under the Juvenile Delinquents Act (JDA) to an emphasis on punishment and determinate sentences under the new legislation, and a subsequent increase in frequency and length of custodial dispositions. Research studies suggest that, while the number of youths charged and the number sentenced to probation has remained the same, committals to custody and average length of detention have increased. Furthermore, victim reconciliation and community service orders are being used more often as dispositions under the YOA, consistent with the principle of accountability of young offenders.

The present study attempts to determine the impact of the YOA on judicial dispositions for 13 to 15 year old young offenders at the Provincial Court (Family Division), Frontenac County, by attempting to control for the nature of the cases and the type of individual brought before the courts. The hypothesis examined is that the YOA has not caused a change in youth court dispositions.

Differences were, in fact, found between dispositions used and it was shown by matching youths under each Act on age, sex, offence, and previous history, that similar youths do not necessarily receive the same dispositions; the probability of receiving a more severe form of disposition is greater for youths under the YOA than for youths with similar background characteristics and current offence under the JDA. Individuals who are given a particular disposition under the JDA and the YOA were also found to differ in terms of background characteristics. A number of reasons for the discovery of a change in dispositions are discussed.  相似文献

Objectives

To test whether an adaptive program improves outcomes in drug court by adjusting the schedule of court hearings and clinical case-management sessions pursuant to a priori performance criteria.

Methods

Consenting participants in a misdemeanor drug court were randomly assigned to the adaptive program (n?=?62) or to a baseline-matching condition (n?=?63) in which they attended court hearings based on the results of a criminal risk assessment. Outcome measures were re-arrest rates at 18 months post-entry to the drug court, and urine drug test results and structured interview results at 6 and 12 months post-entry.

Results

Although previously published analyses revealed significantly fewer positive drug tests for participants in the adaptive condition during the first 18 weeks of drug court, current analyses indicate the effects converged during the ensuing year. Between-group differences in new arrest rates, urine drug test results and self-reported psychosocial problems were small and non-statistically significant at 6, 12, and 18 months post-entry. A non-significant trend (p?=?.10) suggests there may have been a small residual impact (Cramer’s v?=?.15) on new misdemeanor arrests after 18 months.

Conclusions

Adaptive programming shows promise for enhancing short-term outcomes in drug courts; however, additional efforts are needed to extend the effects beyond the first 4 to 6 months of enrollment.  相似文献

Using data from Massachusetts, we illustrate three ways in which National Incident-BasedReporting System (NIBRS) data can improve the collection of importantinformation on intimate partner violence. First, because NIBRS usesincident-based reporting, data are collected on all crimes associated witheach incident. In our sample of women victimized by an intimate partner, 10%had experienced more than one crime during the incident. Second, NIBRSinvolves expanded data collection on the offender–victim relationship, aswell as reporting about additional offenses. For female victims, partnerswere more likely than nonpartners to commit the crimes of simple assault,intimidation, and aggravated assault. For crimes involving male victims, anaquaintance was most likely to be the offender. Third, NIBRS data allow usto connect information about the incident, the offender(s), and thevictim(s). Our data indicted that several victim- offender-, and incident-relatedvariables were risk factors for injury, including victims ethnicity,offenders relationship to the victim, offender's use of a weapon, whether or not thecase was cleared, type of crime committed, and whether or not drugs and/or alcoholwere involved in the incident. Although there are several limitations to NIBRSdata, its potential usefulness to the study of intimate partner violence deserves furtherattention.  相似文献

Therapeutic jurisprudence (TJ) proposes that the law is a social force that can heal or cause harm to parties in a legal action. Historically, women victims of intimate partner rape and domestic violence could not seek justice in the legal system because police, like other actors in the justice system, treated these offenses as private matters or fabrications. In domestic violence and intimate rape cases, TJ is concerned with the needs of the victims, and how the law and police play a role in increasing their well-being. In this article, we use a TJ approach to the study of police responsiveness to victims of these offenses by investigating arrests of the offenders pursuant to law reforms that encourage or mandate arrest. Given that in these offenses, victims have the lowest reporting rates of any violent crime, the victim decision to call the police represents an expectation that the mere physical presence of a police officer may redefine the nature of the violence from a private conflict to a societal wrong that will not be tolerated. Police partnership with and treatment of the victim with respect and dignity can change the dynamics of the violence, terminate the violence, and set the criminal justice process in motion by arresting the offender in most cases. Police arrest, and subsequent prosecution and conviction, sends a message to offenders that society does not tolerate their violence, and allows the victim to begin to heal. Yet, past research indicates that police are less likely to arrest intimates than acquaintances and strangers in misdemeanor and aggravated assault, rape, and sexual assault cases. Using the National Incidence Reporting System (NIBRS) for the year 2000, we examine police arrests of intimate partner rape and domestic violence in jurisdictions with mandatory and presumptive arrest policies compared to police arrests in full discretion jurisdictions. We also ascertain whether arrest rates are higher for strangers and acquaintances than for intimates in misdemeanor and aggravated assault, kidnapping, and rape and sexual assault. Third, we determine whether police arrests of intimate partner rape is more likely if there is evidence of violence, injury to the victim, and use of a weapon. Our multivariate findings suggest that both the rape and the domestic violence reform movements have reversed the tide of historical negative treatment of female victims of these offenses. Logistic regression analysis indicates that police agencies in mandatory and preferred arrest jurisdictions increase the odds of arrest for domestic violence incidents and violations of orders of protection, compared to police agencies in jurisdictions with permissive/discretionary arrest policies. In addition, intimate violence increases the odds of arrest by 98%; forcible rape accompanied by simple assault or kidnapping increases the odds of arrest by 467 and 222%, respectively whereas forcible fondling accompanied by simple assault increases the odds of arrest by 293%. We discuss the implications of our findings for future law reform as well as TJ.  相似文献

Age is the only factor used to demarcate the boundary between juvenile and adult justice. However, little research has examined how age guides the juvenile court in determining which youth within the juvenile justice system merit particular dispositions, especially those that reflect the court's emphasis on rehabilitation. Drawing on scholarship on the court's origins, attribution theory, and cognitive heuristics, we hypothesize that the court focuses on youth in the middle of the range of the court's age of jurisdiction—characterized in this article as “true” juveniles—who may be viewed as meriting more specialized intervention. We use data from Florida for court referrals in 2008 (N = 71,388) to examine the decision to proceed formally or informally and, in turn, to examine formally processed youth dispositions (dismissal, diversion, probation, commitment, and transfer) and informally processed youth dispositions (dismissal, diversion, and probation). The analyses provide partial support for the hypothesis. The very young were more likely to be informally processed; however, among the informally processed youth, the youngest, not “true” juveniles, were most likely to be diverted or placed on probation. By contrast, among formally processed youth, “true” juveniles were most likely to receive traditional juvenile court responses, such as diversion or probation.  相似文献

An important priority of the U.S. juvenile justice system is to reduce the number of youthful offenders who are placed into secure detention placement. Though significant research examining these predictors exists, there is limited analysis of gender-specific predictors. Using existing juvenile court and mental health assessment case records of 433 youthful offenders from two Midwestern U.S. counties, this study sought to identify separately for males and females the legal (including number of delinquency adjudications, age at first delinquency adjudication, number of court offenses, and type of offense) and extralegal (including demographic, maltreatment, mental health, and school-related disabilities) factors that impact recidivism to detention placement. Multivariate logistic regression analyses revealed that the predictors of recidivism leading to repeat secure detention placement were indeed different for males and females, although there were some shared predictors. For both genders, the number of court offenses and having a previous suicide attempt were significant predictors. In addition, for females, having a diagnosis of attention-deficit/hyperactivity disorder and a misdemeanor offense were protective against recidivism. For males, three other variables significantly predicted recidivism: age, race, and a conduct disorder diagnosis.  相似文献

This paper tests hypotheses implicit in the societal-reaction perspective concerning the nature and pattern of the relationship between prior and current youth court dispositions. The dispositional stage is the most critical decision-making level which young offenders encounter in their contact with the youth court system. Previous research has produced inconsistent results in the attempt to determine which model or models of justice underlie dispositional decisions by youth court judges. Log-linear modeling is employed on 16,636 youth court cases in Canada in 1993/1994 to determine the nature and magnitude of the relationship between current and prior dispositions. The results indicate that prior youth court dispositions exert a significant impact on current dispositions, even when relevant variables are controlled. Evidence is found mainly of stabilization—the repetition of the same type of disposition—and also of escalation in dispositions. These findings provide support for the societal-reaction theory and possibly for the desert-based theory of sentencing.  相似文献

Objectives

To examine the effects of specialized probation and recovery management checkups (RMCs) on participation in substance use treatment, substance use, HIV risk behaviors, and recidivism.

Methods

Women (n?=?480) released from the Cook County Jail’s Department of Women’s Justice Services were randomly assigned to either an RMC or control condition and interviewed quarterly for 3 years (greater than 90% completion per wave). At the beginning of each quarter, women were classified as currently on probation (n?=?1984) or not (n?=?2516). Current probation (subject) and experimental condition (intervention nested within probation status) at the beginning of the quarter were used to predict outcomes in the next quarter. Data included self-reports, urinalysis findings, and county and state arrest records.

Results

In the quarter after being on probation (or not), women offenders reported higher rates of participation in substance use treatment and recovery support services, as well as lower rates of substance use and HIV risk behaviors. Nevertheless, they were more likely to commit crimes and be rearrested or reincarcerated. During quarters when the women were not on probation, RMCs were associated with significant increases in participation in substance use treatment and significant reductions in substance use and HIV risk behaviors. However, RMCs had no additional quarterly benefits when women were on probation. Higher levels of substance use treatment, self-help engagement, and reduced substance use predicted reduced recidivism.

Conclusions

This study demonstrates the effects of specialized probation and RMCs (when not on probation) on favorable outcomes for criminally involved women with substance use disorders.

Fiscal constraints and shifting political climates in corrections have recently led to a renewed interest in intermediate punishments. Despite their growing prevalence, though, relatively little empirical research has examined the judicial use of alternative sanctions as a sentencing option. By using 3 years of data from the Pennsylvania Commission on Sentencing (PCS), this study investigates little‐researched questions regarding the use of sentencing alternatives among offenders and across contexts. Results indicate that male and minority offenders are the least likely to receive intermediate sanctions, both as a diversionary jail or prison sentence and as a substitute for probation. The probability of receiving an intermediate sanction also varies significantly across judges and court contexts and is related to county‐level funding for these programs, among other factors. Findings are discussed as they relate to contemporary theoretical perspectives on the perceived suitability of intermediate punishments and on the unique role that offender agency plays in the sentencing of these cases. Directions for future research are discussed.  相似文献

Purpose

This study examines gender differences in the effectiveness of prison in reducing recidivism.

Methods

Using data on released male and female prisoners, we apply a propensity score matching methodology to compare the effects of prison on recidivism versus three counterfactual conditions—jail, intensive probation, and probation.

Results

The analyses indicated that a prison term, as compared to placement on intensive probation or traditional probation, is associated with a greater likelihood of property and drug recidivism. There was little evidence that recidivism was greater when compared to jail, that prison increased the likelihood of violent or other recidivism, or that the criminogenic effect of prison is appreciably greater for females or males.

Conclusions

The findings do not support arguments that prison is an effective alternative to non-incarcerative punishments or that it exerts a differential effect on females or males. Further research is needed on what features of the prison experience contribute to the observed effects.  相似文献

This research analyzes comparative data on offenders, offenses, sentences, and dispositions for El Salvador, Guatemala, Honduras, Panama, Costa Rica, Nicaragua, and the United States. This paper is based upon a larger research project examining political death and homicide in El Salvador through 1984. The analysis examines the effectiveness of the Salvadoran criminal justice system before and after initiation of Its civil war.

The statistics showed that El Salvador's capacity to investigate homicides and detect murder suspects had improved over the last 10 years or so, whereas its ability and length of time to prosecute, try, sentence, and commit offenders had deteriorated over this same period. Substantial numbers of Salvadoran criminals were apprehended, arrested, tried, sentenced, and incarcerated for routine crimes of violence and property. On the other hand virtually none of the perpetrators of thousands of political murders were apprehended by the Salvadoran Government despite the increase in arrest and sentencing for routine homicides. This may be indicative of a lack of commitment by the Salvadoran Government to deal with political killings by death squads.  相似文献

Objectives

This research examines the effect global positioning system (GPS) technology supervision has on pretrial misconduct for defendants facing intimate partner violence charges.

Methods

Drawing on data from one pretrial services division, a retrospective quasi-experimental design was constructed to examine failure to appear to court, failure to appear to meetings with pretrial services, and rearrest outcomes between defendants ordered to pretrial GPS supervision and a comparison group of defendants ordered to pretrial supervision without the use of monitoring technology. Cox regression models were used to assess differences between quasi-experimental conditions. To enhance internal validity and mitigate model dependence, we utilized and compared results across four counterfactual comparison groups (propensity score matching, Mahalanobis distance matching, inverse probability of treatment weighting, and marginal mean weighting through stratification).

Results

Pretrial GPS supervision was no more or less effective than traditional, non-technology based pretrial supervision in reducing the risk of failure to appear to court or the risk of rearrest. GPS supervision did reduce the risk of failing to appear to meetings with pretrial services staff.

Conclusions

The results suggest that GPS supervision may hold untapped case management benefits for pretrial probation officers, a pragmatic focus that may be overshadowed by efforts to mitigate the risk of pretrial misconduct. Further, the results contribute to ongoing discussions on bail reform, pretrial practice, and the movement to reduce local jail populations. Although the cost savings are not entirely clear, relatively higher risk defendants can be managed in the community and produce outcomes that are comparable to other defendants. The results also call into question the ability of matching procedures to construct appropriate counterfactuals in an era where risk assessment informs criminal justice decision-making. Weighting techniques outperformed matching strategies.

Research reveals public dissatisfaction with perceived leniency of the criminal justice system. However, when asked to sentence hypothetical offenders, members of the public tend to choose dispositions similar to what current court practices prescribe. In two studies reported here, subjects completed a mock sentencing exercise and a general attitude survey. In an initial pilot study, they expressed general dissatisfaction with the criminal justice system but the relative punitiveness of their sentences (in terms of their perceptions of how severe various sentencing options are) was only slightly elevated above a set of reference sentences. Providing a typical judge's sentencing decisions did not decrease dissatisfaction but was associated with an anchoring effect. This effect was explored in the main study by manipulating the provided reference sentences to be either lenient, moderate, or punitive. Again, participants expressed general dissatisfaction with the criminal justice system but prescribed generally moderate sentences, anchoring their sentences to the information provided. However, only those exposed to moderate typical sentences subsequently reported reduced dissatisfaction with the criminal justice system.  相似文献

The central question we address in this article is whether participation in court-ordered drug treatment programs reduces future criminal involvement among convicted property offenders who have a history of drug abuse. Using a national sample of male property offenders sentenced to felony probation, we analyze drug treatment experience on probationers’ recidivism rates by employing proportional hazards techniques. Results indicate that how successful white men are in completing courtordered drug treatment programs has no significant effect on their recidivism rates. However, AfricanAmerican and Hispanic men who satisfy the expectations of their drug treatment programs are significantly less likely to be rearrested. Overall, our findings support the contention that drug treatment reduces further criminal behavior among men on probation for felony property offenses. Thus, we recommend that court service personnel strive to provide drug treatment programs for property offenders with a history of drug abuse and that supervisors closely monitor probationers’ activities while in treatment to assure lower rates of recidivism.
