One of the many reasons for gun ownership in the USA is the belief that citizen gun ownership helps to reduce crime. The rationale for this belief can be linked to deterrence – the perception that the threat of harm from confronting someone with a gun outweighs the potential benefit from crime – and will reduce the likelihood of engaging in criminal behavior. Similarly, deterrence is often referenced as a reason to support capital punishment. This is the first study to explicitly link support for the individual threat of lethal violence and the state threat of lethal violence by testing the hypothesis that the belief that guns reduce crime is positively correlated with support for capital punishment. Tests using a 2010 survey support this hypothesis for general support of capital punishment and for support of capital punishment with the life without parole option. The theoretical implications of considering deterrence as a value-expressive argument are explored.  相似文献

This paper critically examines the role of the perceived certainty and severity of punishment in deterring criminal/deviant behavior. A thorough review of the perceptual deterrence literature from 1972–1986 is provided which indicates that cross-sectional correlations between perceptions of sanction threats and self-reported criminal/deviant behavior are moderately negative for diverse offenses, consistent with the deterrence doctrine. It is noted that rather than expressing the deterrent effect, these correlations probably indicate the effect of prior behavior on currently held perceptions—the experiential effect. In addition, since in many instances the reported correlations express simple bivariate relationships, the association may be spurious rather than causal. When researchers employing panel designs have estimated the deterrent relationship with variables in their correct temporal ordering and with more fully specified causal models, the moderate inverse effect for both perceived certainty and severity disappears. Although this would argue strongly for the continued utilization of longitudinal data and fully developed models of deterrence/social control, recent commentaries have raised questions about this line of perceptual deterrence research. These arguments are assessed and an agenda for future deterrence research suggested.  相似文献

This study explores the existence and predictive ability of a behavior-based typology of men who were adjudicated for a domestic violence crime in an urban criminal justice system. Data from 671 men who completed a 2-hour biopsychosocial assessment were analyzed using cluster analysis. Findings indicate a typology of low level criminality (25.6%), dysphoric volatile behavior (42.2%), and dysphoric general violence (32.2%) similar to previous typologies, but with some unique characteristics. The behavior-based typology predicted both program completion and subsequent rearrest. This study provides preliminary support for the development of typological assessment in criminal justice and BIP settings for early identification of men who may need additional interventions.  相似文献

Despite significant advances in the study of neighborhoods and crime, criminologists have paid surprisingly less attention to the extralocal forces that shape violence. To address this issue, we draw on an emerging body of work that stresses the role of home mortgage lending—a resource secured via interaction with external actors—in reducing neighborhood violence and extend it by addressing concerns that the lending–violence relationship is spurious and confounded by simultaneity. We explore the longitudinal relationship between residential mortgage lending and violence in Seattle with a pooled time series of 118 census tracts over 27 years, and we instrument our endogenous predictors (home mortgage lending and violent crime) with changes in their levels from prior periods. Employing Arellano–Bond difference models, we assess both the effect of mortgage lending on violent crime as well as the effect of violent crime levels on mortgage activity. We find that infusions of home mortgage lending yield reductions in subsequent violent crime; yet the impact of violent crime on subsequent lending is not significant. Results underscore the importance of incorporating external forces such as home mortgage lending into explanations of neighborhood violence.  相似文献

It is easy to understand the apparent appeal of strict liability to policymakers and legal reformers seeking to reduce crime: if the criminal law can do away with its traditional culpability requirement, it can increase the likelihood of conviction and punishment of those who engage in prohibited conduct or bring about prohibited harm or evil. And such an increase in punishment rate can enhance the crime-control effectiveness of a system built upon general deterrence or incapacitation of the dangerous. Similar arguments support the use of criminal liability for regulatory offenses. Greater punishment rates suggest greater compliance. But this analysis fails to appreciate the crime-control costs of strict liability. By explicitly providing for punishment in the absence of moral blameworthiness, the law undermines its moral credibility with the community and thereby provokes subversion and resistance instead of the cooperation and acquiescence it needs for effective crime control. More importantly, the system’s lost moral credibility undermines the law’s ability to harness the powerful forces of stigmatization, social influence, and internalized norms. Given the serious limitations inherent in the real-world application of general deterrence and preventive detention programs, the most effective crime-control strategy is to build the criminal law’s reputation for being just, which means avoiding the use of strict liability.  相似文献

This paper presents a model of police response to changes in crime frequencies and a criminal response model characterizing the deterrent effects of police arrest behavior. These models are estimated for data taken from police department records in the city of St. Louis. The underlying theoretical conception is that arrests constitute communication to criminals in general in addition to the specific deterrence achieved through the arrest it see Disaggregation in both space and time enables identification of the statistical models through measurement rather than through statistical manipulation. The models are estimated for burglaries under varying demographic conditions and using data organized through aggregation in time (by weeks) and space (by census tracts). Under some demographic conditions, both police response and deterrent effects on criminal behavior are enhanced. Under other demographic conditions, these effects are suppressed. Enhancements and attenuations arising from specific demographic conditions for both the police response and criminal response models have a similar pattern, consistent with the underlying communication hypothesis.  相似文献

While social support theory has been applied to a variety of criminal justice settings, there has been little empirical research on the effect of social support on inmate behavior. In this article, we test Cullen’s proposition that social support, in whatever form it manifests itself, has an effect on Korean inmates’ experiences. Specifically, we examine whether social support in an all-male prison environment explains inmate misconduct, victimization, fear of victimization, and the intent to commit crime in the future. We build upon previous research by using unique measures of the instrumental and the expressive dimensions of social support to determine their effect on reducing criminogenic engagement in a prison setting. The results indicate that social support is an important factor in reducing prison violence, enhancing pro-social behavior, and potentially reducing recidivism.  相似文献

In this study we propose several mathematical models for describing the behavior of crime-related systems. In the first part is presented a simple model for describing and measuring crime systems with recidivism. This model may be used in estimating the quantitative effects of alternative policies on crime rates. An important factor not recognized by the model is deterrence. One derivative of the mathematical analyses is a proposed method for measuring the relative severity of sentencing in a given system. The second part of the paper deals with the criminal population as a whole, trying to bring into account the non-stationary behavior of the system. This study should be regarded as a preliminary attempt to develop elementary mathematical models fitting crime systems. Some of the assumptions do not have substantial direct support by data.  相似文献

Several previous studies have found that interventions by security forces against criminal organisations result in increased violence related to organised crime. However, much less is known about how and why this effect occurs. Our study not only identifies the causal mechanisms that explain this outcome, but also evaluates the empirical validity of these mechanisms. Employing a novel data set, we find that following security-force intervention, the number of criminal organisations increases, and such greater fragmentation in turn raises the incidence of violence among criminal organisations as the relative power of the organisations changes. We employ a mediation model to verify the existence of these causal mechanisms. In addition, we find a decreasing rate of rise in levels of violence as the number of organisations increases.  相似文献

Objectives

To test whether individuals differ in deterrability by studying whether the effect of criminal experiences on perceived detection risk varies by criminal propensity.

Methods

Data from the British “Offending, Crime and Justice Survey”, a four-wave panel study on criminal behavior and victimization, are analyzed. Two subsamples for analyses are constructed: one of non-offenders at first measurement, to analyze the effect of gaining first offending experiences during the time of study (n = 1,279) and one sample of individuals who have committed offenses within the past year (n = 567), to analyze the effect of police contact among active offenders. Fixed-effects regressions of perceived detection risk on criminal experiences and interactions between criminal experiences and measures of criminal propensity (risk-affinity, impulsivity) are estimated.

Results

Analyses support learning models for the formation and change of risk perceptions, but individual differences by criminal propensity are present in the deterrence process: After gaining first offending experiences, impulsive individuals as well as risk-averse individuals are more likely to lower their perceptions about the probability of detection than less impulsive or risk-affine individuals are. A positive effect of police contact on expected detection risk is restricted to risk-averse individuals.

Conclusions

Findings support claims that deterrence works differently for crime-prone individuals. The differential effects of impulsivity and risk-affinity underline the importance of not combining constituent characteristics of criminal propensity in composite indices, because they might have differential effects on deterrence.  相似文献

A number of jurisdictions have been experimenting with new problem-oriented policing frameworks to understand and respond to gun violence among gang-involved offenders. These interventions are based on the “pulling levers” deterrence strategy that focuses criminal justice and social service attention on a small number of chronically offending gang members responsible for the bulk of urban gun violence problems. Unfortunately, there is relatively little rigorous evaluation evidence on the effectiveness of these approaches to violence prevention. In Stockton, California, an interagency task force implemented a pulling levers strategy to prevent gun homicide among gang-involved offenders. A U.S. Department of Justice-sponsored impact evaluation suggests that the pulling levers strategy was associated with a statistically significant decrease in the monthly number of gun homicide incidents in Stockton. A comparative analysis of gun homicide trends in Stockton relative to other midsize California cities also supports a unique program effect associated with the pulling levers intervention.  相似文献

This paper considers whether publicizing criminal labels is justified as a form of punishment. It begins by arguing that making criminal labels public is inevitably stigmatizing and that stigmatization is not, as is often implied, a defining aspect of censure, but needs independent justification. It argues that justifying grounds for public criminal labelling cannot be found in either the communicative account of punishment or deterrence theory. Rather, public criminal labelling should be understood as undermining of both the communicative and the deterrent functions of punishment. Recent empirical work is drawn upon to support the claims about public criminal labelling and deterrence.  相似文献

Research focusing on deterrence has stressed the negative relationship between perceived formal sanctions and criminal behavior, ignoring the possibility that in some populations formal sanctions may serve to increase offending under some conditions. Utilizing a sample of 300 homeless street youths, the study explores if violent peers, violent values, and the culture of the street moderates the association between perceived legal sanctions and violent offending. The results suggest that violent peers, violent values, and the culture of the street condition the perceived certainty of punishment so that it leads to higher levels of violence. Further, the culture of the street conditions the relationship between perceived severity of punishment and violence. Theoretical and policy implications are discussed.  相似文献

Research on the deterrent effects of punishment falls into two categories: macro‐level studies of the impact of aggregate punishment levels on crime rates, and individual‐level studies of the impact of perceived punishment levels on self‐reported criminal behavior. For policy purposes, however, the missing link—ignored in previous research—is that between aggregate punishment levels and individual perceptions of punishment. This paper addresses whether higher actual punishment levels increase the perceived certainty, severity, or swiftness of punishment. Telephone interviews with 1,500 residents of fifty‐four large urban counties were used to measure perceptions of punishment levels, which were then linked to actual punishment levels as measured in official statistics. Hierarchical linear model estimates of multivariate models generally found no detectable impact of actual punishment levels on perceptions of punishment. The findings raise serious questions about deterrence‐based rationales for more punitive crime control policies.  相似文献

Problem‐oriented policing has been suggested as a promising way to understand and prevent complex gang violence problems. A number of jurisdictions have been experimenting with new problem‐oriented frameworks to understand and respond to gun violence among gang‐involved offenders. As part of the US Department of Justice‐sponsored Project Safe Neighborhoods initiative, an interagency task force implemented a pulling levers strategy to prevent gang‐related gun violence in Lowell, Massachusetts. Our impact evaluation suggests that the pulling levers strategy was associated with a statistically significant decrease in the monthly number of gun homicide and gun‐aggravated assault incidents. A comparative analysis of gun homicide and gun‐aggravated assault trends in Lowell relative to other major Massachusetts cities also supports a unique program effect associated with the pulling levers intervention.  相似文献

Much of the criminal justice literature indicates that people’s support for harsh criminal sanctions such as the death penalty is strongly related to their beliefs about deterrence and their beliefs about retribution. In this paper, using social dominance theory as our organizing framework, we expand upon this literature by showing that social dominance orientation (SDO) is also related to support for harsh criminal sanctions, as well as to deterrence and retribution beliefs. In addition, we show that the relationships between SDO, on the one hand, and support for various forms of severe criminal sanctions, on the other, are mediated by deterrence and retribution beliefs.

Using observational data collected as part of a one-year preventive patrol study in Minneapolis, this investigation employs survival models to test hypotheses about the effects of specific instances of police patrol presence at high-crime locations on the time until the next occurrence of criminal or disorderly behavior at these locations. The results show that patrol stops must reach a threshold dosage of about 10 minutes in order to generate significantly longer survival times without disorder — i.e., greater residual deterrence — than that generated by driving through a hot spot. The optimal length for patrol stops appears to be 11 to 15 minutes. After that point, continued police presence brings diminishing returns. The theoretical and policy implications of these results are discussed.  相似文献

The Supreme Court of California has ruled on several cases involving the question of to what extent a possessor of land is liable for the harm to customers or tenants occurring when a third party commits a criminal act against the customers or tenants present on the land. This paper reviews the historical development of this aspect of negligence law and analyzes the ethical and economic efficiency implications of ascribing legal responsibility for such crimes to: a) local government, b) the possessor of land, c) the customer, and d) the criminal. For example, is there an effort by the judicial system to substitute deterrence from criminal acts provided by possessors of land (i.e., specific deterrence) for the general deterrence traditionally provided through the use of police powers by local government? Analysis indicates that specific deterrence may be more effective in changing the location of criminal acts than in reducing the level of criminal activities. Also, the expense of complying with the legal responsibilities of protecting customers and clients may be especially high in high-crime, low-income areas, thus forcing commercial establishments to move or go out of business. Thus, we have a troubling tradeoff: compensating individual crime victims in a high-crime area could ultimately deprive the residents of basic economic opportunities.  相似文献

Deterrence theory generally finds support among studies focusing on changes in apprehension certainty, in punishment celerity, or in punishment severity. However, scientific evidence establishing a clear deterrent effect of criminal justice institutions on criminal behavior remains problematic partly because of measurement, design and/or experimental control difficulties. This study attempts to overcome some of these methodological difficulties by measuring deterrence in a drunk driving enforcement program in a small Wisconsin city. It demonstrates a statistically significant relationship between a carefully designed enforcement program and driver response measured by accident rates. This finding is contrary to some recent studies challenging the efficacy of enforcement efforts aimed at traffic accident reductions. A general discussion of deterrence and enforcement amplifies the findings and conclusions. A word of caution is added regarding the findings.  相似文献
