In the last few years, many countries have introduced laws combating the phenomenon colloquially known as ‘revenge porn’. While new laws criminalising this practice represent a positive step forwards, the legislative response has been piecemeal and typically focuses only on the practices of vengeful ex-partners. Drawing on Liz Kelly’s (Surviving sexual violence. Polity Press, Cambridge, 1988) pioneering work, we suggest that ‘revenge porn’ should be understood as just one form of a range of gendered, sexualised forms of abuse which have common characteristics, forming what we are conceptualising as the ‘continuum of image-based sexual abuse’. Further, we argue that image-based sexual abuse is on a continuum with other forms of sexual violence. We suggest that this twin approach may enable a more comprehensive legislative and policy response that, in turn, will better reflect the harms to victim-survivors and lead to more appropriate and effective educative and preventative strategies.  相似文献

A key trait distinguishing the writing of Irish American women from that of their male counterparts is a strong feminist bent often expressed in stories featuring sex and sexuality. In ignoring these characteristics, Irish studies scholars have disregarded a trait established by Irish women writers in oral traditions as early as 600 and in written English since 1685. Much of this material was categorized as the ‘Wrongs of Woman’, a phrase used to describe stories about physical and sexual abuse. These same themes can be traced in the writing of Irish American women since the late nineteenth century. By focusing on these ‘wrongs’, Irish American women have not only carried on the tradition begun by their foremothers; they have also battled patriarchal bonds on three fronts: religion, which created such bonds; society, which reinforced them; and politics, which tries to recreate and re-impose them. A complete understanding of Irish American writing therefore depends on recognizing and adding the contributions of these women to the definition of the literature. This essay defines that cohort, then provides a historically contextualized examination of their literary attempts to address the ‘wrongs’ of women inflicted by religion, society and politics from 1899 to the present. In so doing, this discussion demonstrates the role played by Irish American women writers in promoting, protecting and perpetuating the rights of women in the United States and around the world.  相似文献

This article argues that women’s human rights were and are being violated in Afghanistan regardless of who governs the country: Kings, secular rulers, Mujahideen or Taliban, or the incumbent internationally backed government of Karzai. The provisions of the new constitution regarding women’s rights are analysed under three categories: neutral, protective and discriminatory. It is argued that the current constitution is a step in the right direction but, far from protecting women’s rights effectively, it requires substantial revamping. The constitutional commitment to international human rights standards seems to be a hallow slogan as the constitution declares Islam as a state religion which clearly conflicts with women’s human rights standards in certain areas. The Constitution has empowered the Supreme Court to review whether human rights instruments are compatible with Islamic legal norms and, in case of conflict, precedence will be given to Islamic law. Keeping this in view, it is argued that Afghanistan’s ratification of the Women’s Convention without reservations has no real significance unless Islamic law dealing with women’s rights is reformed and reconciled with international women’s rights standards.  相似文献

Through the critical analysis of visual and verbal texts, this essay offers a sighting of New Zealand aviator Jean Batten—one of the greatest women solo flyers of the twentieth century to ‘disappear’. Unlike US flyer Amelia Earhart whose disappearance some miles off Howland Island in the South Pacific prompted endless search and research, Jean Batten’s disappearance from stage and page of flight history engendered no such interest until the late 1980s when a documentary film (1988) and the first book‐length biography (1990) were published by Ian Mackersey. Although important contributions to understanding Jean Batten’s place in aviation history of the twentieth century, Mackersey’s construction of Batten’s life relies heavily upon a psychological interpretation of character and action that is largely removed from and uninformed by gendered history. Hence, an important aim of this essay is to offer an analysis of the impact ‘the accident of sex’ (a phrase coined by Earhart) and the performance of gender had and continues to have upon ‘the life’ of Jean Batten.  相似文献

This paper explores how law might conceive of the injury or harm of endocrine disruption as it applies to an aboriginal community experiencing chronic chemical pollution. The effect of the pollution in this case is not only gendered, but gendering: it seems to be causing the ‘production’ of two girl babies for every boy born on the reserve. This presents an opening to interrogate how law is implicated in the constitution of not just gender but sex. The analysis takes an embodied turn, attempting to validate the real and material consequences of synthetic chemicals acting on bodies—but uncovers that finding a harm in a declining sex ratio depends on a static conception of the human form, based on unfounded assumptions of ‘naturalness’ and ‘normalcy’. Elizabeth Grosz’s theory of ‘becoming’ offers a compelling challenge, essentially pointing to the conclusion that we should find harm where we find illness and suffering and not simply where we find difference. At the same time, we cannot discount the political economy of the pollution: the paper concludes by returning the focus to the role of power, colonialism and the state in the perpetuation of the pollution on the landscape.  相似文献

Taken together, evolutionary psychology and neuroscience combine to provide a compelling heuristic account of sex/gender differences. In this article, I explore how the meta-theoretical framework provided by evolutionary psychology provides support for a reading of sex/gender effects in neuropsychological research that sees these as evidence of a ‘hardwired’ neurobiological basis for sex/gender. I discuss the resistance of these ‘hardwired’ accounts to arguments that—like other neuropsychological phenomena—sex/gender could be theorised in terms of experience-dependent neuroplasticity. I conclude that the evolutionary-neuropsychology heuristic obtains much of its appeal from the apparently ‘scientific’ evidence it provides for understanding sex/gender as a ‘natural’ rather than ‘sociocultural’ phenomenon—a view which is aligned with postfeminist ideologies of sex/gender in the contemporary west.  相似文献

In The Sadeian Woman (1979) Angela Carter suggested that the visions of free female sexuality created by the Marquis de Sade in his violent pornographic novels provided insight into existing female sexualities in her own—British—society. In this article the representation of female sexuality in novels set in contemporary British society, written by women, and published between 1960 and 1975, is examined in relation to Carter's exegesis of the good, virtuous Justine and the meretricious, sexually desirous Juliette, two contrasting characters from Sade's work. The limitations of the three other alternatives present in the novels are described; containment within long-term marriage, good-hearted promiscuity; and the rejection of emotional repression. Then Carter's own solution to women's sexual inequality is placed in the context of feminism in the late 1970s, and the role of the novels in contributing to change is acknowledged.  相似文献

History has played a central role in the construction of nations in the early modern period when national historiography replaced chronicles as the main historical genre. The treatment of female national characters by historians is therefore key to our understanding of the gendering of the nation in its infancy. This article contends that Scotland is a good case in point to explain why some nations were born ‘womenless’, for not only did Scottish historians of the period exclude women from national heroism, but one historian, Buchanan, went as far as theorising a Scottish exception that deliberately excluded Scottish women from the throne.  相似文献

With the rise of ‘bioeconomy’, trees are receiving increasing attention. This contribution conducts a preliminary analysis of the trajectories and the main drivers of change in the rise of new, flexible and multiple uses of trees. It assesses the political dimensions involved in this transformation, which is simultaneously ongoing, anticipated and imagined. Notes are offered on the issues to be considered when the flex-crop framework is operationalized to include the study of trees, and additional conceptualizations that help in analyzing the political economy of tree uses are provided. Areas needing further empirical study are identified and a preliminary research agenda is suggested. The flexible and multiple use of trees and tree-derived commodities is having a large impact on power relations in the global political economy of forestry and the forest industry, the asymmetry of which is based on who is best able to flex or de-multiply, thereby controlling commodity webs and processing technology. It is argued that while flexing seems to increase diversity, in practice it typically increases this only for the processing industry; the converse occurs in terms of the unification of the productive base into monocultures. However, these two processes go hand in hand, and illustrate how flexing is a deeply capitalist process.  相似文献

This article traces the girl in The Second Sex [(1949). Paris: Éditions Gallimard] as a necessary figure for understanding what it means to become woman. I argue that Simone de Beauvoir’s overall significance and philosophical contribution is intimately connected to what she discovered by asking about this moment of feminine becoming. My central contention is that we cannot understand how one ‘becomes’ woman without first/also undertaking the task of understanding the situation of the girl. Drawing on the new translation of The Second Sex by Constance Borde and Sheila Malovany-Chevallier [(2010). London: Vintage], I offer a close reading of the chapter entitled ‘The Girl’ with attention to embodiment and temporality. In so doing, I seek to expand and refine our understanding of Beauvoir’s philosophical project in The Second Sex; a project which launched a fundamental challenge to the meaning of being and gave rise to the possibility of a feminist philosophy.  相似文献

The control of women's public form of mourning in India was undertaken in the colonial era by male social reformers. The article argues that this was both a part of the process which enabled the consolidation of colonial rule – since laments were repositories for the social memory of the dead which could lead to vendettas – and that this fed into the construction of a specific domestic ideology. The latter was predicated on the privatization and interiorization of grief, whereby women were enjoined to bear themselves with rectitude. The taming of the transgressive form of mourning, whereby women who had earlier exhibited their grievances in a spectacular form through lament, took to more quietist (devotional) forms, has reconfigured the relationship to death and mourning. However, this has been a partial phenomenon, limited to the upper-caste, middle-class milieu. Where women continue to hold a dependent position within community, nation-state and international economy, the article suggests that, in contexts of modern conflicts and warfare, where death runs ‘wild’, the exhibitionist and ‘wild’ forms of showing grief and anger continue to be demonstrated by women as an appropriate public response.  相似文献

In this article we identify ‘new traditionalism’ as the discourse that dominates the historiography of the Indian environment. We challenge the new traditionalist equation of ‘forests’ and ‘nature’, their assertion that ‘traditional’ agriculture was ecologically balanced, and was practised by self‐contained communities, and their claims that women, forest dwellers and peasants were primarily the keepers of a special conservationist ethic. We next examine the new traditionalist claim that colonialism, modernity and development were exclusively responsible for the degradation of nature in India. Finally, we examine the new traditionalist interpretations of popular politics around environmental issues, specifically the Chipko movement. We make explicit the assumptions and political implications of new traditionalism and provide an alternative reading of Indian environmental history and politics.  相似文献

In the spring of 2008, fuelled by the impending demise of the undergraduate Women’s/Gender Studies programme at London Metropolitan University, a series of public statements proclaimed the death of Women’s/Gender Studies. This article constitutes a response to these statements. Taking a broadly European view of the state of Women’s/Gender Studies, it argues that the discipline has established a research infrastructure, mainstreamed its undergraduate curricula and its pedagogical underpinnings, and continues to attract research funding and significant numbers of postgraduate students. It finally suggests that the ‘fate’ of disciplines is not teleological but iterative.  相似文献

Analysing sexual harassment law in British Columbia, this paper argues that in highly sexualised work environments, in which practices including sexual ‘jokes’ or innuendo may be common, law embodies and (re)creates the gendered subtext of the workplace. When a complaint of sexual harassment from a sexualised workplace is raised in a legal forum, a complainant has an obligation to clearly object to the sexual remarks, ‘jokes,’ banter, etc.—which may be the ‘norm’—to show the conduct in question was unwelcome. At the same time, however, a workplace may be structured, in part by law, in a way that restricts employee resistance to uncomfortable sexual experiences. This is the case, I argue, for women working in full-service restaurants when it comes to sexual interactions with customers. This paper explores how restaurant work, in the Canadian context with a focus on the province of British Columbia, is organised in a manner that makes women vulnerable to enduring sexually harassing practices as a routine part of their jobs.  相似文献

‘Flex crops’ such as corn, oil palm and soy are understood to have multiple, interchangeable uses; they have material flexibility. We propose that discursive flexibility – the ability to strategically switch between discourses to promote an objective – equally shapes the political economy of flex crops, and thereby patterns of agrarian and environmental change. Comparing oil palm and Jatropha curcas, we find that actors who cast oil palm as a multi-scale solution to food and energy insecurity, climate change and (rural) poverty successfully reinforce its high material flexibility. Jatropha's proponents compensate for low material flexibility by positioning the crop as a ‘sustainable’ energy source that achieves both global and local goals. While this paper focuses on discourses that reinforce the oil palm and jatropha projects, understanding the power of discursive maneuvering can also inform efforts to contest them.  相似文献
