Abstract

One of the principal challenges facing contemporary social philosophy is how to find foundations that are normatively robust yet congruent with its self-understanding. Social philosophy is a critical project within modernity, an interpretative horizon that stresses the influences of history and context on knowledge and experience. However, if it is to engage in intercultural dialogue and normatively robust social critique, social philosophy requires non-arbitrary, universal normative standards. The task of normative foundations can thus be formulated in terms of negotiating the tension between ‘contextualism’ and ‘objectivism’. Six contemporary responses to this challenge are examined. Their respective limitations call for renewed reflection on justificatory strategies, in particular for a conception of ‘objectivity’ based in a normative theory of social learning processes.  相似文献

Abstract

This essay discusses the phenomenon of ‘organized crime’ as a matter for EU foreign and security policy. Primarily aimed at searching for conceptual guidance, it draws on literature on criminology and policing, presenting two different theoretical perspectives for analyzing the phenomenon of ‘organized-crime fighting’, a utilitarian and a critical one. Against this backdrop, the essay discusses how ESDP (European Security and Defence Policy) has developed and engaged the issue of organized crime. Specifically, it outlines the character of ESDP as a mechanism for ‘civilian crisis management’ and illustrates its ‘working’ through the case of the EU's police mission in Bosnia and Herzegovina (EUPM) by placing it in the two different theoretical frames. Deciding in favour of a social constructivist approach, the essay concludes by suggesting that a successful strategy must focus on the dissemination of the EU's understanding of ‘organized crime’ abroad.  相似文献

ABSTRACT

From the time of his nomination as the Democratic Party's 2008 presidential candidate onwards, Barack Obama was the target of a panoply of political attacks. Conservatives, Republicans and even some Democrats played on his alterity in a way that previous non-white political hopefuls, particularly the Reverend Jesse Jackson, had not had to endure. If the intricate twists and turns of Obama's past did not make those attacks particularly surprising, the way in which he chose to deal with them was. In what stands as a deliberate pre-emptive attack, Obama used two substantive texts, Dreams from My Father and The Audacity of Hope, to create and shape a historical narrative of his own past in such a way as to present himself to the US voting public as a truly American figure, worthy of the presidency. By the time he was running for high office, therefore, Obama had already used his knowledge of the discipline of history to create a usable past with which he and his supporters could denude many of those political attacks of their potency, whether they were focused on the years of his upbringing in an Islamic state, his familial ties to Kenya, his religious background or his purported links to radicalism.  相似文献

This article looks at the UK Labour Party’s view of the EU single market over the last four decades, focussing on three case study periods when this issue was particularly salient: first, the time of the single market’s introduction under Neil Kinnock’s leadership; second, the A8 accession with Tony Blair as Labour Prime Minister; and third, between the 2016 European referendum and 2019 general election during Jeremy Corbyn’s time as party leader. This historical narrative uses the theoretical approach of Harvard economist Dani Rodrik—of a ‘trilemma’ faced by national policy makers in response to globalisation—as a lens to describe a clear arc in Labour’s policy towards the single market across the three case studies. A position of initial scepticism moved to support under Kinnock’s leadership, and then active encouragement under Blair, before coming back again under Corbyn to uncomfortable non-commitment. This arc directly correlates with the ebb and flow of the party’s overall economic approach—first the Keynesian, national Alternative Economic Strategy at the time of the party’s 1983 general election defeat; then, the deviation under Blair to a policy that actively encouraged cross-border market liberalisation; and finally the return to an Alternative Economic Strategy-style approach under Corbyn.  相似文献

The European Union (EU) stands out among the major trading powers for its significant and dramatic response to new demands for access and participation in its external trade policymaking process. A spectacular range of mechanisms designed to increase the involvement of civil society organizations, including non-governmental organizations (NGOs), have been introduced recently. This article examines whether these new political opportunities in the EU have an impact on the trade processes and policy outcomes by revisiting a case that has been celebrated as indicative of the potential of global civil society to promote social justice—the Access to Medicines campaign. The findings show that although NGOs were instrumental in providing education, raising awareness, and giving a voice to broader societal concerns about the social and health-related aspects of the proposed trade deals, their impact on policy outcomes was limited. EU policymakers did not pursue policies that placed public health concerns over stringent intellectual property right protection, despite NGO involvement in the external trade policymaking process. I argue that the robust liberal and legal epistemic foundations of the international trade regime effectively hamstrung NGO efforts to move the external trade policies in more sustainable and just directions. These findings have broad implications for the power of epistemes and their ability to enable and delimit NGO agency in global economic governance.  相似文献

Decolonisation of the curriculum is a burgeoning yet controversial project of radical change, gaining slow but steady traction in higher education politics departments across the country. At its heart is the acknowledgement and systematic unravelling of colonial and imperial practices in the UK university system. This article pins down what decolonisation is and is not, highlighting the barriers and tentative opportunities to effective decolonisation work. This is discussed in the context of the structural constraints that critical scholars of race—particularly those at the intersection of marginalised racial and gender identities—work against in the academy.  相似文献

What might be gained by learning to live with ‘the problem’ of irregular migration, rather than attempting to solve it? This article engages two senses of ‘the problem’ at stake: first, the ongoing nature of displacement and migration and second, the contested justice claims that sit behind different policy perspectives. The second sense of the problem (its political dimension) is rarely addressed explicitly in public debate. Yet direct engagement with the political dimension offers the potential to unlock debate from a polarised impasse. To make this argument, I first diagnose debate on irregular migration in terms of three archetypal positions and examine their implicit justice claims. I then argue for a more ambitious debate that pushes contending justice claims to their logical extensions. Debate of this kind requires a more coherent defence of justice claims, whether they are based in communitarian, cosmopolitan, anti-capitalist or hybrid values with respect to citizenship and political community. The article concludes with an illustration of how this approach can generate momentum for less circular, more sustainable and politically achievable policy responses. The argument is made with reference to illustrative examples from Australia and Europe but holds for a variety of contexts where ‘the problem’ is framed in similar ways.  相似文献

How are citizenships and nationalisms constructed, connected, and contested in the post-9/11 USA – performatively, affectively, and visually – and how do their relationships figure ‘Americanness’? This article takes up this question (1) by tracking how Americanness was advertised in the American Ad Council's ‘I am an American’ campaign and (2) by introducing the multimedia project ‘I am an American’: Video Portraits of Unsafe US Citizens, which engages the Ad Council's campaign as a practice-based protest of the Ad Council's advertised ‘Americanness’. The article traces how the Ad Council's campaign advertises what Evelyn Alsultany calls ‘diversity patriotism’. It also constructs a complex, mobile system of differentiation that marks some citizens as ‘safe’ and others as ‘unsafe’, which runs counter to the idealized notion of a unified ‘Americanness’ that it advertises. The article then examines how the practice-based protest project ‘I am an American’ takes these ‘unsafe citizens’ – US citizens who either will not or cannot make their differences normatively conform to the national ideal of the ‘One’ composed of the ‘Many’ propagated by the Ad Council's campaign – as its point of departure to reflect upon how citizenship protests function for and against citizenship, nationalisms, and various figurations of Americanness.  相似文献

ABSTRACT

Under the imperative of ‘prevention’, the process of information production for investigatory purposes forms a crossover between intelligence gathering and law enforcement. Digital surveillance programmes collect personal data prior to any probable cause of suspicion, whereas law enforcement activities are concerned with collecting evidence of crimes after the event. When future looking preventative approaches to the prosecution of crimes are forced into the linear, temporal narrative by which criminal investigations unfold, a tension emerges. The article demonstrates the ultimate incompatibility between ‘out of the ordinary’ intelligence activities and ‘ordinary’ criminal investigations by unearthing the procedural character behind evidence laundering.  相似文献

There is great interest in co-creation of welfare production between municipalities and the civil society in the Nordic countries. Using linking social capital as a theoretical point of departure and examining a qualitative case study in Norway, I critically assess the concepts of co-creation and ‘Municipality 3.0’. It is suggested that even in countries with high trust in the authorities, building linking social capital in the shape of interorganizational networks is a complex process fraught with potential barriers related to trust, network building, municipal resources, and statutory laws and regulations. French local government has been subjected to sweeping reforms since the Socialist Party took office. The numerous measures, not yet all finalised or implemented, are aimed at creating a decentralised administration with local democratic control, particularly through the creation of local civil service corps and the transfer of tax‐revenues to the localities. It is apparent that considerable administrative problems will arise, and the parties will also be affected, not least by the introduction of PR voting at the local level. Democratic control will be enhanced and there will be a greater apparent politicisation of the administration, but it is also to be expected that the bureaucracy will protect its own interests and priorities.  相似文献

Abstract

Japan today is widely portrayed as on the verge of a significant identity shift that could lead to dramatic new security policies. Yet, Japan's first formal national security strategy, adopted in December 2013, proclaims repeatedly Japan's long-standing ‘peace-loving’ policies and principles. Why does a conservative government with high levels of popular support not pursue policies more in line with views widely reported to be central to its values and outlook? The answer lies in Japan's long-standing security identity of domestic antimilitarism, an identity under siege to a degree not seen since its creation over 50 years ago, but – as evidenced in Japan's new national strategy document – one that continues to shape both the framing of Japan's national security debates and the institutions of Japan's postwar security policy-making process. Relational approaches to identity construction illuminate challenges to Japan's dominant security identity, but a focus on domestic institutions and electoral politics offers the best course for modeling identity construction and predicting its future resilience.  相似文献

The aim of this article is to analyse citizens’ attitudes towards governmental accountability in 24 European countries and to examine the influence of contextual and individual factors on perceptions of accountability. Using as a dataset the 2012 European Social Survey, the results show that citizens respond positively when the media provides reliable information on which to judge the government, when individuals perceive that governments perform well, when individuals live in more extensive and generous welfare states and when they live in countries where the rule of law is firmly established. In addition, the findings also provide evidence that compared to politically left-wing citizens, right-wing supporters have, on average, a higher perception of governmental accountability. In particular, the findings show strong positive evaluations of right-wing governments by right-wing voters in comparison with left-wing governments by left-wing voters.  相似文献

Advocates commonly highlight the exploitation that hard-working undocumented immigrants commonly suffer at the hands of employers, the important contribution they make to the US economy, and the fiscal folly of border militarization and enhanced immigration enforcement policies. In this paper, I unpack these economic rationales for expanding immigrant rights, and examine the nuanced ways in which advocates deploy this frame. To do so, I rely on statements issued by publicly present immigrant rights groups in six places: California, Florida, Illinois, New York, Texas, and Washington, DC. I also draw on interviews with immigrant advocates in San Jose, CA and Houston, TX, press releases from two alternative national immigrant rights organizations, and an ethnographic photo-documentation of immigrant rights mobilizations in 2012–2014. Economic rationales, I emphasize, can be found in each of these contexts, but are not mutually exclusive to other justifications, including narratives about civil, human, and family rights for immigrants. However, I argue that an economic framing of immigrant rights nonetheless runs the risk reifying work over conventional understandings of criminality, often relies on a narrow definition of economic worth, and could have negative consequences for coalition building.  相似文献

Abstract

The Law and Economics movement that emerged in the University of Chicago through the 1940s and 1950s, around Ronald Coase's example, is a manifestation of the neo-liberal project of applying neo-classical economics to state sovereignty. In the 1970s and 1980s, Law and Economics ideas revolutionized the application of antitrust laws in the United States. However, this achievement came about not through a transformation in economic orthodoxy, but through persuading legal experts to recognize the inherent ‘nonsense’ at work in their own normative assumptions. The Chicago antitrust revolution is therefore symptomatic of trends that Foucault viewed as definitive of neo-liberalism more broadly.  相似文献

Contemporary accounts of somatization tend to imply that the 'biological' and the 'social' are competing and mutually contradictory epistemological perspectives. This situation ismirrored by the alternative between biomedical objectivism and sociological relativism in accounting for the reality (or, indeed, the non-reality) of this phenomenon as a pathological condition. This paper reads the debate on somatization through Canguilhem's writings. Cnaguilhem's vitalism sees the 'social' and the 'organic' as perspectives pertinent to the living subject, before and beyond being perspectives of the subject of knowledge. As such, they do not represent mutually exclusive choices but rather norms that interact in and through their difference, bearing on the quality of life as healthy or pathological. On this basis, the paper offers an account of how the reality of somatization might be envisaged so as to avoid the implications of both positivism and relativism.  相似文献

The right not to be subjected to torture, cruel, inhuman or degrading treatment or punishment is invariably associated with ‘human dignity’. The idea of dignity plays some role in this right’s interpretation, although the content of the idea in this context, as in others, is unclear. Making sense of the dignity idea involves a number of challenges. These challenges give rise to the methodological-type question at the heart of this article: how should human rights lawyers go about articulating the content of ‘dignity’? The article proposes, and models, a methodological approach in response. Its core argument is that human rights law needs the vocabulary provided by theorizations of dignity but that these theorizations should be anchored in authoritative human rights jurisprudence. It argues that this approach can help make sense of the dignity idea in a way that facilitates a richer understanding of its influence on interpretation.  相似文献

While most histories of SOE tend to emphasize the importance of sabotage and subversion in meeting Churchill’s injunction to ‘set Europe ablaze’, this article argues for a wider understanding of the functions of SOE by focusing on its operations in Crete. With a particular emphasis on the role and influence of Tom Dunbabin, the article shows that SOE in Crete took on a much broader range of functions than commonly understood. They extended into the realm of politics and diplomacy in pursuit of the larger aim of discouraging rather than promoting the use of violence in preparation of a peaceful transition to a post-war order.  相似文献

‘Venona’ remains the greatest secret of the Cold War yet to be declassified, and offers the pieces of a jigsaw that, when assembled and interpreted, reveals the identities of dozens of Soviet agents who participated in GRU and NKVD networks across the globe between 1940 and 1948. Among them, operating in London, were Professor J.B.S Haldane, codenamed ‘Intelligentsia’, and Lord Swaythling's son, the Honourable Ivor Montagu, appropriately codenamed ‘Nobility’. Contained in the sometimes partially decrypted texts are clues to hundreds of other, as yet unexposed, spies, active in Australia, Mexico, Sweden, the United States, Britain, and numerous other countries. Betrayed by William Wiesband and Kim Philby, the ‘Venona’ project failed to find the traitor known as ‘Baron’ inside the wartime GCHQ, but was responsible for the arrest of Klaus Fuchs, confirming the guilt of Alger Hiss, Donald Maclean and the Rosenbergs, supporting the allegations of Whittaker Chambers and Elizabeth Bentley, and sparking off molehunts on three continents. ‘Venona’ sheds important new light on the assassination of Trotsky, Soviet penetration of the Manhattan project at Los Alamos and Berkeley, and reveals high-level espionage in the White House, OSS, the State Department and virtually every government department in Washington DC.  相似文献
