Transfers of undertakings a new meaning?

Defining the meaning of a transfer of an undertaking in the context of outsourcing has led to much litigation. After years of discussion the Acquired Rights Directive, which has been the source of much confusion and misunderstanding, has been amended. Unfortunately, the new Directive does little more than follow the approach of the European Court of Justice and has done little to make matters more certain. This article examines the change of definition and argues that they are inadequate.     

Need money? roll the dice

In 1990, the Mississippi Legislature legalized dockside casino gaming as a surrogate tax system for the state. Since the establishment of the first casino in 1992, the casino industry has become an important component in the state's revenue picture. During fiscal years 1993, 1994, and 1995, gaming taxes and fees accounted for 1.6, 4.1, and 5.04 percent of Mississippi's general fund revenue, respectively. In addition, certain localities have benefitted from the industry as well. Beyond the direct revenue received through local taxation, casino gaming has substantially increased both property tax revenue and sales tax collections. The Mississippi Gaming Commission believes, however, that long-term revenue stability depends on developing resort destinations as opposed to a continued reliance on day-trippers.

Colonists who balked at paying taxes to local governments were willing to purchase lottery tickets by those same governments⁽¹⁾ (yesterday).

Government no longer possesses the capacity to secure the cooperation of the citizenry in meeting the requirements of public need. Consequently, it uses a buffer to take resources from the citizenry without invoking their wrath⁽²⁾ (today).     

China’s development: a new development paradigm?

The emergence of China as a development actor across the global South has raised significant questions regarding the extent to which the country presents new development opportunities to its compatriots in the South. My aim is to reflect on and parse out the experiences and policies that have shaped China’s development to assess how it can inform the field of development studies. I argue that we need to critically engage in China’s development process, as China’s own development has led to the emergence of many more problems than solutions, ranging from increasing inequality to exclusionary development practices pertaining to ethnic minorities.     

Health and human security: a wrinkle in time or a new paradigm?

Since it was first advanced in the 1994 Human development report of the United Nations Development Programme [United Nations Development Project. (1994). Human development report. New York: UN], the concept of ‘human security’ has evolved as a holistic development-oriented acuity [Nef, J. (1999). Human security and mutual vulnerability: The global political economy of development and underdevelopment (2nd ed.). Ottawa: International Development Research Centre]. The human security concept reinforces the right to health, drawing on both the role of states and the global community's commitment to human rights. Yet, health and human security, long the purview of state power and responsibility, increasingly include alliances of state and non-state actors. This paper proceeds in three parts. The first looks at health and human security linkages, charting the trajectory of the health and human security relationship. The second deals with policy and operational implications. It explores the health–human security link, paying particular attention to the allocation of responsibility and accountability, including through private–public partnerships and rising powers such as China. The third provides a theoretical and technical analysis of the status of health and human security since 1994, taking into account its evolution vis-à-vis human rights’ development and development more broadly, also asking whether it represents but a wrinkle in time or a new sustainable development paradigm.     

All You Need is Cable TV?

Robert Jensen and Emily Oster find that arrival of cable TV in rural India reduces women's tolerance of spousal violence, son preference and fertility, and increases women's autonomy, and school enrolment. These results are mostly replicated using their data and code. However, cable TV does not affect uneducated women. Theoretically informed index construction reduces the tolerance of violence effect, and weakens that on autonomy. We have statistical power concerns, and find errors and questionable assumptions in school enrolment constructions. Using our data constructions, effects sizes and significance are weakened. These results suggest that pure, statistical and scientific replication have merit.     

Is the time of suicide a random choice? A new statistical perspective

The problem of the time distribution of suicide has aroused the interest of many authors, but their findings often appear uncertain and contradictory. These inconsistencies can be partially explained by both the choice of the sample and the statistical method used for the analysis. In this study, in order to reveal expected and unexpected periodicities in the time distribution of suicides, we analyzed a small but complete and very homogeneous sample of suicides which occurred in the Mountain District of the Metauro River Valley in Italy in the period 1960-1994. A recent circular statistics technique, the "maximization of mean vector length" was used. We found no significant weekly and lunar patterns, but significant seasonal and intraseasonal cycles, with peaks in March and at the beginning of each season. The superposition of these two significant cyclic trends was also studied.
