In Finland, homicide by ligature strangulation is a rare event. The purpose of this study was to investigate recent homicide cases by ligature strangulation and to analyse offence and offender characteristics. All forensic psychiatric evaluation statements of offenders accused of ligature strangulation homicides during the 7-year period 1996--2002 (n=19) were reviewed retrospectively. Thirty-five percent of the victims were females. In four cases, the victim was the offender's intimate partner; in one case, it was the stepson; in one case, a father and in the rest of the cases (n=13), an acquaintance. None of the cases involved planning, sadism or sexual elements. In 89% of the cases, the offender was either intoxicated or on drugs at the time of the offence and in 94% of the cases, the victim was found at the scene of the killing. Of the offenders, 63% had crime history, and approximately half of the offenders had experienced parental alcohol abuse, domestic violence or previous trauma. Most of the offenders were unemployed at the time of the offence. In all, 89% were diagnosed as having personality disorder and two were schizophrenic.  相似文献

This article examines whether crimes motivated by, or which demonstrate, gender ‘hostility’ should be included within the current framework of hate crime legislation in England and Wales. The article uses the example of rape to explore the parallels (both conceptual and evidential) between gender‐motivated violence and other ‘archetypal’ forms of hate crime. It is asserted that where there is clear evidence of gender hostility during the commission of an offence, a defendant should be pursued in law additionally as a hate crime offender. In particular it is argued that by focusing on the hate‐motivation of many sexual violence offenders, the criminal justice system can begin to move away from its current focus on the ‘sexual’ motivations of offenders and begin to more effectively challenge the gendered prejudices that are frequently causal to such crimes.  相似文献

Purpose. The rate of sexual reconviction for sexual offenders is known to be low. Sexual reconviction, however, is currently the most commonly used outcome measure in sex offender treatment evaluation studies. It is expected that sex offender treatment programmes will reduce the likelihood of reconviction amongst participants. A low base rate of sexual reconviction means that any reduction in reconviction (which could be attributed to treatment) will be small and unlikely to be statistically significant. This study aimed to assess other offence‐related outcomes for sexual offenders, in addition to reconviction. Methods. The sample comprised 173 sexual offenders who had completed a community sex offender treatment programme. Follow‐up information was collected forthe sample from programme files containing multi‐agency information. Official reconviction rates were also calculated using both Home Office and police data. Results. Collecting evidence of any offence‐related sexual behaviour during this study multiplied the sample's sexual reconviction rate by a factor of 5.3. Conclusions. The results show that broadening the outcome measure under observation indicates a higher level of offence‐related sexual behaviour displayed by sexual offenders than reflected by reconviction data. These results have implications for the outcomes measured in treatment evaluation research for sexual offenders.  相似文献

The notion of ‘cognitive distortion’ has become enshrined in the offender treatment literature over the last 20 years, yet the concept still suffers from a lack of definitional clarity. In particular, the umbrella term is often used to refer to offence‐supportive attitudes, cognitive processing during an offence sequence, as well as post‐hoc neutralisations or excuses for offending. Of these very different processes, the last one might be the most popular and problematic. Treatment programmes for offenders often aim to eliminate excuse‐making as a primary aim, and decision‐makers place great weight on the degree to which an offender “takes responsibility” for his or her offending. Yet, the relationship between these after‐the‐fact explanations and future crime is not at all clear. Indeed, the designation of post hoc excuses as criminogenic may itself be an example of fallacious thinking. After all, outside of the criminal context, post hoc excuse‐making is widely viewed as normal, healthy, and socially rewarded behaviour. We argue that the open exploration of contextual risk factors leading to offending can help in the identification of criminogenic factors as well as strengthen the therapeutic experience. Rather than insist that offenders take “responsibility” for the past, we suggest that efforts should focus on helping them take responsibility for the future, shifting the therapeutic focus from post hoc excuses to offence‐supportive attitudes and underlying cognitive schemas that are empirically linked to re‐offending.  相似文献

Purpose . The purpose of this paper was, firstly, to replicate Porter and Alison's (2001) leadership behaviour scale and, secondly, to extend this research through the use of a new sample of group robbery offenders. This will provide further support for the use of such a scale to identify potential criminal leaders and also offer insight into the dynamics and hierarchical structures among group robbery offenders. Methods . One hundred and five cases of group robbery, yielding 290 offender behaviour profiles, were coded according to each offender's level of involvement at each chronological offence stage in terms of decisions, actions and orders. A multidimensional scaling procedure examined the combinations of these, and produced a partially ordered scale of leadership behaviour with the defining aspects being initial decision making and involvement in the offence outcome. Results . The scale identified potential leaders in 103 of the 105 robbery groups, where these leaders scored higher than non‐leaders on the leadership behaviour scale. Two‐thirds of groups comprised a dichotomous leader/follower distinction, whilst the remaining third comprised more dispersed, linear and lieutenant hierarchies. Conclusions . These results further support the leader behaviour scale originally proposed by Porter and Alison (2001) . The results also offer insight into the processes by which robberies evolve; namely, through a series of decisions of one individual who then either participates first or gives orders to his fellow group members to participate, although the former seems far more frequent.  相似文献

Approximately 9% of the homicides in Finland are committed by adolescents under 20 years of age. The purpose of this study was to investigate the offence and offender characteristics in homicidal adolescents. Forensic psychiatric evaluation statements of adolescent offenders accused of a homicide during 1990-2001 were reviewed retrospectively (n=57). In 38% of the cases, there were multiple offenders. In 58% of the cases, the victim was an acquaintance, in 25% a stranger, in 12% a family member and in 5% of the cases an (ex)intimate partner. Sixty-nine percent of the offenders were intoxicated and 21% under the influence of drugs at the time of the killing. The most frequent motives were an argument (25%) and a robbery (25%). Sixty-four percent of the offenders had developmental problems and 42% had a crime history. Approximately half were diagnosed as having a conduct or a personality disorder, but 32% of the offenders were considered not to suffer from a mental illness or substance abuse. For 63%, the level of intellectual functioning was average or above average. There were signs of more than one form of violence in 54% of the cases and 28% of the cases contained excessive violence. The use of multiple and excessive violence was significantly related to the offender age, multiple offenders, offender-victim relationship and substance abuse, but not related to having developmental problems, crime history or mental illness.  相似文献

Abstract

The present study examined the behavioural differences in sexual assault offences in relation to the offender–victim relationship (stranger versus non-stranger). These differences were examined specifically in the context of four interpersonal themes of interaction: dominance, submission, hostility and cooperation. The details of 100 sexual offence cases (50 stranger and 50 non-stranger) were content-analysed, generating 58 dichotomous variables, covering offender and victim behaviour during the offence. χ2 tests comparing the two samples found that offenders who were strangers to their victims were more likely than non-stranger offenders to display behaviours that indicate a hostile, violent offence style. In contrast, those offenders who knew their victims were more likely than strangers to display a less violent and more personal, compliance-gaining offence style. These findings are discussed in terms of their implications for offender rehabilitation and victim support.  相似文献

Technique known as centrography are presented in order to demonstrate their utility for describing and measuring the salient features of a spatial distribution and for facilitating temporal and comparative analyses in discerning trends and contrasting spatial distributions of crime. Centrographic techniques are applied to a 5-year data set of lone-assailant rapes classified by type of offender. The results indicate that different classes of offenders have relatively distinctive spatial distributions. Moreover, changes in the spatial distributions of offender classes, through time, are not uniform.  相似文献

Purpose. Crime scene actions displayed by offenders in arsons were analysed in relation to offender characteristics and self‐reported motives. Methods. Data were drawn from an official police database and consisted of a random sample of arsons occurring in Finland between 1990 and 2001 (N = 189). The structure of dichotomous variables derived through a content analysis of crime scene actions and offender characteristics was analysed using non‐metric multidimensional scaling (MDS) analyses. Results. The analyses revealed four separate crime scene action types, with thematic emphasis on either expressive or instrumental motivation and the target being either a person or object. The MDS solution for offender characteristics suggested four types of offenders: Self‐destructive, Serial, Criminal, and Adolescent. In order to analyse the associations between action and characteristics themes, each case was assigned to one of the action and characteristic themes or a hybrid based on the frequency of variables present from each theme. Several statistically significant associations between the action and characteristic themes were found. Self‐reported motives were also analysed in relation to the themes. Conclusions. The results support the thematic classification of arsonists presented in Canter and Fritzon (1998). The results are discussed with regard to earlier research and deducing offender characteristics based on crime scene actions.  相似文献

Background. Previous reports on the outcome of services for offenders with developmental disabilities have found recidivism rates of between 40% and 70% with an elevated prevalence of sex offending, fire‐raising, and aggression. Studies have also reported that female offending rates in the intellectual disability population are broadly similar to those found in mainstream populations. All reports have been conducted on in‐patient or prison samples. The present report is of a community forensic intellectual disability service. Method. Two male cohorts of sex offenders (N = 121) and other types of offenders (N = 105) and female offenders (N = 21) are studied and compared. Data is reported on characteristics of the cohort, problems identified at referral, criminal justice disposal trends, index offences at time of referral, reoffending rates of up to 12 years after index offence, patterns of referral in the first 6 and second 6 years of the study period and the extent of harm reduction. Results. There were no differences between the groups on IQ and the sex offender cohort tended to be older. Female offenders had higher rates of mental illness although rates for the male cohorts were generally high at around 32%. The sex offending cohort had fewer problems with anger and aggression and alcohol abuse but a higher level of daily living problems and relationship problems. Female offenders had high rates of all problems studied except daily living problems. Unlike certain previous studies, sex offences predominated in the sex offender cohort while other types of offences predominated in the other two cohorts. Average age was lower for more recent referrals. Among recidivists only, a considerable amount of harm reduction was recorded. Conclusions. Fire raising and offences against children are not overly represented when compared with mainstream offenders. When compared with previous studies, it appears that a community forensic intellectual disability service may have an impact in reducing the number of offences committed over a 12 year follow up period.  相似文献

Purpose. This study examined the verbal and non‐verbal behaviours exhibited by criminal offender and non‐offender participants while they related planned truthful and deceptive accounts about emotional autobiographical events. Methods. In a 2 × 2 (participant group × veracity) quasi‐experimental design, offenders (N = 27) and university students (N = 38) provided videotaped accounts of four autobiographical emotional events: two honest and two fabricated (counterbalanced). Patterns of behaviour exhibited during the truthful and the deceptive accounts were then compared. Results. In general, offenders and non‐offenders showed similar patterns of deceptive behaviour. Deceptive accounts by both groups contained fewer details than honest accounts. Deception was associated with an increase in illustrator usage and self‐manipulations; however, univariate analyses indicated only that offenders exhibited significantly more self‐manipulations when lying. A significant interaction emerged in which offenders showed a reduction in smiles when lying about the emotional events, while students showed no difference. Conclusions. Offenders and students showed similar patterns of lying on most cues. However, unlike non‐offenders, offenders smiled less and showed an increase in self‐manipulations when lying. We theorize that offenders may have been aware that smiling and laughing are negatively related to perceived credibility in the speaker and used self‐manipulations to distract listeners from the content of their lies.  相似文献

Purpose. Although it has often been suggested that there is a direct relationship between an individual's sexual interests and behaviours exhibited during the crime they commit, few studies have investigated this question empirically. The purpose of the present study was thus to examine the role of sexual interests and situational factors as to their possible relationship to three components of rapists' modus operandi: (a) the level of organization of the offence, (b) the level of force used by the offender, and (c) the level of injury inflicted on the victim during the sexual assault. Methods. This study is based on a sample of 118 offenders who sexually assaulted a female aged 16 or over. All participants were assessed phallometrically and through the CQSA, a computerized questionnaire. Data were analysed using multiple regression analyses. Results. Our findings showed links between sexual interests, situational factors, and rapists' modus operandi. Firstly, individuals demonstrating a greater sexual interest in nonsexual violence showed a higher level of organization in the modus operandi. Secondly, alcohol consumption prior to the offence was related to a higher level of coercion. Finally, a negative emotional state prior to the crime was related to a high level of injury inflicted on the victim. Conclusions. Despite the fact that several authors postulated a direct link between the offender's sexual interests and his behaviour at the crime scene, our results only partially support this hypothesis. Moreover, our results partly support the fact that crime scene behaviour is related to offenders' personal characteristics, challenging an assumption of criminal profiling. We still believe that the modus operandi is related to offenders' personal attributes. It is, however, dynamic and may fluctuate due to certain situational factors related to offenders and victims. Future studies should take into account situational factors related to offenders and their victims.  相似文献

Abstract

On empirical and theoretical grounds, it is argued that different patterns of moral reasoning development and moral values may characterise different types of offender. Male offenders in six youth correctional institutions in Taiwan and controls from one junior and two senior high schools participated in the study. Self-reported criminal histories were classified according to their characteristic offence type (Drug, Violent, or Theft). Overall moral reasoning development stage, as well as the five individual moral values, were significantly less mature in offenders than in controls despite the offenders’ mean age being higher. The moral value Life differentiated crime types since this was less mature in the violent offenders. Moral reasoning cognitive–developmental delay models were only of limited usefulness in differentiating offender types but were good at differentiating offenders from non-offenders. It is suggested that a more sophisticated understanding of the role of moral reasoning development in the study of crime is needed.  相似文献

To test the assumption that police reports cannot be used as a representative sample of all criminal events, a research study was undertaken comparing the characteristics of robberies and robbery victims derived from police offense reports in San Jose, California, to those derived from a victimization survey in the same area The result of the comparison of these two data sources disclosed that: (1) for commercial robberies there were no differences between police offense reports and victimization survey data for the characteristics which were compared; (2) for personal robberies, there were no differences for the characteristics of victim's sex and age, number of victims, victim/offender relationship, and number of offenders. The differences observed for victim's race and time of occurrence can be attributed to classification problems and methodological differences It is highly probable that the police robbery offense reports and the Victimization survey data are representative of the same population of robberies Results suggest that further evaluation of the assumption that police offense reports do not reflect the “true” nature of all (i.e., reported and unreported) crime is warranted.  相似文献

The purpose of the study was to test the potential utility of a geographical profiling approach for three separate series of rapes committed by a single offender. Two different mathematical distance-decay functions using either a normal distribution with a mean distance and standard deviation based on previous research or a truncated negative exponential function based on distances between crime sites in the series under investigation were applied to each of the series giving prioritised search areas the accuracy of which was then assessed. The prioritised area that had to be searched before the home base of the offender could be located varied from 7.60 km(2) or 2.15% of the total search area at its best to 15 1.10 km(2) or 42.66% at its worst for the normal distribution based on previous research and from 42.06 km(2) or 11.88% to no improvement when the truncated negative exponential function was used. The functions used showed less predictive ability when the offender was a commuter. Explanations for the variations in the findings as well as suggestions for improvements were outlined in the discussion.  相似文献

There has been a notable increase in co-offending research in recent years, with most studies focusing on the causes and correlates of co-offending. There is little known, however, about the consequences of co-offending and how it may influence crime event outcomes for the offender. The present study compares the monetary reward and arrest risk of solo and co-offending robberies. Data from the National Incident Based Reporting System were analyzed to examine the characteristics and outcomes of robberies perpetrated by one, two, three, and four or more offenders. Though co-offending incidents were associated with greater total property value stolen, co-offending incidents resulted in significantly less property value per offender, controlling for other incident characteristics. The likelihood of an incident resulting in an arrest significantly increased with the number of offenders. We discuss the implications of our findings for theory and research on the real and perceived benefits and costs of co-offending.  相似文献

Ethnic minority youths are over-represented in the juvenile justice system in Western societies. However, research on the nature of crime committed by these youths is lacking. In the present study, offending patterns of incarcerated native Dutch adolescents and adolescents of Moroccan origin were compared. Criminal record data were used to examine the offence history of 291 incarcerated adolescents. Offender types were determined through latent class analysis. Adolescents of Moroccan origin were incarcerated more often, for more offences and at a younger age than native Dutch adolescents. A four-class model of offender types was found: property offenders, violent offenders, sexual offenders and arsonists. Property offenders were mainly Moroccan adolescents, the other offender types consisted predominantly of native Dutch adolescents. Moroccan adolescents in pre-trial arrest in the Netherlands can be characterized as early starting offenders who persist in being incarcerated for property-based crime.  相似文献

Purpose. This study investigated the influence of psychopathy and sex offender subtype on criminal history, probability of being granted conditional release, and performance while on conditional release in a diverse group of violent offenders. We predicted that psychopathic sexual offenders would be associated with relatively prolific violent and sexual offending, a high probability of successful conditional release applications despite their past behaviour (resulting from ‘putting on a good show’ in a parole hearing), and poor performance in the community. Methods. Information was gathered via a correctional file review of 310 Canadian male federal offenders. Offenders were categorized into groups based on their sexual offence history (non‐sex offender, rapist, child molester, or mixed rapist/molester) and Psychopathy Checklist – Revised (PCL‐R; Hare, 2003) ratings. Their offences (sexual, violent, or non‐violent) and their complete conditional release histories were coded. Results. Psychopathy was associated with more violent and non‐violent, but not sexual, offences. A significant interaction between psychopathy and offender subtype revealed that psychopathy was associated with a greater number of sex offences within child molesters. High‐psychopathy offenders (both sexual and non‐sexual offenders) were about 2.5 times more likely to be granted conditional release than non‐psychopathic offenders. Conclusions. Psychopathy is associated with more prolific sexual offending among child molesters and – despite their extensive criminal histories and high recidivism rate – a great proficiency in persuading parole boards to release them into the community. Specialized education and training in dealing with psychopathic offenders is urgently needed.  相似文献
