法学研究中的认识论问题

我国法学理论正面临“现代”与“后现代”的双重压力。后现代思潮主要知识进路和思想工具就是对理性的批判和否定。传统法学理论之所以没有足够的能力回应后现代的挑战,其原因也就在于对作为认识主体的人把握作为认识对象的法律的理性能力缺乏充分的批判和论证。由于我国传统法学理论的思维范式发源于知识论思想传统的合法性,所以,后现代思潮实质上是对作为传统法学理论之基础的知识论思想传统进行挑战。因此,若要充分回应这一挑战,就必须实现法学研究范式的转化,路径之一就是将人从单纯的法律认识主体转化为法律实践主体。     

The New Business of Nanotechnology: Exploring Commercial Opportunities and Risks

There is an Alice-in-Wonderland awe associated with nanotechnology. While the technology is both exciting and hopeful for many good reasons, for businesses, and the lawyers who counsel them, the lack of certainty in areas involving potential risk is unsettling. The U.S. Environmental Protection Agency (EPA) is only now beginning to think through how best to apply the authority it has under the traditional environmental statutes, and to adopt regulatory programs and policies to address the potential risks and regulatory challenges nanotechnology invites. While research is progressing briskly on key hazard and exposure nanotechnology issues, much remains to be done leaving commercial applications of nanotechnology in new, unsettled waters. This article identifies some of these challenges and the non-conventional, innovative ways that lawyers, business managers, risk assessors, and others must embrace to manage risk and avoid liability effectively.     

Networked Legal Learning: An Evaluation of the Student Learning Experience

This paper reports the findings from a case study that was conducted as part of the JISC/CALT funded Networked Learning in Higher Education project. The paper casts light on the wider debate about how and whether tutors can 'align' their teaching style with students' approaches to learning. It evaluates a law course that has been taught on campus using Lotus Notes to support group work and to provide a general course environment. The paper builds upon earlier evaluations of the course reported by the course tutor and used to develop the course design. The findings combine a firm understanding of the tutor's intentions and design with an evaluation of the student experience. This allows a consideration of alignment in a networked learning environment and uses several sources of rich data to triangulate designers' intentions with outcomes. Our findings incline us to the view that networked learning environments may be more open to unplanned influences than traditional courses. As a consequence of the increased number of influences students' may encounter greater degrees of variation in their experience.

商品售后服务全国联保是生产者向消费者提供优质合格产品与便捷售后服务的承诺,能够降低交易成本、便利消费者售后服务的获取,有利于促进品牌间竞争,但也可能被附加不合理的交易条件用于经销渠道控制。由于存在着产品出售方和售后服务实际提供方的分离,从《合同法》《消费者权益保护法》的角度不易解决全国联保窜货免责条款争议。生产者以消费者所购产品乃跨区销售、跨区购买为由拒绝提供全国联保,是对消费者施加的不合理限制,抑制了市场竞争。基于《反不正当竞争法》与《反垄断法》有关不合理条件的不同制度设计,全国联保免责案件的诉由选择与法律适用应当有所区别。
