The New International Health Regulations: An Historic Development for International Law and Public Health

The adoption of the new International Health Regulations (IHR) in May 2005 represents an historic development for international law and public health. This article describes the IHR revision process and analyzes why the new IHR constitute an advance in global health governance.     

From International Sanitary Conventions to Global Health Security: The New International Health Regulations

In May 2005, the World Health Organization adopted the new InternationalHealth Regulations (IHR), which constitute one of the most radicaland far-reaching changes to international law on public healthsince the beginning of international health co-operation inthe mid-nineteenth century. This article comprehensively analysesthe new IHR by examining the history of international law oninfectious disease control, the IHR revision process, the substantivechanges contained in the new IHR and concerns regarding thefuture of the new IHR. The article demonstrates why the newIHR constitute a seminal event in the relationship between internationallaw and public health and send messages about how human societiesshould govern their vulnerabilities to serious, acute diseaseevents in the twenty-first century.

WTO<服务贸易总协定>仅为原则性的精神,它必须由具体的可操作性内容或立法机构赋予的强制执行力组成.尽管我国政府或立法机构已经在法律的改革、制订、修正等方面已经作出巨大努力和工作,并对原有的或现有的商事规范作出了相应的调整或修正,但我国各界还应在理念方面需要更新,需要引进合理的法律机制,需要将这些合理的机制与我国国情相结合,构建一个既符合国际社会,也符合中国社会的市场秩序和法制.     

Biosafety considerations for autopsy

An autopsy may subject prosectors and others to a wide variety of infectious agents, including bloodborne and aerosolized pathogens such as human immunodeficiency virus, hepatitis B and C viruses, and Mycobacterium tuberculosis. Other hazards include toxic chemicals (e.g., formalin, cyanide, and organophosphates) and radiation from radionuclides used for patient therapy and diagnosis. These risks can be substantially mitigated through proper assessment, personal protective equipment, appropriate autopsy procedures, and facility design.

为控制传染病而行使国境卫生检疫主权时必须遵循<国际卫生条例>.<国际卫生条例>在我国的适用采取的是混合模式,即融合了"纳入"与"转化"和其他方法.依据修订后的<国际卫生条例>、<国境卫生检疫法>需要进行全面的变革.此外,我们必须解决国境卫生执法和司法中存在的问题.     

国际刑事法院证人规则研究

作为国际法发展的最新成果,国际刑事法院的证人规则代表着两大法系互相借鉴的最新趋势,代表着未来国际证据法发展的大体方向。本文试就国际刑事法院的证人规则(证人资格与范围、证人权利与义务、证人保护等)作初步讨论,并由之谈及对中国刑事立法的启示。     

人体器官买卖的国际刑法规制

人体器官买卖包括个人主动出卖器官、个人强行摘除他人器官出卖、“器官库”人体器官买卖和跨国人体器官买卖等四种主要类型。各国法律对人体器官买卖的规制分为设立专门刑法条款和未设立专门刑法条款两大类。国际社会规制人体器官买卖的努力主要体现在世界卫生组织的不懈工作和世界各国的积极响应。以国际刑法规制人体器官买卖应当明确人体器官买卖的概念、构成要件、犯罪形态、刑罚、管辖和惩处模式。     

国际非政府组织的国际法规制:现状、利弊及展望

国际法领域约束规制国际非政府组织的模式有四种,即全球性国际公约间接管制模式、区域性国际公约直接管制模式、国际政府组织约束管制模式及国际非政府组织自身管制模式。由于非政府组织自身国际法律地位的缺失,四种约束管制方式一方面起到了符合自身特点的积极作用,另一方面也都存在缺陷。为了更好地使国际非政府组织在国际事务中发挥作用,除充分利用现有的规制模式之外,亟需制定全球性国际公约对国际非政府组织进行约束管制。     

Global: HIV/AIDS-related travel restrictions--UNAIDS/IOM statement and revision of International Health Regulations

In June 2004 UNAIDS and the International Organization for Migration (IOM) issued a joint statement on HIV/AIDS-related travel restrictions. While acknowledging that the regulation of immigration matters is widely recognized as falling within the sovereign power of the individual state concerned, the statement distinguishes between short-term (one month or less) and long-term travel.

信用评级机构的法律定位及其国际监管改革研究

信用评级机构是金融市场日益专业化过程中不可或缺的一员,通过其专业化的评价体系,对解决投资者和证券发行人之间的信息不对称问题发挥了很大的作用。但是,随着评级机构日益深入地参与到金融证券化的过程中,不可避免的利益冲突使其中立性、客观性等在一定程度上有所缺失。次贷危机发生后,对信用评级机构加强监管的呼声日益高涨,各国金融监管机构开始对信用评级机构进行全面的严格的监管,但是,由于评级业本身的自然垄断属性以及评级业务的专业性,使其定位上存在模糊之处。在分析信用评级机构存在的缺陷基础之上,对其法律定位进行探讨,并预测国际监管改革与合作的发展趋势是十分必要的。     

生物技术与国际法

随着生物技术的飞速发展,它在现实生活中碰到了一些新的问题,其中既有知识产权法律保护问题,又有社会伦理道德等理论问题;既有政府管理部门实际管理政策问题,又有实践中关涉公民的食品安全等切身利益问题。本文拟结合国内外生物技术知识产权保护的现状,对生物技术与专利、生物技术与食品安全及生物技术与WTO有关协定的关系做些初步的探讨。     

进展与期待中的生物安全国际保护——《卡塔赫纳生物安全议定书》第二次缔约方大会评述

2005年5月30日至6月3日,《卡塔赫纳生物安全议定书》第二次缔约方大会在加拿大蒙特利尔举行。来自全球118个缔约国的代表和欧盟代表、非缔约方代表、联合国及其专门机构代表、政府间组织代表、非政府组织代表、工业代表和教育科研机构代表参加了此次大会。大会除了就财务机制和资源、与其他组织、公约和倡议的合作、管理和预算事项等常设性议题进行讨论外,主要就通知、能力建设、风险评估和风险管理、公众意识和参与、生物安全资料交换所的运行和活动、其他科学技术问题等实质性议题进行了谈判,并取得了不同程度的进展。与此同时,由于各方分歧较大,大会在赔偿责任和补救问题上没有取得实体性成果,在改性活生物体的运输标识问题上甚至未能达成一致。我国派出了由国家环境保护总局牵头、由外交部、科技部、商务部、农业部、国家质检总局、中国政法大学、中科院、农科院等单位的代表组成的政府代表团,以观察员身份参加了此次大会,并积极参加了本次缔约方大会的各项活动。

International Environmental Agreements for biodiversity conservation: a game-theoretic analysis

This paper contributes to the emerging literature on International Environmental Agreements with an analysis of key characteristics for biodiversity conservation. We study three features that are specific to an international conservation agreement: the existence of a natural upper bound of conservation in each country, the importance of local benefits, and the subadditivity of the global conservation function. We consider asymmetries in benefits and costs of conservation and, separately, in the upper bound of conservation in each country, and we examine the impacts of these features on coalition stability and on the effectiveness of biodiversity agreements. Results show that subadditivity of the global conservation function can lead to larger stable coalitions. The inclusion of a transfer scheme that might be implemented through, e.g., international trade of biodiversity credits, can have an impact on coalition composition and can improve conservation outcomes and the size of stable coalitions in certain ranges of the parameter space.
