Justice and Feelings: Toward a New Era in Justice Research

In this special issue, the relationship between feelings and justice and its consequences are highlighted. Five articles discuss the role that affect, feelings, and emotions play in justice processes across a variety of social settings. In the present introductory article, the position of past and present justice research in relationship to these topics is briefly reviewed. In addition, reasons are outlined to show why a focus on these issues may be pivotal for a better understanding of social justice and how this may pave the way for a new, more process-oriented era in social justice research, focusing more on “hot” cognitive aspects as they pertain to social justice concerns.     

基于TRIPS框架下保护传统知识的正当性

对于在TRIPS框架内处理传统知识保护的问题,目前国际社会存在着严重的分歧,但是,反对方的观点并不能构成否定TRIPS框架下保护传统知识的正当性的充分理由,因为恰恰是TRIPS本身提供了在其框架内保护传统知识的根据。首先,TRIPS语境下的“私权”并非是个人化的权利,传统知识的群体持有并不构成在TRIPS框架下保护传统知识的理论障碍;其次,TRIPS确立的平衡各种利益的知识产权保护目标,体现了法律的公平原则,是传统知识寻求TRIPS保护的合法依据;第三,TRIPS将知识产权保护与贸易联系起来的实施机制,使之成为当今保护传统知识的最有效的形式。传统知识保护的国际协调,不是将TRIPS的现行规则推倒重来,而是在TRIPS框架下创造一种适应于传统知识特点的保护机制。     

The Dimensions of Lawyer-Client Relations: Notes Toward a Theory and a Field Study

Recent research on lawyer-client relations has called into question the traditional image of the lawyer as the autonomous professional. This research note reviews this research and proposes a three-dimensional framework for interpreting lawyer-client relationships. The utility of the framework is illustrated using data collected through interviews with corporate lawyers and their clients in Toronto.     

Toward the Assessment of Procedural and Distributive Justice in Resolving Family Disputes

The first phase of this study focused on the development of comprehensive, conceptually integrated measures of procedural and distributive justice in the context of family decision making. In the second phase, these measures were used to examine older adolescents' justice appraisals of specific family disputes and the relation of these justice appraisals to family systems functioning along dimensions of conflict and cohesion. A Family Justice Inventory was constructed, which included two global indices (one for procedural justice and one for outcome fairness) and 13 subscales: 9 measuring specific facets of the procedural justice construct and 4 measuring specific dimensions of the distributive justice construct. Factor analysis revealed that the 13 Family Justice Inventory subscales could be reduced to 5 interpretable procedural justice factors (personal respect, status recognition, process control, correction, and trust) and 4 interpretable distributive justice factors (decision control, need, equality, and equity). Using procedural justice factor scores in regression analyses, personal respect, status recognition, correction, and trust each accounted for unique variance in family conflict and family cohesion. Additionally, equity also accounted for unique variance in family conflict but not family cohesion and the direction of the relationship was positive, that is, more equity in resolving specific family disputes was associated higher levels of general family conflict.

A New Digital Method for the Objective Comparison of Frontal Sinuses for Identification*

Abstract: Use of the frontal sinuses for identification requires an objective method of comparison to meet Daubert standards. Christensen’s application of Elliptical Fourier Analysis and Likelihood Ratios seems to be a viable solution for this problem. The proposed method draws upon this work and attempts to simplify its application. Variation between pairs of digitized sinus tracings was quantified by summing the difference between corresponding measurements taken from a fixed origin to the outer edge of the sinus outlines using Adobe Photoshop^® CS2. Same‐skull and different‐skull pairs were used to develop reference distributions from which the probability of unknown pairs coming from the same or a different individual was estimated. Error rates of 0% were achieved. Resulting correlation coefficients demonstrated inter‐rater and test–retest reliability. Further refinement of the reference distributions and more rigorous testing of error rates should make this technique applicable to casework.

Toward a Methodology for the Science of Administration

It is no longer news to anyone that study and discovery of optimal variants for the organization and functioning of the system of agencies of state administration in the USSR are a pressing, paramount task of the science of administration.     

Illusions and Realities of the "New Era"

"Last week the world suffered a shock that will inevitably make us divide the time into two parts—before the terrorist acts in the United States and after them. Because a new world and a new world order are being born in the ruins of the World Trade Center" (S. Strokan', "The Dawn of a New Era" [Zarevo novoi ery], Kommersant-Vlast', 2001, no. 37 [18 September], p. 35). Not only the Russian political weeklies thought this. The tragic events that the United States suffered on 11 September not only sent many countries into shock but also sparked the idea that humanity suddenly found itself in an incomprehensible world, a new space-time—that life would be different from then on, that we would think differently and structure international relations differently. Even some of the supporters of Francis Fukuyama, who proclaimed the "end of history" more than ten years ago, hurriedly declared that the "oracle" was wrong, since on 11 September events of historic scale and significance had taken place in the United States. One critic of the American "prophet" noted, not without sarcasm, that "Black Tuesday" signified "the end of the end of history." That did not, however, shake the convictions of Fukuyama himself. In an article eloquently titled "History Is Still Going Our Way," published in The Wall Street Journal Europe on 8 October, he continued to assert that "we remain in the final stage of history" (F. Fukuyama, "History Is Still Going Our Way," The Wall Street Journal Europe, 8 October 2001).
