How are global human rights localised in authoritarian societies? How and what human rights discourses are mobilised by indigenous peoples to further their demands? Building upon original fieldwork among Nubian activists in Egypt, this article explores the complexities regarding human rights framing through a discussion of recognition of Nubian indigeneity. The article finds that the history and political experience of Egypt’s Nubians bring about diverging opinions and also limitations as to how, and what, human rights frameworks rights claimants and their supporters are to employ. It argues that Egyptian nationalism not only affects how Nubian activists mobilise in general, but also helps explain the very limited appeals to a global discourse of human rights.  相似文献

This article examines the extent of change under Latin American left governments by assessing their actions on women's and lesbian, gay, bisexual and transgender (LGBT) rights. To provide a historical context, it first offers an overview of the relationship between feminist movements and the left. It then employs a four-country comparison of Brazil, Bolivia, Chile and Venezuela on women's socioeconomic status; feminist state–society relations; women's representation in national decision-making positions; legislation on violence against women; reproductive rights; and sexual rights. It concludes that standard political and economic divisions among the cases do not explain their response to the demands of feminists and LGBT activists. While governments have improved women's status and inclusion, the transformation of gender and sexual power relations remains unfinished.  相似文献

This article explores the development of the Russian youth movement Nashi and its relationship with the state with the purpose of assessing the movement's long-term sustainability. Establishing a link between activists' political autonomy and their potential ability to sustain the movement without state support, this article examines the validity of the assumption that Nashi is simply an extension of the state, which the state can unilaterally direct as it sees fit. It contends that despite the movement's allegiance to the incumbent regime and its utilisation of state resources, Nashi activists have become increasingly politically autonomous and therefore capable of sustaining the movement in their own right.  相似文献

Despite the government's active legislation to protect workers, labor rights still remain widely ignored and poorly enforced in China. Structural constrains, such as the state's development strategy biased on efficiency over equity, tight labor markets, and the lack of an effective safety net, cannot fully explain why Chinese workers have had so little impact on the environment in which they work and the violations of their rights often occur. Using Marshall's theory of citizenship rights, this article explores the structure of China's labor rights for an explanation. It argues that while Chinese labor legislation stipulates workers' individual rights regarding contracts, wages, working conditions, pensions, and so on, it fails to provide them with collective rights, namely the rights to organize, to strike, and to bargain collectively in a meaningful sense. The lack of collective rights is one of the major factors that render workers' individual rights vulnerable, hollow, unenforceable, or often disregarded. Labor legislation that enables workers to act collectively is crucial for safeguarding their individual rights.  相似文献

This paper examines the process of how Crimean Tatars strived to attain group-differentiated rights since they have returned to their homeland in the early 1990s. Whereas the politics of minority rights were viewed through security lens in earlier literature, we emphasize the significance of cultural constructs in influencing the minority policies, based on qualitative content analysis of “speech acts” of elites, and movement and policy documents. Focusing on the interaction of the framing processes of Crimean Tatars with the Crimean regional government, Ukraine, and Russia, we argue that the “neo-Stalinist frame” has played a major role in denying the rights of Crimean Tatars for self-determination and preservation of their ethnic identity in both pre and post annexation Crimea. The Crimean Tatars counter-framed against neo-Stalinist frame both in the pre and post-annexation period by demanding their rights as “indigenous people”. Ukraine experienced a frame transformation after the Euromaidan protests, by shifting from a neo-Stalinist frame into a “multiculturalist frame”, which became evident in recognition of the Crimean Tatar status as indigenous people of Crimea.  相似文献

Scholars have suggested that corruption could serve as a substitute for property-protecting institutions in developing countries, but very few empirical studies have been conducted to test this theory. Most existing studies on the determinants of corruption are cross-national, rely on perception-based measures, and focus on economic development, regime type, and market structure as explanatory variables. Little is known about why corruption occurs in an authoritarian state at the micro level. We theorize bribery as a bargaining process between a firm and a rent-maximizing public official, and we assume that graft-paying firms face different sets of rules and regulations, which govern firms' costs and benefits of bribing. We test the hypothesis that firms' bribes are determined by the rigor of their internal auditing control and the quality of property-protecting institutions. We use entertainment and travel costs directly observed in a large-scale firm-level survey in China as a proxy for corruption. Our study implies that firms operating in a weak property rights regime rely on political connections as a substitute for formal legal protection. The findings shed light on the literature on property rights, corruption, and East Asian development.  相似文献

This article presents evidence of the links between human rights education and social change by analyzing the long-term effects on 88 trainers engaged in a non-formal adult training program sponsored by a women’s human rights group in Turkey, Women for Women’s Human Rights – New Ways. In this article, I show the transformative impacts of carrying out human rights education on the trainers themselves: in their identity; knowledge, skills, and attitudes; and behaviors in their family and in the workplace. This article extends the treatment of an emerging question within social change theory – that of the long-term influence on activists brought about by their very engagement in these activities. At the same time, because the activists are trainers associated with a human rights education program that infuses critical pedagogy with a feminist perspective, this qualitative case study provides the opportunity to explore ‘situated empowerment’ on trainers in both their personal and professional domains. The article concludes that further studies of human rights educators engaged as long-term trainers will further enrich the social change literature and the treatment of activists.  相似文献

This article argues that the contemporary triple crises of finance, food and environment, which have shaken the global economy since 2008, have exposed what should be seen as the Achilles heel of the dominant development theory and practice of the past 30 years: vulnerability. We argue that the crises not only add momentum to the delegitimisation of the old model, but also offer legitimacy for paths that lessen vulnerability and increase what we call ‘rootedness’ (a term we prefer to ‘resilience’ or ‘sustainability’). After offering a brief history of ‘vulnerable’ development and reviewing the literature on vulnerability from the development, economic and environmental fields, we use this vulnerability versus rootedness frame to present analysis from our field work in two ‘vulnerable’ countries: the Philippines and Trinidad and Tobago. Integrating the article's sections, we then propose a new interdisciplinary framework for development that builds on and supplements the human rights, ecological, equity and democracy frames: the notion of ‘rootedness’ at the household, local and country levels.  相似文献

Although the recognition of the adoptive rights of LGBT (lesbian, gay, bisexual, and transgender) couples is a socially salient topic, cross-national variation regarding this issue has been largely underexplored in social science research. With the aid of configurational analysis, this article fills this gap and shows the conditions that explain the recognition of the adoptive rights of homosexual couples in the countries of the EU-27. It is argued that two different paths led to this outcome. All countries where adoptive rights were recognized had higher degrees of secularization and lower levels of social homophobia. In addition, in Northern European countries, the Protestant background and absence of conservative governments for a certain time period seemed to be the determinant. However, for the remaining European countries that recognized these rights, rising levels of gender equality appeared to have a more salient role.  相似文献

This article examines the constitutional position of ethnic minorities in Kosovo, the individual features, and the key protection mechanisms applied therein. At the outset, the article provides a general introduction to the topic, illustrating the character of Kosovo's state model. Subsequently, it builds upon the view that Kosovo was shaped under an international supervision, which aimed to establish a state freed from mono-ethnicity, which is regarded as both multi-ethnic and a state of citizens. The article proceeds to explain the institutional mechanisms established with the objective to protect and uphold the ethnic minorities’ position at both central and local levels. Furthermore, it discusses the affirmative human rights law standards granted to ethnic minorities—both at personal and collective levels. The article concludes by suggesting that the constitution of Kosovo provides for a broad degree of self-rule to ethnic minorities, which, in turn, provides them with the capacity to enjoy a rather constitutive position as regards the essential components of the polity.  相似文献

This article explores global and local discourses on how to implement the newly recognised human right to water and sanitation (HRtWS). We analyse the potential limitations of the human rights frame in the context of critiques that human rights are a liberal, Western discourse that does not reflect the lived experiences of non-Western countries. Through two case studies we find that there are two discourses emerging on how to implement the HRtWS. At the global level, as seen in the work of the UN Special Rapporteur on the HRtWS, we find a hegemonic discourse that is state-centric and market-friendly. In Bolivia, a country currently implementing a human rights-based approach to water services, we find a counter-hegemonic discourse on implementation. We argue that the hegemonic discourse is incomplete and does not fully address barriers to fulfilment of the right, such as state corruption and the needs of peri-urban residents.  相似文献

The experience of the Seoul Olympics in 1988 has led major games boosters to boldly assert their liberalising potential, especially in the context of the Beijing Games of 2008. This paper examines whether in the post-Cold War and post-9/11 eras, there is a sound basis for such arguments. It begins by re-examining the lessons of the Seoul Olympics to clarify the Games' contribution to the democratisation of Korea, as catalyst though not cause. It then assesses the applicability of the lessons of Seoul to Beijing given the different contexts of their 'Olympic journeys'. Finally, based on this comparison it considers the ways in which the 2008 Games may affect prospects for human rights improvements and political liberalisation in the People's Republic of China. While the outcomes of this process are likely to be quite different from the western-style liberal democratisation that occurred in South Korea, the process of engagement between 21st Century China and 21st Century Olympism holds the possibility of stimulating a fruitful, dialogic, and progressive exchange on rights issues.  相似文献

This article seeks to understand why, although widely predicted, very little ethnically motivated political mobilisation has occurred in post-Soviet Central Asia. Building on the contribution of frame analysis, the article examines the case of Uzbek communities in Kyrgyzstan and Tajikistan. Different frames have been articulated by the elites and have been used to mobilise and demobilise the community. The more successful ones (those that resonated) were less confrontational, and ultimately led the Uzbek communities towards a non-confrontational path with the authorities. The article concludes that frame analysis sheds important insights on the process of the mobilisation of ethnic minorities in Central Asia, and also contributes to the literature on ethnic mobilisation.  相似文献

This contribution seeks to engender more nuanced reflection on the role of human rights advocacy and specifically its role in democracy promotion. The two agendas have been seen as conjoined and harmonious by most aid donors; yet, interestingly and perceptively, some commentators have recently criticised the notion that they are agendas that are straightforwardly compatible or coherent. I examine here from a theoretical perspective the plausibility and the consequences of the claim that the two agendas share a more complex and controversial relationship than is often assumed. Specifically, I seek to highlight the importance of paying attention to the possibility that rights themselves are inherently ‘contradictory’ in nature and that therein lies their contribution to the democratisation agenda. Indeed, by drawing on Samuel Bowles's and Herbert Gintis's view of rights claims as ‘clashing’ and ‘politico-economically’ grounded, the aim of this article is to argue for a more politicised and openly contradiction-accepting approach to rights and democracy promotion. I contextualise this (theoretically motivated but practically consequential) argument in the context of the EU's human rights and democracy promotion policies.  相似文献

Abstract

This article attempts to summarize the efforts that have been made during the 1970s in the search for an appropriate definition of international terrorism, its causes, and the measures to combat it. It evaluates these efforts in the context of the simultaneous interests in human rights. It advances some propositions as to how international terrorism could be seen from the perspectives of both social‐psychological theories of violence and Western legal practices. In conclusion, the relationship between the individual and the state is evaluated in the context of the present world order and its operative political and legal principles. Although this approach may not solve the problem of international terrorism by advancing any neat scheme of control which can be readily applied by anxious governmental law enforcement agencies, nor succeed in articulating a strategy for the respect of human rights by governments and individuals, it will hopefully generate some ideas about how justice can be rediscovered while searching for viable solutions for both international terrorism and human rights.  相似文献

When Kosovo declared its independence in 2008, it did so not as a nation-state, but as a “state of communities,” self-defining as multiethnic, diverse, and committed to extensive rights for minorities. In this paper, this choice is understood as a response to a dual legitimation problem. Kosovo experienced both an external legitimation challenge, regarding its contested statehood internationally, and an internal one, vis-à-vis its Serb minority. The focus on diversity and minority rights was expected to confer legitimacy on the state both externally and internally. International state-builders and the domestic political elite in post-conflict Kosovo both pursued this strategy. However, it inadvertently created an additional internal legitimation challenge, this time from within Kosovo’s majority Albanian population. This dynamic is illustrated by the opposition movement “Lëvizja Vetëvendosje” (Self-Determination Movement), which rejects the framing of Kosovo as first and foremost a multiethnic state. The movement’s counter-narrative represents an additional internal legitimation challenge to the new state. This paper thus finds that internationally endorsed “diversity management” through minority rights did not deliver as a panacea for the legitimacy dilemmas of the post-conflict polity. On the contrary, the “state of communities” continues to be contested by both majority and minority groups in Kosovo.  相似文献

The human rights agenda of the United Nations has faltered over recent years. An examination of conditions in a country such as the Philippines highlights some of the reasons. The appallingly high number of political killings in that country was investigated by Philip Alston, UN Special Rapporteur on Extrajudicial, Summary or Arbitrary Executions, early in 2007. Following a well-defined process of review, he spent a short but difficult time examining the situation. His report condemned repressive elements of the Philippine state and directed specific criticisms at the armed forces, noting the omnipresent role of counter-insurgency. He found that a culture of impunity prevailed within the military and that the Arroyo administration had not done enough to address the problem or to protect the rights of its citizens. Alston's visit provided an insight into both the Philippine government's inadequate human rights record and the failure of UN mechanisms established to redress such poor performance.  相似文献

How, when and to whom should a woman marry, what constitutes marriage and what rights has a woman to influence the selection of her spouse? These and other questions were subjects of intense contestation between young men and women and their parents, on one hand, and, on the other, between commoners and members of the traditional elite in the Western Igbo district of Igbuzo in Southern Nigeria during the early twentieth century. Disputes over marriage rites centred on the politics of isinmo or the shaving of a woman's head. Isinmo gave the “barber” exclusive and inalienable rights to the woman. Yet, in what amounted to reversal of tradition, women seeking to end or reduce parental and patriarchal control appropriated some the rituals of isinmo to contest its use and efficacy in the hands of its erstwhile beneficiaries.  相似文献

This article explores contemporary Russian official and media discourse on cases concerning human rights violations in Chechnya which have been heard at the European Court of Human Rights. By comparing and contrasting the discourses on the Court's rulings which have been reproduced by various government representatives and various Russian newspapers, the article aims to demonstrate that, while official discourse remains critical of the Court's work with regard to Chechnya, reporting of such cases provides certain media outlets with the opportunity to criticise the government for its perceived failings in relation to safeguarding Chechnya's civilian population from human rights abuses.  相似文献

Thessaloniki, the second largest city in Greece, has seen a sudden attempt to establish LGBT politics during the last 5 years, due to movement mobilization and favourable local and European opportunity structures. The article suggests a multiscalar analysis of Thessaloniki Prides, which takes into account politics articulated by a series of actors located in distinct scales. These actors include institutional and religious authorities, as well as the local LGBT movement. The analysis demonstrates that Thessaloniki Prides are shaped by conflicting discursive blocks articulated through the national, urban/local, and transnational scale. Prides, as the most visible outcome of the local LGBT movement, become a collective action, which is shaped and continuously challenged by its embeddedness in these scales. This analysis brings new insights into the geo-temporal politics of LGBT politics, reminding that European periphery’s sexual politics are located in a nexus of progressive cosmopolitanism and nationalist anti-modernity. In fact, the Thessaloniki case demonstrates that being part of the Western periphery places sexual politics between a globalist EU-ized discourse of modernity on the one hand and anti-secular views on heteronormative traditions on the other. Such a space is the setting where grassroots LGBTQ movements perform their politics.  相似文献
